Abstract

This study aims to analyze the results of the Peruvian and Chilean international disputes that have been submitted to the International Court of Justice (ICJ). The method used in this study is a descriptive method with a qualitative approach that is descriptive analysis. The method of approach used is qualitative. Qualitative methods are used to obtain in-depth data, data that contains meaning. The subjects in the dispute of this case are the States of Chile and Peru, where the object in question relates to the ownership of the maritime territorial boundaries of the two countries. The dispute that occurred between Chile and Peru regarding the border area resulted in a unilateral ownership claim of the territory and resulted in the signing of various agreements relating to the provisions in the form of norms in the international maritime direction The settlement of cases covering relations with countries is through the ICJ. It is stated that Peru and Chile will abide by any outcome of the provisions of the ICJ. This study deals with international relations as well as how to resolve border disputes according to applicable international law. This study is also a lesson for learners who are studying international relation

Abstract

International criminal law is not part of criminal law, but in fact international criminal law is one source of the development of criminal law. As a form of international criminal law, international agreements generally affect legal values, legal principles, and national criminal law norms. This study tries to explain the position of international criminal law in domestic criminal law and to determine the influence of international criminal law on domestic criminal law. The research methodology used in this study is a prescriptive legal research methodology. These results indicate that the relationship between international criminal law and domestic law is complementary.

Abstract

ABSTRACT; Purpose: In this study, it will be studied how big the influence and role of Saudi Arabia and Qatar in the conflicts that occur in the Middle East region. Methodology/approach: In this study, the author uses the library research method by analyzing some of the data that the author takes from books, journals, and other reliable sources. Results/findings: The results of this study are the discovery of threats to political economy stability and Saudi Arabia's national interest over the alliance made by Qatar with Iran. In the conflict that occurred, Qatar strengthened its country's relations with Iran, especially in the realm of production of natural resources, oil and gas, LNG. The LNG cooperation was so successful that it was considered a threat to the stability of Saudi Arabia's oil trade. Limitations: The limitation in this research is because the research method carried out by the researcher uses the library research method. The author realizes that there are several aspects that the author may not be able to analyze. This happens because of the limitations of the authors in obtaining the data sources needed to analyze the topics in this study, namely the influence and role of Saudi Arabia and Qatar in the conflicts in the Middle East. Contribution: Hopefully, this research will become a reference for knowledge about the role and influence of Saudi Arabia and Qatar in the conflicts that occur in the Middle East region. In addition, the authors hope that this research can be used as a reference material for further research to be able to examine aspects that have not been discussed in this study.

Abstract

Qatar and the United Arab Emirates are the two countries that have clashed in 2017 because Qatar and the United Arab Emirates are the two countries that have clashed in 2017 because of the blockade and expulsion issues carried out by the United Arab Emirates against Qatari citizens, this is what makes the United Arab Emirates violate racial discrimination. The beginning of this problem was because the United Arab Emirates thought that Qatar had violated the 2013 Riyadh Agreement. In international law, human rights have the status of Jus Cogens which is regulated in article 53 of the 1969 Vienna Convention. So that the United Arab Emirates was reported by Qatar to the ICJ for violating racial discrimination . The two countries resolved the dispute through mediation brokered by the ICJ. From these problems, ICJ issued the International Court of Justice Decision Number 172 of 2018. This research uses a qualitative and normative juridical approach, namely by conducting research on literature reading sources and analyzing them by law. The author gets the source by searching for secondary sources, namely scientific journals that have been written by other people as a reference source of this research. This study has limitations, namely analyzing the issue of racial discrimination which is a dispute between Qatar and the United Arab Emirates. This research has a great contribution to provide learning about international disputes and their resolution to the wider community which of course has the aim of providing knowledge and insight for readers. Abstract

The purpose of this research is to analyze the resolution of breach of contract disputes in franchise agreementsthrough a case study of Decision No. 612/Pdt.g/2017/Jkt. Considering that contract violations can occur in anylegal agreement, this study aims to examine various measures available to address such issues. The researchutilizes a qualitative approach with primary sources being written laws, namely the Indonesian Civil Code(KUHPerdata), Franchise Agreements, and Licensing Agreements dated April 25 and June 18, 2015, as thevalidity of these agreements is deemed equivalent to law for the involved parties. The focus of the breach ofcontract dispute began when the Defendant failed to pay royalties for the MySalon franchises in Jababeka andGalaxi Bekasi from June 2016 to September 2017, resulting in losses for the Plaintiff. Various steps can betaken to resolve breach of contract disputes, including issuing warnings, conducting negotiations, and resortingto litigation if no agreement is reached. However, due to the Plaintiff's continued evasion and failure to fulfilltheir obligations in good faith, the Plaintiff eventually filed a lawsuit with the South Jakarta District Court onSeptember 12, 2017. The panel of judges ruled that the Defendant had committed breach of contract and wasobligated to compensate the Plaintiff for the incurred material losses

Abstract

Inheritance problems often arise due to unfair distribution of assets, not in accordance with the provisions of applicable inheritance laws, both according to Civil Law, Customary Law, and Islamic Law. Inheritance involves the transfer of assets after a person's death to the rightful heirs. In some cases, such as in Supreme Court Decision Number 629K/Pdt/2023, disputes related to inherited land become complex problems, involving various legal aspects and disputed facts. This study analyzes the decision with a normative legal approach, using literature studies on primary, secondary, and tertiary legal materials. The Supreme Court in this decision rejected the cassation application on the grounds of ne bis in idem, emphasizing the importance of the principle of finality in inheritance law. Land disputes, such as those in this case, demonstrate the complexity of inheritance law in Indonesia, especially when involving third parties and decisions that have permanent legal force. The analysis of this decision also includes the obstacles faced in the legal process, including the principle of ne bis in idem, the legal force of previous decisions, and the complexity of proving heir status. This research is expected to contribute to the development of legal science, especially in resolving inheritance land disputes and a deeper understanding of judicial practices in Indonesia.

