Abstract

Penelitian ini membahas tentang peran Badan Pengawas Pemilihan Umum (BAWASLU) di Kota Parepare dalam pelaksanaan pengawasan partisipatif dengan berpedoman pada Undang-Undang Nomor 7 Tahun 2017 tentang Pemilihan Umum. Adapun metode yang digunakan dalam menyusun penelitian ini yaitu metode kualitatif dengan menelaah hukum serta melihat fakta yang terjadi di lapangan, serta menggunakan sumber data data primer dan sekunder. Hasil penelitian ini menunjukkan bahwa peran Badan Pengawas Pemilihan Umum Kota Parepare dalam pelaksanaan pengawasan partisipatif telah dilaksanakan sesuai dengan amanah Undang-Undang Nomor 7 Tahun 2017 melalui pengawasan yang melibatkan masyarakat dengan merangkul seluruh elemen masyarakat, tokoh agama, maupun organisasi pemerintah. Badan Pengawas Pemilihan Umum Kota Parepare dalam pelaksanaan pengawasan partisipatif berbasis teknologi untuk memudahkan masyarakat dalam melaporkan dugaan pelanggaran pemilu. Selain itu, Badan Pengawas Pemilihan Umum Kota Parepare juga menjalankan program-program yang mendukung jalanya pengawasan partisipatif.

Abstract

Tulisan ini merupakan tulisan yang bergerak sebagai laporan pengabdian kepada masyarakat dari program studi hukum tata negara. Target kegiatannya adalah untuk mengadakan reformulasi penyusunan rancangan peraturan desa di Kecamatan Mattiro Bulu Kabupaten Pinrang. Hal ini penting untuk dilakukan dengan menilai bahwa minimnya pembentukan peraturan desa pada desa yang berada di Kecamatan Mattiro Bulu. Hal tersebut terjadi karena disebabkan polemik kurangnya tenaga ahli dan tidak terbentuknya budaya hukum yang sesuai dengan budaya hukum yang ada dalam mekanisme formiil dalam pembentukan peraturan desa yakni Undang-Undang No. 16 Tahun 2014 tentang Desa juncto Peraturan Pemerintah No. 43 Tahun 2014 tentang Peraturan Pelaksana Undang-Undang No. 16 Tahun 2014 juncto Permendagri No. 111 Tahun 2014 tentang Pedoman Teknis Peraturan Desa. Metode yang digunakan yakni metode ceramah dengan mengaktifkan ruang diskusi dengan mekanisme tanya jawab antara pemateri dan peserta. Adapun peserta yakni Kepala Desa dan Ketua Badan Permusyawaratan Desa dari seluruh Desa di Kecamatan Mattiro Bulu Kabupaten Pinrang. Hasil yang diperoleh yakni adanya pemahaman baru yang muncul dari unsur pemerintahan desa tentang penyusunan peraturan desa baik secara materiil maupun formiil.

Abstract

Penelitian ini menganalisis mengenai wewenang pemerintah Desa dibidang pertanian yang ditinjau dari perspektif Undang-Undang Nomor 19 Tahun 2013 tentang Perlindungan dan Pemberdayaan Petani. Metode yang digunakan dalam penelitian ini yaitu pendekatan kualitatif dengan subjek pemerintah Desa dan masyarakat petani. Sedangkan teknik pengumpulan data dilakukan melalui observasi, wawancara dan dokumentasi. Hasil penelitian ini menunjukan bahwa pelaksanaan kewenangan Pemerintah Desa Kulo dalam pemberdayaan Petani Desa Kulo Kecamatan Kulo Kabupaten Sidrap telah berjalan dengan baik. Terdapat beberapa pelaksanaan kewenangan yang bersifat substantif dalam pemberdayaan Petani oleh Pemerintah Desa seperti penyaluran informasi, pelatihan dan pendidikan, penyediaan fasilitas, dan penguatan kelembagaan Kelompok Tani, pengawasan dan pelaksanaan distribusi bantuan pupuk, serta pembimbingan Petani. Pemerintah Desa Kulo juga melakukan kegiatan pelatihan pembuatan pupuk kompos dan penggunaan alat pertanian modern seperti handtracktor, robot panen padi dengan melakukan sinergitas dengan Dinas Pertanian.

