Abstract

Pemilihan Umum Republik Indonesia, bukan hanya dilaksanakan di Indonesia, namun juga dilaksakan diluar negeri. Keputusan Komisi Pemilihan Umum Republik Indonesia nomor 2030/PL.02.1-Kpt/01/KPU/XII/2018 tentang Perubahan Atas Keputusan Komisi Pemilihan Umum Republik Indonesia Nomor 1801/PL/02.1-Kpt/01/KPU/IX/2018 tentang Rekapitulasi Daftar Pemilih Tetap dan Badan Penyelenggara Untuk Setiap Daerah Pemilihan dalam Pemilihan Umum tahun 2019 menunjukan information bahwa DPT Luar Negeri tersebar di 130 perwakilan Indonesia di luar negeri baik kedutaan besar, konsulat jenderal, konsulat, hingga kantor dagang dan ekonomi, sebanyak 2.058.191 Jiwa. Metode pemungutan suara di Luar negeri berbeda dengan pemungutan suara di dalam negeri. Kasus yang terjadi tahun 2019 di Malaysia yakni adanya surat suara tercoblos di ruko-ruko yang bukan yuridiksi negara Indonesia sebelum pelaksanaan Pemilihan Umum memungkinkan dapat terjadi lagi di tahun 2024 sebab tidak adanya perubahan peraturan signifikan tentang Pemilihan Umum Republik Indonesia di Luar negeri untuk Pemilu 2024. Pada kasus stersebut, Pihak penyelenggara baik Bawaslu-RI maupun KPU-RI sulit menentukan surat suara yang tercoblos adalah surat suara asli atau bukan, karena untuk menentukan keaslian surat suara merupakan kewenangan Ketua Bawaslu dan Ketua KPU yang mana harus melihat langsung dan menyesuaikan kode rahasia yang tertera dalam surat suara. Kasus rusaknya surat suara di Malaysia tahun 2019 mengakibatkan Bawaslu-RI mengeluarkan rekomendasi untuk tidak menghitung surat suara diwilayah rusaknya surat suara, padahal polisi Malaysia belum menyerahkan surat suara yang rusak dan pihak penyelenggara belum mengetahui bahwa surat suara tersebut Asli atau tidak. Keterbatasan waktu dan daya jangkau akibat adanya batasan yuridiksi tentu memerlukan perubahan konsep terhadap penyerahan alat bukti pada yuridiksi yang berbeda. Olehnya konsep Rebuild terhadap ekstradisi barang bukti perlu dilakukan dalam upaya melakukan penyelidikan tindak Pidana Pemilihan Umum, sehingga oleh penyelenggara Pemilihan Umum dapat sedini mungkin mengetahui bahwa perbuatan tersebut termasuk tindak pidana atau bukan. Hal ini berupaya menerobos konsep bahwa selama ini ekstradisi barang bukti dilakukan sebagai upaya pada tingkat penyidikan tindak pidana yakni telah nyata perbuatan tersebut adalah tindak pidana. Pada penelitian ini, melibatkan information empiris dari Bawaslu-RI untuk mendapatkan sinerjitas terhadap perubahan konsep penanganan Tindak Pidana Pemilu Republik Indonesia yang terjadi di luar negeri.

Abstract

Law Enforcement is a small part of legal development that continues to be pursued. This research uses qualitative data analysis method. The results of the study are then directed at the form of efforts to contribute to superior law enforcement towards ius constituendum and religiosity. The contribution of legal education is able to produce professional and virtuous jurists so as to realize superior Human Resources in the field of law to answer what has become a problem formulation in this study. This research uses a juridical-normative approach. Therefore, it emphasizes the study of library materials and the disclosure of the meaning of a positive legal norm. The data source used is secondary data, conducted through library research. In Islam, there are many statements about the rights and obligations of a Muslim in defending the homeland. On this basis, every Muslim defends the sovereign rights of his nation to achieve a country that is baldatun thoyyibatun wa robin ghofur.  Continuous efforts to develop the legal system are needed so that the law can play its role and function as a guide to behavior in living together

