Abstract

This research examines the development of Arabic language and literature before the arrival of Islam, with a focus on the Jahiliyah era. This study covers the characteristics and variations of pre-Islamic Arabic, Jahiliyah poetry, the role of oral traditions, as well as famous poets such as Nabighah al-Dhubyani and Imru' al-Qais. Further discussion concerns the influence of socio-economic conditions on literary development at that time. This article also refers to the arguments of the Koran, hadith, as well as the views of ulama on this topic. This research uses a qualitative approach with descriptive analysis methods. The data used comes from primary and secondary sources, including Jahiliyah poetry, classical books, and the views of scholars on pre-Islamic Arabic language and literature. This research combines a historical linguistic approach and a sociocultural approach. A linguistic approach is used to analyze dialect variations and characteristics of pre-Islamic Arabic. The themes of Jahiliyah poetry, such as love, war, and praise of the tribe, reflect the social life of pre-Islamic Arab society. The structure of the poem, with its beautiful use of rhetoric and metaphor, shows the linguistic richness of the Arabic language passed down to the Islamic era. Jahiliyah poetry, such as the works of Imru' al-Qais and Nabighah al-Dhubyani, is not only historical documentation but also provides insight into the social, economic and cultural dynamics that shaped Arab society.

Abstract

This research aims to examine the practices regarding the implementation of smartphone usage rules among university students through the perspective of the uṣūl fikih principle of sadd Al-Żarī’ah at the Male Dormitory of STIBA Makassar by identifying two research questions: how the smartphone usage rules are applied within the dormitory environment and how the uṣūl fikih principle is evaluated in the context of the existing regulations. The study employs a qualitative approach using field research design that integrates normative, uṣūl fikih, case, and psychological approaches, with primary data obtained through interviews and secondary data sourced from the Qur’an, hadith, scholarly texts, academic journals, and the internet. The findings indicate that the smartphone usage regulations at the dormitory have been codified in a student handbook and classified into three categories, namely, usage permitted under certain conditions, usage subject to restrictions, and usage absolutely prohibited, with three main types of violations identified: dissatisfaction and protests against the rules, covert and excessive usage, and serious breaches of religious law. The application of the uṣūl fikih principle of sadd Al-Żarī’ah is deemed appropriate based on the principle of maslahat, considering that STIBA is an institution with a dormitory system where all students are required to live together, thereby necessitating strict regulations to prevent declines in academic performance, moral standards, and ethical conduct. The implications of this research are expected to serve as an important reference for the development of literature and policies in the educational sector, particularly for boarding schools or dormitory-based universities such as STIBA Makassar, as well as to provide a positive contribution as a source of information for academics and the general public.

Abstract

This study aims to determine and understand the implementation of the al-'Ādah muhakkamah principle on the inheritance rights of Sasak daughters. The formulation of the problem is: first, what is the form of inheritance distribution for Sasak daughters. Second, how is the implementation of the al-'Ādah muhakkamah principle in determining the inheritance rights of Sasak daughters. This study uses a qualitative research type, namely library research, which focuses on the study of manuscripts and texts, using normative and comparative approaches. The results of the study found: first, the form of inheritance rights obtained by Sasak daughters is in the form of household furniture, jewelry, clothing and woven fabrics. As for inheritance rights in the form of land, houses and rice fields are fully given to sons, because in the distribution of inheritance in the Sasak community, sons are given more priority, because the Sasak community uses a patrilineal kinship system that draws male lineage. The second is related to the implementation of the al-'Ādah muhakkamh principle, if seen from the implementation process, it is determined through deliberation accompanied by traditional leaders in order to maintain family harmony. However, the inheritance rights determined for Sasak girls are not in accordance with Islamic law values ​​where the level cannot be measured, only determined in the form of household furniture, jewelry, clothing and woven fabrics. Al-'Ādah in the Sasak community cannot be used as law because it is a fāsid custom

