Abstract

Peralihan atau pemindahan hak adalah suatu perbuatan hukum yang bertujuan memindahkan hak dari suatu pihak ke pihak lain. Tujuan penelitian ini adalah untuk mengetahui dan menganalisis mekanisme/proses peralihan hak atas tanah dalam bentuk jual beli, serta kendala-kendala yang dihadapi dari masyarakat pada proses peralihak hak atas tanah dalam bentuk jual beli di kantor Pertanahan Bolaang Mongondow Timur. Adapun Jenis penelitian yang digunakan oleh peneliti adalah penelitian empiris dengan pendekatan kualitatif, dan dianalisis secara deskriptif. Berdasarkan hasil Penelitian, peneliti berpendapat bahwa dalam Mekanisme Peralihan Hak Atas Tanah Dalam bentuk Jual Beli masih banyak mengalami kendala-kendala yang di hadapi kantor pertanahan Bolaang Mongondow Timur, Dan kurangnya kesadaran Hukum dari masyarakat itu sendiri mengenai betapa pentingnya proses mengalihan haknya dalam bentuk jual beli agar mendapatkan kepastian Hukum, sehingga masih banyaknya jual beli dibawah tangan, dikarenakan masyarakat berekonomi rendah dan kurang paham Akan Hukum dan betapa pentingnya Peralihan hak tersebut.

Abstract

Perkawinan incest yang terjadi di Indonesia dianggap tidak sah atau tidak mengikat hukum. Hal ini berarti perkawinan tersebut tidak diakui secara resmi oleh negara, dan ketentuan-ketentuan hukum perdata yang mengatur perkawinan dan hak waris tidak berlaku untuk perkawinan tersebut. Tujuan penelitian ini yaitu untuk mengetahui Tinjauan Hukum Hak Waris Anak Hasil Perkawinan Incest Menurut Hukum Perdata. Metode penelitian yang digunakan penulis adalah yuridis normatif. Tentang status hak waris anak dari pernikahan incest, jika di lihat dari pasal 28 ayat 2 dinyatakan bahwa keputusan pembatalan perkawinan tidak berlaku surut terhadap anak- anak yang dilahirkan dari perkawinan tersebut, maka anak incest tergolong pada anak yang sah dan berhak mewarisi sebagaimana anak sah pada umumnya, karena masih memiliki hubungan hukum terhadap kedua orang tuanya.

Abstract

Copyright law protection has basically been regulated in Law Number 19 of 2002 Concerning Copyrights. The Act has regulated in detail regarding copyright. However, in reality there are very many violations of copyright, especially violations committed via the internet. The research questions in this thesis are how to review Law Number 19 of 2002 concerning Copyright and Islamic Law concerning the status of copyright, what are the forms of copyright infringement carried out via the internet and how is the legal protection for copyright holders in Law Number 19 of the Year 2002 Concerning Copyright and Islamic Law. This study uses library research techniques (library research) and is in the form of descriptive analysis which is a systematic description of existing facts accurately and factually. From the results of the study it was found that copyright is among patents, trademarks and other rights in under intellectual property rights (IPR) protected by the state, in Islam also copyright is equated with haqq al-milk (ownership rights) which is a division of haqq al-māl because Islam recognizes copyright as al-māl (property). Law Number 19 of 2002 concerning Copyright stipulates penalties for copyright violators in the form of a minimum fine of IDR 1,000,000 and a maximum of IDR 5,000,000,000 and also imprisonment for a minimum of one month in prison and a maximum of seven years in prison. In Islam it has also been regulated that copyright infringers are subject to ta'zīr laws in the form of jild (flogging), ḥabs (imprisonment) or other penalties which can be heavier or lighter. Thus, it can be concluded that the existence of copyright is recognized and protected by Law Number 19 of 2002 concerning Copyright and Islamic Law.

Abstract

Polyandry marriage is a form of marriage that is prohibited by Islam. This prohibition has been clearly stated in the Al-Qur'an and also the hadith of the Prophet. The scholars also agreed on its prohibition. This marriage also contradicts Law Number 1 of 1974 and article 40 of the Compilation of Islamic Law. However, in reality, polyandry marriages have occurred in Biau District, Buol Regency. The main problems that will be studied in this thesis research are as follows: The Role of the Biau District Office of Religious Affairs in Overcoming Polyandry Marriage Problems in Buol District. Empirical legal research that combines primary data obtained in the field, especially regarding, with primary data derived from primary legal materials, includes primary, secondary and tertiary data. The results of this study, the first is that polyandry marriages that occur in Biau District, Buol Regency are caused by ignorance of the guardian, also the will of the perpetrator himself, low level of knowledge, and also administrative factors which then make this forbidden marriage able to be registered and obtain a marriage book . And the role of the KUA itself is in conducting counseling and fostering the understanding of the people of Biau District, Buol Regency regarding the good and bad of polyandry marriages.