Abstract

Ketentuan Pasal 44 KUHAP secara tegas melarang untuk melakukan pinjam pakai terhadap benda sitaan (barang bukti), namun dalam praktik sehari-harinya sering dijumpai adanya pemberian izin untuk pinjam pakai terhadap benda sitaan (barang bukti) dalam perkara tindak pidana. Penelitian ini menggunakan pendekatan yuridis normatif dan pendekatan yuridis empiris. Pengumpulan data dengan studi lapangan dan studi pustaka. Analisis data dilakukan secara yuridis kualitatif yaitu analisis yang dilakukan secara deskriptif. Hasil penelitian membahas prosedur pelaksanaan pinjam pakai barang bukti perkara tindak pidana terhadap benda sitaan dengan cara pengembalian benda sitaan kepada pemilik yang berhak dan mengajukan permohonan peminjaman/titip pakai barang bukti yang diajukan oleh si Pemohon. Dasar pertimbangan Hakim adalah dengan adanya adanya Surat Permohonan dari si pemohon tentang adanya kepemilikan barang yang dijadikan barang sitaan dan dijadikan barang bukti didalam pembuktian di persidangan karena barang bukti yang disita barang yang digunakan untuk mencari nafkah sehari-hari. Faktor penghambat pelaksanaan penyitaan terhadap barang bukti pada perkara tindak pidana disebabkan oleh faktor hukum, faktor sarana dan prasarana, faktor masyarakat dan faktor kebudayaan, dimana banyak masyarakat yang tidak mengetahui prosedur pelaksanaan pinjam pakai barang bukti dan tata cara syarat-syarat administrasi dalam permohonan pinjam pakai barang bukti tersebut.

Abstract

In an effort to maintain state order and protect all people from various forms of crime and violations, the state has the right to impose criminal sanctions on anyone, including members of the Police who are actually law enforcers. The behavior of Polri members is also often scrutinized and criticized in relation to their professionalism in carrying out their duties due to several internal and external factors. This study aims to find out the aspects of criminal law in cases of murder committed jointly by two members of the National Police. The type of research used in this research is legal research, namely legal research whose object of study includes active legal regulations based on library research. The approaches used are the statute approach, conceptual approach, and case approach. Based on the results of the research, it was concluded that with regard to criminal responsibility, the two perpetrators received the same punishment if both were proven to have committed the crime of murder as stipulated in Article 338 of the Criminal Code in conjunction with Article 55 of the Criminal Code, both the main perpetrator and the perpetrator participating. However, a second perpetrator who is not an executor can also be charged under Article 56 of the Criminal Code if his role is only limited to providing assistance at the time of an assassination attempt or deliberately allowing the perpetrator to kill the victim without any attempts at mediation. With regard to criminal acts committed by members of the Indonesian National Police, there is a mechanism for Enforcing the Police Professional Code of Ethics apart from proceedings in the general courts. So for crimes with the threat of 5 years and above, the legal consequences are serious violations with sanctions of dishonorable dismissal.

Abstract

Immigration crimes are acts of deviation and violations in the immigration sector where these deviations and violations in the immigration sector can be prosecuted through immigration action or through the judicial process. One form of criminal violation in the immigration sector as mentioned above is the crime of misuse of a residence permit without being able to show travel documents in Indonesia. The results of the research are the factors that cause the immigration crime of not being able to show travel documents/residence permits in Indonesia, including legal substance factors, legal structure factors, and legal culture factors. Law enforcement efforts carried out by the TPI Bandar Lampung Class I Immigration Office against perpetrators of immigration crimes who cannot show travel documents/residence permits in Indonesia can be carried out through Immigration Administrative Actions (actions without the application of criminal sanctions) and Pro Justiciary Actions (judicial processes). The responsibility for perpetrators of migration crimes who cannot show travel documents in Indonesia is in accordance with Decision Number: 05/PID.R/2018/PN.Tjk, namely that the perpetrator must be held accountable for his actions because he cannot show travel documents with a fine of Rp. 1,000,000,- (one million rupiah), subidair imprisonment for 7 (seven) days. The advice given is that it is necessary to increase the number of Immigration PPNS to monitor the presence of foreigners in Lampung Province and increase public legal awareness regarding indications of residence permit violations committed by foreign nationals in the Lampung Province area.

