Abstract

Pancasila and Citizenship Education (PPKn) is a learning process that aims to instill the values ​​of Pancasila as the foundation of the state and the outlook on life of the Indonesian nation to all citizens, especially the younger generation. PPKn has a very crucial role in shaping students' character. This subject not only teaches knowledge about the state and government, but also instills the noble values ​​of Pancasila which are expected to be a guideline for students' lives who are currently experiencing many character shifts in student life. This study aims to: (1) analyze the implementation of PPKn learning in shaping students' character, and (2) determine the challenges faced by PPKn teachers in shaping the character of students at SMPN 26 Takengon. This study is a descriptive qualitative study. The data source sample was taken using the Purposive sampling technique. The research variables include the implementation of PPKn learning and student character. Data collection techniques used interviews, documentation, and observation. The results of the study showed that First, the implementation of PPKn learning carried out by teachers in the classroom has included character values, the formation of character values ​​is good but there is no periodic evaluation; Second, the factors that hinder character formation are students' lack of understanding of character, lack of PPKn lesson hours, lack of PPKn teachers; Third, ways to minimize obstacles are to provide students with an understanding and examples of character values, make periodic evaluations, increase lesson hours and increase the number of PPKn teachers.

Abstract

This study aims to analyze the application of the Separation of Powers concept in the Indonesian political system and compare it with the concept of Fiqh Siyasah in Islam. The Separation of Powers theory was first introduced by the French philosopher Montesquieu in the 18th century, dividing state authority into three main branches: legislative, executive, and judicial. This research examines how this concept is applied in the Indonesian political system and compares it with the distribution of power in Fiqh Siyasah, which also divides state power into three branches: executive, legislative, and judicial. The study further explores the relationship between these two concepts by examining the practices of governmental powers in Indonesia and their connection to the principles of Fiqh Siyasah. The findings indicate that there is a convergence in some aspects of the application of Separation of Powers in Indonesia with Fiqh Siyasah in Islam, but challenges in implementation require further development to achieve an effective balance between state institutions.

Abstract

This study examines the legal consequences of annulment of marriage according to Law Number 1 of 1974. The main focus is on Law (UU) No. 1 of 1974 concerning the legal consequences of annulment of marriage. Using qualitative methods, this study analyzes the legal consequences of annulment of marriage contained in Law No. 1 of 1974. Then Law No. 1 of 1974 is used as a legal basis that explains marriage and annulment of marriage. This study concludes that annulment of marriage has very large legal consequences for the husband and wife, one of the causes of which is the invalidity of the marriage due to the failure to fulfill the requirements set by the court.

Abstract

Transfer pricing is the practice of fixing transaction prices between companies that have special relationships within a business group. In the context of the global economy, this practice is often abused by multinational corporations as a mode of tax avoidance, namely by shifting profits to countries with lower tax rates (tax havens). Transfer pricing abuse not only harms state revenues, but also creates unfair business competition. Law enforcement against corporate crime in this case faces various challenges, especially in proving malicious intent (mens rea) and identifying the criminal responsibility of corporate entities. This research aims to identify the modus operandi often used in transfer pricing abuse and analyze the law enforcement strategies that have been implemented in Indonesia. The research methods used are normative and empirical juridical with a qualitative approach. The results show that the common modus operandi includes manipulation of sale/purchase price, use of shell companies, and fictitious contracts. An effective law enforcement strategy requires inter-agency collaboration and firmer regulations regarding corporate criminal liability. Therefore, strengthening the tax audit system and increasing the capacity of law enforcement officers are needed to prevent and crack down on transfer pricing abuse.

Abstract

This study aims to describe the forms of congregation participation in the Cultural Month celebration at GMIT Bukit Kalvari Nunuteta and its implications for the preservation of local culture. In the context of globalization that threatens the existence of traditional cultures, the church is viewed as a key agent in sustaining the cultural identity of its members. Using a descriptive qualitative approach, data were collected through in-depth interviews, participatory observations, and documentation. The findings reveal that congregational participation spans all stages of activity—from planning, implementation, benefit utilization, to evaluation. This involvement is not merely symbolic but active and spiritual, reflecting the integration of faith and culture in church life. The Cultural Month serves not only as a means of inculturation but also strengthens the collective awareness of the congregation regarding the importance of transmitting local cultural values across generations. The study recommends reinforcing culturally based church ministry strategies to support the sustainable preservation of local heritage.

