Abstract

This research aims to reconstruct the history of Islam in Spain, the main problem in this research is how Islam is in Spain. The sub-issues raised are 1) how was the process of the arrival of Islam in Spain? 2) How is the development and progress of Islamic civilization in Spain? 3) What factors led to the decline and destruction of Islam in Spain? The aims of the research are: 1) to examine and analyze the arrival of Islam in Spain, 2) to examine and analyze the development and progress of Islamic civilization in Spain, and 3) to reconstruct the factors causing the decline and destruction of Islam in Spain. Research using historical research methods includes Heuristics, source criticism, interpretation,and historiography. The results of the analysis in this study show that: 1) The origin of the arrival of Islam in Spain cannot be separated from the success of Tariq ibn Ziyad in defeating King Roderic, so this victory became the main capital for Tariq ibn Ziyad and his troops to conquer important cities in Spain. 2) Spain is the most important place for Europe in absorbing knowledge developed by Muslims, both in political, socia, and economic relations and civilization between countries. Europeans witnessed the fact that Spain was under Islamic rule far away from other countries in Europe, especially in the field of thought and science,and other physical structures. this area of ​​Spain flows various knowledge to advance and improve all its shortcomings and even achieve its glory until this century.

Abstract

This study analyzes the "Application of Blended Learning to Overcome Student Saturation in Learning Arabic Class XI MAN 2 Parepare". Aims to find out the saturation of learning caused by learning Arabic that is not optimal. Blended learning combines face-to-face and online meeting learning to be an alternative to learning. This study uses a qualitative research method that is descriptive in nature, namely to provide an overview of the situation factually, and systematically, by collecting data, and facts about learning saturation in learning Arabic at MAN 2 Parepare. The combination of online and offline learning can produce effective and efficient learning. Effectively, blended learning is a balanced concept between increasing insight and knowledge online and increasing skills offline, while attitudes can be obtained from online and offline learning. Efficiently, students can arrange teaching materials in the form of multimedia with a wider and varied range of materials and students can easily access online materials wherever and whenever according to their needs and time availability. The application of Blended learning at MAN 2 Parepare is carried out using the SIATI MADDUPA application. The effect of using this application, in general, is that students can access all the needs of a series of students in this one application only by having a student card that has been equipped with a barcode. With this student card, students can take attendance independently and have their attendance recorded in real-time, can access library books, and can access the school's internet for free with a barcode scan. This application has just been launched, with various features in this application that can be utilized by all school stakeholders. Even so, the use of this application is not maximized because it is still being developed so that it can be optimal in its use. The implications of the whole series with various research objects based on facts, as well as various sources from all school stakeholders are very helpful in the process of writing this scientific paper.

Abstract

This paper aims to reveal the development of Islam in France with the object of discussion including: (1) the process of Islamization in France, (2) the development of Islam in France, (3) Problems and the existence of Muslims in France. To answer this, it is pursued by using the historical method which includes four stages of work systematically, namely: heuristics, conducting a search of literary sources that are relevant to the study being carried out; source criticism, analyzing sources; interpretation of sources; and historiography or writing of research results. The process of Islamization in France began since the Crusades, namely in the 11th to 13th centuries AD, then the process of Islamization continued in 1830, namely when Muslim immigrants arrived in France. In the following periods the process of Islamization in France was through da'wah and marriage. Muslims continued to experience developments in France from year to year, especially through the da'wah and marriage, so it is estimated that in the following years, the Muslim population in France will experience a quantitatively significant. Along with the development of Islam in France, it also faces quite complicated problems, especially the prohibition of wearing the headscarf for Muslim women. Even so, it appears that Muslims in France today still exist and are able to survive against the situations and conditions that surround them.

Abstract

The Arabic language learning strategy is a series of efforts made by the Arabic teacher to make the learning process run according to predetermined concepts. The concept that must be created by the teacher is learning that is effective, communicative, efficient, fun, innovative, and quality. To improve the development of learning Arabic in educational institutions, it is necessary to create innovative strategies from Arabic teachers so that learning objectives are achieved properly. The ability to communicate in Arabic is the main goal in language because the nature of language is speech or speaking, plus the demands of the world of work today, people must be able to communicate in foreign languages, one of which is Arabic. The research model used in this research is Classroom Action Research (CAR) using a qualitative descriptive approach that aims to improve the Arabic language writing skills of tenth tenth-gradents at Madrasah Aliyah Islamic Boarding School Al Ikhlas Addary DDI Takkalas by using an Active Knowledge Sharing Strategy which has unique characteristics. other strategies do not have, namely using a list of questions with various categories including defined words. MultipMultiple-choiceions about facts or concepts ask for possible attitudes or actions. Complete sentences or match. Teachers can include some or all of the categories in making a list of questions. In accordance with the type of research chosen, namely action research, this research uses the action research model from Kemmis and Taggart, which includes planning (planning), implementation (acting), observation (observing or monitoring), and reflection (reflecting or evaluating). These four main steps form a cycle. Action research is an ongoing strategy. Learning using the Active Knowledge Sharing strategy can improve students' writing skills in class X Madrasah Aliyah Pondok Pesantren Al Ikhlas DDI Takkalasi in Arabic subjects. This is shown by the data before it is applied and after it is applied, thus answering the action hypothesis in the research that has been done that the application of the Active Knowledge Sharing strategy can improve Arabic writing skills in class X Madrasah Aliyah Pondok Pesantren Al Ikhlas Addary DDI Takkalasi Barru Regency

