Abstract

Terorisme merupakan kejahatan terorganisir yang memiliki jaringan nasional dan internasional dan sangat meresahkan masyarakat. Salah satu upaya pencegahan tindak pidana terorisme adalah dengan melakukan deradikalisasi narapidana, mantan narapidana dan keluarganya dengan tujuan mengubah paham radikalnya menjadi paham nasional. Dalam Peraturan Kepala Kepolisian Negara Republik Indonesia Nomor 5 Tahun 2019 tentang Perubahan Atas Peraturan Kepala Kepolisian Negara Republik Indonesia Nomor 6 Tahun 2017 tentang Susunan Organisasi Dan Tata Kerja Unit Organisasi di Mabes Polri yaitu Densus 88 Antiteror Polri yang memiliki subdirektorat identifikasi dan sosialisasi (ditidensos) yang bertugas melakukan deradikalisasi narapidana, mantan narapidana dan keluarganya.Penelitian ini menggunakan penelitian hukum normatif yang diperkuat dengan serangkaian wawancara terstruktur dengan pertanyaan dan sumber yang telah ditentukan sesuai dengan aspek dan masalah yang diteliti. Pengumpulan data dilakukan dengan metode studi pustaka dan wawancara dengan narasumber dari Mabes Polri.Kesimpulan yang diperoleh dari: (a) Hasil Deradikalisasi Narapidana Terorisme dan Mantan Narapidana Terorisme yang dilakukan oleh Detasemen 88 Antiteror Polri di Daerah Istimewa Yogyakarta adalah terciptanya hubungan baik dan keterbukaan antara narapidana, mantan narapidana dan keluarganya dengan Tim Identitas Sosial. (b) Kendala dalam deradikalisasi Narapidana Terorisme dan Mantan Narapidana Terorisme yang dilakukan oleh Detasemen Antiteror Polri di Daerah Istimewa Yogyakarta adalah belum adanya peraturan atau undang-undang yang tegas dalam mengatur narapidana, keluarga berkewajiban untuk berpartisipasi dalam proses deradikalisasi. Selain itu, minimnya kerjasama antar masyarakat di beberapa tempat tinggal para napi membuat proses deradikalisasi sedikit terganggu, hambatan dalam proses pencegahan tindak pidana terorisme juga akan datang dari kemajuan teknologi, karena teknologi saat ini sangat memudahkan penyebaran radikalisme.

Abstract

This study aims to analyze and empirically search the information about the exercise of the police officer’s duties and authorities in handling a mass rally in the jurisdiction of the Yogyakarta City Police Department. It also aims to know the obstacles faced by the police officers in handling a mass rally in the jurisdiction of the Yogyakarta City Police Department. This study is normative research that reviews legal norms related to the object of the research. This study was conducted in the jurisdiction of the Yogyakarta City Police Department. This study employed secondary data which is a primary legal material in the form of legislation and the primary data from the result of the interview with the interviewee as the support for the primary legal material. The data were gathered by conducting literature study and field research. The data were analyzed qualitatively. Based on the result of the research, it can be concluded that the intensity of the event of mass rallies in the jurisdiction of the Yogyakarta City Police Department is high. The mass rally was done 172 times in 2015, 146 times in 2016, and 152 times in 2017. The actions taken by the police officers of Yogyakarta City Police Department in exercising the duties and authorities in handling the mass rally consists of 3 steps including preemptive step being initiative to precede the mass rally by persuading and communicating to reduce conflict, preventive step (preventing the anarchism in the mass rally and keeping the mass rally save, conducive, and well controlled, and repressive step some steps are taken to secure the mass rally through service and security procedures of expressing an opinion in public or a mass rally. There are two factors of the obstacles faced by the police officers in handling a mass rally in the jurisdiction of the Yogyakarta City Police Department. The first is the internal factors which are influenced by the lack of Republic of Indonesia Police personnel in Yogyakarta City Police Department Satsabhara, the different intellectuality and knowledge level of Yogyakarta City Police Department members and psychological condition and the ability to control the emotion of each member of Police Department. The second is the external factors which are influenced by the lack of coordination with the Police Department, the field condition and setting of the mass action in doing the rally, the lack of legal knowledge of the mass and the image of a police officer which is always bad in the eye of protesters.

