Abstract

Sharia crowdfunding platforms have evolved as a new paradigm in financing in the digital age, especially for startups and small and medium-sized enterprises (SMEs). The platform offers a more ethical solution by adhering to sharia principles such as mudharabah (profit-sharing) and musharakah (partnership), allowing equitable sharing of risk and profit between investors and business managers. The use of modern technologies such as blockchain, smart contracts, and digital payments has strengthened efficiency, transparency, and security in these platforms. However, some of the main challenges in its implementation include low Islamic financial literacy, immature regulation, as well as limited technological infrastructure. This study aims to explore the potential of sharia crowdfunding as an inclusive financing solution for startups and SMEs, as well as identify the challenges and opportunities that exist in its operationalization. The results are expected to provide recommendations for the development of supportive regulation, increased financial literacy, and the development of adequate infrastructure to maximize the role of sharia crowdfunding in supporting inclusive and sustainable economic growth in the digital age.

Abstract

The pattern of punishment through fines is not widely discussed, especially for law enforcement in the natural resources regime. Fines are always formulated together with other criminal threats, namely imprisonment because of its nature as a form of basic punishment. However, when the fine punishment is faced with acts that cause natural resources losses, the fine punishment has not been seen as a frightening threat or even more deterrent. Therefore, it is important to have a legal concept in a criminal perspective as a replacement for ecological damage. The purpose of this research is to find out the extent of criminal fines and its development, along with an in-depth analysis of criminal fines imposed on corporations to recover ecological losses in the future. This research method uses dogmatic legal research, which is based on literature review, policy, and current knowledge. The results of the discussion of this research include, fines are still not too favoured to deter criminals whose actions are charged with the consequences of damage to natural resources. Criminal fines also need to be reformulated through the basis and perspective of ecological losses, so that the content of the use of ecological losses can be the basis for higher and more optimal criminal fines.

Abstract

A contract that contains an agreement that contains the rights and obligations that must be carried out by the parties in a business is called a business agreement. Failure to fulfill one of the obligations of the parties to the agreement does not automatically terminate the agreement, but this termination must go through a court process as determined by Article 1266 and Article 1267 of the Civil Code. However, in practice, in agreements, there are many clauses that override the two articles because according to business people, these articles are difficult to apply in a business agreement. This has received special attention from legal experts, practitioners, and judges. In this case, there is a dissenting opinion regarding the waiver of articles 1266 and 1267 of the Civil Code, the first of which they argue that the waiver is acceptable because of the principle of freedom of contract and believes that the provisions in book III of the Civil Code are trapping provisions. Meanwhile, some other opinions do not accept the waiver because they believe that the provisions in book III of the Civil Code are mandatory provisions. Based on the principle of pacta sund servanda, the binding force in an agreement that contains a clause of nullity conditions that override articles 1266 and 1267 of the Civil Code is in solidarity and mutual trust to override the article which applies as a law by the parties who determine it earlier.

Abstract

The advancement of digital technology has transformed student consumption patterns, particularly through e-commerce platforms like Shopee and Tokopedia. This article analyzes student consumption behavior using Max Weber's social action theory and an Islamic economic perspective. Employing a qualitative, descriptive-analytical method, data were gathered through in-depth interviews with students who actively use e-commerce. The study reveals that student consumption is influenced not only by instrumental rationality but also by social, cultural, and religious values. From an Islamic economic viewpoint, some behaviors—such as excessive consumption, use of paylater services, and neglect of halal product considerations—do not align with ethical consumption principles. The findings highlight the need for increased Islamic economic literacy that extends beyond fiqh muamalah to encompass social ethics and awareness in digital transactions. Abstract

This article analyzes the implementation of the Job Creation Law as a tool to achieve public welfare through Karl Marx’s conflict theory, focusing on historical materialism and class struggle. Intended to boost investment, employment, and ease of doing business, the law has sparked controversy and widespread protests. Although enacted, it was declared unconstitutional by the Constitutional Court in November 2021. Using a descriptive qualitative method and library research, this study draws on articles, books, and online sources, analyzed through Marxist theory. Findings suggest that while the law aimed to support economic recovery post-pandemic, several of its regulations still require collective attention to truly realize its goal of public welfare.

Abstract

Dengan populasi Muslim terbesar di dunia, Indonesia telah berupaya untuk memasukkan hukum Islam ke dalam sistem hukum nasionalnya sejak memperoleh kemerdekaan, khususnya di bidang pengadilan agama dan hukum keluarga. Tujuan dari penelitian ini adalah untuk mengkaji bagaimana hukum Indonesia memasukkan hukum Islam dan untuk mengidentifikasi kesulitan dalam mengintegrasikannya dengan struktur hukum negara. Evaluasi literatur kualitatif menggunakan berbagai sumber, termasuk buku, jurnal, dan materi terkait, adalah metodologi yang digunakan dalam penelitian ini. Menurut hasil penelitian, hukum nasional Indonesia sangat memasukkan hukum Islam. Prinsip-prinsipnya terwakili dalam pengadilan agama, zakat (sedekah), dan peraturan perkawinan. Namun ada juga hambatan sosial, politik, dan budaya terhadap hukum Islam. Meningkatkan kesadaran publik, menyesuaikan diri dengan situasi kontemporer, dan mereformasi hukum Islam melalui cara yang inklusif adalah beberapa cara untuk menyelesaikan masalah ini.

Abstract

The Supreme Audit Agency of the Republic of Indonesia in implementing the constitutional mandate of the 1945 Constitution Article 23E paragraph (1) is specifically regulated through the Supreme Audit Agency Regulation Number 4 of 2018 concerning the Code of Ethics of the Supreme Audit Agency, the main problems in writing this journal are how the juridical review of the code of ethics of the Supreme Audit Agency of the Republic of Indonesia regarding Independence, how the form of sanctions given to members of the Supreme Audit Agency for violating the Code of Ethics regarding Independence. This research method is normative legal research, this research uses a statutory approach and a concept approach. From the findings in this journal, it is found that independence is needed in producing the Audit Report in accordance with the principles, principles and values of the Supreme Audit Agency.

Abstract

The legal framework governing bankruptcy and mortgage rights has been stated in Law Number 37 of 2004 concerning Bankruptcy and Suspension of Debt Payment Obligations (hereinafter referred to as: KPKPU Law) and Law Number 4 of 1996 concerning Mortgage Rights on Land and Objects Related to Land (hereinafter referred to as UUHT). Normatively, the two regulations are designed to complement each other. However, in its implementation, there is disharmony between Article 56 paragraph (1) of the KPKPU and Article 6 and Article 21 of the UUHT. Therefore, this study focuses on the analysis of legal protection for creditors holding mortgage rights in the condition of debtor bankruptcy and reviews the aspect of legal certainty in the process of executing collateral assets. This study adopts three main approaches, namely the legislative approach, the conceptual approach, and the case approach
