Abstract

Franchise agreements are modern business contracts that carry legal implications based on the principle of freedom of contract in the Civil Code, as well as administrative provisions such as registration with the Ministry of Trade, regulated under Minister of Trade Regulation No. 71 of 2019 on Franchise Implementation. Notaries play a critical role in formalizing these agreements through authentic deeds. However, issues arise when franchise agreements are made without a Franchise Registration Certificate (STPW). While notaries can still create deeds based on the parties' will, they are obligated to provide a legal explanation regarding the administrative status and associated risks. This research employs a normative legal methodology using both legislative and conceptual approaches, with qualitative analysis of legal documents and regulations. The study aims to highlight the significance of franchise agreement registration and the notary’s role in ensuring legal clarity. The findings suggest that notaries should be proactive in informing parties about the legal risks involved when a franchise agreement lacks an STPW, thereby enhancing legal protection for all parties. This research provides recommendations for both notaries and the government to strengthen the understanding of administrative obligations in franchise agreements and ensure better legal safeguards.

Abstract

Humanitarian law education for military personnel plays a crucial role in reducing violations of international law during armed conflicts. Humanitarian law aims to protect individuals who are not or are no longer involved in combat, such as civilians and prisoners of war, as well as to limit the means in war to reduce human suffering. This study aims to explore effective strategies for humanitarian law education for military personnel, focusing on training programs implemented in several countries and their impact on soldiers' behavior on the battlefield. Through case studies of training programs in countries that have successfully integrated humanitarian law principles into military education, this research identifies successful approaches as well as challenges faced in its implementation. The findings indicate that a deeper understanding of humanitarian law can enhance military personnel's adherence to international law and reduce violations in the field. This research provides recommendations for the development of more comprehensive and sustainable training programs, integrating ethics, morality, and practical application of humanitarian law in military daily life.

Abstract

This study discusses the regulation and legal protection of consumers in online lending practices (pinjol) in Indonesia, especially regarding the risk of default or failure to pay. The phenomenon of online loans is increasingly widespread, along with advances in digital technology and the increasing need for people to access funds quickly and easily. However, this convenience is often accompanied by the risk of high interest rates, unethical debt collection, and legal uncertainty, especially if the debtor is in default. The study aims to analyze the legal implications of online loan defaults in Indonesia, particularly focusing on the risks faced by borrowers when using unregistered online lending platforms. This study employs a normative legal approach, utilizing primary, secondary, and tertiary legal materials as data sources, which are analyzed qualitatively. The results of the study show that regulations regarding online loans have been regulated in various regulations, such as POJK No. 10/POJK.05/2022, SE OJK No. 19/2023, as well as the ITE Law, Consumer Protection Law, and Civil Code. However, even though regulations are available against illegal online lending practices. Therefore, it is necessary to strengthen rules, enforce stricter laws, and educate the public about the law to create a fair and safe online lending ecosystem for all parties.

Abstract

The shift of activism from the real world to the digital world has intensified year by year, driven by social phenomena at both national and global levels. The existence of misinformation, malinformation, and disinformation certainly distorts the general public's ability to participate in digital activism activities. This study aims to examine the factors that motivate the educated general public to engage in digital activism activities on Instagram, as well as their discretion regarding the presence of misinformation, malinformation, and disinformation. Through a semi-structured interview process, it was found that the factors motivating individuals to participate in digital activism include the desire to increase public awareness or vigilance, as well as to educate the public about social issues considered important. In responding to non-credible information, the criticality and willingness of individuals to conduct research on social issues they wish to address play a crucial role.

Abstract

The type of research uses the empirical legal research method quantitatively descriptive analytical, because it observes and examines reality in filling out the medical resume of inpatients at Prof. Dr.I.G.N.G.Ngoerah Denpasar Hospital. The approach used is factual, legislative, and conceptual approaches. This data comes from primary, secondary, and tertiary data along with primary, secondary, and tertiary legal materials. Data collection methods include observation, document studies, interviews and checklists. The results of this study show that: 1). Incompleteness in filling out inpatient electronic medical records at Prof. Dr. I. G. N. G. Ngoerah Denpasar Hospital has the potential to cause losses for patients and become the basis for a lawsuit. The lawsuit can be based on the non-conformity of electronic medical records with applicable legal standards and violations of patient rights, access to medical data by unauthorized parties, as well as non-compliance with regulations that can result in administrative and criminal sanctions for healthcare facilities, electronic medical resumes have legal implications because medical resumes are legal documents that can be used as evidence in medical dispute cases. Regulation of the Minister of Health Number 24 of 2022 regulates medical records, and incomplete filling can be considered a violation if there is negligence in filling it. The effectiveness of law enforcement in this case is influenced by the factors stated by Soerjono Soekanto, including clear regulations, competent law enforcement, adequate support facilities, public awareness, and a supportive work culture. 2). The factors causing the incompleteness of filling out inpatient electronic medical resumes are in the Gynecological Oncology Division (19%) and Surgical Oncology (18%). The factors causing the incompleteness of filling out an electronic medical resume are seen in terms of legal factors and non-legal factors.

