The Journal of Muhammadiyah Law Review is published into two volumes a year (January and July). As the peer-review of Indonesian Journal, we accept scientific works on islamic studies which are writen both in English and Indonesia. Feel free to send the papers through registering this page. To expedite the development process and economic growth through investment, the Government has taken steps to increase of business in Indonesia. In consideration of the above-mentioned points, it is necessary to change the authorized capital of a Limited Liability Company into an amount left to the discretion of the founders of a Limited Liability Company by agreement, on condition that the founders of a Limited Liability Company have net assets within the criteria for micro, small, and medium business. The government policy to give founders of a Limited Liability Company discretion to set the amount of authorized capital aims to increase investment as regulate by Government Regulation Number 29 of 2016. According hierarchy of law, government regulation lower than act, so the substance og government regulation can not contradictive with the substance of the act. This study will be analyze about the different of those regulation with Normative method. The major issue are finding answer about question “how about binding strength of government regulation number 29 of 2016 compare the act number 40 of 2007” and “how about legality of Company who establish according government regulation number 29 of 2016. Finally, we have conclusion that substance about authorize capital of regulation number 29 or 2016 is not conflict with act number 40 of 2007. We can look that as a discretion who made government to support the programe of “eazy of doing business” in Indonesia. Looking from hierarky of those regulation, although regulation number 29 or 2016 up down than act number 40 of 2007, that can make special rules as not conflict.

Diterbitkannya Undang-Undang Nomor 5 Tahun 2014 tentang Aparatur Sipil Negara, serta Peraturan Pemerintah Nomor 18 Tahun 2016 tentang Perangkat Daerah, membawa pengaruh terhadap keberadaan Korpri/Sekretariat Dewan Pengurus Korpri baik secara nasional maupun di daerah. Keberadaan Korpri dibentuk untuk mewadahi seluruh Pegawai Republik Indonesia/PNS, sebagai perekat dan pemersatu Bangsa dan Negara Republik Indonesia. Permasalahan yang dikemukakan dalam penelitian ini adalah (1) bagaimanakah peran ASN sebagai Perekat KeBhinekaan di Provinsi Lampung dan (2) bagaimanakah Peran Badan Penyelenggara KORPRI Provinsi Lampung sebagai Perekat KeBhinekaan Aparaur Sipil Negara (ASN). Metode penelitian yang digunakan dalam penelitian ini adalah pendekatan masalah secara normatif dan empiris. Hasil penelitian menunjukkan bahwa, (1) peran ASN sebagai perekat kebhinekaan telah terlaksana dengan dibuktika dengan adanya KORPRI yang menjadi pilar utama pemersatu bangsa dan Negara Indonesia dan menjadi organisasi dengan budaya yang penuh inovasi dan kreatifitas yang modern dan efisien dan melayani dengan jiwa dan semangat Pancasila sesuai dengan amanat Peraturan Pemerintah Nomor 42 Tahun 2004 tentang Pembinaan Jiwa Korps dan Kode Etik PNS. (2) peran Badan Penyelenggara KORPRI Provinsi Lampung sebagai perekat kebhinekaan ASN telah dilaksanakan sesuai denan peraturan yang ada, dapat terlihat dari penyelenggaraan progran/kegiatan, selain mengacu pada Anggaran Dasar Korpri sesuai Kepetusan Presiden Republik Indonesia Nomor 24 Tahun 2010,sebagai perwuudannya berlandasakan pada Peraturan Gubernur Lampung Nomor 40 Tahun 2017 tentang Rincian, Fungsi dan Tata Kerja Badan Penyelenggara KORPRI dan Badan Layanan Pengadaan barang dan Jasa Pemerintah Provinsi Lampung mengatur kedudukan, tugas pokok dan fungsi Badan Penyelenggara KORPRI Provinsi Lampung.

Peraturan Mahkamah Agung RI Nomor 1 Tahun 2016, Hal tersebut diatur oleh mediator dan akan menyimpulkan dua kesimpulan yaitu mediasi berhasil atau mediasi tidak berhasil yang telah ditentukan oleh mediator dan kemudian kalau mediasi berhasil akan di berikan kesepakatan perdamaian yang telah ditanatangani oleh para pihak dan Kekuatan Hukum Mediasi Oleh Mediator di Luar Pengadilan adalah Kekuatan Hukum dari kesepakatan berdamai sebagaimana ditentukan oleh Pasal 1 angka 8 dan angka 9 PERMA Mediasi, maupun Pasal 1851 KUHPerdata.