Abstract

Capital markets become one of the important instruments for improving the economic wheel because it can help public companies or the government get financing or financing, but on the other hand opens opportunities for the community to be able to invest and increase its capital (capital gain) and profit or reward results (return). .One of the types of transactions that happens in the stock market is a REPO transaction (Repurchase Agreement) which are contract transactions or purchase effects with purchase or resale at the specified time and price. But the problem of this transaction still raises problems from some market players who violate the regulations in the field of capital markets that ultimately harm investors or customers as happened in the case PT Sinergi Millenium Sekuritas (PT SMS) in running REPO transactions carried out between Michael widja against 14 (fourteen) parties did not include an equity attachment and agency attachment in the agreement. Next, PT SMS did not have directors and/or employees authorized to conduct REPO transaction, where the director PT SMS should have authority in this is in accordance with existing regulations regarding REPO transactions. Things can also impact the decline in public confidence to invest his money in the capital market.

Abstract

Advancements in technology have had a significant impact on commercial activities, particularly in the realm of online commerce, which facilitates the promotion, marketing, sale, and purchase of products or services through digital platforms. While these developments offer numerous benefits, they also raise concerns regarding potential violations of consumer rights. Law Number 8 of 1999 aims to ensure legal certainty in e-commerce transactions. The rapid growth of e-commerce in Indonesia provides convenience for consumers, but it also presents new challenges in terms of legal protection. This article examines the legal framework for consumer protection in e-commerce transactions in Indonesia, highlighting gaps in regulation and assessing the effectiveness of existing laws. A normative juridical approach is used to analyze various relevant legal instruments, including the Consumer Protection Law, the Law on Electronic Information and Transactions, and their implementing regulations. The findings indicate that, despite the existence of appropriate regulations, there are still shortcomings in law enforcement, consumer education, and dispute resolution mechanisms. This article recommends enhancing inter-agency cooperation, strengthening digital literacy among consumers, and improving dispute resolution systems to ensure comprehensive consumer protection in the e-commerce era.

Abstract

Electronic money laundering has become a critical issue as a form of cybercrime. Advances in technology demonstrate that digital forensic applications, particularly those utilizing smartphones, can be employed to uncover digital traces of money laundering transactions. This study aims to analyze the relevance of existing legal frameworks, the effectiveness of smartphone forensic techniques, and the challenges faced in their implementation in Indonesia. Based on a review of the literature and regulatory analysis, it was found that legal frameworks such as UU No. 8 of 2010 on the Prevention and Eradication of Money Laundering (TPPU) and UU No. 19 of 2016 on Information and Electronic Transactions (ITE) provide an adequate legal foundation. However, gaps in implementation, such as limited human and technological resources, remain significant obstacles. Forensic techniques, including metadata analysis and device extraction, have shown great potential in identifying the flow of illicit funds. Nonetheless, their application is hindered by data confidentiality and the lack of uniform technical standards. Given the increasing complexity of digital crimes, an integrated approach is required, combining regulatory strengthening with technological capacity building, to enhance the effectiveness of smartphone forensics in addressing electronic money laundering.

Abstract

Traditional games play a crucial role in children's motor, cognitive, and social development. However, changes in times and rapid technological advancements have led to a greater preference for digital games, replacing traditional games rich in cultural and philosophical values. This phenomenon occurs not only in urban areas but also in rural communities, resulting in reduced social interactions and a weakening connection between children and their cultural heritage. To preserve the existence of traditional games, contemporary art is chosen as a medium to document and reinterpret the local wisdom embedded in these games. Through high-relief printmaking using the reduction technique, this work aims to capture public attention and evoke nostalgia, inspiring younger generations to reconnect with and appreciate traditional games. The artwork is printed on fabric and displayed by hanging, offering a more dynamic visual experience compared to conventional framed artworks. With this approach, contemporary printmaking is expected to serve as an educational and reflective medium for society in rediscovering fading cultural values.

Abstract

This study aims to describe the effectiveness of the implementation of the principal's workload based on Permendikbud Ristek No. 40 of 2021 at SD Negeri 1 Lebung Batang, Pangkalan Lampam District. Data collection tools used interview methods, documentation, observation and literature review. Data analysis used descriptive qualitative analysis with the stages of data collection, data reduction, data presentation and drawing conclusions. The results of the study stated that the implementation of the principal's workload in carrying out managerial, entrepreneurial and supervisory tasks in PTK based on Permendikbud Ristek No. 40 of 2021 at SD Negeri 1 Lebung Batang which consists of managerial tasks, has been going well. There are several internal obstacles experienced by the principal in carrying out the workload based on Permendikbud Ristek No. 40 of 2021 at SD Negeri 1 Lebung Batang, Pangkalan District, including the lack of working group forums and training for the principal to attend, limited funds received by the school, lack of facilities and infrastructure, lack of teacher professionalism and lack of involvement of stakeholders and parents of students in making the principal's work programs a success. The solutions taken include trying to take part in training, increasing experience and knowledge and carrying out more effective supervision.
