Abstract

Perkembangan teknologi dalam era modernisasi memberikan pengaruh yang signifikan terhadap seluruh aspek tanpa terkecuali, termasuk aspek ekonomi. Modernisasi ekonomi digital membuat segala kebutuhan pelaku ekonomi sebagai penggunanya menjadi lebih efisien dan modern. Kelebihan yang ditawarkan dengan adanya modernisasi ekonomi digital mampu memberikan daya tarik yang tinggi bagi pelaku ekonomi dalam mengembangkan bisnisnya, termasuk pelaku UMKM. Usaha Mikro, Kecil, dan Menengah (UMKM) merupakan pelaku bisnis yang bergerak pada berbagai bidang usaha, yang menyentuh kepentingan masyarakat. UMKM memiliki peran penting terhadap pertumbuhan ekonomi nasional. Atas peran penting tersebut tentunya UMKM dituntut untuk menguasai modernisasi ekonomi digital yang tengah terjadi. Dibalik kelebihan yang diberikan oleh adanya modernisasi ekonomi digital yang kompleks, tentu saja membutuhkan perlindungan hukum yang maksimal. Dalam hal ini terwujudnya prinsip kepastian hukum menjadi esensi utama bagi pelaku UMKM untuk mendapatkan haknya sebagai subjek hukum yang diatur dalam perundang-undangan. Pelaku UMKM dapat dengan aman menjalankan bisnisnya jika regulasi yang berlaku menjanjikan kepastian hukum, sehingga kemajuan ekonomi melalui UMKM dapat tercapai.

Abstract

Single capital investment is an activity aimed at increasing economic growth and optimizing existing resources in Indonesia. However, in the implementation of foreign investment, there may be setbacks between foreign investors and the government. Article 32 paragraph (1) UUPM states that in the event of a transfer of capital between the investing government and the government, the parties must first complete the settlement through deliberation and consensus. Furthermore, Article 32 paragraph (2) UUPM states, in the event that the settlement as intended in paragraph (1) is not achieved, the dispute can be resolved through arbitration or alternative settlement or court in accordance with statutory provisions. However, in practice, arbitration settlements are detrimental to the Indonesian government, so that economic diplomacy can be an effort that needs to be prioritized for the sake of national interests. The research was carried out using normative juridical methods and aims to determine the urgency and positive impact of implementing economic diplomacy as an effort to resolve foreign investment. Abstract

Pertumbuhan ekonomi dan kemajuan teknologi semakin berkembang pesat di era modern pada saat ini. Dilihat dari semakin berkembangnya ekonomi berbasis digital yang memudahkan di berbagai aspek perekonomian. Namun dibalik kemudahan tersebut ada tantangan terkait perlindungan data pribadi yang keamanannya masih belum maksimal. Besarnya kasus kebocoran data yang menimbulkan kerugian baik materiil maupun immateriil bagi pemilik data pribadi. oleh karena itu, diperlukan prinsip kerahasiaan dalam perlindungan data pribadi konsumen di setiap kegiatan transaksi elektronik. Dengan diberlakukannya UU. No 27 Tahun 2022 tentang Pelindungan Data Pribadi, aspek hukum dijadikan sebagai landasan payung hukum dalam menjaga dan melindungi subjek data pribadi. metode penelitian yang digunakan dalam penulisan karya tulis ini menggunakan tipe penelitian yuridis normatif. Untuk pendekatannya menggunakan pendekatan konseptual dan peraturan-undangan. Bahan hukum yang digunakan dalam karya tulis ini menggunakan bahan hukum primer, sekunder dan non hukum. Prinsip kerahasiaan dalam hukum pelindungan data pribadi menegaskan akan pentingnya menjaga keamanan data dari pihak yang tidak mempunyai hak ataupun dari berbagai kegiatan pemrosesan data pribadi yang tidak sah.

Abstract

The development of technology affects the work system in all fields, including in the field of Business. Technological developments in the business sector are characterized by the emergence of new companies that utilize the internet, these new companies are in the form of Start Up. Business using the internet is more profitable for businesses and consumers so that it makes people flock to open businesses. With the increasing number of business actors, business competition is getting tighter and the potential for business competition violations is also increasing. This is a challenge for the Business Competition Supervisory Commission as an institution that oversees business competition. therefore, this research will discuss the role of the KPPU in enforcing business competition law. this research aims to increase understanding for business actors regarding the legal certainty of business competition in the digital economy era. The research was conducted using normative juridical research methods that are qualitative in nature. In this research, the discussion chapter is a description of the research results. From this research, a new regulation was found regarding violations of fair business competition in business through the internet/digital. As well as known about the actual functions, powers and duties of KPPU.

