Abstract

This research is motivated by the gap in technology, information and communication between villages and cities which causes slow governance in villages. This condition is a challenge for villages to actively participate in the current era of digitalization. The aim of village innovation is to encourage village development of higher quality, effectiveness and efficiency through various activities in village government administration that are more innovative and sensitive to the needs of village communities. This effort can encourage productivity and economic growth in rural communities in a sustainable manner to improve the socio-economic welfare of the community and village independence. However, in the development of village innovation, it has not proceeded according to the plans that have been set. This is because the community's digital awareness is still low, as well as the culture and organizational arrangements of the village government which are not yet fully ready to implement digitalization in the administration of village government. This research aims to analyze and explain innovative governance in the implementation of village government in Kuantan Singingi Regency, as well as identifying obstacles to implementing innovation in the form of the Gigades.id application and website. This research uses the Innovative Governance theory of Sangkala Tahun (2014) which explains that there are 6 criteria for best practices in an innovation, namely impact, partnership, sustainability, leadership and community empowerment, gender equality and social exclusion, innovation in the local context and transferability. This research uses an explanatory qualitative research method with a case study approach that uses data collection techniques through interviews, observation and documentation. The results of this research show that the implementation of village government in Kuantan Singingi Regency has made a breakthrough in the form of innovative governance in the implementation of village government in the form of innovation in the form of the Gigades.id application and website, but it has not been successfully implemented properly by the village government. Findings in the field show that the implementation of partnerships is still formed between the village government and the private sector, the trilogy of good governance in building partnerships has not been implemented well, even though the community has a big role in realizing the implementation of village government. Then the obstacles experienced by this innovation are the lack of socialization carried out by the village government and the private sector to village communities, the low quality of knowledge and innovation skills of village government officials, the inadequate quality of the internet network, and a community culture that is difficult to change.

Abstract

Politik kreatif menjadi salah satu pilihan terbaik bagi para pemimpin khususnya di Indonesia dalam memenangkan kepercayaan masyarakat. Politik kreatif menjadi salah satu sarana untuk menyampaikan pesan-pesan politik. Hal ini menunjukkan bahwa politik kreatif memiliki kekhasan dan keunikan tersendiri. Presiden Jokowi juga menggunakan politik kreatif selama masa pemerintahannya. Objek penelitian ini adalah politik kreatif Presiden Jokowi. Tujuannya untuk mengetahui kekhasan dari politik kreatif yang dilakukan oleh Presiden Jokowi. Metode yang digunakan adalah kepustakaan dan dibantu dengan data-data yang penting dari berita online. Teori dasar yang digunakan adalah konsep habitus, modal dan ranah perspektif Pierre Felix Bourdieu. Maka judul penelitian ini adalah “Politik Kreatif Presiden Jokowi (Analisis Berdasarkan Habitus, Modal dan Ranah Perspektif Pierre Bourdieu)”. Dari penelitian ini ditemukan bahwa Jokowi dapat berpolitik secara kreatif karena memiliki kemampuan menafsir atau membaca situasi secara baik. Dengan kemampuan tersebut, Jokowi bisa menyampaikan pesan-pesan politik secara kreatif.

Abstract

Natural disasters seem to be daily events and news in Indonesia, and even the world. Various forms of disasters have caused enormous losses, both moral and material losses. The earthquake that occurred on February 25 2022, centered in Talamau District, West Pasaman Regency, was a major disaster. As the epicenter of the earthquake, Talamau District was the worst affected area. It was recorded that 25 people were killed and 465 people were injured, 14 of whom were residents of East Pasaman. Apart from immaterial losses, the earthquake that occurred in West Pasaman Regency also resulted in material losses such as heavily damaged public facilities, schools and houses of worship (mosques). Due to this disaster, thousands of West Pasaman residents are waiting for development assistance from the government, however the expected assistance is still being delayed before it can be realized immediately by the Regional Government. This problem needs to be formulated into two problem statements. First, how is the implementation of regional government authority in post-earthquake rehabilitation efforts in Nagari Kajai, West Pasaman Regency? Second, what are the obstacles to implementing Regional Government Authority in post-earthquake rehabilitation efforts in Nagari Kajai, West Pasaman Regency? This research is a type of normative legal research or doctrinal legal research. The results of this research show that as a form of disaster management, the West Pasaman Regional Government carries out rehabilitation activities, one of these activities is providing assistance to repair houses for people affected by the disaster. This development is carried out through three systems, namely: independent reinbuce, facilitator reinbuce, and self-sufficiency. In an effort to exercise its authority to carry out post-disaster rehabilitation, the Regional Government encountered obstacles, including APIP's finding that there was an error in collecting data on houses of disaster victims which required data collection again, which took quite a long time and the regional financial capacity was inadequate.

Abstract

Parenting has an impact on children's attitudes and behavior in interaction. In providing these parenting activities, parents will provide attention, rules, discipline, rewards and punishments as well as responses to their children's wishes in order to avoid juvenile delinquency. The problem that occurs in Medan Amplas, Medan City is the existence of juvenile delinquency behavior. This is due to the loss of parental control over their children in parenting and educating their children. The purpose of this research is to find out how the impact of permissive parenting on adolescent behavior in Medan Amplas and how Islamic Law views permissive parenting. This type of research is empirical juridical with a living case studies approach and conceptual approach. Data is collected through interviews and document studies, then the data is processed and analyzed with qualitative methods. The results showed that permissive parenting characterized by a lack of parental supervision and guidance of children is not in accordance with parenting in the view of Islamic law because parents have the obligation to educate, guide, and prevent children from doing bad things.

