Abstract

Breach of exclusive distribution agreement is one of the critical issues that often arise in business relationships between manufacturers and distributors, especially in competitive industries such as fast-moving consumer goods. The case involving PT Unilever Indonesia Tbk and PT Indomarco Prismatama (Indomaret) is a clear example of such a dispute, where the dispute arose from an alleged breach of an exclusive distribution agreement by Indomaret. Unilever claimed that Indomaret, acting as one of their main distributors, had sold Unilever's products outside the terms stipulated in the exclusive agreement, including selling the products below the agreed price or even to third parties not included in the authorized distribution network. This study examines in depth the legal aspects of exclusive distribution agreements in the context of business disputes in Indonesia, with a focus on the Supreme Court's decision number 1559 K/Pdt/2015 which upheld Unilever's claim for breach of contract by Indomaret. Through normative juridical analysis, this research seeks to explore the implications of the ruling for product distribution practices in Indonesia, as well as how such breaches may affect the long-term business relationship between manufacturers and distributors. The analysis shows that exclusive distribution agreements are contractual instruments that have a significant impact on competition in the market. When one party breaches the agreed terms, whether in terms of price, distribution area, or other requirements, the impact is not only limited to legal aspects, but also touches on aspects of reputation and business relationships. In this case, the Supreme Court ruled that PT Indomarco Prismatama was guilty of breach of contract and was required to compensate PT Unilever Indonesia Tbk. This judgment emphasizes the importance of compliance with exclusive distribution contracts and the need for strict sanctions to maintain market integrity. The broader impact of this breach also includes aspects of fair competition. This research highlights how non-compliant distribution practices can affect market dynamics, especially when large distributors such as Indomaret are involved. Under these conditions, exclusive distribution violations can create unfair conditions for other business actors who operate in accordance with existing rules. Therefore, in addition to the legal implications of breach of contract, this study also proposes stricter regulations and effective monitoring mechanisms to prevent such practices from occurring in the future. In addition, this study also provides insights into how the business relationship between producers and distributors should be maintained through a clear and transparent contractual mechanism. One of the key findings of this research is the importance of detailed agreements and strict sanctions against violations, as well as the need for close supervision of contract implementation, especially in highly competitive industries. This applies not only to the consumer goods sector, but also to other sectors that rely on extensive and complex distribution systems. Thus, this research contributes to the understanding of the importance of exclusive distribution agreements in maintaining a balance between the business interests of producers and distributors, as well as in ensuring the creation of a competitive and fair business climate. This research also enriches the literature on business and distribution law in Indonesia, and provides practical insights for companies involved in distribution agreements to avoid potential disputes in the future.

Abstract

Gender-based violence is a social phenomenon that has existed since ancient times and has become increasingly prevalent lately. In fact, gender-based violence is increasing, both in terms of number, form and modus operandi which are increasingly diverse. The Law on the Crime of Sexual Violence is considered to still require more nuances in the definition and details of sexual violence, does not provide a guarantee of safety and protection for victims and also does not fully consider an adequate gender perspective. The research method uses a descriptive normative legal research type, and the data is analyzed qualitatively. Drawing conclusions uses deductive logic. The purpose of the study is to describe the effectiveness of the Law on the Crime of Sexual Violence against cases of gender-based violence. The results of the study indicate that the existence of the Law on the Crime of Sexual Violence is still not fully effective because it is seen from the increasing cases of gender-based violence every year. It is recommended that there needs to be a strong commitment from law enforcement to consistently apply the rules of the Law on the Crime of Sexual Violence to support the effectiveness of the Law on the Crime of Sexual Violence.