Abstract

The imprisonment system initially emphasizes elements of revenge and enmity. But now the system of imprisonment is seen no longer in line with the concept of rehabilitation and social reintegration that aims to make inmates acceptable again by the community and no longer repeat the mistakes he made. One of the stages of coaching that every prisoner must take is the stage of social reintegration. Every prisoner who is in Rumah Tahanan Negara Kelas IIA Yogyakarta must follow in an orderly manner every specific guidance and activity program conducted by Rumah Tahanan Negara Kelas IIA Yogyakarta. If in the coaching program runs well, then the inmates who follow the program are entitled to an appreciation, one of which is the provision of Conditional Leave.The results obtained in this study are the mechanism of the release of conditional leave declaration and the implementation of conditional leave in Rumah Tahanan Negara Kelas IIA Yogyakarta.

Abstract

The purpose of this study was to find out and assess the basis of consideration of Wates District Court Judges in deciding cases of Ultra Extra High Voltage Channel SUTET corruption under a special minimum threat  and the legal consequences arising from the existence of a mild criminal verdict in the corruption case of the Ultra Extra High Voltage Channel SUTET.This research is empirical legal researchnamely research conducted by conducting field research to obtain primary data as its main resource and secondary data as a supplement. Data that has been collected from the results of research, both library research and field research, will be analyzed qualitatively. The results of this study are: 1 In Article 2 paragraph 1 of Law Number 31 Year 1999 as amended and supplemented by Law Number 20 of 2001, it has been explicitly stipulated regarding the minimum criminal sanctions that must be imposed on the perpetrators non-imprisonment, namely 4 years in prison and a fine of at least Rp. 200,000,000. Although in Article 2 paragraph 1 of Law Number 31 of 1999 as amended and supplemented by Law Number 20 of 2001 which explicitly has determined the minimum criminal sanctions that must be imposed on the perpetrators of the crime, the Judge have a consideration that in order to be able to create a decision that can reflect a judge's sense of justice in deciding each case, it should consider aspects of legal certainty, namely implementing legal justice must also consider moral justice and social conditionsofthe community social justice and 2 In accordance with the aim of punishmentthat gives a sense of deterrent to the convict, convictions solely as a reward of an unlawful act with an emphasis on policing the community, criminal special minimum impact on the lives of the accused while in custody and after the defendant was released from prison and return to the community. Here it can be said impact conviction against the accused of corruption are disconnected special minimum, despite the judge's decision only ruled on special minimum, but the impact of acts of corruption defendant heavier than the result of a criminal act of corruption, because of concerns about the life of the accused later in the general public, among othersloss ofhonor, impoverishment oftheaccused,administrativesanctions he received because of the corruption of corruption itself.

Abstract

This thesis is entitled "The Role of Clerks in the Practice of the Indonesian Criminal Justice System". The thesis with the title aims to find out and analyze the existence of the Registrar in the practice of the Indonesian criminal justice system and to find out the role of the ideal clerk in the practice of the Indonesian criminal justice system. This research is a normative study with a statutory approach. Source of data in the form of secondary data consisting of primary legal materials, secondary legal materials and tertiary legal materials. The data collection method uses library research (interview) and interviewees. Primary legal materials and secondary legal materials were analyzed using legal analysis methods. The purpose of the above method can be interpreted that the research method is a knowledge to explore the truth of a methodological systematically in accordance with applicable research guidelines in scientific papers. Increasing the credibility and transparency of the judiciary is a goal of the Supreme Court in an effort to realize a judiciary that can provide maximum public service. A Registrar and officials under him are fully responsible for the administrative duties carried out by the commander of the case until the case is legally binding on the Chief Justice and always under the command of the Chief Justice. Based on this difference in duties and responsibilities between a Judge and the duties of a Court Clerk. In the criminal justice process a lot of clerks' tasks especially with the advancement of information technology as it is now many applications launched by the Supreme Court of the Republic of Indonesia. from E-Court, E-Litigation, Case Search Information System (SIPP) there are some Courts that have used the Audio Text Recording Application or better known as ATR. The role of the court clerk is not only as a courtesan preacher but has a very important role in the practice of the criminal justice system.