Abstract

This research reviews constitutional review at the Constitutional Court (MK), especially in Case No.90/PUU-XXI/2023. The focus is on the applicant's legal standing and the Constitutional Court's considerations in making decisions. Legal standing is a legal right or position that allows a party to file a lawsuit before a court. In the context of material review, the applicant's legal position is the main determinant of the legitimacy of judicial review. Normative legal methods are used in this research to systematically and in-depth analyze the legal framework governing legal standing and the Constitutional Court's interpretation of it in the context of the cases studied. This research discusses the requirements and criteria for legal standing which are regulated in both the law and MK regulations, as well as the MK's interpretation of them in this case. The results show a debate surrounding the consistency, independence, and integrity of the Constitutional Court, especially regarding the controversial decisions received. Criticism emerged regarding the Constitutional Court's approach in assessing legal standing, where there were allegations of inconsistencies, loose assessments, and potentially dubious conflicts of interest. Thus, this research provides in-depth insight into the constitutional review process and the challenges faced by the Constitutional Court in maintaining its authority as an independent and credible constitutional justice institution.

Abstract

This study aims to analyze the legal protection provided to victims of accidents caused by potholes on the Palembang-Lampung toll road. The research method used is descriptive with a qualitative approach, involving analysis of legal documents, interviews, and field observations. The results show that the losses suffered by victims due to potholes on the road do not always receive adequate compensation in accordance with the losses suffered. Legal protection for victims is still limited and not optimal, especially in terms of fulfilling the rights of victims to compensation and rehabilitation. Improvements in the legal system and law enforcement are needed to ensure that victims of potholes receive legal protection in accordance with their rights. This is important to improve road safety and justice for accident victims

Abstract

Weak law enforcement in Indonesia has caused crimes such as corruption of social assistance funds among state officials to increase. Law enforcement is defined as the process of enforcing the norms that apply in Indonesia. Law enforcement is not a fundamental problem, not only because of the complexity of the legal system, the interaction between the legal system and the social, political and economic systems can also be a problem. Corruption has been classified as an extraordinary crime, because it is a criminal offense that has harmed state finances and economic potential. The imposition of criminal penalties or sanctions for perpetrators of criminal acts of corruption has recently been quite less frightening, including in the case of corruption of covid 19 social assistance funds. The writing of this thesis aims to find out the law enforcement against the criminal act of corruption of the covid 19 social assistance fund and the sanctions imposed on the perpetrators of corruption. Sources of legal materials consist of primary materials and secondary materials. The technique of collecting legal materials and data by quoting from data in loose-leaf notes by recording the author's name, book title, publisher's name, year of publication, and page number quoted. Law enforcement against corruption in criminal case decision Number 29/Pid.Sus-TPK/2021/PN Jkt Pst is in accordance with legal norms.

Abstract

Amid the development of cellphone penetration, the issue of black market cellphone distribution has become an important part of the telecommunications industry. By selling goods at below-market prices or relatively cheap, which occurs on the black market, most cell phones have unofficial IMEIs. This research aims to find out the legal implementation of smartphone sale and purchase agreements with unregistered or illegal IMEIs. The research method used in this research is the juridical-normative method. This research uses a statutory approach and a conceptual approach from secondary legal materials. The results of his research show that the validity of an illegal smartphone sale and purchase agreement based on the Civil Code is null and void. This is based on the failure to fulfill the legal requirements of the agreement based on Article 1320 of the Civil Code, namely that the object being agreed upon is an unlawful cause. If viewed from the legal aspect of consumer protection, responsibility for buying and selling is regulated in the provisions of Article 19 of Law Number 8 of 1999.

Abstract

The case of a simple claim for breach of contract in the Magelang court decision number 15/Pdt.G/2023/PN Mgg was caused by the claim that the peace deed he made was legally flawed and did not have binding legal force. In the process of granting credit, it is in accordance with the 5C credit granting procedure, especially regarding collateral or guarantees, but there is a legal defect in the collateral for mortgage rights whose ownership status is owned by deceased heirs. This research uses normative juridical research with descriptive analysis research methods. Analysis of the Magelang court decision Number 15/Pdt.G/2023/PN Mgg. The results of the research concluded that rescue and settlement of problematic credit was provided after it arose and was resolved in relation to the simple lawsuit decision in the Magelang Court case by filing a simple lawsuit because a simple lawsuit was filed in a case with a material claim value of a maximum of IDR 500 million, namely: breach of contract (default); and/or unlawful acts. In this case, the cooperative filed a lawsuit with the Magelang District Court to obtain a fair decision. Once it is declared rejected in its entirety, the debtor does not compensate for the loss of the lawsuit.

Abstract

Indegenous Law Peoples have always been marginalized with growing of time. A special law is needed to address problems among customary law communities. The establishment of Law Indigenous Peoples has actually started since 2014 under the name of the PP-MHA and change into the MHA in 2019. Currently MHA Bill is in the national legislation and waiting schedule for the discussion. This research aims analyze the legislative process of MHA Bill using model of policy formulation and concept of meaningful participation. This research uses qualitative methods with exploratory approach and case study strategy. The results are. First, problems among customary law communities are mostly caused by legal uncertainty. Sectoral laws who regulate indegenous law communities different from one another. Second, the stage of selecting alternative policies, there is conflict of interest between factions debating of development and investment will be disrupted because the birth of this Law. Third, the main reason MHA Bill has not been passed, is there are no political will from President and DPR RI to pass MHA Bill. Finally, public participation cannot be said to be meaningful participation. This is caused lack of public access related to conveying aspirations, considering aspirations, and explaining aspirations.