Abstract

The learning of Arabic for prospective Hajj and Umrah pilgrims is an essential necessity to facilitate smooth communication during their pilgrimage journey in the Holy Land. This study analyzes the implementation of a communicative approach in Arabic language learning conducted by the Arabic Language Education Study Program at Universitas Muhammadiyah Karanganyar within the Tour and Travel Community at The Park Mall. The program aims to equip pilgrims with practical and applicable language skills. This research employs a qualitative method with a case study approach, utilizing data collection techniques such as observation, interviews, documentation, and relevant literature review. A total of 21 participants took part in the Arabic language learning program, which applied a communicative approach through conversation simulations, role-playing, and context-based exercises related to worship and daily life in Mecca and Medina. The findings indicate that the implementation of a communicative approach has a positive impact on improving participants' Arabic language skills, providing them with a more practical understanding and speaking ability. Before joining the program, most participants struggled to comprehend and use Arabic. However, after engaging in communicative-based learning, they showed significant progress in speaking, understanding instructions, and recognizing basic Arabic writing commonly encountered during their pilgrimage journey.

Abstract

This study aims to investigate and understand the rulings on the use of mixed and synthetic silk fabrics for men from the perspective of Islamic jurisprudence. The methodology employed in this research is library research, collecting data from the Qur’an, Hadiths, Islamic jurisprudence texts, books, scholarly journals, encyclopedias, and electronic sources. A normative approach is used to examine the Qur’anic evidence, Hadiths, and the opinions of scholars concerning the use of silk fabric. The findings of the study are as follows. First, the use of silk fabric by men is a matter of debate among Islamic jurists. Second, in general, the use of natural silk fabric is prohibited for men based on the Hadiths of the Prophet Muhammad (peace be upon him). Third, artificial or mixed silk fabrics made from synthetic materials or plant fibers are permissible because the basic ruling on clothing in Islam is that it is permissible. The implications of this study are expected to serve as a reference, literature, or consideration for the academic world, as well as a source of positive guidance and information for the government, entrepreneurs, and the general public.

Abstract

This study aims to explore Islamic principles that emphasize the strategic management of individual potential, as exemplified in the lives of Prophet Muhammad (peace be upon him) and his companions. Additionally, the study seeks to develop an effective talent management strategy that aligns with each individual's unique abilities and potential, ensuring that da'wah activities become more effective, efficient, and sustainable. A descriptive qualitative approach is employed to examine and analyze the integration of Islamic principles with modern management strategies in the context of talent management within da'wah organizations. The findings reveal that Islamic principles encourage every individual to recognize, develop, and manage the potential bestowed upon them by Allah, as emphasized in various Quranic verses and hadiths of the Prophet, which highlight the importance of maximizing one's abilities for the benefit of the ummah. Furthermore, this study identifies key strategies for talent management in da'wah, including potential-based recruitment, competency-based placement, continuous training, performance evaluation, the utilization of digital technology, the creation of a conducive work environment, and the enhancement of collaboration within da'wah efforts.

Abstract

This study aims to examine and understand the legal status of trading feces processed into fertilizer from the perspective of the four major Islamic schools of thought (mazhab). The primary issues addressed in this research are: first, the process of converting feces into usable fertilizer; second, the legal perspectives of the four mazhab on the trade of feces as fertilizer. This research adopts a library-based approach (library research), focusing on textual and manuscript studies using normative, historical, and comparative methods. The findings reveal two key points. First, the process of converting feces into usable fertilizer involves several stages: the feces are initially dried and then mixed with other materials such as rice husks, sawdust, manure, and kitchen waste, including spinach, tomatoes, or spoiled rice. Subsequently, the mixture is treated with fermentation liquid to facilitate decomposition. Second, the four mazhab offer differing views regarding the legality of trading feces as fertilizer. The Shafi’i school prohibits the trade of feces as fertilizer, as feces are considered impure (najis) and thus forbidden for trade. In contrast, the Hanbali and Maliki schools permit the trade of such fertilizer, provided the feces come from areas where the local population consumes lawful food. The Hanafi school, meanwhile, allows the trade of feces-based fertilizer on the grounds that it serves a beneficial purpose.