Abstract

Murabaha contract is a contract of buying and selling goods by stating the acquisition price and profit margin agreed by the seller and buyer. The mechanism for determining customers is found to have turned out to be different operating standards between Islamic banks. As the results of research murabaha contract clause on Islamic banks in Magelang. There are at least two ways, namely through the determination of the court and through the determination based on the contract clause. This research is an empirical normative legal research that uses literature studies and field studies at PT. Magelang State Savings Bank and PT. Islamic People's Financing Bank Meru Sankara Magelang. Savings on problematic financing as a form of legal protection for sharia banking customers can be done by several methods, namely: rescheduling, reconditioning, restructuring, combination and executing collateral sale of collateral through auction. There are 5  forms of legal protection for sharia banking customers in Murabaha contract, namely: protection of sharia principles and usury practices, protection from manipulation of financing agreements, protection from takwid  takzir expenses and financing risks, protection of financial guarantees from insurance companies, and protection in financing contract disputes.

Abstract

Abstract This thesis aims to review and analyze the application of the law against children of narcotics offenders in the jurisdiction of the Yogyakarta City Resort Police and review and analyze the factors that affect the application of the law to children of narcotics offenders and how to countermeasures. Used type of research is normative juridical with conceptual, statutory and case approaches. The method of analcys is qualitative descriptive. Research result was Yogyakarta City Resort Police applied the law to the children of narcotics offenders by applying Diversion in reference to Law Number 11 of 2012 on the Juvenile Criminal Justice System. Diversion stage with mediation and deliberation with related elements. Factors that affect the application of the law to children of narcotics offenders include internal and external factors. Internal factors (Law enforcement officers and facilities), while for external factors (There are no implementing rules on Diversion, Society and culture). As for the efforts made to overcome these obstacles can be done, namely: Increasing understanding of the concept of diversion that is fair restorative; Increased education; Providing personality training; Have to make a change.

Abstract

Tujuan Penelitian.Tujuan Objektif. Untuk mengetahui dan menganalisis perlindungan hukum bagi nasabah lembaga keuangan berbasis teknologi informasi di Indonesia. Untuk mengetahui dan menganalisis upaya terkait layanan pinjaman uang berbasis Financial Technology dalam proses penyelesaian hukum yang dapat ditempuh debitur.Metode Penelitian.Dalam penelitian ini digunakan beberapa metode penelitian sebagai sarana untuk memahami objek masalah. Metode yang digunakan adalah sebagai berikut: Dalam penelitian ini menggunakan jenis penelitian hukum normatif yang berfokus pada norma hukum positif yaitu “peraturan perundangan-undangan untuk menjawab isu hukum yang ditemukan akan dikaji dalam tataran dogmatik hukum, teori hukum dan filsafat hukum.”Hasil Penelitian diseluruh materi yang diuraikan mengenai permasalahan yang dikemukakan Menurut ketentuan Pasal 29 POJK 77/2016 Penyelenggara wajib menerapkan prinsip dasar dari perlindungan Pengguna yaitu: Transparansi; Perlakuan yang adil; Keandalan;Kerahasiaan dan keamanan data Penyelesaian sengketa Pengguna secara sederhana, cepat, dan biaya terjangkau. Selain itu wajib juga memperhatikan ketentuan Peraturan perundang-undangan lainnya seperti Undang-Undang Perlindungan Konsumen,Kesimpulan Berdasarkan pembahasan diseluruh materi yang diuraikan mengenai permasalahan yang dikemukakan tentang perlindungan hukum bagi konsumen lembaga keuangan financial technology di Indonesia, sebagai berikut: Upaya hukum dan penyelesaian sengketa yang dapat ditempuh debitur apabila mengalami permasalahan pada layanan pinjaman uang berbasis Financial Technology.

