Abstract

HAM dan negara adalah dua hal yang tidak dapat dipisahkan dalam hal menjamin stabilitas internal suatu negara. HAM menjadi pembatas untuk negara agar tidak bertindak sewenang-wenang terhadap warga negaranya. Negara berkewajiban untuk menghargai, melindungi dan memenuhi HAM warga negaranya. Tulisan ini bertujuan untuk menganalisis perlindungan HAM internasional dan bentuk tanggung jawab negara sehubungan dengan pemenuhan HAM WNI Eks-ISIS yang berstatus Stasteless. Tulisan ini menggunakan metode penelitian normatif berdasarkan kerangka hukum internasional. Hasil studi menunjukkan bahwa konsep perlindungan HAM Internasional dalam upaya melindungi hak-hak orang-orang tanpa kewarganegaraan sebagaimana diatur dalam Konvensi 1954 serta upaya untuk mencegah dan mengurangi keadaan tanpa kewarganegaraan yang tertuang dalam Konvensi 1961 belum menjadikan Indonesia sebagai negara yang berusaha untuk memenuhi HAM WNI eks-ISIS yang berstatus stateless. Kebijakan yang diambil oleh pemerintah Indonesia dengan tidak memulangkan dan mencabut kewarganegaraan WNI eks-ISIS menjadi suatu bentuk pelanggaran terhadap HAM. Pelanggaran yang terjadi akan menghasilkan sebuah bentuk tanggung jawab negara dalam pemenuhan HAM. Beberapa pilihan yang bisa dilakukan oleh Indonesia sebagai bentuk tanggung jawab dalam upaya pemenuhan HAM yaitu: (1) pemberlakuan prinsip exhaustion of local remedies; (2) pembentukan hybrid court; (3) penggunaan yurisdiksi International Criminal Court

Abstract

This study aims to provide policy recommendations in the legal context regarding regional needs for integrative problems so that the flexibility to open access to international cooperation is not only to promote regional potential but can empower that potential for sustainable development. The article was compiled using a juridical normative method supported by field data relating to the existing conditions in Gorontalo in terms of developing international law in the region, namely optimizing the role of the region in international relations as a consequence of the Regulation of the Minister of Foreign Affairs Number 3 of 2019 concerning General Guidelines for Foreign Relations by Local government. The results of the study indicate that strengthening diplomacy is part of the Gorontalo provincial government's efforts to get to know the personal identity of the region (regency and city) both in the context of local excellence and globally competent regional advantages and can even build future-oriented international relations. Sister cities or twin cities in the Gorontalo government will be one way to strengthen foreign diplomatic relations through international cooperation mechanisms that can enable the Gorontalo provincial government, both district and city, to play a strategic role to take advantage of the inter-governments/inter-federation state network. in other countries in order to realize the vision of good governance and the vision of a sustainable smart governance/smart city

Abstract

Sebagian besar masyarakat di desa Botubarani yang memiliki pemukiman di pinggir pantai dan pesisir belum menyadari adanya pengaturan tentang hak batas ruang dan hak pemanfaatan wilayah pesisir dan pantai. Paradigma masyarakat tentang penguasaan wilayah pesisir dapat dimanfaatkan untuk kesejahteraan dan kepentingan ekonomi seluas-luasnya oleh masyarakat setempat tanpa memperhatikan kelestarian lingkungan hidup. Implementasi program penyuluhan di desa Botubarani dilaksanakan dengan menggunakan metode sosialisasi. Tujuan yang diharapkan dari kegiatan tersebut adalah memberikan edukasi yang dapat mendorong pengetahuan, pemahaman, wawasan tentang penetapan batas ruang dan pemanfaatan wilayah pesisir khususnya pada masyarakat desa Botubarani. Penyluhan tersebut diterima dengan baik masyarakat hingga menghasilkan pembentukkan sebuah kelompok pemberdayaan masyarakat sebagai alternatif penegakkan hukum dan keamanan pesisir Botubarani.

Abstract

The current method that is very appropriate for limiting children's social interactions while preventing the practice of minor human rights violations is to get more intense in inviting children to actualize what they see and read into human rights theory through a case study approach. The research method used in this theory is the Creswell case study, the focus of the case study is the specification of the case in an event, whether it includes individuals, cultural groups or a portrait of life. The results of this study indicate that elementary school children more easily understand the theory that is transformed in the form of the case method by the teacher. This is because the case study approach is carried out based on practice or actualization through a good habit process.

Abstract

This study aims to determine the fulfillment of assimilation rights and integration rights to correctional students. The type of research method used in this study is empirical research with sampling using purposive sampling. This study also uses a qualitative approach and descriptive analysis techniques. The results of this study indicate thatIn the implementation of the fulfillment of the right of assimilation and the right of integration to correctional students, there are several obstacles, as for these obstacles, namely there is no guarantor of the correctional students, has register f records, Community Environment, excess capacity, minimal quality of officers and less bureaucratic processes. effective. The government carries out alternative non-prison punishments that can be carried out such as supervision and community service which is seen as more efficient than prison law because in achieving the goal of fostering or rehabilitating correctional students before finally being able to be free and return to life in the community and for the community.The community is expected to participate actively in the implementation of community programs, so that correctional students feel they can be accepted again in the community.