Abstract

Asuransi atau proteksi asuransi muncul dari kebutuhan dasar manusia untuk mengelola risiko yang mungkin terjadi, baik secara sadar maupun tidak sadar, dalam kehidupannya. Untuk mengatasi risiko tersebut, berbagai produk asuransi telah dikembangkan, khususnya produk asuransi jiwa unit link yang menggabungkan fitur proteksi dan investasi. PT Kresna Life merupakan salah satu perusahaan yang menawarkan produk asuransi unit link ini, yang dikenal dengan nama *Asuransi Jiwa Kresna Link Investor (K-LITA)*. Namun, seiring berjalannya waktu, PT Kresna Life mengalami kendala likuiditas yang menyebabkan perusahaan tersebut gagal memenuhi kewajibannya. Akibatnya, perusahaan tersebut dinyatakan pailit oleh Mahkamah Agung (MA) pada tahun 2018, sebagaimana tercantum dalam Putusan Mahkamah Agung Nomor 647 K/Pdt.Sus-Pailit/2021 yang dikeluarkan pada tanggal 8 Juni 2021. Artikel ini membahas mengenai gugatan pailit yang diajukan terhadap PT Kresna Life dalam putusan Mahkamah Agung tersebut, serta akibat hukum yang timbul, khususnya bagi pemegang polis. Penelitian ini menggunakan metodologi penelitian hukum normatif, yaitu dengan menelaah berbagai literatur hukum seperti peraturan perundang-undangan, jurnal, buku, putusan pengadilan, dokumen, dan karya akademis lain yang relevan. Hasil penelitian menunjukkan bahwa pasca pailit PT Kresna Life, perusahaan kehilangan kendali atas aset pemegang polisnya. Pengelolaan aset tersebut dialihkan kepada pengurus pailit, sehingga pemegang polis semakin sulit memperoleh manfaat asuransi. Proses likuidasi oleh pengurus pailit biasanya memakan waktu yang cukup lama. Setelah likuidasi, biaya-biaya tambahan seperti honorarium pengurus dan pajak dipotong dari hasil likuidasi, sehingga mengakibatkan berkurangnya jumlah yang diterima pemegang polis sebesar 4,444%. Kepailitan PT Kresna Life berdampak signifikan terhadap pemegang polis, dengan proses likuidasi yang panjang dan berkurangnya jumlah klaim asuransi yang dibayarkan. Sebagai bentuk pertanggungjawaban, debitur dapat menyampaikan Rencana Pemulihan Keuangan (RPK) kepada Otoritas Jasa Keuangan (OJK) dalam upaya memenuhi kewajibannya kepada pemegang polis.

Abstract

International organizations have issued various resolutions and diplomatic efforts to support Palestinian independence. However, implementation on the ground continues to face significant obstacles due to the political interests of major powers and the lack of effectiveness in enforcing agreed resolutions. This study aims to examine the role of international organizations in supporting Palestine's right to independence.This research employs a literature study and qualitative analysis with a descriptive-analytical approach to understand the role of international organizations in supporting Palestinian independence. The study is based on academic sources, official documents, and credible news reports, ensuring data validity through source triangulation.The findings indicate that international organizations play a significant role in supporting Palestinian independence through diplomacy, humanitarian aid, human rights advocacy, and international law enforcement. However, various challenges, such as the political interests of major powers, vetoes in the UN Security Council, and the lack of concrete actions against Israel, remain major obstacles to achieving Palestinian independence. Therefore, more effective strategies and stronger coordination among international organizations are necessary to ensure that Palestinian independence is not merely a discourse but a reality in global politics.

Abstract

International law has guaranteed the right to education through various legal instruments; however, its implementation in developing countries still faces serious obstacles due to economic, social, political, and cultural factors, leading to significant disparities in access to and quality of education. This study aims to examine the role of international law in ensuring the right to education in developing countries. A qualitative approach using literature review is employed to analyze the effectiveness of international law in guaranteeing the right to education in these countries. A descriptive-analytical analysis and a comparative study with Thailand are used to identify gaps and solutions for implementing education policies. The findings indicate that the role of international law includes affirming the right to education through various legal instruments, despite persistent challenges in developing countries, such as budget constraints and unequal access. International organizations play a crucial role in supporting global education policies, while Thailand serves as an example of a more progressive country in aligning its policies with international standards. To enhance the effectiveness of international law, stricter monitoring, sanctions for non-compliant states, and global cooperation in providing educational resources are necessary.

Abstract

The new emergence of Koperasi Merah Putih (KMP) reflects Indonesia’s renewed effort to realign its economic development with the foundational values of Pancasila. Despite the country’s rich history of cooperative movements, legal fragmentation and philosophical detachment have hindered their transformative potential. This paper aims to analyze KMP as both a legal and philosophical manifestation of Indonesia’s economic identity. Using a descriptive qualitative approach, the study examines existing legal frameworks, the integration of Pancasila values into cooperative practice, and the institutional dynamics surrounding KMP implementation. Key findings show that while KMP has a strong normative foundation rooted in Law No. 25/1992 and the 1945 Constitution, its practical application faces challenges in regulatory adaptation, institutional synergy, and philosophical consistency. The research highlights the importance of reconstructing legal instruments to support village-based economic democracy and advocates for embedding justice, solidarity, and identity within the cooperative structure. This study concludes that KMP can serve as a strategic model for reimagining Indonesia’s future economy—one that is community-centered, ethically grounded, and constitutionally aligned.