Formation of the legislation is a requirement in the development of national law which can only be achieved if supported by a good method, which is binding on all institutions authorized to make Regulations. Indonesia is a country that has a legal obligation to carry out the development of a good national law, which is done in a planned, sustainable, and integrated into the national legal system. The concept of the establishment of laws and regulations in Indonesia includes several concepts, namely the concept of the establishment of legislation must be in accordance with State law concept of Pancasila. In addition, the concept of the establishment of legislation that either must prioritize the protection of Human Rights. The concept of the establishment of legislation that both must put forward the principle of equality before the law. The concept of the establishment of legislation that either should be in accordance with the principles of the formation of legislation predetermined by law. Henceforth, the concept of the establishment of law established by legal authority, elected by the people in a democracy.

Nowadays Indonesia has a tendency to apply the legal sistem administratively, which dominate in every activities include public administration must be on rules written. If there are conditions in making of legislations that runs low, or their conditions had not been anticipated in certain condition. Beside that, there is the dynamic development of social life runs rapidly that requires immediate treatment by government or local government. In this circumstance, it requires the autonomy of the government to act in dealing with issues that happened. The use of freies ermessen can be shown to emerge certain innovation from the bureaucracy reformation for public interest. The form of this freies ermessen can be shown in some forms such as circular letter, guidance, and announcement, abstract and general letter of decision as well as in a form f regulation which is called pseude-wet giving.

ASEAN Economic Community (AEC) promotes the development and economic welfare in ASEAN nation. Indonesia, on the other side, accept it as a big chance of investment. Through investment, the government hopes to achieve economic development. Policies, regulation, even deregulation has been made for a friendly investment. But, there is no guaranteed investment will also bring social welfare. Regulation not only as a tool for investment but also to protect socio-economic rights of people's. As the example, the regulation made for protecting the local worker, or employment opportunities. The regulation also provided for protection and empowerment for small and middle economies or the poverty alleviation. This condition will be the dilemma for the government to balance the investment and to fulfill socio-economic rights at the same time. Truly are UUDNRI 1945 already formulate to solve this dilemma. We can learn from article 33 UUDNRI 1945, about the idea to keep it economic development work together in harmony with the will to fulfill socio-economic rights. This paper focuses on seeing how regulation consistence in fulfills socio-economic rights in AEC Free Trade, with the normative method through legislation, social, and economic approach, The research result describe the regulations used for facing AEC dominate by investment design and forgot about socio-economic rights.

Suami istri dituntut sanggup menyesuaikan diri dengan pasangannya, mertua, saudara ipar, kerabat, dan pekerjaan atau karier. Bila mereka sukses dalam saling menyesuaikan diri akan menjadi keluarga yang semakin kokoh dan kuat. Namun bila mereka gagal untuk menyesuaikan diri hal itu akan menyebabkan problema semakin meruncing dan tidak terselesaikan atau terjadi perceraian. Indonesia merupakan salah satu negara dengan tingkat perceraian yang cukup tinggi. Hal ini terbukti dengan data-data yang tercatat di Pengadilan Agama dan Pengadilan Negeri. Hal ini juga dapat dibuktikan bila mengunjungi Pengadilan Agama selalu ramai dengan orang-orang yang menunggu sidang cerai. Angka perceraian berdasarkan data sementara yg ada di Pengadilan Agama Sukadana Kabupaten Lampung Timur angka perceraian yg telah diputus di pengadilan Agama sukadana Tergolong banyak. factor-faktor yang paling banyak menyebabkan perceraian itu terjadi di Pengadilan Agama Sukadana Lampung Timur adalah factor ekonomi. Factor ekonomi merupakan factor utama dalam ikatan perkawinan. Yaitu mengenai keluhan tentang biaya hidup yang kurang dalam meberi nafkah yang tidak berkecukupan pemicu retaknya hubungan suatu ikatan perkawinan dalam rumah tangga. Walaupum merupakan factor utama, factor yang tidak kalah penting yaitu factor agama sebab penanaman nilai-nilai agama harus di lakukan sejak dini terutama keimanan, sebab mau seperti apa nanti harus di landaskan dengan keimanan.

