Abstract

The article explains the sufism tafsir of Surah Al-Fatihah in the tafsir of Tâj Al- Muslimîn and al-Iklîl written by KH. Misbah Musthofa by using tahlili method. The findings shows that 7 verses of Al-fâtihah have Sufism nuances, especially in verse 5, dealing with worship to Allah which consists of 3 levels; low, middle, and high worship. The tafsir of Tâj Al- Muslimîn and al-Iklîl, written by KH. Misbah Musthofa, have some strengths and flaws. The tafsir of Surah Al-Fatihah in Tâj Al- Muslimîn and al-Iklîl are still relevant in this modern era. It is proven by the explanation of the importance model of multi-dimension and multi-function of the human services. Still, from the aspect of the language, it needs some adjustment and modification. So that, to understand Al-Qur’an, as proposed by Muhammed Arkoun by using mystical analysis, such as: reading “ar-rahman ar-rahim”, we do not say or do the action, but we also create the action; hope, forgiveness, confession, or request.

Abstract

The objective of this study was to describe the ideal guarantee system of halal and thayib product from the juridical and politics aspects in the context of Indonesia. The research methodology is normative law research and literature approach. The data consists of primary law data, secondary law data, and tertiary law data. Then, the data were edited, classified, and explained descriptively. The data were analyzed by using inductive methods and content analysis. This study tried to describe the problems of current product guarantee system (ius constitutum) and the upcoming product guarantee system (ius contituendum). The study found that the need of halal product is dharuriah,and obligatory. It have the important benefits to Moslems. The problems of regulation overlapping in Indonesia should be ended by unification of the law, that is, the establishment of the regulation of halal product guarantee where BNP2H becomes the institutional halal product office. Meanwhile, MUI still have a strategic role, since it develops the construction of halal product guarantee system together with BNP2H. MUI is the only institution which has the authority to certify halal or non-halal of a product. This policy becomes a bridge to develop a unification of law and the uniform of institution of the halal product offices, so that, there is no more dualism institutions which certify halal product. It guarantees the system of halal product for Moslems in Indonesia.

Abstract

Television is a technology product which becomes the need of human being. It becomes an important part of human life from morning up to the next morning. It is important, since it becomes an effective media to promote education, information, entertainment, and social connection. This is a descriptive qualitative research with communicative and management approach which aims at describing the effectiveness of da’wah in TVRI Kalimantan Timur. The findings of the study shows that there are two kinds of da’wah in TVRI, they are: 1) integrative da’wah which consists of the da’wah in the da’wah and non-da’wah program, 2) partial da’wah which is done by da’wah in the process of production and in the process of broadcasting. To measure the effectiveness of da’wah, it was done by doing a survei to the TVRI viewers. The result shows that da’wah in TVRI is not effective yet, since it has some flaws and weaknesses. Most of viewers state that the program should be improved by developing the quality of da’wah program in TVRI. TVRI has done and tried hard to create the program, yet it still needs to be improved and produce a qualified da’wah program.

Abstract

This paper explains the concept of ruh in the context of western and Islamic perspectif using psychology and temathic tafsir as its analysis tool. The term of ”ruh” refers to the description of human both physically and psychologically. It involves 3 dimensions; al-jismiah, al-nafsiyah and al-ruhaniah. al-jismiah deals with the dimension of al-jism (body) and its physical organs. al-nafsiyah consists of  al-aqal, al-nafs and al-qalb. al-ruhaniah consists of al-ruh and fitrah. Western psychology,-pyshoanalysis, behaviorsim, and humanism-, is misuse in interpreting al-ruh. The dimension of al-ruh is the place of the seed of religion. Western psychology views the structure of human psychology reducibility and reductivelly. Islamic psychology, which develops the concept of human structure based  on the understanding of Al-Qur;an, can accomodate that concept as long as it can be places proportionally in the system of the human spirit structure. The dimension of al-ruh can be collaborated and applied furthermore with the methods of former ulama by using more modern approaches, that is, the methods of riyadah, zikir, tazkiyah al-nufus and other methods.