Abstract

Infrastructure have a crucial role in the development of a country. The availability of adequate infrastructure makes it easier for the population to access their basic needs, such as highways, public transportation, clean water, and employment opportunities. In this regard, the government has been actively involved in sustainable infrastructure development, considering various aspects such as economic, social, cultural, and environmental to ensure that no aspect is neglected. Of course, such infrastructure development requires sufficient funding, one of which is through private investors, such as infrastructure financing companies. The purpose of this research is to examine the implementation of equitable infrastructure financing in Indonesia, aiming to achieve the expected outcomes of such development. The research method employed in this study is a normative juridical approach, utilizing legal regulations and a conceptual approach. The findings of this research reveal that infrastructure financing in Indonesia is not solely reliant on the national budget (APBN) but also involves private investors. The collaboration between the government and private investors in infrastructure financing is facilitated through the Public Private Partnership (PPP) scheme, with project execution under the Private Sector Participation (KPS). Furthermore, the government has introduced various policies and strategies to realize equitable infrastructure development in Indonesia.

Abstract

There are several forms of counterfeiting crimes, which are regulated in the provisions of Indonesian criminal law, including counterfeiting money, counterfeiting brands, and so on. The research problem is: What are the factors causing the criminal act of making fake diplomas at the Ma'arif Nahdlatul 'Ulama Islamic Institute (IAIM NU) NU Metro and what is the basis for the judge's consideration in handing down a decision against the perpetrator of the crime of making fake diplomas at the Ma' Islamic Institute? arif Nahdlatul 'Ulama (IAIM NU) Nu Metro. The research method is normative and empirical juridical, using secondary data and primary data, obtained from literature studies and field studies, and qualitative juridical data analysis. Economic factors are the strongest factors that cause criminal acts to occur. The judge's basic consideration in handing down a decision on the crime of diploma forgery is based on criminal evidence through positive legal rules, as well as the judge's knowledge and experience. It is hoped that the police will provide more education to the public, especially young people, so that they do not use shortcuts to earn income, because criminal acts are very detrimental to themselves and others. The aim of imposing a sentence is to deter the perpetrator so that he does not repeat his actions again, but in addition to the maximum sentence, it is hoped that the panel of judges will also provide special mental assistance so that the perpetrator will feel ashamed if they have to deal with the law again.

Abstract

The condition of handling children who commit crimes is very apprehensive. Many children facing criminal cases must be detained in a place that is disproportionate to the capacity of the existing Children's Penitentiary (Lapas). Often law enforcement officials make peace so that cases are not forwarded to the legal process. But peace like this is not the expected diversion mechanism, because peace here does not pay attention to the best interests of the child. This is understandable, considering that in carrying out diversion as desired, law enforcement officials do not yet have a legal umbrella, besides that there are no implementation guidelines or technical instructions. for law enforcement officials to implement ways of solving diversion for children who are facing criminal cases. This type of legal research is normative legal research. The nature of the research in this study is analytical descriptive in nature. The type of data used in this research is library research. By using the concept of restorative justice, the expected result is a reduction in the number of children who are arrested, detained and sentenced to prison; eliminating the stigma/stamp and returning children to normal human beings so that it is hoped that they will be useful in the future, juvenile offenders can realize their mistakes, so they do not repeat their actions reducing the workload of the police, prosecutors, detention centers, courts and prisons; saving state finances, not causing a feeling of revenge because the perpetrator has been forgiven by the victim, quickly getting compensation; empowering parents and the community in overcoming child delinquency and reintegrating children into society. Especially Indonesia, which has made Law no. 11 of 2012 concerning the Juvenile Criminal Justice System which has regulated the concept of diversion and restorative justice

