Abstract

Waqf is a unique concept in Islam that has significantly impacted the development and support of economic development in Indonesia. One of the characteristics of waqf is that the assets given cannot be sold, and the benefits of waqf must be used for the public good. In addition, waqf also supports economic development. In an example of its application, waqf land can be used for agriculture or business ventures, thus generating income that can be used to help the community in various ways. This is an example of the application of productive waqf. Productive waqf is an important part of the economic development of society. In the application of Maqasid Sharia principles, productive waqf is an effort to preserve wealth or Hifdz Al-Mal. Basically, productive waqf is not only about preserving existing assets, but also maximizing their growth potential. According to Jasser Auda, Hifdz Al-Mal is not only defined as an effort to protect property from other people's interference, but holistically, namely as a person's right to obtain property in a halal manner. In a broad sense, the right in this case is related to giving someone the authority to open employment opportunities for others.

Abstract

This kind of approach focuses on rehabilitation and taking responsibility for one’s action rather than severe punishment. Pretrial interventions also allow the offender to participate in rehabilitative programs aimed at skills training and preventing future offenses without the stressful effect of the traditional criminal scion. More training and resources for police are crucial in the management of petty theft cases without the loss of public trust in the system of justice. Wanting community education efforts are also important in the elimination of petty theft. The study in this research uses the literature research method. Literature research method, also known as literature study, is an approach in research that relies on secondary data through the collection, analysis, and interpretation of published materials relevant to the research topic. The rationale for alternative legal solutions for petty theft cases cases demonstrates an advancement of criminal justice systems going beyond punitive measures. With the help of the restorative methods of justice, the two parties- the offender and the victim – become participants in the process of redress, which makes it possible for the offender to accept responsibility for his/her behaviour and for the victim to be reinstated with a sense of justice.

Abstract

The object of this research study is to know how the judge's considerations in implementing the decision regarding hadhanah for ex-husbands at the Class 1A Tanjung Karang Religious Court. The method used in this study is to use a normative legal approach with qualitative literature (Library Research) and analytical nature. The data source in this study is secondary data by conducting a study of data sources in the form of legal materials, both in the form of primary legal materials, secondary legal materials, and tertiary legal materials, the data collection method is carried out by means of literature studies and documentation. Data processing is carried out by editing, coding, reconstructing, and constructing/systematizing. Data analysis using qualitative analysis with inductive thinking method. The result of this study is that the Religious Court Class 1A Tanjung Karang in deciding the case of hadhanah against a child who has not mumayyiz is given to the father. The Panel of Judges in considering its decision set aside Article 105 of the Compilation of Islamic Law. This is based on the Supreme Court Jurisprudence which contains the legal principle that child maintenance (hadhanah) is not absolute to the mother as in Article 105 letter (a) of the Compilation of Islamic Law but can be given to the father by considering the welfare of the child or the best interests of the child. Another consideration used by the Panel of Judges is by looking at the moral justice aspect of the child, because the child is comfortable and peaceful living with his father. When viewed from positive Indonesian law, the provision of hadhanah is appropriately given to the father, namely by considering the welfare and protection of the child.

Abstract

The increasing involvement of children as perpetrators of crimes has become a serious concern in Indonesia. This study aims to analyse the factors contributing to juvenile delinquency using a juridical empirical approach. It examines three cases of children in conflict with the law involving acts of assault, sexual misconduct, and theft. The findings reveal that the primary factors influencing such behaviour include unstable family conditions, such as parental divorce and lack of parental attention, negative peer environments, and the adverse effects of technology, particularly easy access to pornographic content. Additionally, online gaming addiction significantly contributes to criminal behaviour, especially in theft cases. This study underscores the importance of family roles in moral education, supportive social environments, and monitoring the use of technology to prevent children from engaging in criminal acts. It recommends a holistic approach involving families, communities, and the government to address this issue. Effective interventions include strengthening family based education, enhancing digital literacy, and developing community based rehabilitation programs for children involved in criminal activities.

Abstract

Consumer protection is a basic right that must be guaranteed by the state, especially in the insurance sector which has a high potential risk for consumers. Although Law No. 8 Year 1999 on Consumer Protection (UUPK) has provided a legal basis, there are still various challenges in its implementation, especially related to fraudulent practices that often occur in the process of filing insurance claims. This fraud can cause significant financial losses for consumers, both financially and psychologically. In this context, advocates have a very important role in protecting consumer rights, from assisting during the dispute resolution process to advocating for policy changes that better protect consumers. This research uses a normative juridical method with a literature study approach to analyze the role of advocates in handling cases of insurance fraud. It is hoped that the results of this study can provide a comprehensive understanding of the importance of the role of advocates as companions and protectors of consumer rights in the face of fraudulent practices of insurance companies and encourage the creation of a more fair, transparent and accountable insurance system

