Abstract

The sustainability and competitiveness of the company is supported by good human capital management. Human capital plays an important role in achieving the company's vision, mission and goals. The expression human capital was established to increase productivity and maintain competitive advantage as an important factor in expanding business and employee assets. Attention to human resources or human capital as one of the main production factors for most companies is often put second compared to other production factors such as capital, technology, and money. Many company leaders are less aware that the profits obtained by the company actually come from human capital. Human capital supported by a well-built shared vision will increase the company's ability to achieve its goals. Shared vision is a development tool to build organizational learning capabilities. This study examines the strategy for optimizing the role of shared vision and human capital in companies in an era of change. This type of research is a systematic literature review that will provide benefits in the implementation of shared vision and human capital in companies.

Abstract

The legal force of covernotes made by notaries in the granting of credit by banks is an important topic because of their vital role in banking and property transactions in Indonesia. Covernotes have become a common practice to speed up the credit disbursement process before all legal documents are processed, even though they are not authentic deeds. The status of covernotes raises serious questions about their legal force, because they are not explicitly regulated in the Notary Law. Cases of misuse of covernotes that have resulted in major losses for banks and customers increasingly emphasize the urgency of clarifying the legal status and limitations of the use of this instrument. The formulation of the problem in this study is, namely what is the function and legal position of covernotes made in the process of granting credit by banks, what is the authority of notaries in making covernotes in the disbursement of credit at banks, and what are the legal consequences of covernotes by notaries in the process of granting credit by banks. The research method used is empirical juridical, combining normative legal analysis with field research. Literature studies were conducted to examine legal regulations and literature, while field research included interviews with Notary Yetty Rosliana Sembiring and banking parties, as well as observations at notary offices. The data were analyzed qualitatively to understand the legal force of covernotes in bank credit practices. Covernotes in the bank credit process function as temporary collateral and instruments to accelerate credit disbursement, although they do not have the same legal force as notarial deeds. The authority of a notary to make a covernote is not explicitly regulated in the UUJN, but can be linked to the general authority of a notary in Articles 15 and 16 of the UUJN. The legal consequences of making a covernote that does not correspond to the facts can be very serious, including potential financial losses for the bank, criminal and administrative sanctions for notaries, civil lawsuits, and broader impacts on public trust in the notary profession and the banking system. This shows the importance of the integrity and caution of notaries in making covernotes, as well as the need for clearer regulations to regulate this practice in order to protect the interests of all parties involved and maintain the stability of the legal and banking systems.

Abstract

Operator Work Performance calculated in the Electronic Performance Management (EPM) Application has decreased from 2013 to 2015. From the results of the pre-survey of the General Manager Leadership Style of PT. Pelindo I BICT Branch, the majority of employees, 78%, showed a transactional leadership style. The discrepancy between attendance according to the Operator and attendance according to the EPM affects the amount of Operator Compensation. This condition is related to Motivation, namely the Motivation of Operators who arrive late and go home earlier than their working hours. The purpose of this study was to determine and analyze the effect of Transactional Leadership Style, Compensation and Motivation on Work Performance. This type of research is quantitative descriptive and the nature of this research is explanatory research. The population in this study was 77 employees and the sample of this study was the entire population to be observed (census research). Data analysis used multiple linear regression. The results of the study showed that partially Transactional Leadership Style had a positive and insignificant effect on Work Performance. However, Compensation and Work Motivation partially had a positive and significant effect on Work Performance. Simultaneously, Transactional Leadership Style, Compensation, and Work Motivation have a significant influence on Work Performance.