Abstract

Pemindahan ibu kota negara dari Jakarta ke Nusantara adalah sebuah keniscayaan yang dibutuhkan Indonesia sebagai sebuah negara besar. Lahirnya Undang – Undang Nomor 3 Tahun 2022 tenang IKN merupakan sebuah politik hukum terhadap kebijakan pemindahan Ibu Kota Negara. Secara visioner Ibu Kota Negara ini diharapkan menjadi kota dunia yang modern, maju dan startegis. Oleh karena itu kajian geopolitik dan geostrategi menjadi persfektif penting dalam analisis penelitian ini. Permasalahan utama dalam tesis ini adalah bagaimanakah strategi politik hukum lahirnya UU No. 3 tahun 2022 tentang Ibu Kota Negara (IKN) dan bagaimanakah aspek geopolitik dan geostrategi pemindahan ibu kota negara. Penelitian ini dilakukan dengan metode penelitian yuridis normatif dengan jenis analisis data kualitatif. Pendekatan yang digunakan adalah pendekatan undang-undang (statuta approach) karena akan menelaah Undang-Undang atau regulasi yang terkait dengan penelitian. Analisis data kualitatif dilakukan dengan tahapan Collection, Reduction, Display data, dan Conclusion Drawing. Setelah dilakukan penelitian maka dapat disimpulkan bahwa Kajian politik Hukum yang melahirkan Undang-Undang Nomor 3 Tahun 2022 tentang IKN pada prinsipnya memiliki keserasian dengan azas pembentukan peraturan perundang-undangan sebagaimana ketentuan dalam UU Nomor 12 Tahun 2011. Aspek geopolitik dan geostrategi menjadi landasan strategis untuk memastikan bahwa kebijakan pemindahan ibu kota negara tersebut telah melalui kajian dan analisis yang komprehensif, mendalam dan visioner.

Abstract

Rentang wilayah negara mengharuskan penanganan moda transportasi angkutan darat, laut dan udara secara terpadu untuk mewujudkan sistem angkutan nasional yang andal, efektif dan efisien, kewajiban pengangkut adalah menjamin bahwa penumpang dan/ atau bagasi atau kargo yang diangkutnya sampai di tempat tujuan dengan selamat, UU 1/2009 atau UU Penerbangan dan Permenhub 77 Tahun 2011 telah memberikan perlindungan. Oleh karenanya menarik untuk meneliti bagaimana Pengaturan tanggungjawab maskapai penerbangan terhadap penumpang atas kecelakaan pesawat berdasarkan hukum penerbangan Indonesia dan Pelaksanaan tanggungjawab maskapai Sriwijaya Air terhadap penumpang atas kecelakaan pesawat SJ 182. Untuk menjawab permasalahan tersebut, digunakan metode penelitian hukum normatif (yuridis normatif) dengan pendekatan undang-undang, pendekatan kasus, pendekatan konseptual, menggunakan data sekunder yang diperoleh dari sumber bahan hukum primer, sekunder dan tertier. Penelitian menemukan Pengaturan tanggungjawab maskapai penerbangan terhadap penumpang atas kecelakaan pesawat berdasarkan hukum penerbangan Indonesia diatur dalam Pasal 141 UU 1/2009, Pasal 2 dan Pasal 3 Permenhub 77 Tahun 2011, Pasal 22 Ayat (1) Konvensi Warsawa dan Pasal 17 Ayat (2) Konvensi Montreal dan Pelaksanaan tanggungjawab maskapai Sriwijaya Air terhadap penumpang atas kecelakaan pesawat SJ 182 merujuk pada 3 (tiga) hal, yaitu Rezim hukum yang berlaku; Peristiwa kecelakaan yang terjadi; Tiket perjalanan. Dapat dikatakan pengaturan terkait tanggungjawab pengangkut dari sisi norma sudah baik, tetapi dalam pelaksanaan masih terjadi inkonsistensi. Besaran ganti kerugian terhadap korban, keluarga korban dan ahli waris menjadi hal yang penting untuk memberikan jaminan perlindungan secara hukum, sehingga memberikan kepastian hukum bagi para pihak dan tidak bertentangan dengan rasa keadilan masyarakat.
