Abstract

This study aims to determine the decision of the constitutional court ruling Number 2-3 / PUU-V / 2007 concerning capital punishment in Indonesia in relation to the implementation of human rights in the 1945 Constitution, to find out what factors are obstacles to the application of capital punishment in Indonesia and to know how is the basic consideration of the judge in imposing the death sentence on the intermediary for the sale and purchase of narcotics accompanied by money laundering in Decision Number 594 / Pid.Sus / 2015 / PN. Tjb. Data collection method used is library research (library researc), namely by reviewing from various relevant literature sources and browsing reading sources, namely books, opinions of scholars, articles on the internet and downloading decisions from the decision directory site. The results showed the constitutional panel of judges stated that the death penalty in the Narcotics Law does not contradict the right to life guaranteed by the 1945 Constitution because the guarantee of human rights in the 1945 Constitution does not adhere to the principle of absoluteness. According to the Court, the basic rights guaranteed by articles 28A to 28I of the 1945 Constitution have been locked by article 28J which functions as a limit. Constraints to the execution of a number of convicts, namely juridical constraints with the Constitutional Court's decision to cancel the maximum limit for filing a one-year pardon, then the Constitutional Court's ruling that allows the submission of legal review (PK) may be more than once, as well as the presence of negative respondents from the public death penalty. The defendant committed his crime in an organized manner, including providing means of transporting narcotics and money laundering, imposing capital punishment was appropriate. His criminal act has been punished twice (resivided), and the last criminal act has also been carried out three times and then caught and tried (concurs). The defendant from the prison also continued to coordinate the provision of transportation of narcotics from Malaysia to Indonesia. The defendant has been difficult to be rehabilitated, so the only criminal that can stop the defendant is Death Crime.

Abstract

This study aims at determining the significant effect of audio-visual assisted generative learning strategies on students' critical thinking skills in the Measurement Material for class X Semester I SMA Nurani Belawan T.P 2019/2020. The population in this study is all class X students of Nurani Belawan Private High School which consists of 4 classes totaling 120 students. The research sample was taken from 2 classes with cluster random sampling, so class X-2 was chosen as the experimental class which was taught using generative learning strategies assisted by audio-visual and class X-4 as the control class which was taught using the direct learning model. Each class consists of 30 students. The instrument in this study consists of 9 items in the form of essays that has been tested for validity, reliability, difficulty level, and distinction. The results show that the sample coming from a homogeneous population and normal distribution. The results show that the pre-test average value for the audio-visual assisted generative learning strategy is 35.28 and the direct learning class is 35.21. From the results of the two-party t test, it was obtained tcount = 0.248 ttable = 2.002 because tcount < ttable , it can be concluded that the initial abilities of the two classes are the same. A different treatment were given and post-test was given.After the posttest was carried out, the post-test average score for the generative audio-visual assisted learning strategy is 82.42 and the post-test average score for direct learning is 68.57. The results of the t-test for one party obtained tcount = 9.964 and ttable = 1.671 because tcount > ttable, this shows that there is a significant effect of Audio-Visuala Assisted Generative Learning Strategies on Students' Critical Thinking Ability on Measurement Materials in class X Nurani Belawan Private Senior High School Academic Year 2019 / 2020.

Abstract

The purpose of this study is to find out (1) whether there is an influence of teacher workload and teacher work motivation in a parse manner on teacher performance at SMK Negeri 1 Rantau Utara, (2) whether there is an influence of teacher workload and teacher work motivation simultaneously on student achievement in SMK Negeri 1 Rantau Utara. The technique of sampling in this study was total sampling with total 44 respondents. Data collection techniques using questionnaires, before the questionnaire was distributed first carried out trial analysis, namely test validity and reliability. Hypothesis testing is done by using multiple linear regression tests. Partially, the results of this study are tcount X12> ttable = 1.68 and the probability value (0.000) <0.05 means that partially the teacher's workload and teacher work motivation significantly influence teacher performance. Simultaneously, the results of this study are Fcount X12> Ftable = 21,050 and probability values (0,000) <0.05 means that simultaneously the teacher's workload and teacher's work motivation significantly influence teacher performance. Based on the test results of the R2 coefficient of determination, it is known that Adjusted R Square found that teacher workload and teacher work motivation simultaneously on teacher performance in SMK Negeri 1 Rantau Utara amounted to 48.30%.