Abstract

This research wants to know proprietary tasawuf thinking by Anregurtta H. Abdurrahman Ambo Dalle (called Ambo Dalle) in his book in Bugis's lingual version “al Qawl al shadiq li Ma ’ rifat al Khaliq / ada tongeng tongengnge ri annessana pappejeppue ri puang pancajie“. Thus, this research is bibliographical observational type (library research) one that gets character descriptive analysis. Anregurutta Abdurrahman Ambo Dalle is constitute ulama's figure that combine among knowledge syariat and tasawuf's knowledge. Harmony who did by Anregurutta among knowledge syariat with reality knowledge is an effort for unbent tarekat's concept or flow (tasawuf) one that amends, notably on Bugis's society who restrains from al Qur'an and hadits. That thing is looked while Anregurutta combine among bodily religious service and spritual religious service, one that religious service comes into the world is territorial temporary carnal job religious service, spritual is territorial heart job which is as recitation (remember) to God and that is core than religious service in Islamic. Such too its criticism to tasawuf's teaching with concept ittihad and hulul,  which is a concept that teaches one to declare for self a slave until to its The Infinite upon remembers (recitation) and at that moment as one with God, therefore expression “العابد والمعبود واحد “ while Anregurutta Ambo Dalle is “ العابد واحد والمعبود واحد ”

Abstract

The curriculum evaluation is a necessity. In Indonesia, the latest implemented curriculum for schools and madrasah is 2013 scientific based-approach curriculum which has not been implemented in all levels of school yet. As a guidance of the implementation of 2013 curriculum for madrasah, the religious affairs minister has established a Guidance Book for students and teachers. The Indonesian government will gradually provide the Guidance Book for students and teachers covering all subject taught in the school, Arabic in particular. Recently, Indonesian government has established Arabic textbook for class X of Madrasah Aliyah, for class VII of Madrasah Tsanawiyah, and for class I and IV of Madrasaha Ibtidaiyah. This textbook is important in emerging the ideology for students. That is why, the development of discourse through the use of pictures and sentences become important since they are integrative and meaningful for students in organizing the information and concepts of a book. This paper describes the significance of the textbook in socializing and internalizing the moral characters as well as gender equality.

Abstract

Nowadays, Indonesia still faces various problems related to the moral issues. Many cases occur in the society which should be solved by the educators, such as: corruption, collusion, and nepotism in all level of Indonesian governmental institutions, juvenile delinquency, and drugs.  To prevent those, the Indonesian government through education minister in 2010 established the 18 values of characters building. At school, this character building becomes the pivotal role in developing the characters of the students. This paper tries to describe how the teaching of Arabic done by implementing the values of the character building. The character building at SD Muhammadiyah Kleco is done by centralizing the role of teachers. The role of teachers in building the moral characters of the students is done by applying the principle role as teacher, such as: catalyst, row model, inspirer, motivator, dynamist, and evaluator. The teaching of Arabic skills,-listening (istima'), speaking (kalam), reading (qiro'ah), and writing (kitabah)-, is done by implementing the moral character such as: religiosity, honesty, tolerance, independency, democratic, curiosity, friendship, social awareness, responsibility, discipline, environmental care, and appreciation.

Abstract

The epistemology paradigm of Islamic thoughts is developed from one era to another. This paper tries to reveal the modern Islamic thoughts proposed by Jamaluddin Al-Afghani in reconstructing the understanding of qadha and qadar (takdir) from fatalistic and statis thoughts into dynamic thoughts. The meaning of fana and baqa in sufism, according to Al-Afghani’s thought, is real. The faith does not mean avoiding the needs of real life, but it should empower the social welfare and improve the social life. Al-Afghani states that the confession of the faith (qadha and qadar) is one of the basic elements in theology which cannot be avoided, yet it should be understood correctly and positively to reach the happiness in this world and the life after death.