Abstract

This study aims to find out how the rights and obligations of children towards parents as objects of commercial content on TikTok according to the marriage law. The research method used is normative. The results of the study show that the rights and obligations of children towards their parents are based on the Marriage Law; children must respect their parents and obey their good wishes. And if the child has grown up, he is obliged to look after according to his ability, parents and family in a straight line upwards, if they need help. Legal consequences for children who do not carry out their alimony obligations towards parents, namely parents can submit a determination to the District Court and file civil lawsuits regarding unlawful acts (PMH) committed by children due to non-fulfillment of children's obligations in providing care to parents whether it's looking after and caring for parents in a healthy or sick condition, as well as providing a living and other things, including the cost of compensation.

Abstract

This article aims to describe the application of the concept of neutrality law in the current era with the contamination of digitalization. The main problem refers to the intervention of third countries or neutral states in the Russian conflict v. Ukraine, then questioned the existence of neutrality law in the era of digitalization. The method used is a normative juridical method with a statute approach analyzed qualitatively and descriptively. The results show that validity is needed in determining the attitude of third countries or neutral states that intervene with belligerents (Russia/Ukraine). The determination of the validity is based on the scale of the intervention provided by the third country. Validity refers to the 1907 Hague Convention and the UN Charter, which generally outlines violations of territorial sovereignty and international law. So, in conclusion, the concept of open access, broad and immeasurable digitalization, cannot be avoided in the conflict between Russia and Ukraine. This does not necessarily become a justification because the essence of the principle of neutrality and intervention is very different; the two cannot be combined unless a violation of international law indicates one. So basically, neutrality law can no longer be the primary regulation to control the attitude of a neutral state but requires new norms that shape the attitude of a neutral state so that it can be used as international customary law.

Abstract

The purpose of this study is that this research discusses the review of Islamic law on the impact of buying and selling thrift goods in Gorontalo City . As for the objectives of this research are: to find out how the review of Islamic law on the impact of buying and selling thrift goods in Gorontalo City. This study uses empirical legal research methods. Empirical legal study itself is a study that views law as a reality, including social reality, cultural reality, and empirical studies of the world. This research took place at the Saturday and Sunday Markets in Gorontalo City. The results obtained from this study are that in Islamic law the practice of selling is not in accordance with one of the pillars and conditions of the contract, namely Ma'qud alaih (object), because the goods are not clearly specified. Sellers and buyers do not know clearly the quality of goods with certainty or gharar. Therefore, this thrift sale and purchase is included in the ghajr sahih fasid contract because one of the pillars is not fulfilled and ghair shahih , a vanity contract because it is not clearly specified so that it does not have a legal impact.

Abstract

This study aims to determine the Regulation of Article 20 of the United Nations Convention Against Corruption (UNCAC) concerning Illicit Entrichment in Positive Law in Indonesia. The method used in this study is a type of normative juridical research that uses a legal approach to views and doctrines. The results of this study show that Indonesia's current positive law does not contain regulations related to Article 20 of the United Nations Convention Against Corruption (UNCAC) on the acquisition of assets of public officials (Illicit Enrichment) which allows asset seizure if the state official cannot explain the cause of the increase in assets related to his legitimate income. However, in Indonesia's positive law, there are relevant regulations close to those in Article 2 paragraph (1), Article 18, and Article 37 of the Corruption Eradication Law

Abstract

Harmonisasi antara hukum adat dan regulasi modern menimbulkan konflik budaya, perspektif, dan kepentingan. Pembangunan Indonesia bertujuan mensejahterakan rakyat dengan pemerataan pembangunan dan memanfaatkan potensi alam dan manusia. Meskipun potensi alam dan manusia di desa besar, pengembangan ekonomi pedesaan belum optimal karena ketergantungan pada bantuan pemerintah dan kurangnya inovasi. Pemberdayaan masyarakat pedesaan sebagai subjek pembangunan adalah tujuan, tetapi masih terkendala pemahaman dan keterampilan dalam pengelolaan potensi alam serta keterbatasan dalam menerima modernisasi dan teknologi baru. Regulasi desa bertujuan mendorong partisipasi masyarakat dalam pembangunan ekonomi dan mengatasi kesenjangan. Namun, desa masih mengandalkan bantuan pemerintah pusat dan memiliki rendahnya kreativitas sumber daya manusia karena kurangnya pemahaman dan pengetahuan. BUMDes merupakan upaya pemerintah untuk meningkatkan kesejahteraan desa melalui penguatan kapasitas kelembagaan dan partisipasi masyarakat dalam pengelolaan potensi desa. Namun, tantangan yang dihadapi termasuk kurangnya pemahaman masyarakat tentang BUMDes, lemahnya sistem dan tata kelola, kekurangan SDM dan aparat desa, serta minimnya penguasaan IT. Memperhatikan permasalahan diatas maka tim Pengabdian Masyarakat Fakultas Hukum Universitas Negeri Gorontalo melakukan kegiatan pengabdian ini sebagai upaya untuk meningkatkan Kapasistas Masyarakat Desa Melalui  Kerjasama sama berkelanjutan dalam pengelolaan BUMDes. Adapun luaran yang nantinya akan dihasilkan melalui pengabdian ini ialah kegiatan Penyuluhan dan Penegmbangan kapasitas Masyarakat, Artikel Ilmiah di Jurnal Pengabdian kepada Masyarakat, Publikasi di Media Masa (Cetak/Online), selanjutnya Laporan Wajib berupa Laporan Hasil Pelaksanaan Pengabdian, Buku Catatan Keuangan.
