Abstract

The regulation in Law Number 5 Year 1999 on the Prohibition of Monopolistic Practices and Unfair Business Competition broadly addresses prohibited agreements, activities, and dominant positions. This study uses a normative juridical research method with the aim of analyzing the closed agreements made by PT Forisa Nusapersada based on Law No. 5 of 1999, Commission Regulation No. 3 of 2009, and Commission Regulation No. 6 of 2010. The research specifically focuses on the abuse of the dominant position through the "Pop Ice The Real Ice Blender" program, which is alleged to have limited market competition and harmed consumer choice. The findings indicate that PT Forisa Nusapersada’s actions constitute an abuse of its dominant position, as it used its market share of 90.09% to 92.16% to monopolize the market by limiting competitors' ability to sell similar products and forcing retailers to display Pop Ice products exclusively. This violation is supported by the findings in KPPU Decision Number 14/KPPU-L/2015, which continued until the Supreme Court Decision Number: 1106 K/Pdt.Sus-KPPU/2017. The research concludes that such strategies violate the provisions of Article 25 paragraph (1) of Law No. 5 of 1999 by unfairly restricting market access and consumer choice, thus undermining fair competition.

Second, to know the implications of human nature in the Islamic perspective on Islamic education. The results of the study, first, in Islam, humans have a special position as creatures created by Allah SWT who are given reason, spirit, and responsibility in the world. The Qur'an uses three main terms to refer to humans, namely al-insân, al-basyar, and Bani Adam. The Qur'an explains that humans were created through several stages, starting from the ground which then developed into nutfah, alaqah, mudghah, until finally perfected by the inhalation of the spirit by Allah SWT. The purpose of human creation is to recognize and worship Allah, with reason or intellect as a tool for thinking and the heart as a tool for believing in the Essence that cannot be achieved by reason. Second, the implication of human creation with Islamic education has a very close relationship, because Islamic education must be balanced between the science taught and the science of the hereafter. That Islamic education must be based on the concept of human creation in order to have a clear direction in developing human nature in a balanced manner. Human identity as a perfect Muslim can only be realized if all of his potential as a creature of God, educator, learner, servant, and khalifah is well integrated. Islamic education must be based on the integration between qalbiyah (heart) and aqliyah (reason) education in order to form intellectually intelligent and morally superior humans. Islamic education must also be able to develop all human potential through hard skills and soft skills, become a means of transforming Islamic knowledge and culture, and internalize Islamic values in individuals.

Abstract

This research examines the influence of religiosity on resilience in individuals facing failure. Titled "The Influence of Religiosity on Resilience in Situations of Failure," the study aims to understand how different levels of religiosity affect resilience amid the psychological stress of failure. Data was collected from 100 adults aged 18-65 who had experienced failure and were members of a religious community. Participants completed the Brief Resilience Scale (BRS) questionnaire to measure resilience and the Religious Commitment Inventory (RCI) to measure religiosity. The research hypothesis stated that higher levels of religiosity correlated with greater resilience. The results showed that religiosity has a direct impact on resilience in the context of failure. The findings revealed a positive relationship between religiosity and resilience, supporting the hypothesis that the more religious a person is, the higher their resilience. This relationship was significant, with t-tests and F-tests confirming that religiosity contributed significantly to explaining variation in participants' resilience scores. Regression analysis reinforced these findings, emphasizing the importance of religiosity for resilience. Greater commitment to religious practices and beliefs was shown to improve coping strategies, emotion regulation and the ability to bounce back from failure. The findings imply that religiosity can act as a protective factor, providing individuals with a sense of purpose, meaning and community support to cope with adversity and failure. This research contributes to the understanding of the role of religiosity in enhancing psychological resilience.

Abstract

Indonesia’s current account balance has frequently shown instability, largely influenced by macroeconomic variables such as inflation, exchange rate, and interest rates. This instability has implications for the country’s financial resilience and trade competitiveness. This study aims to analyze the partial and simultaneous effects of inflation, exchange rate, and interest rates on Indonesia’s current account balance using quarterly time series data. The research adopts a quantitative approach utilizing Error Correction Model (ECM) analysis, which allows for the identification of both short-run and long-run relationships among variables. The study finds that inflation and interest rate variables have significant partial effects on the current account, while the exchange rate shows less impact individually. However, when examined simultaneously, all three variables influence the current account significantly. These findings highlight the importance of coordinated macroeconomic policy, especially in managing inflationary pressure and monetary policy responses to safeguard external balance. The results provide valuable insights for policymakers aiming to stabilize Indonesia’s external sector and formulate sustainable economic policies amidst global economic uncertainty.