Abstract

Article 02 of Law No. 5 of 1960 concerning the Basic Agrarian Law states that ownership rights can be transferred. In hte process of transferring ownership, legal disputes are often unavoidable. One such legal issue related to the transfer of ownership is highlighted in the Supreme Court Decision No. 1206 K/Pdt/2020, in conjunction with the Makasar High Court Decision No. : 504/PDT/2018/PT MKS, and the Makasar District Court Decision No : 4/Pdt.G/2018/PN.Mks. The decisions indicate that the Defendants committed an unlawful act that harmed the Plaintiff, who was the heir. These rulings show discrepancies and conflicts in the court's verdicts. This thesis aims to explore the following issues: the legality of gifts between spouses under the Indonesian Civil Code and hte Compilation of Islamic Law, hte legal resolution of inheritance land transfers involving unlawful acts, and the judicial considerations in ruling on disputes involving unlawful acts in inheritance land transfers that harm the heirs (Case Study of Supreme Court Decision No. : 1206 K/Pdt/2020 dated June 3, 2020). The research method used in this thesis is normative juridical research, which is descriptive-analytic. It employs a normative juridical approach and secondary data sources, including primary, secondary, and tertiary legal materials. The data collection techniques include literature review and document analysis. The research uses qualitative analysis to examine the legal materials, followed by deductive reasoning to draw conclusions and provide answers to the research problems. The findings of this study reveal that hte legitimacy of gifting land between spouses during the marriage is prohibited under Article 1678 of the Civil Code, whereas, under Article 78 of the Compilation of Islamic Law, such gifts are not prohibited. Dispute resolution in land ownership transfers involving unlawful acts can be carried out through mediation or legal proceedings in court. The legal basis for the judge's consideration is Article 283 Rbg/163 HIR, where the Plaintiff successfully proved the claims in the lawsuit through a deed of gift and witness testimony. As a result, the court ruled that the disputed land was an inheritance from the Plaintiff's mother, and it was proven that the Defendants had committed unlawful acts. It is recommended that the parties clarify the legal status of the inheritance land by filing a petition with the Religious Court to prevent future inheritance disputes. Additionally, regional officials, such as the sub-district head, village head, and PPAT (land deed officials), should thoroughly investigate hte objects and family history of the gift applicant to ensure legal certainty in future gift transactions.

Abstract

One of the benchmarks of a company's success is human resources. Human resources are considered important because they can affect the efficiency and effectiveness of the company, and are the company's main expenses in carrying out its activities. Humans always play an active role in every company activity, namely as planners, actors and determinants of the realization of company goals, thus making humans a company asset that must be maintained, its efficiency and productivity improved. Saying that employee work loyalty is the determination and ability to follow with full awareness, responsibility, determination and ability that must be shown in daily attitudes and behavior, and in carrying out tasks. This opinion is interpreted that employee loyalty to work arises internally and loyalty to the company where they work because of their responsibility and ability. This research approach is quantitative research. Quantitative research methods can be interpreted as methods used to research a particular population or sample, data collection using research instruments, statistical data analysis, with the aim of testing the established hypothesis. While this type of research uses associative research. Associative research is research that aims to determine the relationship between two or more variables.

Abstract

There is a growing body of study and interest worldwide concerning the experiences of women in senior leadership roles in higher education institutions (HEIs). Hence, this study examined persistence of women leaders in senior leadership positions in the HEIs in Namibia. To gather the lived experiences and narratives of female leaders taking senior leadership positions the study combined qualitative methods with a critical paradigm-supported phenomenological case study design. Thematic analysis was used to semi-structured interview data, emphasising recurrent themes, patterns, and important topics. The study's findings were theoretically interpreted using feminist and role modelling motivation theories. Findings reveal that women leaders’ leadership experiences have been influenced by their attendance at conferences, seminars, and workshops. They made a positive difference in the lives of their colleagues and fostered a positive work environment. They have also inspired other women to aspire to leadership roles. By shedding light on these experiences, the study enriches understanding of gender dynamics in academic leadership, providing valuable insights for institutions striving towards gender equity and inclusive leadership. It sheds light on the strategies that contribute to their sustained success in senior roles. Future researchers should consider collecting data from aspiring women leaders so that there would be informed comparisons of their experiences. In addition to investigating the experiences of male leaders in senior leadership roles and establishing their perspectives of women leaders in senior leadership positions, future researchers should examine the impact of mentoring on career advancement and retention of women in senior leadership positions.