bagi pelaku tindak pidana korupsi menurut UU Pemberantasan Tindak Pidana Korupsi adalah dalam Pasal 17 Jo. Pasal 18 ayat (1) UU PTPK bahwa selain dapat dijatuhi pidana pokok terdakwa dalam perkara korupsi dapat dijatuhi pidana tambahan yakni selain pidana tambahan sebagaimana dimaksud dalam Kitab Undang-undang Hukum Pidana, sebagai pidana tambahan adalah: Perampasan barang bergerak yang berwujud atau yang tidak berwujud atau barang tidak bergerak yang digunakan untuk atau yang diperoleh dari tindak pidana korupsi, termasuk perusahaan milik terpidana dimana tindak pidana korupsi dilakukan, begitu pula dari barang yang mengantikan barang-barang tersebut; Pembayaran uang pengganti yang jumlahnya sebanyak-banyaknya sama dengan harta benda yang diperoleh dari tindak pidana korupsi; Penutupan seluruh atau sebagian perusahaan untuk waktu paling lama 1(satu) tahun; Pencabutan seluruh atau sebagian hak-hak tertentu atau penghapusan seluruh atau sebagian keuntungan tertentu, yang telah atau dapat diberikan oleh Pemerintah kepada terpidana. Pelaksanaan pidana berupa pembayaran uang pengganti terhadap terpidana pelaku tindak pidana korupsi di Kejaksaan Tinggi Sumatera Utara adalah pembayaran pidana uang pengganti yang jumlahnya sebanyak-banyaknya sama dengan harta benda yang diperoleh dari tindak pidana korupsi. Mempertegas Pasal 18 ayat (1)b, dalam Pasal 18 ayat (2) dinyatakan pula bahwa: Jika terpidana tidak membayar uang pengganti sebagaimana dimaksud dalam ayat (1) huruf b paling lama dalam waktu 1 (satu) bulan sesudah putusan pengadilan yang telah memperoleh kekuatan hukum tetap, maka harta bendanya dapat disita oleh jaksa dan dilelang untuk menutupi uang pengganti tersebut. Hambatan-hambatan atau kendala-kendala yang dialami berkaitan dengan pidana tambahan berupa uang pengganti dalam tindak pidana korupsi adalah hasil audit yang dikeluarkan BPK (Badan Pemeriksaan Keuangan) dan hasil audit yang diluarkan oleh BPKP (Badan pemeriksaan Keuangan Propinsi) sering menimbulkan hasil audit keuangan negara yang berbeda-beda, antara kedua audit yang diluarkan oleh BPKP (Badan pemeriksaan Keuangan Propinsi) sering menimbulkan hasil audit keuangan negara yang berbeda-beda, antara kedua lembaga tersebut, sehingga dalam menjatuhan pidana tambahan berupa pembayaran uang pengganti kepada terdakwa pelaku tindak pidana korupsi menjadi sulit menentukan berapa besar pelaku harus mengambalikan uang pengganti tersebut. Dalam hal terpidana tidak membayar uang pengganti, paling lama dalam waktu 1 (satu) bulan sesudah putusan pengadilan yang telah memperoleh kekuatan hukum tetap, maka harta bendanya dapat disita oleh jaksa dan dilelang untuk menutupi uang pengganti tersebut. Dalam hal ini terdapat kesulitan untuk memilah-milah mana aset yang berasal tipikor dan mana yang bukan. Dalam zaman yang serba canggih ini, sangat mudah bagi para koruptor untuk melakukan metamorfosa aset-aset hasil korupsinya (asset tracing) melalui jasa transaksi keuangan dan perbankan. Melakukan hal ini jelas butuh keahlian khusus serta data dan informasi yang lengkap. Belum lagi kalau kita bicara soal waktu yang tentunya tidak sebentar, apalagi jika harta yang akan dihitung berada di luar negeri sehingga membutuhkan birokrasi diplomatik yang pasti sangat rumit dan memakan waktu. Kemudian sulit dilakukan apabila asset terdakwa yang akan dinilai ternyata telah dikonversi dalam bentuk aset yang berdasarkan sifatnya mempunyai nilai yang fluktuatif, seperti asset properti, perhiasan, saham dan sebagainya. Di kalangan penegak hukum sering terjadi kebuntuan komunikasi dan mispersepsi diantara penegak hukum yang ada, sehingga muncullah preseden-preseden fenomenal yang bisa berakibat buruk bagi iklim pemberantasan korupsi. Salah satunya adalah lahirnya Keputusan Mahkamah Konstitusi (MK) yang menghapus ketentuan mengenai perbuatan hukum materil dalam tindak pidana korupsi, padahal ketentuan perbuatan melawan hukum materil telah menjadi yurisprudensi dalam hukum Indonesia.

