Abstract

This study examines the process of divorce (talaq) undertaken by Civil Servants (Pegawai Negeri Sipil/PNS) in Peureulak Kota District and analyzes the views of the Aceh Ulama Consultative Council (Majelis Permusyawaratan Ulama/MPU) on the implementation of government regulations governing divorce permits for civil servants. The objectives of the study are to identify the constraints faced by PNS in obtaining divorce authorization and to assess the implications of these regulations for Islamic Family Law in Aceh, which is grounded in Sharia-based values. The research employs a qualitative methodology with a descriptive-analytical approach, utilizing interviews with village residents (warga gampong), tuha peut (members of the village consultative council), imum gampong (village imams), and geuchik (village heads). The findings indicate that although the grounds for divorce cited by civil servants meet the Sharia requirements, they nonetheless encounter significant difficulties in securing official permission from their superiors due to stringent administrative procedures. From the perspective of Islamic Family Law, this situation reflects an inherent tension between the individual right to initiate talaq and the state’s policy objective of safeguarding the public interest (maslahah ammah). The MPU Aceh maintains that such regulations are consistent with the principles of Maqasid al-Sharia, particularly the preservation of family integrity (hifz al-nasl) and social order (hifz al-mujtama). Accordingly, restrictions on divorce permits for civil servants may be understood as a form of tanzhimi (administrative regulation) intended to support the objectives of the Sharia in realizing justice and social welfare within Islamic Family Law.

Abstract

Early marriage continues to pose significant legal and social challenges in Indonesia, despite regulatory reforms introduced by Law No. 16 of 2019, which raised the minimum legal age of marriage to 19 years for both men and women. This reform has led to a marked increase in applications for marriage dispensation submitted to the Religious Courts, indicating a persistent gap between statutory norms and social realities. This study examines judicial considerations in Case No. 15/Pdt.P/2024/PA.Bji at the Binjai Religious Court. A qualitative approach is employed to explore the social, psychological, and cultural factors influencing judicial decision-making. The findings reveal that judges take into account psychological readiness, social pressures, and the principle of child protection in rendering their decisions. The study underscores the central role of judges as interpreters of substantive law amid complex social dilemmas and recommends strengthening support systems—such as the involvement of psychologists and enhanced public education—to prevent child marriage.

Abstract

This study examines the role of the usul al-fiqh maxim al-hukmu yaduru maa illatihi wujudan wa adaman (a legal ruling revolves with its effective cause in both its existence and nonexistence) as a foundation for the flexibility of Islamic law in responding to contemporary social dynamics. Employing a qualitative library research method, the study analyzes the application of this maxim in both classical cases (such as the prohibition of khamr and the obligation of zakat) and contemporary contexts (including the suspension of Friday prayers and the formulation of Sharia-based policies during the COVID-19 pandemic). The findings indicate that this maxim effectively sustains the relevance of Islamic law by ensuring its conformity with the Maqasid al-Shariah, particularly in safeguarding life (hifz al-nafs) and promoting the public interest (al-maslahah al-ammah). These findings underscore the urgency of applying rational Sharia legal maxims as a foundational basis for the development of positive law oriented toward Islamic values.

Abstract

This study examines the right of wives to receive financial support (nafkah) within nomadic households from the perspective of contemporary Islamic family law. The research aims to explore how Islamic principles can be flexibly applied to ensure the fulfillment of this right in dynamic social contexts. Using a qualitative approach, this study combines normative analysis—based on the Qur’an, Hadith, classical fiqh, and contemporary fatwas—with empirical fieldwork involving semi-structured interviews with ten Muslim couples living nomadic lifestyles in Jakarta, Surabaya, and Makassar. Findings reveal that while the obligation of husbands to provide nafkah remains central, nomadism creates challenges such as unstable income, high living costs, and disrupted emotional support. Nevertheless, families adopt adaptive strategies, including digital financial management, joint decision-making, and remote employment opportunities, to maintain stability. The normative-empirical integration demonstrates that sharia principles, when applied with contextual flexibility, can offer practical solutions for nomadic families. This study contributes to the discourse of Islamic family law by highlighting its responsiveness to contemporary socio-economic dynamics and recommends further research on rural contexts and policy advocacy to strengthen protections for wives’ rights.

Abstract

The concept of nusyuz originates from classical fiqh constructions and has evolved into a component of family law systems in several Muslim-majority countries. However, its classical formulation has frequently been criticized for potentially perpetuating unequal marital relations by legitimizing the husband's authority without systematically defined limitations. This situation raises concerns regarding the legal protection of wives from a human rights perspective. This study employs a doctrinal approach by examining legal principles, doctrines, and positive legal constructions concerning the limits of a husband's rights in addressing nusyuz. The analysis is conducted descriptively and critically through inductive and deductive reasoning to assess the potential abuse of authority and its juridical implications. The findings indicate that classical fiqh in fact contains normative limitations on the husband's actions, including the principles of gradual measures (tadarruj), the prohibition of harm, and the corrective purpose of sanctions. Nevertheless, these limitations have not been systematically formulated within a framework of marital partnership and the protection of human dignity. In the Indonesian context, any action that exceeds the principles of proportionality and non-violence may be classified as a legal violation, including criminal liability. This study affirms that the harmonization of Islamic law and human rights is achievable through reconstructing the limits of the husband's authority based on maqasid al-shariah, partnership principles, and the protection of women's life and dignity.

Abstract

This study is based on the increasing number of child custody (hadhanah) disputes after divorce in Indonesia, which highlights the limitations of litigation-based dispute resolution, particularly in terms of time, cost, and the psychological impact on children. Therefore, there is a need for alternative dispute resolution mechanisms that are more oriented toward the best interests of the child. This study aims to analyze out-of-court child custody dispute resolution within the Indonesian legal system and to assess the effectiveness of non-litigation mediation based on the child’s best interests through a case study of Non-Litigation Mediation Deed Number 078/AKTA-MED/LMKN-JKT/V/2024 issued by the Lembaga Mediasi Keluarga Nusantara (LMKN) Jakarta. The research method used is normative-empirical legal research with a statutory approach and case study analysis. The data are analyzed through the study of positive legal norms, legal doctrines, and the practice of child custody dispute resolution through non-litigation mediation. The findings show that the Indonesian legal system has provided a fairly comprehensive legal foundation for Alternative Dispute Resolution (ADR) mechanisms through Law No. 1 of 1974 on Marriage, the Compilation of Islamic Law (KHI), Law No. 35 of 2014 on Child Protection, and Law No. 30 of 1999 on Arbitration and Alternative Dispute Resolution. There are five forms of ADR used in child custody disputes, namely negotiation, family mediation, conciliation, customary deliberation, and institutional counseling. The LMKN case study demonstrates that a child-inclusive mediation model involving a psychologist co-mediator can produce more comprehensive agreements, including the application of joint legal custody with primary physical custody and a parenting schedule that is more adaptive to the child’s needs. The findings also indicate that the joint legal custody model combined with primary physical custody can be integrated with the concept of hadhanah in Islamic law, particularly within the framework of maqāṣid al-sharī’ah and the principle of child welfare (maslahah al-walad), and is therefore not contrary to Islamic law as long as it prioritizes the best interests of the child. This study concludes that child psychology-based non-litigation mediation is an effective dispute resolution model; however, it still faces challenges such as the absence of a specific family mediation regulation, low public literacy regarding ADR, and the limited number of certified mediators.