Abstract

The malam bainai tradition is one of a series of activities in a marriage ceremony that puts inai on the hands of the bride and groom. In Jorong Lubuk Gadang, Nagari Lubuk Gadang, Koto Balingka District, West Pasaman Regency, the malam bainai tradition is the closing event in a series of weddings. In this tradition, inai is used as a symbol of prayer and hope for the happiness and welfare of the bride and groom in their married life. This study aims to analyze the meaning of the Malam Bainai tradition for the community in the marriage ceremony in Jorong Lubuk Gadang Nagari Koto Tangah, Koto Balingka District, West Pasaman Regency. phenomenological theory proposed by Alfred Schutz, (1961). This research uses a qualitative approach with descriptive type. The technique of withdrawing informants in this study was carried out by purposive sampling technique. Data collection methods were carried out by document study, non-participant observation, in-depth interviews. The data analysis used was interactive data analysis developed by Milles and Huberman (1992). The results of this study indicate that in the process of implementing malam bainai in the marriage ceremony in Jorong The tradition of malam bainai in Jorong Lubuk Gadang has a deep meaning, seen through two concepts of motifs from Alfred Schutz. At the stage of sounding the drum, wearing inai, and eating together, this tradition reflects the meaning of the Objective Motive (in order to motive), because these stages are used as a foothold by the community in undergoing the process to achieve blessing results in a series of events. While the stage of making wages is included in the category of because of motive, because this process is a part that has existed since before in the malam bainai event and cannot be changed, and reflects the deep beliefs inherited from the past by the community. The update in this study is malam bainai as a closing event held at the end of a series of events after the wedding is held.

Abstract

This research aims to analyze the structural performance of the Tanjung Balai State Treasury Services Office Building (KPPN) against the latest earthquake provisions in SNI 1726-2019. This analysis is important to ensure that existing building structures meet the latest regulations and are able to withstand anticipated earthquake loads. The research methodology includes collecting building technical data, structural modeling using SAP2000. Building technical data includes information regarding dimensions, materials and main structural elements. Structural modeling is carried out to create a digital representation of the building. The results of the structural analysis program show that the natural period value according to both regulations and modeling is 0.196769 seconds. The basic earthquake force obtained from SNI 1726-2019 is 51,314 kN for the However, the base reaction is considered safe in both regulations because of the static earthquake force, namely 38,962 kN for SNI 1726-2019 and 31.17 kN for SNI 1726-2012. Then the story drift in the X direction of SNI 1726-2019 is 0.114 mm, in the Y direction 0.437 mm with a clearance deviation of 80 mm. And SNI 1726-2012 X direction 0.096 mm, Y direction 0.3 mm with a clearance deviation of 80 mm. According to the ATC-40 analysis which was analyzed using SAP2000 software, the building performance that occurs on soft soil (SE) has a drift value of 0.015 which is included in the Damage Control phase. From the results of this analysis, it can be concluded that the Tanjung Balai State Treasury Services Office Building (KPPN) meets the security criteria in accordance with SNI 1726-2019. These findings are expected to provide valuable recommendations for building owners to ensure the safety and suitability of existing building structures against earthquake risks in Indonesia.

By owning shares, a person or company has the right to a portion of the company's assets and profits. When investors sell or buy shares of a particular company, they change their shareholdings. This condition is caused by market conditions, business performance and investors' strategic decisions. Information recorded on the stock exchange when a transaction occurs can influence the share price and ownership structure of the company. Abstract

Health services play an important role in fulfilling human rights, especially the right to health. In this context, health law serves to protect the rights and obligations between medical personnel and patients. Various regulations, such as Law No. 36 of 2009 concerning Health and Law No. 29 of 2004 concerning Medical Practice, regulate standards and ethics in medical services. Medical personnel are required to provide professional services and respect patient rights, such as the right to information and consent, while patients are required to provide accurate information. However, legal issues such as malpractice and violations of patient rights often occur, which shows the importance of understanding and implementing the law in health services. The era of digitalization and the pandemic also presents new challenges, such as data security and electronic medical consent. Therefore, this study discusses the legal implications in health services, highlighting the importance of education and compliance with regulations to prevent conflict and improve the quality of services. By understanding each other's rights and obligations, it is hoped that a fairer, more transparent, and quality health service system can be created.