Abstract

Efficient and competency-based educational administration management is an important key in improving the operational quality of educational institutions, especially at the PAUD level, which functions to ensure the smooth learning process and service to the community. This community service activity was carried out at the Merpati PAUD Institute, Kutawaluya District with the aim of increasing the capacity of PAUD administration and management staff in the Kutawaluya subdistrict area through the Asset-Based Community Development (ABCD) approach. This approach focuses on utilizing local potential to strengthen administrative management and increase work efficiency. The aim of this activity is to develop the competence of administrative staff and teachers in more efficient competency-based administrative management, as well as building community solidarity in supporting better PAUD management. The methods used include identifying needs through focus group discussions (FGD), training, mentoring and participation-based evaluation. Activities began with local resource mapping, followed by technical training on administrative management and the use of simple technology. Mentoring is carried out intensively to ensure the implementation of training results in the field. The results of the activity show an increase in the understanding of administrative staff and teachers regarding the importance of competency-based administrative management, as well as positive changes in a more professional work culture. The implication is improving the quality of PAUD management which can strengthen public trust in the institution and create a sustainable social impact in the management of early childhood education.

Abstract

The 2024 Presidential Election (Pilpres) in Indonesia is an important moment involving a debate on the vice presidential candidates (Cawapres). This research aims to analyze the sentiment and comment network on the Cawapres debate video on YouTube KompasTV using the Social Network Analysis (SNA) approach. Data collected from YouTube comments, analyzed using Netlytic and Gephi to identify public sentiment and key actors. The results show that interaction between actors is relatively easy with the dominance of positive comments. The word "Gibran" appeared most frequently, indicating attention to one of the candidates. The fachrurrozinoorkhomarudin1253 account has the highest degree centrality, while Lena_Palma has the highest betweenness centrality, indicating significant influence in the network. Conclusion: The Vice Presidential Debate creates active interaction on YouTube, with public sentiment tending to be positive.

Abstract

This study aims to explore the influence of CSR on employee happiness and company performance at PT Indofood. The method used in this research is a literature study, where data is collected from various literatures, including books, journals, and articles that discuss CSR and its impact on companies. Through a comprehensive CSR program, including initiatives such as Indofood Riset Nugraha, this study found that employee involvement in social activities conducted by the company can increase their sense of ownership and job satisfaction. The results show that employees who feel valued and involved in CSR programs tend to show higher loyalty, as well as better productivity. In addition, there is a positive influence of CSR on company performance, which is reflected in an improved corporate image and Net Profit Margin (NPM). This finding confirms the importance of CSR integration in PT Indofood's business strategy to achieve sustainability and long-term growth. Thus, CSR not only provides benefits to society but also strengthens relationships with employees, creating a more positive and productive work environment.

Abstract

This study examines the implementation of online culinary digital marketing by resellers from the perspective of fiqh muamalah, with a focus on the study in Gedangan Hamlet, Gedangan Village, Mojowarno District, Jombang Regency. Using a qualitative approach, this study aims to analyze the suitability of digital marketing practices with sharia principles in the context of online culinary trade. Direct observation, documentation studies, and in-depth interviews with six online culinary business actors were used to gather data. According to the study's findings, online culinary digital marketing  by resellers has not quite complied with the requirements of fiqh muamalah, particularly with regard to contracts and transaction transparency. The majority of business actors use WhatsApp, Facebook, and Instagram platforms with a profit-sharing system of between 10-20%, but without adequate formal documentation. This research shows that the majority of business actors carry out promotions using other parties' product content without permission and take advantage without any formal agreement. From the perspective of muamalah fiqh, this practice does not meet the legal requirements for buying and selling because the goods sold are not their own or do not have official power of attorney from the owner. To overcome this problem, the study recommends the standardization of reseller contracts in accordance with the principles of muamalah fiqh, including clear documentation of agreements. In addition, it is important to form a sharia business community to support the implementation of sharia-compliant digital marketing.

Abstract

Marriage agreements based on their benefits in fact do not run as they should because many people still do not understand how important marriage agreements are to protect women’s rights in marriage, so this research aims to analyze the marriage agreement influencing the Decision of the Panel of Judges in the division of joint property and examine the concept of separation of property in the household contained in the marriage agreement from a legal purpose perspective. The results of this study indicate that (a). the division of joint assets in the Religious Court sees the existence of a Marriage Agreement, namely the Samarinda Religious Court Number 1726 / Pdt.G / 2019 / PA.Smd and the Balikpapan Religious Court Number 1672 / Pdt.G / 2023 / PA.Bpp, prioritizes maslahah, namely an effort to bring benefits and goodness by rejecting harm that will cause damage to humans, this is known as the substantive justice of the judge as a case resolver who fulfills the sense of justice of the community, while for cases where there is no marriage agreement, the Panel of Judges adjudicates in accordance with Article 97 and Article 98 of the Compilation of Islamic Law in conjunction with Article 35 of Law No. 16 of 2019 concerning Amendments to Law Number 1 of 1974 concerning Marriage, namely dividing joint assets for the wife ½ part and the husband ½ part, b) Marriage Agreement in accordance with Jeremy Bentham's opinion where the law must contain legal objectives in the form of maximum benefits for many people, by fulfilling several factors, namely to provide a living, to provide abundant food, to provide protection, to achieve equality, then the Marriage Agreement can protect the wife's rights in marriage
