Abstract

Background: The practice of illegal polygamy, conducted without court permission or the wife's knowledge, remains a persistent issue in Indonesia, undermining the legal protection of women's rights in marriage. The enactment of Law Number 1 of 2023 concerning the National Criminal Code (KUHP) introduces new provisions that criminalize such actions, potentially shifting the paradigm from viewing polygamy violations as mere administrative or civil offenses. Objective: This research aims to analyze the legal protection afforded to wives involved in illegal polygamy under the current marriage law regime and to assess the relevance and direction of enforcing Articles 402 and 403 of the 2023 KUHP in strengthening this protection. Methods: This study employed a normative juridical approach with a legislative and conceptual focus. It examines primary legal materials, including the Marriage Law, the Compilation of Islamic Law (KHI), and the 2023 KUHP, alongside secondary legal materials such as scholarly articles and legal expert opinions. Data were analyzed qualitatively through interpretation of legal norms and assessment of normative synchronization. Findings: The research reveals that while the Marriage Law and KHI provide preventive and repressive civil mechanisms for wife protection, these instruments have structural limitations, particularly when polygamy is conducted secretly. Articles 402-403 of the 2023 KUHP introduce an additional layer of protection by criminalizing marriage conducted despite a lawful obstacle or concealment of marital status. However, the effectiveness of these criminal provisions depends on a synchronized interpretation with marriage law, particularly regarding the concept of "lawful obstacle."

Abstract

Law as an instrument of justice is essentially created to bring certainty to society with the aim of achieving as much justice as possible. However, the existence of Article 1 number 5 of Law Number 20 of 2016 concerning Trademarks and Geographical Indications—which confirms the first to file principle in the protection of trademark rights holders—actually creates a very essential problem in law, namely justice. The first to file principle, which emphasizes the fulfillment of procedural administrative aspects in providing legal protection for trademark rights holders, actually prevents the application of the principle of substantial justice, which is actually the main element in the protection of intellectual property rights. Normative research—which also raises several case examples such as the DKI Jakarta High Court Decision Number 304/PID/2022/PT.DKI—shows that criminal law enforcement in trademark infringement cases often faces difficulties in proving the element of malicious intent, especially when there is evidence of prior use of the trademark by the defendant or when the validity of the registered trademark is disputed. The results of the study indicate that these conditions create legal uncertainty and demonstrate that the current legal system tends to prioritize procedural justice over substantive justice. This study concludes that the criminal enforcement of trademark infringement in Indonesia requires improvements in legal policy, particularly through clearer regulations regarding the elements of malicious intent and the recognition of prior use of trademarks, so that legal protection can be implemented more fairly and provide greater legal certainty for all parties involved.

Abstract

PT Kereta Api Indonesia (Persero) views its employees as strategic assets, whose well-being directly affects organizational performance. Rising rates of overweight and obesity pose health and productivity challenges, increasing risks of fatigue and chronic disease. This study aims to evaluate the effectiveness of gamification in improving employee engagement and consistency during the Weight Loss Challenge program at PT Kereta Api Indonesia (Persero) DAOP 1 Jakarta. A total of 98 employees with a Body Mass Index (BMI) of ≥30 kg/m² participated in the program over a three-month period. Health indicators were measured using BMI and the percentage of weight loss, while engagement was evaluated through a point system, sharing activities, and webinar participation. Analysis using paired-sample t-tests and cross-tabulation with chi-square tests revealed a significant decrease in average BMI by 1.79 kg/m² and an average weight loss percentage of 6.16%, both statistically significant (p < 0.001). Outcome-oriented and behavior-intensive components, such as weight loss and activity points, showed a very strong relationship with the participants' final scores, while supportive components like sharing activities and webinar participation showed moderate influence. The findings suggest that gamification effectively promotes healthy behavior changes through increased employee engagement and consistency. Programs with measurable, intensive activities boost participation and support sustainable workplace health and productivity.

Abstract

The purpose of this study is to examine the influence of tax planning, corporate governance, and financial performance on manufacturing companies in the real estate and property sub-sector listed on the Indonesia Stock Exchange (IDX) for the period 2018 – 2020. This study uses a type of quantitative research with a descriptive research strategy. The population of this study is 65 companies in the real estate and property sub-sector listed on the Indonesia Stock Exchange (IDX) for the period 2018 – 2020. The sample selection in this study used purposive sampling with a sample of 42 companies so that there were 126 total observations. The data used is secondary data. Data collection techniques through the official IDX website: www.idx.co.id and the company's official website. This study uses Eviews software version 10.  The results of the study prove that, (1) Tax Planning has no effect on Company Value, (2) Managerial Ownership has no effect on Company Value, (3) Institutional Ownership has a significant positive effect on Company Value, (4) Independent Commissioners have a significant positive effect on Company Value, (5) Audit Committee has a significant positive effect on Company Value, (6) Capital Structure has a significant negative effect on Company Value,  (7) Profitability has a significant positive effect on Company Value, (8) Liquidity has a significant positive effect on Company Value.

Abstract

Globalization and the rapid development of digital media have intensified adolescents’ exposure to foreign cultures, potentially affecting the sustainability of local culture and the effectiveness of cultural education in schools. This research aims to compare students’ preferences for local and foreign cultures at SMAN 1 Samarinda and to examine their implications for cultural learning. A quantitative approach with a descriptive-comparative survey design was employed. The participants consisted of 50 students selected through purposive sampling. Data were collected using a cultural literacy questionnaire covering cultural preferences, familiarity, participation, and attitudes toward local cultural preservation, and were analyzed using descriptive and simple comparative statistics. The findings reveal that students demonstrate higher preferences, familiarity, and participation toward foreign culture than local culture. However, students show positive attitudes toward the importance of preserving local culture, although this awareness is not fully reflected in active participation. These results indicate a gap between cultural awareness and preservation practices. The study concludes that students’ cultural preferences have significant pedagogical implications, suggesting that local cultural learning should be designed in a more contextual, adaptive, and experiential manner to enhance student engagement in the era of globalization.

