Abstract

This study examines the issues surrounding land rights certification through the Complete Systematic Land Registration (PTSL) program at the West Kutai Regency Land Office. The research aims to identify the challenges faced in the certification process and the role of the land office in addressing these issues. Utilizing a normative legal research method, data was collected through literature studies and field research. The findings reveal several problems, including unstable internet connections, unvalidated National Identity Numbers (NIK), incomplete documentation, low public understanding of the importance of certificates, geographical challenges, and inadequate human resources. The study also highlights the proactive measures taken by the West Kutai Land Office, such as implementing Starlink for internet connectivity, coordinating with Dukcapil for data validation, conducting massive socialization efforts, and hiring additional staff to improve service delivery.

Abstract

This study examines the legal analysis of the neutrality of State Civil Apparatus (ASN) in Samarinda during the implementation of the General Election. The research focuses on the legal framework governing ASN neutrality, the challenges faced by oversight bodies in enforcing these regulations, and the implications for democratic processes. The findings reveal that while legal provisions such as Law No. 20 of 2023 on ASN and Law No. 7 of 2017 on General Elections provide a strong foundation for neutrality, practical challenges including bureaucratic delays, limited authority of oversight bodies, and political interference hinder effective enforcement. Recommendations include strengthening inter-institutional coordination, enhancing public awareness, and ensuring the independence of oversight mechanisms to promote fair and transparent elections.

Abstract

Consumer disputes between defaulting bank debtors and banks are a crucial issue in consumer protection within the financial services sector. This research aims to examine the efforts and obstacles faced by the Consumer Dispute Settlement Board (BPSK) of Samarinda City in resolving such disputes, viewed through Law No. 8 of 1999 concerning Consumer Protection. Employing a normative juridical research method supplemented by interview data, this study analyzes BPSK's authority, procedures, and challenges. The findings indicate that BPSK Samarinda endeavors to resolve these disputes, particularly through mediation. BPSK facilitates dialogue between consumers (debtors) and business actors (banks), provides education, and guides the parties toward achieving amicable, win-win solution agreements according to established procedures. However, BPSK encounters significant constraints, including potential jurisdictional overlap with other financial sector dispute resolution bodies (LAPS-SJK), limitations in the legal basis specifically governing its authority in the banking sector, late reporting by consumers after enforcement actions (auctions), and insufficient public awareness, sometimes coupled with delayed responsiveness from business actors. Although BPSK serves as an accessible and low-cost alternative dispute resolution mechanism, strengthening its legal foundation and conducting massive outreach are necessary to enhance its effectiveness in handling complex banking disputes.

Abstract

This research examines the legal responsibility of PT. ID Express Logistik Indonesia for damaged goods during the delivery process, focusing on the application of Law Number 8 of 1999 concerning Consumer Protection. The methodology employed is normative legal research with a legislative and case study approach. The findings indicate that although consumers have the right to file compensation claims, the claim process is often hindered by reporting deadlines, verification procedures, and compensation limits set by the company. The case of consumer IS, who experienced damage to goods due to improper packaging, highlights an imbalance in legal protection for consumers. PT. ID Express frequently limits its liability through standard clauses in shipping agreements, which can create legal uncertainty. This study emphasizes the importance of balancing the rights and obligations between consumers and companies to establish legal certainty in goods delivery services. It is hoped that the results of this research can contribute positively to the development of consumer protection practices in Indonesia.

Abstract

This study aims to analyze the implementation of the 30% women's representation quota in the 2024 legislative elections for the Samarinda City DPRD, based on Law Number 7 of 2017 concerning General Elections. The research method employed is empirical juridical, with data collection through interviews with members of the General Election Commission (KPU) and representatives of political parties, as well as document studies related to the topic. The findings indicate that although the 30% quota has been implemented, various challenges persist, such as the low interest of women in entering politics, societal stereotypes that view politics as a male domain, and the strong patriarchal culture still present in society. Additionally, the lack of family support for women wishing to participate in politics also serves as a hindrance. This research found that while the percentage of women's representation in candidacy reached 36.90%, the number of women elected to the DPRD decreased compared to the previous election. Therefore, this study is expected to provide recommendations for political parties and related institutions to enhance women's representation in politics and promote gender equality in Indonesia through better political education and support.

