Abstract

The criminal act of corruption is a crime that has long been known to mankind. Various efforts in Indonesia have been carried out to increase the effectiveness of corruption eradication. Such support is demonstrated by the Supreme Court through the issuance of Supreme Court Regulation Number 1 of 2020 concerning Sentencing Guidelines for Article 2 and Article 3 of the Eradication of Corruption Crimes Law (Perma No. 1 of 2020). However, this regulation lacks concrete formulation of criminal sanctions and insight of corruption impacts on society. The aim of this research is to analyze approaches for judges in concretizing their considerations when imposing criminal sanctions to support the eradication of corruption. This research was prepared using normative legal research methods and supported by descriptive economic analysis. The result of this study shows the need for improvements to Perma No. 1 of 2020 by focusing the impacts of corruption on legal developments in society. These efforts, moreover, need to be supported by reviewing the range of criminal sanctions contained in the provisions of Article 2 and Article 3 of the Law concerning the Eradication of Corruption Crimes, as well as Article 603 and Article 604 of Law Number 1 of 2023 concerning the Criminal Code.

Abstract

Beauty industry sector in Indonesia can be used as a profitable investment location for both local and foreign investors. The Investment growth levels in a country can be influenced by the level of economic growth in the country concerned. The capital market is an activity that occurs in the economic market which is used for various financial instruments that have long term terms with a time span of more than 1 year. A share is a sign of participation in capital that has been invested by a person or business entity in the company concerned. Inflation itself can be said to be a a situation when the price of an item is experiencing increase that occurs continuously and also occurs globally. In general, the rupiah exchange rate is a value or can also be called the price level of a country's currency which can be measured and expressed in another country's currency. The interest rate is an interest rate that has been determined and then issued by Bank Indonesia (BI) for the issuance of securities or certificates that will also be issued by Bank Indonesia. The research being carried out also has a goal, namely to be able to analyze the independent variables, namely inflation, the rupiah exchange rate and interest rates which can influence the dependent variable, namely the share price of the company PT Mustika Ratu Tbk. The method that can be used is Ordinary Least Squares (OLS). Data processing results show that this inflation rate variable can influence, but not significantly, the level of share prices in PT Mustika Ratu Tbk. The rupiah exchange rate has a significant effect influence on the share price of PT Mustika Ratu Tbk. The interest rate variable has no influence on the share price of PT Mustika Ratu Tbk.

Abstract

Since the Chinese government prohibited the import of plastic waste, it has encouraged the Japanese government to increase the domestic processing of plastic waste. In 2018, among the highest rates worldwide, Japan successfully recycled up to 84 percent of all plastic collected. Although some efforts have been made by the Indonesian government to collect plastics, the overall performance of plastic recycling is unknown due to the failure to integrate informal sector recycling actors’ activities with the government and community activities in the formal sector. This limited information on the generation and management of plastic waste is a gap that needs to be addressed. This study was conducted using a qualitative descriptive method through an article review. The article review was conducted on several scientific articles on post-consumer plastic waste management policies in Japan and Indonesia. In general, plastic recycling activities in Japan are more formalized in terms of collecting and recycling through a special organization founded by the Japanese government, namely the Japan Containers and Packaging Recycling Association (JCPRA). The JCPRA helps the Japanese government to provide more detailed documented data on policy development and technical management of plastic waste. One that can be applied by Indonesia is to form an organization similar to JCPRA in Japan to become an operator in managing the plastic materials flow and plastic waste recycling in Indonesia so that Indonesia can provide valid information on plastic waste generation and management to develop plastic waste management strategies to control plastic waste pollution in the environment.

Abstract

VVIP security challenges are becoming increasingly complex and dynamic in the era of globalization and rapid technological change. This research aims to analyze how the Presidential Security Detail (Paspampres) can adapt to these changes through the application of the concept of a learning organization, specifically the five key disciplines proposed by Senge (1997). Through a qualitative approach, this study collected data through interviews and the study of related literature. The results show that by applying the principles of a learning organization, the Paspampres can improve its effectiveness in carrying out VVIP security duties. This research emphasizes the importance of adaptation and continuous learning in ensuring VVIP security amid constant security challenges. The implications of this research are for the improvement of VVIP security in Indonesia through a more adaptive and learning-oriented approach.

Abstract

As a commitment to realizing the Green Deal which aims to reduce greenhouse gas emissions, the European Union has issued new regulations, namely the European Union Deforestation Regulation (EUDR) which focuses on eradicating products related to deforestation and forest degradation. Several provisions are implemented ranging from due diligence requirements to state assessments based on a three-level system. Based on the international trade conflict that occurred previously between the European Union and Indonesia regarding palm oil commodities, the author uses a qualitative approach to analyze tendencies in the EUDR as a continuation of the European Union's new protectionism against Indonesian palm oil commodities through administrative barriers. Several potential impacts are also visible, ranging from disputes at the WTO to losses in the Indonesian economy and development.

Abstract

This research presents a comprehensive discussion of social conflict in the implementation of the gadeso tradition that occurs in the community in Pecalukan Subdistrict. The main points of discussion contained include conflict mapping, phasing and dynamics of conflict, as well as forms of conflict resolution efforts. This research uses a qualitative method with a case study approach. As a unit of analysis, this research uses the perspective of conflict theory by Ibnu Khaldun together with the concepts initiated by Geertz regarding santri and abangan. From the research that has been carried out, it can be seen that the root of the conflict comes from strong differences in values between social groups (ashabiyah) in Pecalukan Subdistrict. Namely, between the santri group and the abangan group who then contest each other and fight for power over the truth in the gadeso tradition, thus creating an attempt at domination and giving rise to conflict. This condition is further exacerbated by the stigma of "bigotry" imposed by the government and society local towards groups of students. This article also attempts to present a discussion regarding the efforts of the Pecalukan Subdistrict government together with local actors to minimize conflict tensions in the implementation of the gadeso tradition. Even though various efforts have been made, in fact the existence of conflict cannot be completely eliminated, even though its intensity has decreased considerably.

Abstract

Manufacturing business contract is agreements that are unique in the procurement of goods and services. Execution of these business contracts often encounters obstacles because there are errors in interpreting contract clauses that can lead to a settlement. After a dispute occurs, what efforts can be made by the parties in resolving disturbances that occur in the procurement of goods, and what is the settlement process if there is a discrepancy in the delivery of goods that are in accordance with the contract but are claimed not to meet the technical specifications stated in the business contract? The purpose of this research is to analyze the manufacturing business contract between Gagah Lambang Perkasa (GLP) and PT Corin Teknik Solusi (CTS). This study used a normative juridical method by reviewing and examining the contents of the agreement. The results show that CTS's failure to interpret the contents of the contract occurred because of the inaccuracy of the technical data on the ordered goods provided by GLP. The efforts made by GLP and CTS to resolve the disputes were by negotiation that prioritized good faith to reach a mutually beneficial agreement. The dispute resolution was achieved with CTS's willingness to accept GLP's claims. GLP provides compensation in the form of additional time, cost, and new orders for CTS so that the agreement can be implemented properly and business relations still run well. The conclusion obtained from this research is that the principle of resolving disputes in invoice business contracts is a mutual benefit (win-win solution) so that the business contract can be continued and not hamper the production process.