Abstract

The aims of this research are (1) to know the response of moral philosophy to contemporary ethical thinking (2) to know the position and response of moral philosophy to contemporary ethical thinking (3) to know the solutions to contemporary problems. The type of research used in this research is qualitative research. This study uses a library study approach because it collects data from books, journals, the internet, or other written literature as a basis for writing. The results of this study indicate that: (1) the response of moral philosophy to contemporary ethical thinking is that the study of morality and ethics has the same goal but has differences in terms of defining its goals. Ethics as part of philosophy bases its theory on relative logic while moral philosophy bases it on transcendent revelation (2) when ethics is used as a sub of philosophy, ethical philosophy will include moral philosophy. Morals are not ethics but they both have something in common, that is, they both discuss good and bad issues. The difference is that morals are closer to manners and are applicable in nature, while ethics tend to be more philosophical (3) Solutions to contemporary problems: first, it is necessary to uphold justice as an ethical solution. Second, the need to develop a caring and responsible character. Third, the need for socialization and teaching of moral philosophy from an early age.

Abstract

One of the efforts of Islamic law to elevate the dignity of women is to oblige a man who will become her husband to give her a dowry. Apart from being an obligatory right for him, dowry is a respect for the rights of a woman, dowry is not intended as a self-respect for a woman. Mahar and dui' menre' of the Bugis community in Sidenreng Rappang Regency according to the reality that from the preparation of the proposal until the prospective groom prepares the dowry and dui' menre' from 2018 to 2020 it is a habit that has been ingrained in society that dui' menre ' is one of the things that must be fulfilled in carrying out every marriage so dui' menre is very difficult to make changes. The research method used is a qualitative method, by approaching existing theories, such as Theory of Maqasid Shari'ah, Theory of Al 'Urf, Social Law Change Theory and Youth Perception. the conclusion obtained from this study is that Giving dui' menre' based on Islamic law is mubah or permissible because in general dui' menre' is only a tradition, but mahar and dui’ menre’ in a Bugis traditional marriage are an inseparable unit. Youth in Sidenreng Rappang Regency do not fully understand dowry and dui' menre'. Especially in determining the dowry and dui' menre' because almost all young people who get married only use a gold ring as a dowry while the dui' menre' is even higher in value than the dowry.

Abstract

In Islam, marriage between a Muslim man and a non-Muslim woman is absolutely prohibited. If in a marriage there is a divorce because the wife is out of her religious belief (apostasy), then there is a dispute over the authority of whether the wife can carry out maintenance in the form of care for her child or not. The majority of mazhab scholars allow infidel wives to perform hadhanah on the grounds that mothers have more love for their children. However, Wahbah Az-Zuhaili in his book Fiqhul Islami waadilatuhu, argues that the right to hadhanah is not stipulated for an apostate wife. Abstract

The main study in this thesis is the dynamics of judges' considerations in determining the dispensation of marriage at the Enrekang Religious Court. Ideally, marriages are carried out in accordance with existing regulations, but there are still opportunities provided by the state for prospective brides and families/guardians of prospective brides who still wish to enter into underage marriages. Data at the Religious Court of Enrekang every year there has been an increase in marriage dispensation cases being handled in the last 4 years. In 2017, 35 cases were received, in 2018, 36 cases were received, but in 2019 there was a spike in cases as many as 42 cases, this was as a result of the enactment of Law no. 16 of 2019 and in 2020 as of July 10 2020 there have been 70 cases that have been submitted. This type of research is field researchqualitative research methods through normative juridical and sociological juridical approaches.The paradigm of this research is constructivist. Data sourceprimary is the determination of marriage dispensation andthe testimony of the judges, while secondary data comes from scientific books, accredited journals, theses, dissertations and documents related to the object of research. The research instruments are observation guidelines, interview guidelines and documentation tools.Data collection techniques areobservation, in-depth interviews and documentation. Data processing techniquesby describing it in the form of sentences that are orderly, coherent, logical, not overlapping and effectivewhile data analysis includes:data checking, classification, verification, data analysis, conclusion. As for tthe technique of testing the validity of the data is using a triangulation technique. The results of the study showed that (1) the discrepancy between the applicant's expectations and the request for a marriage dispensation was not granted in accordance with the Marriage Dispensation Stipulation of the Enrekang Religious Court, indicating that there was a social conflict contained in the stipulation. And the applicant still marries her child with her future husband but is not registered at the Office of Religious Affairs or married in an unregistered manner which will have a social impact because there is no recognition from the state, problems in managing population administration and others. (2) The factors considered by the judge in determining the dispensation for marriage at the Enrekang Religious Court are psychological, health, educational and economic factors. (3). The dynamics in determining the marriage dispensation at the Enrekang Religious Court can be seen in the determination of the marriage dispensation, differ from one case to another. Because sometimes judges differ in giving legal considerations to a case. If there is a difference of opinion in an assembly, a vote is made on the case by following the majority vote after going through deliberation. After the entry into force of PERMA No. 5 of 2019 which regulates the settlement of marriage dispensation cases is a single judge, this will reduce the complexity in examining and determining marriage dispensation. This provision has been enforced at the Enrekang Religious Court since the date of its stipulation. If there is a difference of opinion in an assembly, voting will be carried out on the case by following the majority vote after going through deliberation. Abstract