Abstract

Land acquisition for public interest in the Nusantara Capital City (IKN) is a complex legal issue, particularly concerning compensation for communities affected by land acquisition. This study aims to analyze the mechanism of land compensation, especially for communities without land certificates, and to identify the obstacles faced by the government in the land acquisition process. The research method employed is normative legal research, utilizing literature and field data approaches. The findings indicate that although communities without land certificates are still entitled to compensation, various obstacles exist, such as uncertainty in land ownership and resistance to the proposed compensation amounts. Additionally, the land acquisition process is often hindered by administrative issues and a lack of public understanding regarding their rights. This study recommends enhancing socialization and transparency in the land acquisition process, as well as a review of compensation policies to ensure fairness and adequacy for all affected parties.

Abstract

The development of digital technology has posed challenges and opportunities for legal protection of traditional trade motifs, such as Sarung Samarinda. This study aims to analyze the legal protection of the Sarung Samarinda trade motif in the context of Law Number 01 of 2024 concerning Information and Electronic Transactions (ITE). The method used in this research is a juridical-normative approach, analyzing applicable regulations and conducting interviews with relevant parties. The research findings indicate that although the ITE Law provides a stronger legal framework, the main challenges lie in the low legal awareness of the public and limited digital supervision. This study recommends the need for collaboration between the government, motif owners, and digital platforms to enhance legal protection and law enforcement against violations of trade motifs in the digital environment.

Abstract

The acquisition of land rights is a crucial issue in public infrastructure development in Indonesia, including in Samarinda City, where the revitalization project of Pasar Pagi requires the acquisition of land with ownership certificates. This study aims to analyze the efforts of the Samarinda City Government in acquiring land rights and the obstacles faced in the process. Employing an empirical juridical method with a qualitative approach, this research involves interviews with landowners and related institutions. The findings indicate that the government's efforts in land acquisition are not optimal, with the main obstacles being the rejection of landowners regarding compensation deemed insufficient and the lack of community involvement in planning. Therefore, the Samarinda City Government needs to enhance communication and transparency in the land acquisition process to achieve mutually beneficial agreements.

Abstract

Green Open Space (RTH) plays a crucial role in creating a healthy and sustainable urban environment; however, the Samarinda Ulu District in Samarinda City faces challenges in meeting the RTH standards set by Law No. 26 of 2007 and the Samarinda City Regional Regulation No. 7 of 2023. This study aims to analyze the implementation of the Spatial Planning of RTH, identify the challenges faced, and provide recommendations to enhance the effectiveness of RTH management. The research employs a normative approach, collecting data through literature studies, interviews, and field observations. The findings indicate that out of the targeted 30% RTH, the Samarinda Ulu District has only achieved approximately 0.4393%, with the main challenges being land limitations, a lack of competent human resources, and low community participation. Collaborative efforts between the government and the community are essential to raise awareness of the importance of RTH, along with intensive education and outreach to realize optimal RTH for improving the quality of the environment and the well-being of the community.

Abstract

This research uses sociological juridical with an empirical approach. Primary data used is Law Number 32 of 2009 concerning Environmental Protection and Management. Meanwhile, secondary data is in the form of statutory regulations, books, and journals relating to environmental criminal law enforcement related to environmental pollution due to electronic waste. The legal material analysis technique used is deductive. To obtain data that matches the facts in the field, this research was located at the Sidoarjo Regency Environment and Hygiene Service. The results of this research found that government officials as providers of authority or permits regarding the environment, especially electronic waste, only carried out outreach. Administrative law enforcement carried out by the Sidoarjo Regency Environment and Hygiene Service is still not running optimally and only has the authority to issue permits for B3 waste collection on a district scale. Then, the public as law enforcers tend to be indifferent, such as the lack of level of compliance in complying with provisions related to the obligation to carry out electronic waste management.