Abstract

The emergence of electronic money or e-money for short as a payment instrument is part of the development of information and technology. Using e-money makes transactions easier and faster for people because without carrying cash, there is no need to receive change in the form of goods. In 2017, the government aggressively promoted e-money transactions by issuing Bank Indonesia Regulation Number 18/17/PBI/2016 concerning Electronic Money. This regulation aims to increase the use of e-money and support financial inclusion. The aim of writing this scientific journal is to determine the position and existence of money as a legal means of payment with the issuance of e-money which even functions as the only means of payment. Writing this scientific journal is a normative legal research , which is carried out to find scientific truth through a statutory and conceptual approach. The legal materials used are primary, secondary and other legal materials. The results of the discussion are that money is a legal means of payment in accordance with what is stated in Article 1 number 2 of the Currency Law. E-money is a legal means of payment. Abstract

This study focuses on a comparative analysis of the separation (spin-off) policies of Islamic business units in Indonesia and Malaysia, two countries with significant developments in the Islamic banking and finance sector in Southeast Asia. This research employs a normative juridical method with a legislative and conceptual approach to examine various legal and operational aspects of the Islamic business unit separation policy. The findings reveal significant differences in the implementation and impact of the spin-off policy in both countries. In Indonesia, the separation is triggered by the achievement of a certain asset proportion by the Islamic Business Unit (UUS) relative to its parent Conventional Bank (BUK), while in Malaysia, the focus is more on strengthening the operational independence of Islamic banks. This research provides a deep understanding of how this policy affects the structure and performance of the Islamic banking sector in both countries, as well as its implications for the development of the Islamic economy in the region.

Abstract

Most oil reserves are located in developing countries, which often lack the regulations necessary to comply with international standards. Developing countries have developed the necessary laws and regulations due to new technologies like framing, which are reflected in drilling and development contracts. Study and analysis of the environmental conditions in oil contracts have been conducted in the present article, including the new generation of oil contracts for the Islamic Republic of Iran. This study aims to review the solutions provided in international agreements, analyze the current status of the laws and regulations of the Islamic Republic of Iran, and provide the necessary solutions according to the current situation of oil operations in Iran. In addition to its ethical value, the conclusions of this paper can be useful to policymakers and lawyers involved in oil and gas contracts. In the first part of paper, the environmental effects of oil and gas activities are mentioned; In the second part, the method of forecasting environmental considerations in international oil contracts are examined, and then in the third part, the environmental criteria of Iranian oil contracts are examined. Finally, according to the problems in the adopted methods, a solution is presented.

Abstract

Basically, providing credit with or without collateral, a credit agreement is a principal agreement that contains about the parties, the object of the agreement between the creditor and the debtor, whose rights and obligations of the parties are even to strengthen the fulfillment of achievements, strengthened by a guarantee agreement that is useful if at the time of the debtor's default, the guarantee can be auctioned and the auction results can be used as the fulfillment of achievements. However, in the case of decision No. 21/Pdt.G.S/2019/PN Tte., even though it has met the requirements of the simple lawsuit requirements in relation to not making a guarantee agreement, there are obstacles in the execution of the object that is placed as collateral in the principal agreement. The purpose of this study is to review and find legal certainty of credit agreements without being accompanied by land guarantee agreements. Second, to examine and find the judge's ratio of the application for collateral confiscation that is not the property of the debtor. Third, to find the concept of related execution in decision No. 21/Pdt.G.S/2019/PN Tte. Ratio decidendi on the application for confiscation of collateral that does not belong to the debtor. The Judge considered that the application for bail confiscation was rejected based on the fact that the plaintiff had no intention that the defendant would move or transfer the object of the dispute and because the examination of this case was carried out based on a simple lawsuit that was limited by the time of the examination, the judge considered it quite reasonable if the petition number 4 of the lawsuit should be rejected. Regulation of the ratio decidendi of execution that supports Article 20 of the Law on the Rights of Dependents. The payment of a certain amount of money can be made by auction, the location of the real execution with the payment of a sum of money.

Abstract

The banking and construction industry has a strategic role in supporting economic stability and growth in Indonesia. Bank guarantee as one of the important instruments in the banking sector, provides guarantees to the recipient of customer obligations. In the construction industry, bank guarantees are used to mitigate risks in infrastructure development projects. However, the regulations governing the bank guarantee mechanism are still general and not detailed, giving rise to many interpretations and deviations. This affects dispute resolution, project implementation, and trust between the parties involved. On the other hand, challenges in the construction industry, such as project delays, contract disputes, and regulatory complexity, are also obstacles in supporting national development. Therefore, it is necessary to prepare more detailed regulations and standardize operational procedures related to bank guarantees, as well as strengthen supervision and professionalism in the construction industry, to create legal certainty, efficiency, and sustainability of national infrastructure development. The method used in this study is normative. Relevant legislative and conceptual approaches.

Abstract

As an essential part of Islamic economic instruments, Zakat has a strategic role in supporting Sharia-based fiscal policies in Indonesia. Integrating Zakat into fiscal policy can strengthen budgetary sustainability and improve social justice through wealth redistribution, economic empowerment, and poverty alleviation. This study explores the potential of Zakat in supporting the reformulation of a more inclusive and equitable fiscal policy. The method used in this study is thematic with a library research approach, reviewing literature on Zakat, budgetary policy, and Islamic economics. The study results show that Zakat contributes to the equitable distribution of wealth and empowers the economy through transparent and accountable management. Zakat also plays a role in strengthening collaboration with financial authorities to improve the efficiency of its collection and distribution. The principles of Islamic economics, such as social justice, multi-type ownership, and equitable distribution, provide a strong foundation for efficient and inclusive resource management. This study recommends optimizing Zakat through digital technology and strengthening synergy between institutions for more effective zakat management.