Pasal 4 ayat (1) UUD Negara RI Tahun 1945 dinyatakan bahwa wewenang eksekutif ada pada Presiden. Hal ini menunjukkan salah satu ciri penting dalam pemerintahan presidensial. Kemudian Pasal 17 UUD Negara RI Tahun 1945 mempertegas hal ini dengan menetapkan bahwa presidenlah yang memilih menterimenterinya. Dalam sistem presidensial ini, kedudukan eksekutif tidak tergantung kepada badan perwakilan rakyat. Adapun dasar hukum dari kekuasaan eksekutif dikembalikan kepada pemilihan rakyat. Sebagai kepala eksekutif, Presiden menunjuk pembantu-pembantu yang akan memimpin departemennya masingmasing dan mereka hanya bertanggung jawab kepada Presiden. Permasalahan yang akan dibahas dalam penelitian ini adalah Bagaiamanakah Kedudukan Kementerian Negara dalam Sistem Ketatanegaraan Indonesia Berdasarkan Undang-Undang Nomor 39 Tahun 2008 tentang Kementerian Negara. dan apakah Tugas dan Fungsi Kementerian Negara dalam Sistem Ketatanegaraan Indonesia Berdasarkan UndangUndang Nomor 39 Tahun 2008 tentang Kementerian Negara. Metode yang akan digunakan dalam penelitian ini adalah metode penelitian hukum normatif yang merupakan penelitian hukum kepustakaan, yaitu penelitian hukum yang dilakukan dengan cara meneliti bahan pustaka. Hasil penelitian ini menunjukan bahwa kedudukannya telah jelas dalam struktur ketatanegaraan kementerian berada dibawah dan bertanggung jawab kepada presiden secara langsung atas segala tugas dan kewajiban yang diemban oleh masing-masing menteri sesuai dengan bidangnya masing-masing. Sedangkan tugas, fungsi dan susunan organisasi Kementerian Negara diatur dengan Peraturan Presiden Nomor 68 Tahun 2019. Pada dasarnya Tugas para menteri adalah untuk menyelenggarakan urusan tertentu dalam pemerintahan untuk membantu Presiden dalam menyelenggarakan dan menjalankan pemerintahan Negara sesuai dengan amanat konstitusi, dalam melaksanakan tugasnya, fungsi Kementerian.

The perpetrators of these criminal acts of corruption tried to cover up their crimes by all means and even made scenarios so that their crimes were difficult to identify by investigators and the prosecutor's office as the body authorized to conduct investigations in cases of corruption. Because the perpetrators of these crimes are difficult to identify, it is very effective if law enforcers invite the defendants of the corruption crime to reveal who are the other defendants and the mastermind behind the corruption and become a Justice Collaborator. The problem in the study is how the procedure for the defendant who commits a criminal act of corruption to apply as a justice collaborator, how the defendant returns state losses due to corruption committed by the defendant and how the judge's consideration in granting the application for justice collaborator against the accused of corruption. The research method used in this study is a normative juridical approach, namely an approach through library research, comparative studies and document studies by reading, quoting, and examining the rules or regulations related to the problem to be discussed and the empirical approach, namely collecting data. based on the results of direct interviews with resource persons who will relate to the problems that exist in this research. The results of the study show how the defendant who commits a criminal act of corruption to apply as a justice collaborator. The defendant can apply as a justice collaborator if the defendant is not the main actor in the case. The judge's consideration in granting the defendant's justice collaborator application, the judge considered several aspects including the defendant being able to cooperate cooperatively and in good faith during the trial, not covering up and witness testimony in line with what was explained by the defendant.

Alternative dispute resolution can be one option the parties to resolve business disputes when the settlement of disputes through the courts used are considered less advantageous for businesses and consumers alike. Although there is still a shortage of the power of law and legal compliance agreements and the development of professional arbitration institution. This paper analyzes the institutionalization of ADR in Indonesia as ASEAN countries member and how readiness Indonesian National Board of Arbitration to facing AEC. A basic distinction is drawn regulation in Indonesia. The method used in this paper is a descriptive analyzis normative legal method. In this case the author uses literature study from a legal perspective and regulatory in Indonesia. This paper discusses the development of institutional ADR, which includes institutional ADR in indigenous people in Indonesia, the institutionalization of ADR outside the court and the institutionalization of ADR in courts as well as the readiness of BANI as an independent agency that provides alternative dispute resolution services.
