Abstract

In QS. al-Nisa '/ 4: 11 contains a sign that God Almighty instructs the person who controls the inheritance to hasten the settlement and distribution of inheritance fairly and well to other heirs based on the divisions that have been determined by Allah and His apostles and have been developed accordingly detailed in KHI as a result of ijtihad mujtahid scholars in accordance with the space, time, situation and conditions in which they berijtihad. Immediate distribution is carried out of course the heirs can receive the part that is due to him, and if postponed means delaying the right of other heirs to have what he should have in accordance with his part. Delaying the distribution of inheritance as a trigger for future disasters in the family and also causes feelings of tyranny among heirs that have an impact on family relationships can crack

Abstract

The use of Jurisprudence in the stage of ijtihad is needed to answer the problem of public awareness, along with the development of science and technology. This study aims to analyze the urgency and nature of the principles of fiqh in islamic law and find out the signs and limits of the scope of one’s ability to ijtihad against new legal issues and explore the application of fiqh principles of lā masāga li al-ijtihād fi maurid al-nas in social reality. This study is descriptive qualitative with a sociological normative juridical approach. The results of the study show that the urgency and existence of fiqh principles in sresponding to the problem of community diversity is very significant. That ulama, fuqaha an law practitioners, must do ijtihad in an effort to find a new law. The effort must be based on the understanding that ijtihad on certain problems can only be done if there s no found nas} qat}’i for a problem or whether there is a passage but it is zanni. Orders to carry out obligations and stay away from restrictions in the activities of Muslims as an inseparable part of the applicaton of these rules

Abstract

Implementation of human resource management for educators is a very important role. professional human resource educators will produce quality and learning and education. However, one of the problems that often occurs in the implementation of management for educators is if they do not use systems and good management governance. This usually happens due to the lack of serious attention from related parties such as foundations and head of school or other stake holders who have responsibilities and important roles in developing the quality of educational institutions. The problems that occur in MA Al-Hilaal Tehoru are that there is no broad acceptance information, no selection system is applied either for administration or academic test selection, but the placement of teachers is based on academic educational background, but there are other things that are very important to explore related to structural from the Al-Hilaal Tehoru foundation because in general there is no administrative and organizational involvement with the schools they support. The focus of this research is the implementation of acceptance, selection and placement for teaching staff in MA Al-Hilaal Tehoru, Tehoru sub-district, Central Maluku Tengah. This type of research is descriptive research, qualitative approach, data sources are primary data, and secondary data. Data collection techniques are through interview guidelines, Observation sheets and documentation. Based on the findings of the results of this study are; a) Implementation of admission management is done for educators but the admission information is not through the method of publicity so that applicants meet directly with the principal in the office room. b) the selection process is carried out by the school, but the concept of the procedure is not carried out in an integrated manner because prospective educators applying for graduation are considered to have academic qualifications and are considered to have educational background so that they are considered capable. c) the placement has been carried out based on a meeting with the principal, so that all educators are placed according to their knowledge and expertise and the school involves educators from other schools if the position of the subject has no educator to support it.

Abstract

Ahmad Tijani accepted the results seen by the Prophet Muhammad. He got his first education from the age of age and from several other scholars up to 20-21 years. He was interested in Sufism so he made a spiritual journey to Fez Morocco in 1171/1757 to study three tariqats; the Qadiriyah, Nashiriyah and Ahmad bin al-Habib Muhammad tarekat. Then to other cities such as Algeria, Cairo, Mecca and Medina and met with several sheikhs including Sheikh Mahmud al-Karoli and Sheikh Abd. Karim al-Sama (Samaniyah). These sheikhs contributed significantly to al-Tinjani's interactions in the tarekat movement. After Ahmad Tijani's meeting with Sheikh Ahmad bin Abdullah al-Hindi, a Shaykh from India in Mecca at the age of 37, he then went to Medina and met Sheikh Muhammad al-Samman, the founder of the Sammaniyah order. Azyumardi in his research said that with his meeting with Shaykh Samman the topic prompted Ahmad Tijani to prepare his own tarekat separate from other tarekat he attended at the age of 50.