Abstract

The quality of education in schools is influenced by various factors, including financial management, school climate, and teacher performance. These factors play a crucial role in improving school services and overall educational outcomes. This study was conducted to explore how these variables impact the quality of education in public junior high schools in the Sungai Durian subdistrict, Kotabaru Regency. The objective of this research was to determine the influence of financial management, school climate, and teacher performance on the quality of education in public junior high schools. A quantitative and explanatory research approach was used in this study. Data was collected through questionnaires distributed to respondents, including school administrators, teachers, and staff. The analysis employed multiple linear regression, with a T-test to examine the significance of the relationships between the variables. The study found that financial management, school climate, and teacher performance all have a positive relationship with school services and the quality of education. The T-test results showed that the values for financial management (4.343), school climate (3.426), and teacher performance (3.426) were higher than the T-table value, indicating significant positive influences. These findings suggest that improving financial management, enhancing the school climate, and increasing teacher performance are essential strategies for improving the quality of education in junior high schools. Educational authorities should focus on these areas to foster a more conducive learning environment and better educational outcomes.

Abstract

Waste management remains a major challenge in Indonesia, requiring innovative and sustainable solutions to achieve the national goal of Zero Waste by 2050. One strategic approach is the development of Reduce, Reuse, Recycle Waste Processing Sites (TPS 3R), which aim to reduce the volume of waste disposed of in final landfills (TPA). This study analyzes the operational performance of TPS 3R and explores their potential to enhance waste management efficiency. A mixed-methods approach was employed, combining quantitative analysis of TPS 3R operational data with qualitative insights gathered through interviews with TPS 3R managers, government officials, and community members. The findings reveal that TPS 3R operations face key challenges, including limited funding, underdeveloped regulatory frameworks, and low community participation in waste sorting activities. To address these issues, this study proposes strategic recommendations to strengthen TPS 3R effectiveness through policy enhancement, increased financial support, and optimized waste processing technologies. With proper implementation, TPS 3R holds significant potential to serve as a cornerstone in achieving Indonesia's Zero Waste 2050 vision.

Abstract

The purpose of this research is to provide accounting students with a thorough conceptual framework for internal whistleblowing, which will subsequently be empirically validated. In order to achieve this goal, the study looks at the moderating effect of moral intensity perception and the mediating role of professional commitment in relation to anticipatory socialization's impact on the inclination to report infractions. The study's target demographic consists of accounting majors who plan to graduate in 2024. A survey that is self-administered is given to 186 accounting students. To evaluate the suggested hypotheses, route analysis and moderation regression analysis are also used. The results of the hypothesis test show that the following relationships exist: moral intensity positively influences whistleblowing intention, moral intensity negatively moderates the relationship between professional commitment and whistleblowing intention, and moral intensity does not moderate the mediating effect of anticipatory socialization on whistleblowing intention. Positive relationships are found between anticipatory socialization and professional commitment, professional commitment and whistleblowing intention, and professional commitment and professional socialization. The aforementioned results highlight the significance of incorporating ethical education into undergraduate courses and educating students about the ethical principles, goals, and societal duties of the accounting profession.

Abstract

The growth of the bulk port industry increasingly demands more effective supply chain integration to enhance competitiveness and operational efficiency. This study examines the growth-driving factors in Growth Driving Supply Chain Integration (GDSCI) at Petrokimia Gresik Bulk Port using Confirmatory Factor Analysis (CFA). The research model evaluates three main dimensions of GDSCI: Collaborative Competitive Advantage (CCA), System Resilience (SR), and System Stakeholder Satisfaction (SSS). The CFA results indicate that all indicators have loading factors above 0.70, except for one indicator that still meets the convergent validity tolerance threshold. The Goodness-of-Fit (GOF) index demonstrates that the model has a good fit with empirical data, with values of GFI = 0.952, CFI = 0.954, and RMSEA = 0.092. These findings confirm that supply chain integration plays a crucial role in improving logistics efficiency, Collaborative competitiveness, and stakeholder satisfaction. The results support the Dynamic Capability Theory, which emphasizes the importance of dynamic capabilities in dealing with market uncertainty and changes in the business environment. Practically, this study provides insights for port managers and regulators to optimize supply chain integration strategies to enhance operational performance and long-term business growth. The study also recommends strengthening stakeholder collaboration and leveraging digital technology to improve the resilience of the logistics system.

Abstract

Character and spiritual transformation aims to describe how the standard of life and character of each person is before and after accepting and placing God in his or her life. Professionals will have a professional character, while those who live in the social world live a life with the culture they accept and aim to live a life without involving God. Furthermore, those who are willing to accept God and become new creations will live as believers who serve God alone. This paper aims to explore how character and spiritual transformation occurs when individuals move from living according to cultural or professional ethics to adopting Christian values. This paper uses a qualitative descriptive method. Research shows that character and spiritual transformation only occurs when there is a transformation from character standards in the form of codes of ethics or culture to biblical standards. Successful transformation can only be assured by the presence of surrender and the helpful role of the Holy Spirit. The success of the transformation will bring about a change in the standard of character to the Christian character or the standard of Christ, prioritizing serving the Lord God and improving the spirituality and life of the believer.
