Jurnal Al-Hakim is a Student Scientific Journal published by the Fakultas Syariah Universitas Islam Negeri Raden Mas Said Surakarta. Jurnal Al-Hakim is published twice a year (May and November). Jurnal Al-hakim aims to facilitate and disseminate innovative and creative ideas from students who concentrate in Sharia and Law. Abstract

Advancements in science and technology have reshaped societal perspectives, leading to significant social changes, including expanded career opportunities for women. As wives and mothers increasingly enter the workforce, their dual roles influence family resilience. This study examines the role of career women in supporting family resilience in Tulung District, Klaten Regency. Using a field research approach, data were collected through observation, interviews, and documentation, then analyzed using the Milles Huberman interactive analysis method. Findings reveal that women in Tulung District engage in diverse professions while balancing responsibilities in both domestic and public spheres. Their ability to maintain family resilience depends on effective communication and decision-making with their spouses. The study highlights that career women contribute to family resilience across multiple dimensions, including physical, economic, psychological, and socio-cultural aspects. The division of responsibilities between husband and wife reflects mutual cooperation, guided by principles such as mītsāqan ghalīẓan, zawāj, mu’āsharah bil ma’rūf, mushāwarah, and tarāḍin min humaā. These principles align with the fulfillment of the eight core family functions, reinforcing family stability and well-being.

Abstract

This study explores the supervision of the self-declared halal certification system under Government Regulation No. 39 of 2021 on the Administration of Halal Product Assurance, analyzed through the sadd al-dzarī'ah perspective. The research focuses on the mechanism for supervising self-declared certifications, identifying potential deviations, and proposing solutions through sadd al-dzarī'ah, which emphasizes preventing risks that could harm society. Using a qualitative normative legal method, this study incorporates a statutory approach and literature review, supported by secondary data from legal documents and interviews with relevant institutions and business actors. The findings highlight challenges in supervising self-declarations, such as limited human resources, inadequate infrastructure, and difficulties in ensuring compliance among businesses. While self-declaration aims to simplify the certification process for micro and small enterprises, insufficient monitoring jeopardizes public trust in product halal integrity. From the sadd al-dzarī'ah perspective, strengthening this regulation is necessary to mitigate violations by expanding the number of supervisors, leveraging monitoring technologies, and raising awareness about halal compliance. These efforts can enhance the effectiveness of the self-declaration system, improve consumer confidence, and bolster Indonesia's reputation in the global halal industry. The study calls for comprehensive policy revisions to ensure the program's accountability and sustainability.

Abstract

The sandwich generation phenomenon is a global issue, with society acknowledging the financial and emotional challenges these people encounter. In the history of European evolution emerged influences that focus on individual rights can sometimes overshadow collective welfare and social justice, resulting in persistent disparities in wealth, access to healthcare, and educational opportunities. Consequently, the liberal perspective, which primarily examines economic factors, advocates for social benefits and counselling support to prevent members of this generation from succumbing to despair. The Islamic concept of maqāṣid sharia offers a holistic approach to tackle these challenges by striving for equilibrium in religious, spiritual, intellectual, genealogical, and material domains. This study utilises library research method employing maqāṣid sharia as an analytical framework to explore the application of its five core principles in addressing the pressures encountered by the sandwich generation. The findings reveal that enhancing spiritual values (hifẓ ad-dīn), preserving mental and physical well-being through work-life balance (hifẓ an-nafs), fostering intellectual growth and resilience (hifẓ al-aql), cultivating an Islamic parenting approach rooted in communal support (hifẓ an-nasl), and promoting social responsibility to bolster familial welfare (hifẓ al-māl) can effectively mitigate the dual burden faced by this generation. These strategies aim to achieve overall well-being whilst safeguarding spiritual, psychological, and social aspects of life.

Abstract

This article explores the factors that influence individual behavior within philanthropic organizations. In the context of organizations, individual behavior greatly determines operational success and the achievement of social goals. This research uses a literature study approach to analyze various relevant literatures, identifying internal and external factors that influence individual behavior. Internal factors include motivation, personality, and personal values, while external factors encompass social, cultural, and educational environmental conditions. Emphasis is placed on the importance of motivation as the primary driver of behavior, as well as how individual characteristics can influence dynamics within an organization. This article also discusses the role of philanthropic institutions in creating an environment that supports positive interactions and individual development. Thus, this research aims to provide insights for leaders of philanthropic organizations in designing effective strategies to enhance individual engagement and productivity, as well as contribute to the development of literature in the field of individual behavior in the context of philanthropy.

Abstract

The pond industry plays a crucial role in shaping the social and economic landscape of local communities. However, the economic empowerment of pond workers has yet to demonstrate a substantial positive impact on broader community welfare. This study examines how economic empowerment initiatives targeting pond worker communities contribute to their well-being, using the Maqāṣid Sharia framework and evaluating the role of social philanthropy integrated by PT. Panen Berkat Sejahtera Bersama. Data were collected through unstructured interviews and direct observation at pond sites, focusing on the economic effects experienced by workers’ families. Findings indicate that the pond industry significantly enhances community economic welfare. It provides permanent employment with relatively stable income for workers, while seasonal harvests offer temporary work and bonuses that boost earnings for casual laborers. This improved income contributes to better living standards, including home renovations, children's education, and the fulfillment of daily necessities. From the perspective of Maqāṣid Sharia, the industry contributes positively to several key dimensions: ḥifẓ māl (protection of wealth), ḥifẓ ‘aql (protection of intellect), ḥifẓ dīn (protection of religion), and ḥifẓ nasl (protection of progeny). The study highlights the importance of supportive policies that strengthen the pond sector by expanding access to education, vocational training, and sustainable employment, thereby enhancing the overall welfare of pond workers.

