Abstract

The study desires to find out the basic considerations and analysis of the Constitutional Court regarding the dispute over the results of the 2019 Presidential General Election. The type of research used is normative research. The results obtained from this study are that Bawaslu has too broad authority and even the Constitutional Court cannot re-examine the results of the Bawaslu decision because it is final. It is contrary to the principle of checks and balances applied in Indonesia. Therefore, the Drafters view that Law Number 7 of 2017 concerning General Elections needs to be replaced by a regulation that can expand the authority of the Constitutional Court or at least the Constitutional Court has the authority to re-examine decisions from election management bodies.

Abstract

The study strives to determine the effect of investment, workforce, and level of education on the real GRDP growth in Bangka Belitung Province either partially or simultaneously. The research is quantitative descriptive research, and the research method used is panel data regression analysis. This study uses time series data published by BPS Bangka Belitung Islands. The results of this study show: 1) There is an effect of investment, workforce, and education level on the real GRDP growth simultaneously in the Bangka Belitung Islands Province. 2) There is an effect of investment, workforce, and education level on the real GRDP growth partially in the Bangka Belitung Islands Province. 3) Of the three research variables, namely Investment, Workforce, and Education Level, the variable that has the most dominant effect on the PDRB of the Bangka Belitung Islands is the Labor Force variable.

Abstract

Basic performance is necessary to maintain employees with a decent standard of living, but compensation also provides a tangible measure of an individual's value to the company. Human resource management according to the author is a protest to regulate existing human resources within an organization so that it is effective and efficient and is carried out through existing functions to achieve sales, employee, and community goals. the authors use an error tolerance limit of 5%, the population used in this study are employees of PT. Pasma Karya Indonesia. The HR Division, namely the HRD Section, totaled 100 people. The results of the study show that compensation, motivation have positive and significant direct effect on job satisfaction and employee performance.

Abstract

Sports law in Indonesia has been inadequate, with the absence of comprehensive regulations governing various aspects of national sports. This has resulted in the lack of legal protection and unfulfilled welfare for sports actors who demand their rights. The Sports Law (SKN Law) emphasizes the need to position sports clearly in the national legal system as part of the process and achievement of national development goals. This research adopts a normative approach, using both statutory and conceptual methods. Secondary data serves as the primary source, and qualitative descriptive analysis is employed. Conclusions are drawn deductively, focusing on the topic of Legal Protection for the Welfare of Sports Athletes in relation to Law Number 3 of 2005. The findings reveal that Law Number 3, which established the National Sports System, encompasses interconnected elements such as sports actors, organizations, infrastructure, facilities, community participation, and supporting aspects like science, technology, information, and the sports industry. These elements require support from decision-making institutions, organizational empowerment, human resource development, sports facilities improvement, and adequate funding. The ultimate objective of sporting activities is to ensure the welfare of athletes.

Abstract

The use of electronic technology has become prevalent in banking services, offering convenience to customers through internet transaction services. However, this reliance on technology has also exposed vulnerabilities, leading to violations and crimes that result in significant losses for individuals and even the state. Hacker techniques and breaches of bank financial systems have become unavoidable risks. Banks play a crucial role in the financial system, overseeing business transactions and economic activities. Individuals and businesses choose banks as their preferred institutions for depositing funds, conducting transactions, and obtaining capital. Given the importance of banks, legal protection for customers is essential. This research adopts a normative approach, utilizing both statutory and conceptual methods. Secondary data serves as the primary source, and qualitative descriptive analysis is employed. Conclusions are drawn deductively, specifically regarding the topic of Legal Protection of Banking Customers in relation to Law Number 8 of 1999. The findings emphasize the urgency of legal protection for bank customers under the Consumer Protection Law. This law ensures legal certainty for customers by obligating banks to provide correct and honest services, as well as transparent and accurate information about service conditions and guarantees. Banks should collaborate with consumer institutions or other bodies to formulate clauses that meet the needs of all parties without compromising legal certainty. Agreement on the interpretation of relevant clauses is also crucial.