Abstract

In this modern era, Khamar (liquor) is more identical and better known by the name of drugs (narcotics, psychotropic, and other dangerous drugs). Drugs are forbidden to consume for human. Narcotics and psychotropic are cited in Law Number 22 of 1997 where both are Khamars. In Law Number 5 of 1997, psychotropic is a drug or a substance, natural or synthetic, both are not narcotics which have psychoactive effect through central nervous system that causes typically changes in mental activity and behavior. This study is descriptive qualitative. Research on Law, descriptive is to show or describe individual accurately, condition, symptom or a particular group, and to determine the spread of a phenomenon. It is stated that someone is a drunk of Khamar and gets a Had punishment when she or he is tried and true or proved by his or her self-testimony or two witnesses. Law number 35 of 2009 about narcotics classifies a criminal of drug abuse into two types; the criminal as a drugs user is cited 116, 121 and 127 articles and the criminal is not as a drug user is cited in 112, 113, 114, and 129 articles. There are two types of drugs users, for himself and drug dealer (cited in 116 and 121 articles). The drugs users without any doctor’s supervision, they should be rehabilitated when they are addicted. But for the criminal as drugs not-user, is classified into four; owner (cited in 111 and 112 articles), producer (cited in 113 article), carrier (cited in 114 and 119 articles), drugs dealer (cited in 129 article). So that, base-foundation of Islamic Laws is based on “benefitted, resisted damage and danger.” The importance of Islamic Law to be built based on resisted damage and danger is to prevent and prohibit all kinds of substances that endanger.

Abstract

Meskipun para mahasiswa  menganut agama Islam dan sudah mempelajari serta memahami tentang ilmu faraid/fiqh mawaris, namun di sisi lain, mereka juga mempelajari Hukum Perdata yang tentunya cara pembagiannya berbeda dengan cara yang ada dalam hukum kewarisan Islam. Di samping itu, para mahasiswa tersebut juga berasal dari latar belakang suku yang berbeda, sehingga kemungkinan besar juga akan sangat berpengaruh terhadap cara pandang mereka dalam menganalisis dinamika hukum kewarisan yang ada di Indonesia.Berdasarkan latar belakang tersebut, maka rumusan masalah dalam penelitian ini adalah: Bagaimanakah pandangan mahasiswa Program Studi Hukum Keluarga (HK) Jurusan Ilmu Syariah Fakultas Syariah IAIN Samarinda terhadap dinamika hukum kewarisan yang ada di Indonesia ?Untuk menjawab masalah di atas, maka dilakukanlah penelitian lapangan (field research). Penelitian ini menggunakan pendekatan yuridis normatif sosiologis. Penelitian ini merupakan  penelitian kualitatif, oleh sebab itu maka teknik pengumpulan data yang dilakukan adalah teknik observasi dan wawancaraHasil penelitian menunjukkan bahwa ada tiga (3) pandangan mahasiswa terhadap dinamika hukum kewarisan yang ada di Indonesia; Pertama; sebagian  mahasiswa menganggap meskipun ada dinamika hukum kewarisan di Indonesia, tetapi mereka tetap berkeyakinan bahwa hukum kewarisan berdasarkan hukum Islam adalah yang lebih adil. Kedua; Sebagian mahasiswa menganggap bahwa setiap warga negara Indonesia dapat memilih di antara ketiga cara tersebut dalam menyelesaikan permasalahan kewarisan dalam keluarga mereka sesuai dengan kesepakatan di antara ahli waris dan dianggap adil menurut mereka. Tetapi yang paling baik itu adalah bagi warga negara yang beragama Islam, hendaklah membagi harta warisan berdasarkan hukum Islam. Kalau mereka ingin membagi harta warisan berdasarkan hukum adat maupun KUH Perdata/BW, hendaklah setiap ahli waris harus terlebih dahulu mengetahui bagiannya masing-masing berdasarkan hukum Islam, agar tidak ada yang merasa dirugikan. Ketiga, sebagian mahasiswa menganggap bahwa adanya dinamika hukum kewarisan di Indonesia ini adalah sebuah keniscayaan. Intinya adalah musyawarah mufakat. Kalau mereka sudah mencapai sebuah kesepakatan, maka pembagian warisan dapat dilakukan.