Abstract

This study examines innovations in productive waqf management by nāẓīrs of Islamic community organizations to enhance economic welfare. Using a qualitative field research approach, data were collected through observation, interviews, and documentation of waqf practices in Muhammadiyah and Nahdlatul Ulama in Banyumas. Analysis was conducted through data reduction, presentation, and conclusion drawing to identify management patterns, challenges, and innovation opportunities. Findings highlight the need for digitalization, capacity building, and regulatory reform to optimize productive waqf. Key innovations include the use of digital records to enhance transparency and security in transactions, enabling permanent documentation of fund receipts, investments, and benefit distribution. Integration with the Waqf Information System (SIMSIWAK) facilitates real-time asset monitoring, while smart contracts ensure automatic and targeted fund distribution. However, challenges such as limited digital infrastructure and regulatory gaps persist. Strengthening collaboration between nāẓīrs, Islamic financial institutions, and government bodies is crucial to overcoming these barriers. Digital applications can significantly improve management efficiency, transparency, and community engagement, but building a sustainable waqf ecosystem will require continued investment in infrastructure and regulatory understanding.

Abstract

Overcrowding in detention centers remains a critical issue within Indonesia's criminal justice system, particularly due to its detrimental impact on the fulfillment of prisoners' basic rights. This study aims to examine how the rights of inmates are upheld at the Class IIB Boyolali Penitentiary under overcrowded conditions and to identify the key obstacles encountered in the process. Employing an empirical juridical method with a qualitative approach, the research was conducted through interviews, observations, and the analysis of relevant legal documents. The findings reveal that, despite the overcrowded environment, efforts are still made to uphold fundamental prisoner rights, including access to healthcare, adequate nutrition, religious practices, legal aid, and family communication. However, the fulfillment of these rights is hindered by limitations in infrastructure, budget, and human resources. The study concludes that enhancing the effectiveness of alternative sentencing policies and improving prison management systems are essential to ensuring the optimal protection of prisoners' rights.

Abstract

This study aims to evaluate the practice of gold futures trading at PT. Agung Cindo Berjangka and assess its compliance with the Fatwa of the National Sharia Council of the Indonesian Ulema Council (DSN-MUI) No. 77/DSN-MUI/V/2010 regarding non-cash gold transactions. The problem identified in this research is the misalignment between trading practices and Islamic legal provisions, which raises concerns about the validity of such transactions from a Sharia perspective. Utilizing a qualitative field research method and a case study approach, data were collected through interviews, observations, and documentation. The findings indicate that the trading practices involve contract-based transactions that do not entail physical gold delivery, thereby contradicting several key provisions in the DSN-MUI Fatwa No. 77. Specifically, the study highlights violations of the clause prohibiting price increases during the contract period and the presence of gharar (uncertainty), maysir (speculation), and riba (usury). These elements render the practice non-compliant with Sharia principles and Islamic economic ethics.

Abstract

The rigidity of the takhrīj mażhabi methodology in pesantren fatwa traditions necessitates a new epistemological approach that is more responsive to contemporary realities. This study aims to explore ijtihād irsyādi as a methodological alternative that maintains continuity with classical tradition while enabling contextual creativity grounded in maqāṣid al-sharī’ah. Employing a qualitative-descriptive-analytical-exploratory approach and a case study method focused on the fatwas of the Lajnah Bahtsul Masail (LBM) Lirboyo from 2019 to 2024, the analysis reveals significant epistemological transformation in istinbath structures. Key findings demonstrate that ijtihād irsyadī prioritizes maslahat (public interest), referential flexibility, and social interpretation as legal foundations, replacing the deductive-formalistic patterns of madhhab-based takhrīj. This approach reinterprets classical authority through maqāṣid frameworks without negating its legitimacy, as evidenced in the 2023 BPJS Healthcare fatwa that teleologically reconstructs social insurance concepts via taḥrīr al-mafhūm (conceptual liberation), tanqīḥ al-manāṭ (ratio legis purification), and ta'līl maqāṣidī (teleological justification). The novelty lies in articulating an adaptive, integrative fatwa epistemology that proactively engages temporal dynamics, offering a reformative paradigm for Indonesian pesantren fatwa methodologies and a substantive contribution to renewing contemporary Islamic legal thought.

Abstract

This study examines the concept of kafā’ah (compatibility) in marital partner selection within the Indonesian context, focusing on the interaction between Islamic legal norms and evolving social realities. Although classical Islamic jurisprudence emphasizes religious and moral compatibility as primary criteria, contemporary marriage practices in Indonesia increasingly incorporate social variables such as education, economic status, and family background. Using a qualitative descriptive approach through literature review and document analysis, this research analyzes classical fiqh texts, the Compilation of Islamic Law (KHI), and empirical studies on marriage practices across different cultural settings in Indonesia. The findings reveal that kafā’ah remains relevant as a principle for ensuring marital harmony; however, its interpretation has shifted from lineage and socio-economic status toward shared values, emotional maturity, and religious commitment. The study also indicates a gap between normative legal frameworks and practical social considerations, influenced by cultural dynamics and modernization. This research contributes to contemporary Islamic family law discourse by highlighting the need for a contextual reinterpretation of kafā’ah that prioritizes ethical and spiritual dimensions over hierarchical social classifications.