Abstract

Credit is one part of capital formation carried out by financial institutions in this case the banking sector to the society in an effort to encourage business performance so that it can be used to increase the productivity of real sector businesses carried out by the community individually or in groups. Credit demand can be influenced by several factors including inflation, exchange rates and interest rates. The theory used in this study is a theory relating to corporate finance, inflation, exchange rates, interest rates and credit demand. This research is a quantitative descriptive approach. Data collection techniques used are documentation techniques and secondary data collection from financial statements of Banking Sector companies that are listed on the Indonesia Stock Exchange for the period 2013-2016. The population in this study is 43 Banking Sector companies listed on the Indonesia Stock Exchange for the period 2013-2016, while the total number of samples used in this study is 23 companies with 4 research periods with a total of 92 observations. The analysis model in this study is multiple linear regressions using the SPSS program. Data testing was done by classical assumption test, test coefficient of determination, F test and t test. The conclusions from the results of this study are partially and simultaneously inflation, exchange rates and interest rates have no significant effect on the demand for credit in the Banking Sector Companies Listed on the Indonesia Stock Exchange Period 2013-2016. The value of the hypothesis determination coefficient is 0.006 which means 0.6% Variable variation. Request credit (Y) can be explained by variations in the variables of inflation, exchange rates and interest rates

Abstract

This study aims at analyzing the effect of academic supervision, the effect of work motivation and the effect of academic supervision and work motivation on increasing the pedagogical competence of teachers at SMP Parulian 2 P. Mandala Medan. The population used in this study are all 68 teachers and all of them are used as research samples. The data were collected using a questionnaire technique for the variables of academic supervision, work motivation and teacher pedagogical competence variables and documentation to obtain biographical data for the private SMP Swasta Parulian 2 P. Mandala Medan. Data were analyzed using product moment correlation and multiple correlation analysis. The results of the analysis show that there is an effect of academic supervision on teacher pedagogical competence with a coefficient of r = 0.611 or having moderate and positive strength. There is an effect of motivation on teacher pedagogic competence with a coefficient value of r = 0.694 or having moderate and positive strength. There is an effect of academic supervision and motivation on teacher pedagogical competence which is stated by the regression equation, namely Ŷ = 14.571 + 0.434 X1 + 0.737X2 with a contribution of 55.4%. The strength of the relationship is moderate and positive with a coefficient value of r = 0.744. Teachers can improve pedagogical competence through various activities, including teaching innovative learning techniques according to student character so that students understand the material presented more easily.

Abstract

Performance can be influenced by many factors, including management, leadership, work ability, work discipline, training and work motivation. But the most important factors are the factors of leadership, work discipline and work ability. This study aims at finding the influence of leadership, work discipline, work ability partially and simultaneously on employee performance at PT. Rajawali Nusantara Indonesia (Persero) Medan Branch. The population of this research is 170 employees. To determine the number of samples, the Slovin formula is used and obtained as many as 63 people. Data collection techniques are such as questionnaires, interviews and documentation studies. While the data analysis techniques used are the classical assumption test, multiple regression, t test, F test and coefficient of determination. The results show that the significant influence of leadership on performance at PT. Rajawali Nusantara Indonesia (Persero) Medan Branch. When the leadership is better, the employee's performance is also better. The effect of work ability on performance is significant at PT. Rajawali Nusantara Indonesia (Persero) Medan Branch. It is found that better work discipline, performance is also better. The effect of significant work ability on performance at PT. Rajawali Nusantara Indonesia (Persero) Medan Branch is the better the work ability, the better the employee's performance.The variables of leadership, work discipline, work ability simultaneously have a significant effect on employee performance. It is recommended that company leaders need to give freedom to employees to make decisions in their respective fields of work, and avoid personal closeness with employees for matters that are not work-related. Leaders should only communicate with employees for matters related to office work. Company leaders need to improve employee attendance discipline and provide sanctions on the basis of the right considerations. Punishment should be imposed in proportion to the employee's error rate. Leaders need to place employees in work fields that are suitable for their educational backgrounds, and employees need to improve work experience, especially in the work field handled. Work experience can be improved by providing training in accordance with the work field of each employee.