Abstract

Penelitian ini bertujuan untuk menganalisis jenis-jenis pelanggaran kedisiplinan tata tertib sekolah dan hukuman yang akan didapatkan jika melanggar kedisiplinan tata tertib sekolah.Jenis penelitian ini adalah penelitian kuantitatif dengan metode causal.populasi dalam penelitian ini adalah 131 siswa dan sampelnya sebanyak 49 siswa. Pengambilan sampel menggunakan teknik cluster random sampling. Pengumpulan data menggunakan teknik kuisioner. Hasil analisis regresi linear sederhana menunjukan bahwa hasil analisis dengan menggunakan SPSS 26. Dengan melihat nilai sig 0,416 > 0,05 dan nilai t hitung dan t tabel (0,832 < 1,677) dan pada tabel summary dengan melihat R Square = 0,083 atau 8,3%, jadi besar pengaruh kebijakan sekolah terhadap tingkat kedisiplinan tata tertib siswa MA Ma’arif NU Nurul Islam Pasirian adalah 8,3%. Abstract

Parenting style plays an important role in shaping children's learning achievement. It was found that an authoritative parenting style, which includes a combination of clear rules and emotional support, is associated with better learning achievement. Parents who are actively involved in their child's education, either through support at home or participating in school activities, also make a positive contribution to learning achievement. The purpose of this research is to find out whether there is an effect of parenting style on students' achievement in MAN 2 Probolinggo City. The method used is a quantitative method with the Simple Random Sampling approach. The sample that became the target of this study were students and their parents. The achievements of MAN 2 Probolinggo City students are very diverse, ranging from academic and non-academic fields. According to the results that have been researched by researchers, we found that there was an influence on the parenting style applied by parents on the learning achievement of MAN 2 Probolinggo City students. So that parents must be smart in determining or implementing step-by-step and appropriate parenting styles for their children, so that they become good individuals.

Abstract

Abstract The purpose of this research is 1) To determine and analyze the accountability for criminals of online fraud and criminal of conventional fraud which set in the Code of Criminal Law 2) To determine and analyze the juridical consequences of Article 28 paragraph (1 ) of the Code of Information and Electronic Transactions Article 378 of the Code of Penal, as well as providing insight into the crime of online fraud that uses the internet as the main medium. The result of study is the Article 378 of the Code of Criminal Law concerning criminal fraud can not be used to punish the online fraud criminals, there are obstacles in the way to punish the criminal sanctions on criminals such as limitation of the proof which limited by the Code of Criminal Procedure (Criminal Code) and jurisdiction. Given the shortcomings in the Criminal Code, Article 28 paragraph (1) juncto Article 45 paragraph (2) of Law No. 8 of 2011 on information and electronic transactions can be used to charge the criminals to take account for his actions in the case of criminal fraud online, because Article 28 paragraph (1) of the Act ITE is Lex Specialis of Article 378 which is Lex Generalis. Juridical consequences of using Article 28 paragraph (1) Code of Information and Electronic Transactions against Article 378 of the Code of Criminal Law on online fraud is both of article in a two code laws that override and exclude each other.

Abstract

The thesis entitled "The Effectiveness of Group Counseling Using Assertive Training Techniques in Improving Social Interaction in Adolescents at the Ar Rahman Drug Rehabilitation Center Palembang". The background of this research is that there are many teenagers who are still not brave or not used to interacting with fellow teenagers and their environment, social interaction is something that is very inherent in humans as it is known that humans are social beings, therefore social interaction becomes one of the inherent characteristics of everyday human life. This thesis aims to determine the level of social interaction in adolescents and the effectiveness of group counseling with assertive training techniques in increasing social interaction in adolescents at the ar Rahman drug rehabilitation center in Palembang. The approach in this research is quantitative research with the type of experimental research in which the research design is quasi-experimental one group pretest and posttest design. The population is 30 people, where the sampling technique is by looking at the age range from 13 to 20 years, so as to get a sample of 6 people from the entire population. The instruments used in this study are through questionnaires and documentation. Data analysis used Wilcoxcon test. The results of the first study show that the level of social interaction among adolescents is in the moderate category with a percentage of 66%. The results of the Wilcoxson test show that asymp.sig (2-tailed) is worth 0.027, so it can be concluded that group counseling with assertive training techniques is effective in increasing social interaction in adolescents at the Ar-Rahman Palembang drug rehabilitation center. Which means Hₐ is accepted and Hₒ is rejected.

Abstract

Anxiety in communicating in public is a condition in which individuals feel unsafe or unpleasant, followed by physical and psychological reactions due to fears of not being able to adapt or deal with situations when speaking in public that arise before or during public speaking. in public. The purpose of this study is to determine the description of anxiety in communicating in public in adolescents before individual counseling is applied, to determine the implementation of individual counseling in the anxiety of communicating in public among adolescents, and to determine the description of anxiety in communicating in public in adolescents after counseling. individual. This research approach is a qualitative approach with descriptive research methods. The subjects of the study were 3 teenagers. Data collection techniques were observation, interviews, documentation. Data analysis techniques, the Miller and Huberman models, collected data, presented data, and reduced data. The results of this study indicate that the physiological aspects of anxiety in communicating in public in adolescents are shaking, palms are sweaty, heart rate is beating faster, regarding psychological aspects it is difficult to express words when speaking, difficulties in conveying messages smoothly, and from a behavioral aspect namely walking around the room, unable to sit for a long time. The implementation of counseling is carried out in three stages, namely the initial stage, the middle stage, the final stage, counseling is given 6x meetings, showing changes in reducing anxiety when speaking in public, the client is able to overcome situations that make him anxious and can be relieved by suggesting himself everything will be fine. fine.

Abstract

Gadgets are sophisticated tools that present various news media, social networks, lifestyle information, hobbies, to entertainment that are presented online and offline, now successfully attracting a lot of public attention. It should be noted that gadgets have positive and negative impacts on humans, especially children. The positive impact for humans is that it is easier to find information, makes learning easier, and also makes work easier. While the negative impact is mental health problems such as anxiety disorders, difficulty focusing and depression, all of which can be caused by gadget addiction. The aims of the researchers in writing this journal are: to get a description of gadgets, to get a description of the function of gadgets and the types of gadgets, to get a description of the positive and negative impacts of using gadgets on children aged 0-5 years, to find out the role of parents in assisting children aged 0-5 years in using gadgets, and finally to get what tips people do in teaching good use of gadgets to children aged 4-6 years.
