Abstract

This writing aimed to find out how the forms of legal protection for women workers are stipulated in Law No. 13 of 2003 concerning employment as viewed from an Islamic law perspective. To answer the problems in this study, the authors conducted formative research with a comparative legal study specification. The research method used is library research. The results showed that the legal protection provided by law in the aspects of working time, workplace, leave, menstruation, pregnancy, breastfeeding, and work safety is not balanced with the biological tendency of women that could be painful, and even tend not to make women productive. At the same time, the law does not pay attention to the tendency of today's society that has a higher crime rate so that it is dangerous for women to work at night or in places where they cannot bring their mahram (a member of one’s family). The lack of clarity in attitudes and procedures for legal protection for women workers, according to Islamic law, is not proportional to the risks that will be received by families because they work outside the home beyond their time for children and families.

Abstract

The purpose of this research is to determine factors that cause Poliandry cases, both lead some people to chooce and facilitate poliandry in Padang Pariaman. Qualitative research  by using normative law or doctrinal law methods was used. data taken from interview to some informants was analyzed thematically based on the indicators of the study. The result of the study showed that some factors may facilitate people to have poliandry. They are the low educational level, the willingness to make the marital commitement, both the view of  figh and positive law. The cases of  Poliandry  especially for write recorded marriage, and divorce are due to the the lack of comprehension on the a marriage legallity and illegallity beside the knowledge limitattion related with the ban in a marriage before a divorce formally or legally approved. It could be considered by the the office of religious court to educate its societies on the effect of Poliandry.

Abstract

Impulse buying for buying things behavior known as unplanned purchase behavior often that spread to everyone.There is no exception among Muslim women, often stuck to make purchases that are not planned on products woman fashion online. This is because of the ease of online shopping procedure in making a woman could has the deal of buying the things, without having to get out of the door of his home. By using qualitative methods, then this researchl concerned to discuss how the behavior of impulse buying is done by the Muslim Indonesia through online purchase. This research useed the analysis of case studies, with the observation, interviewing and documenting data from fifty informants from several cities in Indonesia. This research resulted  several things related to how the woman of fashion moving behavior of impulsive purchases, backgrounds and types of Muslim women who make purchases are impulsive, and lastly the shifting trend Muslim perpetrators impulse buying, being a Muslimah dropshipping way of the online sellers or other ways

Abstract

The low participation and involvement of women in politics has seen some discrimination and injustice against women, because they do not attention development policies are gender oriented. It is well recognized by women in Indonesia, so the post-New Order government women's advocacy movement that gave birth to affirmative action that essentially encourages and guarantees against women to be involved in politics. Significant impact of affirmative action is the birth of a minimal system of representation of women in parliament 30%. This representation system, reinforced in 2009 with the implementation zipper election system, where from 1-3 candidates proposed must be female. Abstract

This paper explains a phenomenon of ta’aruf which has been flourishing in the digital world. With the mode of revitalization of pure Islamic teachings and overlaid with the doctrine of hijrah, ta’aruf onlne is a way to invite man and woman to marry without dating. However, this article also explains the other side relating to this phenomenon of ta’aruf which in the process is involved in the practice of commodification. In this connection, there are two focus of studies reviewed in this paper, first, what is the background of the emergence of the phenomenon of online ta’aruf. Second, how the online ta’aruf phenomenon is commodified by its users. Using qualitative methods, research explores various website s and accounts that provide online ta’aruf services. The findings are that online ta’aruf in the digital world has been motivated by the movement of migratory trends in the Muslim community in recent years. However, in its development, online ta’aruf was later commodified by the perpetrators because there were interested people and the market wanted it.

Abstract

The number of internet users fewer females than males, internet brings many benefits for women. Internet helps reconstruct people's views about gender. High encourage women to have equal footing with men; facilitate women to engage in activities in the context of the public sphere, has space for mengaktualisaikan themselves, as well as an opportunity  to  live  more  independently.  On  the  other  hand,  the Internet also raises new problems for women. Internet often becomes a medium for the occurrence of crime and violence against women. Such forms of violence in the form of a message containing the anger and hatred, harassment, threats, fraud, use of false identities, or stalking. From the description, it is necessary encouragement and support for women in order to use the Internet in a healthy and productive. Abstract

Indonesia is one of disaster-prone countries. The disasters in Indonesia have destructed infra and supra structure that evoked more problems in human life, in example, the problems faced by elderly women. Not feasible residence, poor health service, and not guaranteed well-being are the examples of negative effect of disaster for elderly women. Therefore, elderly women face a dilemmatic situation that disrupts their life. Related to this poor condition post of earthquake in 2009, some tarekhat ulamas in West Sumatera performed a protection act through sumbayang 40 (40 praying). By means of this religious tradition, the elderly women who were disrupted by the earthquake gain protections from this activity such as religious education, economic support, psychological recovery, and settlement protection. As the result, the elderly women who followed this tradition obtained a well-being guarantee in the post disaster phase. Consequently, direct or indirect, sumbayang 40 tradition that is established in Minangkabau, contributes in achieving the goal of Millennium Development Goals (MGDs) program and improving life quality of elderly women.

Abstract

This article focuses on unregistered marriage among Samin community and its disadvantages to women and children. Using qualitative method, this paper tries to answer the question on how the practice of marriage among Samin community is and what are legal consequences of their marriage. Data were collected through observation and FGD. Since the marriage is not registered, it is not legally acknowledged by the government and Samin people do not have marriage certificate. Consequently, husband’s name is not mentioned in the family registration card and in child’s birth certificate since the children are considered as born out of wedlock. However, after the Constitutional Court’s Decision on judicial review of Administrative Law, believers of faith (penghayat kepercayaan) are allowed to state so in their national identity card. Thus, Samin people try to use this opportunity to declare their religious identity and to have their marriage registered.

Touch of education of gender perspective is a needs today because the children to be a complex  scircle. Purpose of this study is to explain what the learning follow children cauntion. Abstract

The village women leader (Klèbun Babine’) in Madura is not fully considered. They were merely a symbol and administrative officer. While the policy determinant is on the husband or family of the male party. In contrast, the case study of women Head Village chief Ponteh successfully run the village government without the influence of the husband or family from the male side. The leadership of Klèbun Babine' is not inferior to the village head led by men. The case study revealed the leadership practices, leadership styles and driving factors of Klèbun Babine ' in the village government. By doing observasion, in-depth interviews and playing documentation revealed that Klèbun Babine's leadership performed by paddling the community as a child, giving freedom to the official village to work well and to tighten on Primary community interests from personal interests. Klèbun Babine' implements the style of masculine-transformational leadership with the hallmark of totality in leading based on Divine value (transcendentalism). The driving factor of Klèbun Babine' success in the first village government are the individual ability, communication to bring out a layer of community, second, community suppor and active, third, the maximum role of village government. This study shows a new fact about Klèbun Babine ' that is not a symbol and administrative officer but it can lead the village government in rural Madura.