Abstract

This study aims to determine the effect of job leadership, motivation and incentives on job satisfaction of BPKPAD Binjai City employees. The design in this study uses quantitative descriptive. The sampling technique in this study uses the saturated sample method. So that the number of samples in this study were 40 respondents. The independent variable in this study consisted of work leadership (X1), motivation (X2), and incentives (X3), while the dependent variable was job satisfaction (Y). Data analysis uses multiple regression analysis. The results showed that work leadership partially had a significant effect on employee job satisfaction at the Binjai City BPKPAD with a t-test value of 2.894> from a t-table of 1.685 or with a significance value of 0.006 <0.05. Motivation partially has a significant effect on job satisfaction of BPKPAD the City of Binjai with a t-test value of 4.660> from a t-table of 1.685 or with a significance value of 0,000 <0.05. Incentives partially have a significant effect on job satisfaction with of BPKPAD Binjai City with a t-value of 2.678> from a t-table of 1.685 or a significance value of 0.011 <0.05. Work leadership, motivation and incentives simultaneously have a significant effect on incentives in of BPKPAD Binjai City with an F-calculated value of 25.458> F-table 2.87 or with a significance value of 0.000 <0.05.

Abstract

ABSTRACT Performance is the work quality and quantity achieved by a person in carrying out his duties in accordance with the responsibilities given to him. Some elements that are often used in assessing teacher performance are mastery of subject matter, ability to manage classes and the ability of teachers to increase student learning interest. This study aims at determining the effect of personality competency and work motivation partially and simultaneously on performance of teachers in SMA Negeri 8 Medan. The population in this study is all teachers who taught at SMA Negeri 8 Medan, with a total of 41 teachers. The entire population of 41 people was taken as a sample. Data collection techniques in this study are questionnaires, interviews and documentation studies. While the data analysis technique used is the classic assumption test, multiple regression, t test, F test and coefficient of determination. The results show partially the personality competency of teachers had a positive and significant effect on the teacher performance of SMA Negeri 8 Medan. The better the teacher's personal competence, the better the teacher's performance will be. Partially the work motivation of the teacher has a positive and significant effect on the teacher performance of SMA Negeri 8 Medan. The higher the teacher's work motivation, the better the teacher's performance will be. Simultaneously personality competency and work motivation of teachers have a significant effect on teacher performance in SMA Negeri 8 Medan The coefficient of determination shows that 90,20% variation in teacher performance can be explained by personality competency and teacher's work motivation simultaneously, while the remaining 9.80% is explained by other factors, such as education and work discipline

Abstract

The purpose of this study was to identify and compare the income and costs of IR64 and Ciherang rice farming in Deli Serdang District and The Rice Development strategy in Deli Serdang Regency.The methode of the research is the survey methode that is direct observation like interviews and questionnaires to the sample farmers. The sample of this study amounted to 60 people. Divided into 2 subdistricts. The amount uses the formulation of determining purposive sampling. The analysis used is I = TR-TC. To show whether there are significant differences between the IR64 varieties and Ciherang used the t test. By using the confidence level of 0.01 (99%) and 0.05 (95%). The results of the study show that rice farming in Deli Serdang District based on financial analysis still get the benefits for both Ciherang and IR 64 varieties with the results of the R / C 1.8 ratio. Based on the results of the t test, the income of IR 64 variety is higher than the Ciherang variety. Development strategies with improved technology and innovation by utilizing opportunities the strengths include expanding planting areas, increasing productivity effectively and also involving the government in providing site-specific that is targeted for development.