Abstract

This study focuses on poverty and the efforts of the government in Indonesia to improve the welfare of the poor through the Family Hope Program (PKH). The research utilizes a qualitative descriptive method to examine the role of the government in providing assistance through PKH. The study highlights the various roles and skills required of PKH facilitators in their interactions with program beneficiaries. The government's role includes facilitative roles and skills, where PKH facilitators act as motivators and provide support in health services such as regular check-ups for pregnant women and children at local health centers. PKH facilitators also require educational roles and skills to effectively communicate information and conduct activities with the community. These educational roles are essential for increasing knowledge and raising awareness among program beneficiaries. Additionally, PKH facilitators need representative roles and skills to effectively convey information and feedback between beneficiaries and local government authorities. This role ensures that the voices and concerns of beneficiaries are heard and addressed by relevant stakeholders.

Abstract

Local government has a dual function of holding executive and legislative powers. Meanwhile, the DPRD acts as a managing or controlling institution which can approve certain changes or reject them altogether. However, the DPRD may occasionally submit proposals on its initiative regarding draft regional regulations. This study uses a qualitative approach, namely the approach used by researchers based on data stated by respondents orally or in writing, governing it by the legal hierarchy in Indonesia. Whereas the DPR/DPRD as people's representative institutions and functioning as legislators should form a law that does not deviate from the purpose of the law, namely to provide certainty to the community, justice to the community, and benefits to the community. In this case, the law is a tool to regulate the social balance, and the interests of society to realize the ideals of society. The formation of laws and regulations must also pay attention to the Theory and Objectives of Legal Politics, namely the policies of state administrators in the field of law that have been in effect, are in force, and will be in effect, sourced from the values prevailing in society to achieve the aspired goals of the state.

Abstract

The Indonesian National Police (POLRI) is responsible for maintaining public security and order, as well as serving and protecting the community. However, there have been instances where members of the police force have clashed with civilians while carrying out their duties. This study employs normative legal research, focusing on secondary data obtained from various sources. The legal methodology approach is utilized to examine relevant regulations and guidelines related to the legal issues at hand. According to Article 2 of Unofficial Law No. 3 of 2003, which pertains to the Specialized Execution of General Legal Foundations for members of the Indonesian National Police, the law enforcement process for police officers is carried out within the procedural regulations applicable in general court proceedings. Thus, if a member of the National Police is reported to have committed a crime, they are processed by the Criminal Investigation Unit. Article 12 (4) of the Police Professional Code of Conduct stipulates administrative sanctions, which include 1) transferring duties to a different position, 2) transferring duties to different areas, 3) honorable discharge, or 4) dishonorable discharge. Transfers of positions and areas serve as administrative sanctions for police officers who have violated the Professional Code of Conduct, involving either demotion (transfer to a lower position) or reassignment to a different place/region. Honorable discharge or dishonorable discharge, on the other hand, are administrative actions taken against police officers who have demonstrated a violation of the Professional Code of Conduct.

Abstract

An athlete who excels can bring and make the name of Indonesia proud, both locally, nationally, and internationally. So that it is appropriate to get high appreciation from the State, in this case the State is represented by the Youth and Sports Service (Dispora). This is as regulated in Article 21 of Law Number 3 of 2005 concerning the Sports System. The main issue of fulfilling welfare seems to have no end, due to very little attention from the state towards the welfare of its athletes. The athlete's rights that must be fulfilled are contained in Article 55 paragraph 3 and Article 64 of Law Number 3 of 2005 concerning the Sports System. Thus, many related laws have regulated the issue of athlete welfare. However, there is still a lot of confusion over the welfare of athletes (athletes) despite the existence of the Law on the National Sports System.

Abstract

Indonesia is a country that has natural beauty that is rich in cultural and artistic diversity which can provide an increase in state income. In line with the development of the world of tourism in Indonesia, efforts have been made to display interesting things, such as bringing in tourists. Efforts that can bring in tourists include: maintaining the authenticity of the renovated building and promoting tourist objects as tourist attractions. In addition, the government can provide support for efforts to attract tourists to tourist objects such as providing a special selfie room for tourists taking pictures, thus developing tourism as an industry becomes easy to increase economic growth, namely by only exploiting natural beauty, arts, culture, and hospitality to address the balance of payments deficit it experienced. That is why many experts are worried and consider it crucial to have careful planning in tourism development. The consideration is based on the concern regarding tourism as an industry that is expected to spur economic growth in DTW (Tourist Destination Areas) or countries visited by tourists. So that balanced growth can be developed, and the number of tourist arrivals can continue to grow. The research focuses on planning local cultural attractions in increasing tourist visits in the Central Java region.