Abstract

This study aims to explore how infertility can be used as a legitimate reason for khulu' in terms of maqāṣid al-Syarī'ah, and how sharia principles can provide wise and fair guidance in this situation. This study uses a qualitative descriptive research type (non-statistical) that focuses on literature research with normative and conceptual approaches. The results of the study are as follows; First, Islamic scholars have different opinions regarding infertility which is used as a reason for khulu' (divorce lawsuit by the wife). Some scholars allow it and some do not. The Ḥambali school of thought allows khulu' due to infertility in each marriage partner. Meanwhile, the scholars of the Sāfi'iyyah and Ḥanafiyyah schools of thought are of the opinion that it is not permissible to ask for khulu' from an infertile husband because what allows khulu' is the husband's inability to provide his wife's rights in the form of intimate relations. However, contemporary scholars such as Abdullah ibn Bāz and Ibn al-Qayyim allow it. Second, in the view of maqāṣid al-Syarī’ah, khulu’ caused by infertility aims to maintain the five main objectives of maqāṣid al-Syarī’ah especially Ḥifẓ al-Nasl (preserving offspring). The proposed khulu’ is one form of preserving offspring in infertile couples. Based on the fatwa of scholars, infertility sufferers are allowed to separate from their partners in order to remarry someone else to have offspring. However, before separating, it is better to try medical or non-medical therapy first. The implications of this research are expected to be a reference, literature or consideration for the academic world, and can be a positive reference material and information for the community.

Abstract

This research aims to examine the term tamkīn in the Al-Qur'an, identify its categorization, and analyze its function at a practical level. This research is in the nature of a library research, namely collecting data sourced from libraries (both individual and institutional libraries), because the data studied is in the form of books, manuscripts or magazines sourced from the library treasury. The results of this research show several things. First, the term tamkīn in the Al-Qur'an has several meanings, namely the granting of power or kingdom, position at the side of the ruler, preparation for attaining power, granting worldly favors, steadfastness in religion, and stability and victory. Second, the division of tamkīn in the Al-Qur'an consists of two types, namely maddi and artiwi. tamkīn maddi relates to giving strength in the form of property, wealth, or resources to achieve economic and social independence, while tamkīn artiwi focuses more on spiritual, mental, or moral strength, which includes the quality of faith and the ability to carry out religious and social obligations. Third, the concept of tamkīn in everyday life leads to empowerment in various aspects, such as economic, social, spiritual, educational and leadership. Allah SWT. through His revelation, it provides instructions for His people to pay attention to the principles of justice, prosperity and progress.

Abstract

This research aims to find out how the criminal act of trading wild plants and animals in the perspective of jinayah fiqh and law no. 5 of 1990. This research method is library research. Library research is a data collection technique that involves an in-depth study of books, literature, notes that are relevant to the problem under study, this research approach method is normative juridical and comparative approach. The results of this research are: First, in jinayah fiqh, the type of criminal act of trading wild plants and animals falls into the takzir category, where the punishment is determined by the ruler or government. Meanwhile, according to Law No. 5 of 1990, Article 40 states that the maximum imprisonment of 5 years and a maximum fine of 100,000,000.00 for intentional violations, as well as a maximum imprisonment of 1 year and a maximum fine of Rp. 50,000,000.00 for violations due to negligence. Second, the similarities between the two are both aimed at protecting the preservation of nature and punishing perpetrators who harm the environment who trade in protected plants and wildlife, while the significant differences between the two between jinayah fiqh and the Law include aspects of the legal basis, approach in determining penalties, emphasis on moral values, and the process of applying different laws. The implication of this research is that it is expected to be a consideration for the community.