Requests for dispensation of marriage at the Sidenreng Rappang Religious Court have increased from year to year, and in 2019 there were 222 cases. describe the development of mating dispensation. (2). Analyzing the background to the marriage dispensation application, and (3). Describe and analyze the judge's consideration of the intent of the Marriage Law in article 7 paragraph (2) of Law Number 16 of 2019 concerning amendments to Law Number 1 of 1974, because the intention of deviation is not explained, so a separate interpretation is needed from the Judge. And how the Judge in his considerations must prioritize and guarantee the best interests of the childfulfilled, so as to suppress early marriage. This type of research is descriptive qualitative, the research location is at the Sidenreng Rappang Religious Court, for primary data sources, namely copies of decisions, marriage laws, Judges, Registrars and Justice Seekers and secondary data sources, namely from Annual Report documents and LKjIP Court case data Religion Sidenreng Rappang, several books as references. To solve the problems in this thesis the author uses the theory of judges' considerations (Mukti Arto 2007), this is also supported by the maqashid al-Syariah theory to parse Islamic law against requests for dispensation of marriage. Based on the results of this study, the authors formulated conclusions (1). The dispensation for marriage at the Sidenreng Rappang Religious Court has always increased from year to year and in 2019 experienced a very sharp increase. (2). The background is cultural, educational, economic, environmental and pregnant outside of marriage. (3). Juridical analysis of the legal considerations of the judges of the Religious Court of Sidenreng Rappang regarding dispensation of marriage examines article 7 of the Marriage Law Number 16 of 2019, guided by PERMA Number 5 of 2019 as a guideline for adjudicating applications for dispensation of marriage, and based on fiqhi principles and paying attention to maaqashid al-Syariah. It turned out that it ignored several administrative requirements that could support the judge's considerations in realizing and guaranteeing the best interests of the child.

Abstract

This thesis discusses the use of communication technology to be able to become a solution and a means to support the effectiveness and efficiency of the peace process in online mediation in the Religious Courts. The objectives of the thesis research include: (1) to find out the trend of divorce cases being sued in the Religious Courts, the urgency of implementing and the effectiveness of implementing online mediation in the era of the Covid-19 pandemic. (2) to determine benchmarks for the effectiveness of mediation in the Religious Courts and (3) to determine the effectiveness of online mediation for contested divorces in the Religious Courts during the Covid-19 pandemic era. This type of research is field research and development (Research and Development) with a sociological juridical approach. The primary data source is in the form of interview data from three informants, namely, the Deputy Chairperson of the Court and the Mediator and is supported by observation and documentation in the form of files or documents related to divorce cases being contested at the Class 1 B Parepare Religious Court. The data in this study were analyzed qualitatively descriptively by testing the validity of the data using the triangulation technique. The results of this study indicate that (1) during the Covid-19 pandemic, the tendency for divorce cases to be sued at the Parepare Religious Court did not experience a significant change in the number of cases, only in April and May there was a decrease in the number of divorce cases due to the government's policy of restrictions related to emergencies health and the policy of the Parepare Religious Court which limits the number of cases that justice seekers wish to register. (2) Five factors that influence law enforcement, these five factors become benchmarks for measuring the effectiveness of mediation in the Religious Courtsnamely, legal factors, law enforcement factors, infrastructure factors, community factors and cultural factors. So that in divorce cases the benchmark for the success of mediation is the number of cases revoked (3)Mediation conducted online has not been effective as an alternative to dispute resolution in an effort to reconcile the parties who wish to file for divorce, so it is necessary to update the law regarding the regulations governing online mediation which are equipped with telecommunication infrastructure, security systems, and online mediation institutions, especially during the Covid pandemic -19.
