Abstract

In a debt agreement, of course the existence of collateral is very important so that the creditor can feel safe about the loan given to the debtor. Shares are one of the valuable and valuable intangible moving objects. Arrangements relating to shares are regulated in Law Number 40 of 2007 concerning Limited Liability Companies. Although it is not yet known the exact and clear definition of shares in Law Number 40 of 2007 concerning Limited Liability Companies, the regulation provides several provisions which are presumably related to shares. One of the interesting guarantees discussed in relation to shares is fiduciary. Fiduciary provides several arrangements related to fiduciary based on Law Number 42 of 1999 concerning Fiduciary Guarantees.

Abstract

Pancasila as the nation's view of life is a form of crystallization of cultural values, social behavior of the people, customs that serve as guidelines in the life of the nation and state. Today, Indonesia faces various challenges in the digital era. The digital era is the point of progress of human civilization, especially in the development of Science and Technology (IPTEK), one of which is marked by the emergence of the existence of social media. Social media certainly makes it easy for its users, through social media we can share information and communicate without being limited by space and time. However, like the two sides of a coin, we cannot deny that social media also has a negative influence, especially on millennials. If we look at the existing reality, of course we realize that this social media causes norms, values, manners, customs which are truly the identity of the Indonesian nation which gradually fade away. Thus, in facing the current rapid flow of digitalization, it is necessary to have Pancasila resilience as a form of maintaining Pancasila values so that they live on in the soul of the Indonesian nation.

Abstract

The government's efforts to overcome the global economic crisis with its citizens, especially business people, are one of the main reasons to stabilize the economy, maintain financial balance, and avoid bankruptcy for most businesses. Causes termination of employment and termination of employment. The problem of this research is to clarify whether labor law can be projected as a normative based law, namely a philosophical based law based on legal certainty and justice as well as benefits for producers (goods or services). In compiling this journal, the author uses the method of writing prescriptive law. This method aims to use legal norms and conduct normative legal research from an internal perspective. Labor law helps maintain order in the employment relationship between workers and employers. To maintain order, we need a code of conduct in the form of legal ideals, normative law (legal certainty) based on justice and expediency. These three values underlie compliance with labor law and as a rule of law Indonesia upholds caste equality before the law. (Equality before the Law).

Abstract

Articles 20, 21, 22, 23, 24, 25, and Article 26 concerning WPR and Articles 66-73 concerning IPR from Law no. 4/2009 on Resource and Coal Mining contains implicit rules for craft mining. To achieve peace in society, we use practical methods to resolve conflicts. People's mining, which is an option for conventional mining, is a very real occurrence. Pre-existing issues will be investigated using standard legal study methods. This study will focus on the part of the law that was amended in 2009 that regulates the extraction of minerals and coal, Minerba Law no. 4. Various types of complementary legal documents, such as books and scholarly articles on the topic, can be found in the library's collection. The findings of this study include, first, the city government no longer has the authority to issue permits after the ratification of the Minerba Law in 2020. The government is now responsible for coordinating permits as a whole. Second, if smallholder mining actually occurs, it is not clear who has the authority to designate smallholder mining zones. Third, a culture of bureaucratization will develop in smallholder mining administration as a result of the loss of the strategic role of local governments and their current status as an extension of the central government. Currently, local governments have no powers of their own beyond what has been granted to them by the federal government. Every aspect of mining - from initial exploration to post-mining environmental management (reclamation) and protection of labor health and safety - falls under the purview of the federal government. The sole purpose of local government is to facilitate central cooperation efforts.

Abstract

The Urgency of Implementing the Legislative General Election System Open and closed proportional election systems (elections) are two legislative election systems that differ in the way votes are counted and the allocation of seats in parliament. The two systems shocked the public because of plans to re-implement a closed proportional election system, which was marked by a lawsuit for judicial review of the Election Law to the Constitutional Court (MK) with case number 114/PUU-XX/2022. In this research, a normative research method was used with a comparative approach to the two systems based on several criteria, including effectiveness in representing various political interests, political stability, and people's participation in politics. The purpose of this study is to identify and examine the proper application of the legislative election system in the development of democracy in Indonesia. The results of this study indicate that an open proportional electoral system in the election of candidates for legislative members tends to be more appropriate in the development of democracy in Indonesia and is more effective in representing diverse political interests and strengthening political parties as political institutions. With this system, the development of democracy in Indonesia will be even better with well-run elections that uphold people's sovereignty.

Abstract

Baggage handling has an important role, this is because handling is related to passenger satisfaction. Baggage handling must be managed properly to avoid mistakes such as loss and damage. Baggage handling is the process of servicing passenger baggage at the departure station to the arrival station. The baggage handling process must be carried out carefully, conscientiously, caringly and carefully so that timeliness (OTP) can be achieved. This study uses qualitative methods and the data produced is in the form of descriptions. The primary data in this study were the results of interviews with the load master, ramp and porter officers. As for the secondary data in this study in the form of literature and previous research. Data collection techniques used are observation, interviews, and documentation. Data analysis techniques were carried out in the form of data collection, data reduction, data presentation, and conclusions. The handling carried out during the loading unloading process is preparing documents such as loading check lists, loading instructions, stowing, and coordinating with load control or FOO and porters. While the obstacles during the loading and unloading process to achieve OTP include weather factors, aircraft engine damage, lack of supporting facilities and lack of porter personnel.