Abstract

Jamu adalah salah satu obat tradisional yang banyak digunakan oleh masyarakat untuk mencegah dan atau membantu menyembuhkan penyakit, jamu juga sering kita temukan dalam kehidupan sehari-hari. Peningkatan minat masyarakat serta kebutuhan untuk mengkonsumsi jamu telah disalahgunakan oleh produsen jamu dengan menambahkan Bahan Kimia Obat (BKO), paracetamol merupakan salah satu BKO yang sering ditambahkan dalam jamu yang memiliki khasiat cepat serta keuntungan yang besar. Tujuan penelitian ini untuk mengetahui ada tidaknya kandungan paracetamol dalam jamu pegal linu dianalisis secara kualitatif berupa uji reaksi warna dan uji kromatografi lapis tipis. Tiga pereaksi warna yang digunakan yaitu pereaksi FeCl₃ 10%, K₂Cr₂07, dan NaN0₂. Berdasarkan hasil pengamatan dari sampel yang ditetesi larutan kalium dikromat menghasilkan sampel yang negatif paracetamol, sedangkan larutan FeCl₃ dan natrium nitrit yang dihasilkan sampel jamu positif mengandung paracetamol. Analisis kualitatif menggunakan KLT dan dibaca bercaknya dibawah sinar UV 254 nm lalu di hitung nilai Rf-nya. Hasil analisis kualitatif penelitian ini menunjukkan terdapat dua sampel jamu yang mengandung BKO parasetamol dari 3 sampel yang dikumpulkan. Kesimpulan dari penelitian ini adalah terdapat 2 sampel positif mengandung paracetamol.

Abstract

Menstruation is a biological function that occurs naturally and is important in contributing to reproduction for all women. Even though it is a reproductive function that is experienced naturally by women, the experience of menstruation can vary, from mild symptoms to severe symptoms. As a result of menstrual symptoms on the first and second day experienced by almost all women, this causes their activities, performance and quality of life to be disrupted. This is a consideration for the Government to implement menstrual leave for companies in Indonesia. Menstrual leave was implemented by the government in labor law No.13 of 2003. The creation of labor law regulations was nothing more than a relief to working conditions for female workers. Although the law recognizes the right to menstrual leave, there are many obstacles to exploiting the right which requires a lot of practical activities and a deep understanding of more real situations or actions.

Abstract

Construction projects are of course carried out in accordance with the implementation plan which is prepared based on the letter of agreement, general contract conditions, special contract conditions and technical specifications. In this plan, it is determined when the project must start and when the project must be finished. In every construction project, of course all parties involved want the project to be completed on time as previously determined. However, in reality, projects have their own problems and obstacles. One of the problems that really affects project performance in terms of time, quality and cost is the problem of project delays. In this study, a case study was carried out regarding the identification and analysis of factors causing delays in work on the Wiego Warehouse Building Construction project so that from the results of the analysis of factors causing delays, dominant factors and responses to handling them can be obtained. The Wiego Warehouse building is located on Jalan Letda Sujono, Medan and was built by contractor PT. Mitra Mandiri Asset Indo. This became the basis for conducting this research. The aim of this research is to determine the causes/risk factors that have a high level (dominant) and risk management responses that have a high level, in order to improve contractor performance. The research used is descriptive, using a questionnaire as a research instrument. Study of factors causing delays using the risk frequency scale, risk impact scale, and risk analysis matrix. The research results show that risk events are included in the classification of causal factors/high risk (high risk), which are significant for the problem of delays in building project implementation and the handling response to risk events that have a high ratio level. The dominant factor factor causing delays has a Severity index value of 61% - 80% and a risk level value of 16 (sixteen). For handling, there are several handling actions for dominant risks. Handling is carried out to minimize factors that cause delays and avoid sanctions or fines.

Abstract

This article aims to develop a learning multimedia application specifically designed to support the learning process of educational psychology using the VB.Net programming language. With the increasing utilization of technology in education, the need for effective and interactive learning materials is becoming more urgent. This application comes with various features including learning material modules, interactive quizzes, and evaluation of learning outcomes that allow users to track their learning progress. In addition, the app is designed to be easily accessed and used by teachers and students, both in the classroom and in a self-study environment. The application development process includes many stages, from requirements analysis, system design, software development to testing and evaluation. The trial results show that this application has the potential to improve understanding of educational psychology concepts and provide a more dynamic learning experience. Through the use of this application, students can learn more deeply and repeatedly, thus significantly increasing their motivation and learning outcomes.