Abstract

The authors' purpose through this conceptual paper is to explore the challenges novice female teachers encounter in classroom management within secondary schools. The main question guiding this research is: "What are the specific classroom management difficulties faced by novice female teachers in secondary school settings?" A qualitative approach is employed, using recent literature reviews encompassing scholarly books and articles published between (2018-2024 on the perspectives of authors regarding the topic under discussion. This study is grounded within an interpretive paradigm which provides deeper insight into the scholarly perceptions regarding the topic under discussion. The findings reveal that novice female teachers often struggle with maintaining discipline, establishing authority and balancing relationships with students. Similarly, issues related to gender dynamics and societal expectations further exacerbate their classroom management strategies. Notably, this study is significant as it contributes to the existing body of knowledge on gender-specific challenges in education providing insights for teacher training programs and policy adjustments. Nonetheless, the limitations of this study include its focus on a single case study and its reliance on qualitative data which may not be generalizable to all contexts. Thus, further research is recommended to explore broader patterns across different school environments.

Abstract

This article explores the intricate relationship between artificial intelligence (AI) and the fundamental human right to life, with a specific focus on the context of a few African countries. The article begins by establishing a contextual understanding of both AI and the right to life, examining their theoretical underpinnings and historical development. It then looks at the relationship between AI and the right to life and how AI technologies are being deployed in the selected African countries, particularly in contexts relevant to the right to life, such as healthcare, criminal justice, transportation and disaster response. The article then looks at the ethical considerations that arise from the intersection of AI and the right to life in African contexts particularly in the context of three contentious issues that the right raises, namely, the death penalty, abortion and euthanasia. This is followed by an overview of the legal and policy frameworks governing AI in these countries, and how they address concerns related to the right to life. The article concludes with lessons from the experiences of South Africa, Mauritius, Egypt, and Kenya in navigating the ethical challenges of AI governance, and recommendations on what these countries can learn from each other on one hand and what they can learn together, on the other.

Abstract

GEPIKAS is an initiative that aims to improve access to quality education for children with disabilities in Indonesia. In the context of inclusive education, GEPIKAS focuses on developing policies and programs that support the integration of children with disabilities into the formal education system. Through collaboration between the government, educational institutions, and the community, this movement seeks to create a friendly learning environment that supports the special needs of students. The importance of accurate data on the number and type of disabilities in educational institutions is one of the main pillars in the implementation of GEPIKAS. With applications such as the Student Learning Profile (PBS), it is hoped that inclusive student data collection can be carried out in detail, so that the policies taken can be more targeted. In addition, training for educators on how to teach children with disabilities is also a main focus to ensure the quality of education received. Through socialization and training activities, GEPIKAS not only seeks to increase public awareness of the importance of inclusive education, but also encourages active participation from various parties in supporting children with disabilities. Thus, GEPIKAS is expected to become an effective model in equalizing quality education in Indonesia, ensuring that every child, without exception, gets their right to learn and develop.

Abstract

Many factors determine the level of poverty in a region, therefore comprehensive steps are needed to achieve general prosperity and reduce the rate of poverty, taking into account the underlying factors. The urgency and renewal regarding service solvency which has not been studied extensively and the level of poverty has become important topic, as Aceh is one of the 10 poorest provinces in Indonesia. This research aims to determine the effect of service solvency and the growth of original local government revenue on poverty levels using gross regional domestic product as mediating factor in Langsa city. Based on research findings, it is known that simultaneously service solvency and original local government revenue variables have significant effect on poverty level. Partially, original local government revenue variable has positive and significant effect on poverty level, while service solvency has no effect on poverty level. The result of path analysis testing indicates gross regional domestic product variable is not able to serve as a mediating variable for service solvency and original local government revenue on poverty level in Langsa city.