Abstract

The background of this research is the inability to overcome the problems that have arisen after the Constitutional Court Decision Number 100/PUU-XII/2015. The reason is, this decision raises many problems, especially regarding the rise of single candidates that have emerged. The purpose of this research is to find out the implications of the Constitutional Court's decision Number 100/PUU-XIII/2015 for regional elections. This study uses normative juridical research methods using primary and secondary legal materials. The data collection used was library researchwhichwas conducted on various data that has relevance to the implications of the Constitutional Court decision Number 100/PUU-XIII/2015 on the local elections. This study uses a statutory approach (statute approach), and a conceptual approach (conceptual approach). The results of this study indicate that das sein and das sollen are not in sync, because after the decision it only creates new phenomena which are considered to undermine democratic values. Even so, in reality in PKPU the implementation of single candidate and empty box regional elections does have rules. However, there is no certainty regarding the regulation regarding the mechanism for holding regional elections with a single candidate if the problems in it are deadlocked.

Abstract

During Covid-19 Pandemic, the election in Indonesia was still carried out. However, there had previously been a withdrawal of the schedule. Among those who conducted the election was the Surabaya mayoral election. In this case, the KPU of Surabaya city is obliged to act on voter data collection. This article discusses the voter data for Surabaya mayoral elections during the Covid-19 pandemic from the fiqh al-siyasah perspective. The research is field research with qualitative data processing. Data is collected with observations, interviews, and documentation and then analyzed by fiqh al-siyasah. This study results in implementing the updated voter data of the Surabaya mayoral election in 2020; KPU of Surabaya city used conducting Voter Data Determination (DPT). It’s based on legislation Number 10 of 2016 concerning the election of Governors, Regents, and Mayors. Updating voter data on the Surabaya election by KPU of Surabaya City is according to the concept of fiqh al-siyasah. KPU of Surabaya city applies the principles of fiqh al-siyasah, honesty, transparency, and supervision, in the data collection of voters to achieve public benefit. This is according to the concept of tasharruf al-imam ‘ala al-ra’iyyah manuth bi al-mashlahah (the leader’s policy on people must align with the public interest).

Abstract

Artikel ini mengkaji fenomena perkawinan beda agama di Indonesia pada aspek yuridis formal, konsep HAM, dan hukum Islam. Tujuan penelitian ini untuk menganalisis arah politik hukum pengaturan perkawinan beda agama dalam sistem hukum Indonesia. Jenis penelitian ini yakni library research (penelitian kepustakaan) yang berbentuk penelitian hukum normatif dengan menggunakan pendekatan peraturan perundang-undangan (statue approach), pendekatan kompratif (comparative approach), dan pendekatan konspetual (conseptual approach). Hasil penelitian ini menunjukkan bahwa: (1) Sistem hukum Indonesia belum mengatur secara expressis verbis klausal perkawinan beda agama secara komprehensif sehingga menibulkan ketidakpastian hukum dan hermeneutika hukum yang tumpang tindih; (2) Konsep perlindungan dan penegakan HAM di Indonesia bersifat partikularisme sehingga pembatasan hak perkawinan beda agama harus diintegrasikan dengan norma agama dan norma hukum; dan (3) Perkawinan beda agama menurut hukum Islam hukumnya haram, terkecuali pernikahan antara pria muslim dengan wanita Ahli Kitab. Akan tetapi, sebagian besar Ulama kontemporer berpendapat bahwa wanita Ahli Kitab sangat sulit ditemukan saat ini karena ketiadaan standarisasi yang jelas dan bersifat progresif sesuai perkembangan sosial dan norma agama komptemporer. Bahkan beberapa organisasi Ulama kontemporer mengharamkan perkawinan beda agama tanpa pengecualian. Kata kunci: Perkawinan Beda Agama, Sistem Hukum, Hak, Islam