Abstract

Following several years of world political leadership beset by clashes between nations, the trend lately is to spread invisible turmoil within a nation, such as between ethnic struggles and withdrawal or rebellion. New issues in the globalization cycle are related to issues of basic freedoms, political, monetary and social changes, followed by the development of different struggles. According to social researcher Hugh Miall, "the breakdown of the Soviet Association completed a wide-ranging series of battles in which solitary clashes around the world dominated the global framework, rather than subterranean struggles such as ethnic strife, disobedience and clashes for power in many countries, finally becoming something of a signature" (Miall, 2002: 3) As a result of continuing patriotic clashes, it has resulted in ethnic clashes or national conflicts between regions that want to alienate themselves from the real government, as happened in Indonesia, such as in Papua, Maluku, Aceh, and East Timor which in the end it was discovered how to isolate it from the Unitary State of the Republic of Indonesia.Relating to Aceh, Wahyudi (2005: 2) argues that, the changes that brought an environment of opportunity for individual Acehnese were successfully used by dissident developments to inflame the spirit of independence, so that the situation that occurred was true. -absolutely wild and full of vulnerabilities. Public administration is paralyzed, regulations and instruments are ineffective, the economy is stale, and perhaps the turbulent state is allowed to continue. The issue of disobedience was revitalized in recent improvements in Indonesia, beginning with the raising of the South Maluku Republic (RMS) banner before President Susilo Bambang Yudhoyono, with a gathering of RMS supporters in commemoration of Big Family Day at Merdeka Square in Ambon. The raising of the RMS banner, in addition to the performance of the Cakalele dance on that occasion, the raising of the Morning Star flag in Papua and the tendency for GAM credit to continue to be used in Aceh.

Abstract

Today's criminal acts of fraud continue to develop following the development of existing technology, existing legal regulations function to overcome this, but existing regulations cannot reduce these crimes but increase them. This study aims to find out how existing law enforcement is against criminal acts of fraud through electronic systems, knowing various kinds of inhibiting factors in enforcing criminal law against a crime of fraud. This research was carried out using normative juridical methods through library research by examining secondary data including regulations legislation, research results, scientific journals and references. The results of the study provide an illustration, where criminal acts of fraud through electronic systems are in principle the same as fraud in conventional ways, but the difference lies in the evidence or means of action, namely using electronic systems (computers, internet, telecommunication devices), because that is law enforcement. Fraud crimes can still be overcome by Article 378 of the Criminal Code concerning fraud and Article 28 Paragraph (1) of the ITE Law concerning Information and Electronic Transactions Furthermore, obstacles in law enforcement against criminal acts of fraud based on electronic transactions are still influenced by five factors, namely legal factors, law enforcement factors , factors of facilities or facilities that support law enforcement, social factors and cultural factors.

Abstract

This study aims to examine the role of bank facilitating institutions and their functions in relation to the policy of banking business activities in Indonesia in carrying out the management system and work system of the bank. In this study the authors used explanatory qualitative research methods, data were obtained from official sources related to information regarding the roles and functions of facilitating institutions with Islamic banking financial institutions as well as from book reference sources and other relevant references. The author finds that overall the bank facilitator institution plays an important role as an institution that supports the running of Islamic bank activities in a proportional and orderly manner. And the authors found that according to LPS information, so far there have been no Islamic banks, especially those that have failed banks or banks whose existence needs to be saved. The essence of the role and function of the facilitating institution is very closely related to financial institutions. And each institution has different authorities, functions and duties in supervising, overseeing, protecting, resolving problems, issuing fatwas related to bank products and regulations regarding work systems. The main function of the bank facilitating institution is to support bank business activities so that they run effectively and in a sound and orderly manner.

Abstract

Foreign Object Debris (FOD) is an object or foreign object that is alive or not living in the apron area (aircraft parking area), taxiway and runway (runway) which can cause damage to aircraft and has the potential to pose a hazard to the safety and security of aircraft operations fly. The purpose of this study was to determine the efforts, constraints, and solutions of Apron Movement Control (AMC) officers in monitoring the cleanliness of aprons from Foreign Object Debris (FOD) at Supadio Pontianak International Airport. This study used a qualitative research method using primary and secondary data which was conducted in March 2023 at Supadio Pontianak International Airport. This research was conducted in the Apron Movement Control and Ground Handling units using data collection and retrieval techniques through interviews conducted with 1 resource person from the Apron Movement Control Coordinator, 1 marshaller from PT. Mulio Citra Angkasa as the Ground Handling Agent, through observation, documentation and library research. To test the validity of the data, researchers used credibility, transferability, dependability, and confirmability tests. As for data analysis that researchers use, namely data collection, data reduction, data presentation, verification and conclusions. The results of this study indicate that AMC officers make efforts to monitor the cleanliness of the apron by carrying out scheduled inspections, outside of the scheduled ones, and coordinating with related stake holders such as ground handling, bukaka, and Pertamina. The obstacle faced by AMC officers is the number of officers who are only 2 to 3 people per shift makes it difficult for officers to carry out supervision on the apron, the condition of the apron is cracked, and the construction of new corridors so that it is feared that it can cause FOD to enter the apron. The solution to deal with these obstacles is to carry out routine inspections at least 2 times per shift and additional inspections if the weather is bad, conduct socialization to increase awareness of all stakeholders at the airport, conduct FOD Walks when AMC officers want to operate garbarata.