Abstract

Problematika status ganda hakim sebagai pejabat negara sekaligus sebagai pegawai negeri sipil memperngaruhi terhadap pelaksanaan tugas hakim.Tujuan penelitian adalah 1. Mengatahui implikasi status ganda hakim sebagai pejabat negara dan sebagai pegawai negeri sipil terhadap pelaksanaan tugas hakim. 2. Memberikan solusi tentang kemungkinan menjadikan status tunggal hakim yaitu sebagai pejabat negara.Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan penelitian Undang-Undang (statute approach) yang dilakukan dengan menelaah semua Undang-Undang dan regulasi yang bersangkut paut dengan isu hukum yang sedang ditangan. Pendekatan perundang-undangam ini  dilakukan untuk menalaah semua undang-undang dan regulasi yang berkaitan dengan penelitian ini. Pendekatan undang-undang ini akan memberikan peluang bagi peneliti untuk mempelajari adakah konsistensi, kesesuaian ataupun kontradiksi antara satu undang-undang dengan undang-undang lainnya. Selain pendekatan undang-undang penulis juga menggunakan pendekatan penelitian konseptual (consceptual approach) dan dianalisis menggunakan pendekatan kualitatif.Hasil penelitian menunjukkan sebagai berikut:Status ganda hakim sebagai pegawai nege ri sipil dan sekaligus sebagai pejabat negara berimplikasi pada independensi kekuasaan kehakiman sebab seluruh pegawai negeri sipil tidak terkecuali hakim harus tunduk kepada aturan-aturan serta program-program kepegawaian yang diterbikan oleh eksekutif sehingga ada potensi independensi kekuasaan hakim terdegradasi terlebih lagi jika hakim menangani perkara yang berkaitan dengan berkaitan dengan perkara peninjauan kebijakan eksekutif dan judicial review regulasi yang diterbitkan oleh eksekutif.Kemungkinan menjadikan status tunggal hakim yaitu hakim sebagai pejabat negara dapat dilakukan yaitu dengan merumuskan kembali Rancangan Undang-Undang Jabatan Hakim dengan status hakim sebagai pejabat negara murni dan memasukkan kedalam Program Legislasi Nasional (Prolegnas).

Abstract

Tujuan dari penelitian ini adalah untuk mengetahui implementasi aturan tentang hak-hak narapidana perempuan di Lapas Wanita IIB Yogyakarta pada masa pandemi Covid-19.Metode penelitian ini menggunakan penelitian yuridis empiris yaitu penelitian yang mengkaji ketentuan hukum yang berlaku dan yang terjadi dalam kenyataan di masyarakat. Pendekatan yang digunakan melalui pendekatan hukum normatif kualitatif dan lokasi dilakukan di Lapas Wanita IIB Yogyakarta.Hasil penelitian ini menunjukkan bahwa (1) Sebelum pandemi Covid-19, Lapas memenuhi tiga hal dalam implementasinya, pertama, aturan yuridis normatif tentang pemenuhan hak asasi manusia sejalan dengan konsep Non-Derogable Rights agar narapidana perempuan tidak pernah diperlakukan secara tidak manusiawi. Kedua, pemenuhan hak keperdataan dengan membuat program pembinaan yang diikuti oleh seluruh narapidana dewasa dan anak agar terjadi perubahan perilaku yang baik. (2) Selama pandemi Covid-19 ada 3 implementasi. Pertama, peraturan yuridis normatif terkait pemenuhan hak asasi manusia di Lapas adalah memberikan pelayanan yang maksimal tanpa diskriminasi kepada narapidana untuk mendapatkan akses sumber daya di bidang kesehatan. aman, berkualitas dan terjangkau. Kedua, pemenuhan hak keperdataan dilakukan dengan memberikan pelayanan maksimal namun diwajibkan 1) dengan mengukur suhu tubuh, 2) kewajiban Self Assessment Risiko COVID-19 dengan memakai masker, dan 3) mencuci tangan. Aturan ini juga berlaku untuk siswa pemasyarakatan, keluarga dan klien. Ketiga, dalam memenuhi realitas hak narapidana perempuan, Lapas menerapkan layanan berbasis online bagi narapidana dalam beberapa hal seperti pembebasan bersyarat, cuti sebelum bebas, dan cuti bersyarat bagi narapidana selama pencegahan Covid-19.