Abstract

Pemilu serentak di Indonesia merupakan salah satu momen penting dalam perjalanan demokrasi negara ini. Sejak era reformasi pada tahun 1998, Indonesia telah berhasil melaksanakan beberapa pemilu serentak yang melibatkan pemilihan presiden, anggota parlemen, dan tingkat pemerintahan daerah. Pemilu serentak ini melibatkan jutaan pemilih dan melibatkan berbagai pihak, termasuk penyelenggara pemilu, partai politik, calon, dan masyarakat secara luas. Metode penelitian yang diterapkan dalam artikel ini adalah pendekatan kualitatif yang digambarkan melalui laporan verbal untuk menjelaskan dan menggambarkan informasi yang telah dikumpulkan. Sumber data dalam penelitian ini dibagi menjadi dua jenis, yaitu sumber data primer yang diperoleh secara langsung dari lapangan, dan sumber data sekunder yang merupakan informasi yang sudah ada sebelumnya.Tantangan keadilan dalam pemilu serentak di Indonesia memiliki dampak yang signifikan terhadap integritas proses demokratis. Ketidakadilan dalam pemilihan, seperti adanya praktek kecurangan, distribusi sumber daya tidak merata, atau ketidaknetralan penyelenggaraan pemilu, dapat merusak integritas pemilihan dan mengurangi representativitas hasil pemilihan. Ketika pemilih merasakan adanya ketidakadilan, mungkin kehilangan kepercayaan terhadap sistem demokrasi dan meragukan legitimasi pemerintahan yang dihasilkan dari pemilihan tersebut. Untuk mengatasi tantangan keadilan dalam pemilu serentak di Indonesia, perlu adanya komitmen yang kuat untuk memperkuat integritas dan representativitas proses demokratis.

Abstract

This article discusses the results of research related to cases of domestic violence in the Arso Religious Court, the causes of which include physical violence, economic violence, psychological violence, sexual violence, and spiritual violence. This research was conducted to find out the causes and resolution of cases of domestic violence that resulted in divorce. This research was conducted for 2 months (June-August 2022) with the research location in Keerom Regency (Arso Religious Court). The results of the study explain that the form of Divorce Case Settlement Due to Domestic Violence in the Arso Religious Court is by advising through trials or mediation outside the court and if the peace process does not succeed in reaching an agreement between the two parties, then the process of examining the case is continued in court using the principle of personality to-th Islam, the principle of freedom, the principle of the obligation to reconcile, the simple principle of fast and low cost, the principle of closed court hearings for certain cases, and the principle of equality before the law. As for the legal consequences for victims of domestic violence at the Arso Religious Court, namely that the plaintiff may sue/ sue for their rights post-divorce, namely past income, iddah maintenance, mut'ah, child custody, child maintenance and other assets.

Abstract

This study aims to examine the overlapping authority between the Ministry of Home Affairs and the Ministry of Village and Development of Disadvantaged Regions, Transmigration and Ministerial Regulations issued can disrupt the constitutional system of the Republic of Indonesia, especially related to the system and hierarchy of applicable laws and regulations. At the local level, such conditions create difficulties for village governments as technical implementers of policies issued by several ministries at once. The conflict between Ministerial Regulation norms and PDTT Amendments makes village governments as stakeholders feel confused about which laws and regulations will be used as guidelines. The type of research used is normative juridical research with a conceptual approach. The results obtained are based on the perspective of legal politics and legal harmonization analyses of two things. First, overlapping authorities and ministerial regulations occur because the Ministry of Home Affairs and the Ministry of Village Affairs have different perceptions about who has more authority to manage village affairs. Second, harmonization of the law of the Ministerial regulation that regulates villages can be realized through the political law of amending Law Number 6 of 2014 concerning Villages and the issuance of a new Presidential Regulation that specifies that there is only one ministry that handles villages. In this context, the author considers that village affairs should be more appropriately under the authority of the Ministry of Villages and Development of Disadvantaged Regions, Transmigration.

Abstract

This article explores the dynamics of Indonesian diplomacy in the Israeli-Palestinian conflict. Despite ongoing tensions and armed confrontations between Palestinian fighters and the Israeli military, Indonesia has consistently advocated for Palestinian independence through a two-state solution. The historical ties between Indonesia and Palestine, coupled with the academic connections between Palestinian scholars and Indonesian students studying in Egypt, have strengthened the diplomatic relationship between the two nations. Indonesia's active role in supporting Palestinian recognition of Indonesian independence, alongside Egypt, remains relevant today. Using conflict resolution theory as a framework, this article delves into Indonesia's diplomatic efforts to address the Israeli-Palestinian conflict. Notably, Indonesia has actively participated as a non-permanent member of the UN Security Council, opposing policies such as US President Donald Trump's decision to recognize Jerusalem as the capital of Israel and relocate the embassy there. The findings illustrate Indonesia's multifaceted role in conflict resolution, encompassing positions as a co-sponsor, facilitator, mediator, participant, initiator, actor, motivator, and justifier in its endeavors to help resolve the Israeli-Palestinian conflict. By presenting these insights, the article aims to contribute to the understanding of Indonesia's unique diplomatic contributions to the ongoing conflict while avoiding plagiarism.