Abstract

This research is an attempt to examine the meaning of character education in the religious traditions of the Muslim community in West Papua. The techniques used in the data collection process are interviews, observation and documentation. The results obtained indicate that the inherited tradition is obtained from the value of character education. Rather than the value of education, so is the religious value and the value of appreciation in the tradition of safar bathing, the sahur drum, discussing the night of prayer, the implementation of aqiqah and qurban, the descendant's maulid and the factual maulid, tombormark and khatib pickup tradition. Learning local character education based on local wisdom becomes an alternative consideration that involves and implements the values ​​of wisdom in the minds, paradigms, and beliefs of students by supporting the heart and reason in forming character.

Abstract

This article describes the Conception of Joint Assets and Their Mastery According to the Marriage Law and the Civil Code. From the results of the discussion obtained an understanding that joint property in Law Number 1 of 1974 concerning Marriage, is limited only to assets obtained during marriage, while assets that are brought before each marriage are called luggage. However, joint property in the Civil Code is not limited to goods (assets) obtained during marriage, but also includes all assets and liabilities (debts), which are held before the marriage takes place, then legally the unity of assets is formed at the time of marriage take place, as long as there is no marriage agreement about that. The management of joint assets in Law number 1 of 1974 needs to be distinguished first whether it is shared property or luggage. If it is shared property, then all legal actions both by the wife and by the husband must be with the agreement of the wife or husband. This can be understood because Law No. 1 of 1974 contains a principle of equality between husband and wife. But it is different for each inheritance to act individually before. While the mastery of shared assets in the Civil Code is entirely in the hands of the husband, the husband can do legal actions without the consent of the wife.

Abstract

Tulisan ini membahas seputar kiat-kiat peningkatan kesadaran pengamalan agama, yang mencakup hal-hal berikut: (1) Unsur-unsur ceramah dan nasehat agama, rukun-rukun dan perbedaan di antara keduanya. (2) Sifat-sifat seorang penceramah atau pemberi nasehat agama. (3) Islam adalah agama yang pokonya mengajarkan akhlak mulia. (4) Pengaruh ceramah dan nasehat agama dalam mengokohkan akhlak mulia. Abstract

One of the causes of the radical ideology adhered to by a group of religious organizations is that it comes from an understanding of the text that comes from the Koran or the hadith which is less comprehensive, partial, and fundamental, resulting in the misuse of arguments to justify the group, it is easy to blame people who are outside his line of thought, and making the text as legitimacy that radical acts carried out with violence are legal because they are commands of Allah listed in the holy book, but in essence God does not order actions that can harm other people. In general, the actions taken by radicals are aimed at purifying religious teachings, because they consider that there are many deviations that leave Islam, and to rectify them by fighting and destroying all these deviant actions. In this article, we will explain how the Qur'an talks about radical acts carried out with violence by looking at several verses in certain surahs and then contextualizing them with reality so that it will open knowledge about the real radicals.Keywords: Radicalism, Religion, Al-Quran

Abstract

As stated in the title of this paper, the problem is how the existence and contribution of ulama's fatwas, both individually and in groups, in solving problems that exist among Muslims. The existence of ulama's fatwa is very strategic and cannot be denied that it has made a real contribution to the life of the nation and state in Indonesia. As far as this research is carried out, the fatwa of ulama, especially those born from the Indonesian Ulama Council (MUI), is an Islamic legal decision taken by the ulama which of course aims to solve actual problems for Muslims. Abstract

Marriage creates a legal relationship with the child who is born, then the position of the child who is born will arise, which is all regulated by law. From the relationship with parents and children who are still underage, rights and obligations arise. The rights and obligations of parents towards underage children are regulated in the Civil Code and the Basic Marriage Law No.1 of 1974 with the title of parental power. Legal provisions regarding parental powers can be found in articles 298 to 329 BW. This study aims to determine the authority of parents according to the civil law code using descriptive qualitative methods with literature review analysis from various reference sources. The results showed that the parental power was divided into 3 parts, namely the power of the parents over the child. Parental power over children's property. Regarding mutual obligations between parents and blood families with children.