Abstract

Information Technology Service Management (ITSM) is a strategic approach in managing and providing quality IT services to users. In the era of digital transformation, organizations face complex challenges in managing IT services that are increasingly critical to business operations. The ITIL (Information Technology Infrastructure Library) framework has become the most widely adopted international standard for ITSM implementation. This study aims to comprehensively analyze the main components of ITIL 4, the implementation process, the challenges faced, and the impact of implementation on the effectiveness of IT services in the organization. The research method used is a systematic literature study with case analysis of ITIL implementation in various industrial sectors and higher education institutions. Data sources were obtained from 25 indexed scientific journals, official ITIL documentation, and case study reports from organizations that have implemented ITIL. The results show that proper ITIL implementation can improve the quality of IT services by up to 40%, reduce downtime by up to 35%, increase first-call resolution rate by up to 50%, and significantly increase user satisfaction. The study also identifies critical factors for the successful implementation of ITIL, including executive sponsorship, effective change management, human resource competence, and selection of the right tools. The findings of the research provide practical contributions to organizations planning to adopt ITIL and theoretical contributions in the development of the body of knowledge.

Abstract

Structural Legal Aid is an advocacy approach that not only focuses on individual defense but also seeks to address the structural roots of social and legal inequality. Within the sociocultural framework of West Sumatra, characterized by the Nagari system and customary communities, the Padang Legal Aid Institute adopts this approach in handling structural cases that reflect systemic injustice. This research aims to analyze the forms of Structural Legal Aid implementation by the Padang Legal Aid Institute and to identify the opportunities and challenges that affect its sustainability. Using a juridical-empirical method, this study is based on an inventory of data comprising the 2024 Annual Report of the Padang Legal Aid Institute, in-depth interviews with the Director and the Structural Legal Aid Division of the Padang Legal Aid Institute, as well as an examination of relevant legislation, legal literature, and scholarly journals. The research findings indicate that the implementation of Structural Legal Aid is carried out through an integration of litigation and non-litigation strategies that create an advocacy ecosystem bridging judicial processes and community movements. Opportunities for strengthening Structural Legal Aid arise from social capital, national advocacy networks, and the presence of paralegals at the nagari level, while the main obstacles include limited funding, the criminalization of human rights defenders, and weak policy support. This study contributes to the development of a contextual model of structural legal aid within Indonesia’s socio-legal framework and provides both conceptual and empirical insights for formulating community-based legal aid policies supported by the state

Abstract

Modernization and urbanization have changed the patterns of social relations in society and contributed to the increase in mental health problems, especially in urban Muslim communities. The dominant clinically oriented approach to mental health is considered suboptimal without the integration of social and spiritual dimensions. This research aims to analyze the role of ukhuwah and friendship as spiritual social capital in improving the subjective well-being and mental health of the Muslim community. The method used is an integrative literature review conducted by analyzing reputable scientific publications, global health reports, and classical and contemporary Islamic literature. The results of the study show that ukhuwah strengthens social identity, spiritual solidarity, and a sense of belonging in the community, while communal gathering improves the quality of interpersonal communication and emotional support. Both form a spiritual social capital that contributes significantly to increased life satisfaction, emotional stability, and a reduced risk of mental health disorders. These findings are in line with the Harvard Study of Adult Development, which confirms that the quality of social relationships is a major predictor of long-term happiness and health. This study concludes that strengthening ukhuwah and friendship can serve as a community-based promotive-preventive strategy in the promotion of mental health within the Muslim community.

Abstract

This community service activity aims to strengthen the entrepreneurial mindset and attitudes of the community in facing various social and economic challenges through a local cultural approach. The activity was carried out as part of the Kenduri Budaya Benteng Tujuh Lapis series, with the author serving as a speaker on the theme of Entrepreneur: Mindset and Attitude in Facing Challenges. The activity was held at the Benteng Tujuh Lapis Tuanku Tambusai, Dalu-Dalu, Luhak Tambusai, Rokan Hulu Regency, Riau Province. It was organized by the Cultural Preservation Center (Balai Pelestarian Kebudayaan/BPK) Region IV of Riau and the Riau Islands, in collaboration with LKA Luhak Tambusai. Implementation methods included educational lectures, interactive discussions, and a participatory approach. The results demonstrated an increase in participants' understanding of the importance of a positive mindset, adaptive attitude, and psychological resilience as the foundational pillars of entrepreneurship in navigating challenges and leveraging local cultural potential in a sustainable manner. The implication of this activity is the development of a community empowerment model that integrates local cultural values with entrepreneurship education, which may be replicated in other regions with comparable cultural richness.

Abstract

Work-life balance (WLB) and employee engagement are important factors that can drive a company's sustainable growth. Turnover intention has become a common problem faced by many companies, resulting in an increase in employee turnover rates. This has a significant impact on the sustainability of the company's operations. This study aims to test the influence of work-life balance (WLB) and work environment on turnover intention, with remuneration as an intervening variable, among employees of Company X in Central Jakarta. Using a quantitative method with the Partial Least Squares (PLS) analysis technique, data were collected from 120 respondents through a questionnaire. The results of the study show that the work environment has a negative and significant effect on turnover intention. In contrast, WLB was found to have a positive and significant effect on turnover intention in this sample. Remuneration has been proven to significantly mediate the influence of the work environment on employee exit intention but is unable to mediate the relationship between WLB and exit intention.
