Abstract

This study examines the legal aspects and implementation of employment contracts in Indonesia in the context of changes in labor regulations. The study analyzes the legal framework underlying employment contracts, worker rights protection, employer obligations, and implementation challenges in the field. Using a qualitative approach and legal document analysis, this study identifies several key issues related to employment contracts, including imbalance in bargaining power, unclear clauses, and compliance with the latest regulations. The results of the study show that although there has been progress in legal protection through labor laws, implementation in the field still faces various challenges. This study provides recommendations for improving policies and practices related to employment contracts that are more balanced, transparent, and in line with the principle of fairness for all parties.

Abstract

Debt-receivable problems are classic problems in economic activities that if not resolved properly can result in legal uncertainty and losses to the parties involved. One of the legal instruments provided in the Indonesian legal system to resolve these disputes is through the bankruptcy mechanism. This study aims to review the legal provisions regarding bankruptcy as regulated in Law Number 37 of 2004 and evaluate the effectiveness of its implementation as a solution to resolving debt-receivable problems. The method used in this study is the normative legal approach, by reviewing statutory provisions, legal doctrine, and court decisions. The results of the study indicate that although normatively the bankruptcy mechanism has a clear legal structure, its implementation in the field still faces obstacles in terms of process efficiency, protection of creditor and debtor rights, and supervision of curators. Therefore, policy updates and optimization of the function of judicial institutions are needed to increase public trust in this mechanism.

Abstract

The Tiatiki tradition in Teluk Depapre, Papua, is not merely an ecological ritual but serves as a cultural communication medium that conveys social and political messages. This study aims to analyze Tiatiki as vernacular media representing environmental conservation while articulating the resistance of indigenous communities against development policies that potentially threaten their customary territories. The research employs a qualitative approach with vernacular discourse analysis methods. Primary data were sourced from a 22-minute-22-second documentary produced by the Balai Pelestarian Nilai Budaya Papua (2020), analyzed through narrative transcription, identification of visual symbols, open coding, axial coding, and theoretical interpretation based on the Two-Step Flow theory and the concept of vernacular media. The findings reveal that the ritual prohibition symbolized by the “kayul larangan” is not merely a sign of marine closure for ecological purposes but also a political statement asserting indigenous territorial claims. Indigenous opinion leaders play a strategic role as cultural communicators and as drivers of subtle resistance against external interventions. These results affirm that local wisdom-based conservation in Papua is not solely ecological but also constitutes a political discourse arena projecting cultural identity and indigenous rights. This study contributes theoretically to cultural communication studies, particularly in analyzing vernacular media as instruments of local political resistance.

Abstract

This study aims to analyze the representation of the figure of the prolific sundel in the 2025 version of Pocari Sweat #IONTahanBocor advertisement using Roland Barthes' semiotic approach. The ad features a local mystical figure sundel bolong in an unusual humorous narrative to convey an educational message about the importance of staying hydrated during fasting. This study uses a descriptive qualitative method with a constructivist paradigm and analyzes visual impressions based on three layers of Barthes' meaning: denotation, connotation, and myth. The results of the analysis showed that the sundel bolong was shown as a figure who was dehydrated and then recovered after consuming Pocari Sweat, which is interpreted as a symbolic form of loss and recovery of body fluids. This representation shows a shift in meaning from a creepy figure to a funny and educational figure. Visual symbols such as the body leaking and the transformation into a cactus reinforce the educational message about hydration that is popularly packaged and lightweight. These findings suggest that advertising not only becomes a promotional medium, but also builds new myths through the construction of popular culture and visual communication.

Abstract

The People’s Palm Oil Replanting Program (PSR) is a national policy aimed at improving the productivity of smallholder plantations through the replanting of aging and unproductive oil palm trees. This study reviews the implementation of PSR in Indonesia by analyzing ten scholarly articles through a literature study approach. The findings indicate that program effectiveness is significantly influenced by technical support such as training, mentoring, the application of Good Agricultural Practices (GAP), and strategic partnerships for harvest absorption. However, implementation faces several challenges, including limited human resources, damaged equipment, inadequate funding, prolonged replanting periods, weak coordination among stakeholders, and lack of policy dissemination. Local institutions such as cooperatives (KUD) and farmer groups (Gapoktan) play crucial roles in ensuring program sustainability and inclusiveness by acting as managers and conflict mediators. Although farmers are generally ready and actively participate, regulatory constraints—particularly the requirement of financial guarantors—remain a barrier. The study recommends strengthening local institutional capacity, enhancing stakeholder synergy, and simplifying financial schemes as strategic steps to improve the long-term effectiveness of the PSR program.

Abstract

The River Basin (DAS) as a place of absorption and water source for living things, forms an ecosystem and a direct relationship between humans and nature. This study aims to determine the function of the Subayang River for the DAS community in Tanjung Belit Village, and to analyze the process of interpreting the river using the social construction theory of Peter L. Berger and Thomas Luckman. This study uses a descriptive qualitative approach, with data collection techniques in the form of in-depth interviews, observation, and documentation. Data analysis uses the Miles and Huberman model. The research subjects numbered eight people, consisting of six main subjects (selected purposively) and two key subjects. The results of the study show that the Subayang River has domestic functions (consumption and MCK) and non-domestic (interaction space, economic function, mobility, culture, conservation, and disposal). The process of the community interpreting the Subayang River consists of three processes, namely externalization (Knowledge) sources of community knowledge about rivers are formed through direct experience, family heritage, social interaction, norms or unwritten rules maintained by the community. Objectivation (Attitude) of Subayang River is not only seen as a water source but as a source of life, as a sacred object, river as identity and river as a place of purification. Internalization (Action) of society carries out various actions that come from the community's response to the river. The social construction process is influenced by internal factors (Personal Experience, Cognitive Awareness, Emotional) and external factors (Family, Norms/Rules, Community Culture, Environmental Conditions).

Abstract

The exploitation of street children is a complex social problem in Indonesia, especially in large cities. Children living on the streets are highly vulnerable to exploitation. Although the government has regulated child protection through Law No. 35 of 2014 as a revision of Law No. 23 of 2002, the implementation of these protections has not been optimal in practice. This study aims to analyze the implementation of the Child Protection Law in addressing the exploitation of street children, identify obstacles in its implementation, and evaluate the suitability of legal norms with their practices. This study uses a normative legal method with a descriptive qualitative approach, based on an analysis of legal documents, scientific literature, and relevant data. The results of the study show that the implementation of child protection still faces many obstacles, such as a lack of supporting facilities, poor coordination between institutions, a lack of education for the community, and weak law enforcement. In addition, there is still a gap between ideal legal provisions and practices in the field. In conclusion, child protection is not sufficient with regulations alone but also requires integrated, sustainable, and participatory implementation so that Indonesian children, especially street children, can live safely, be protected, and develop optimally.

Abstract

An advocate is a legal professional who provides legal services both inside and outside the courtroom based on statutory law. During the Dutch colonial era, legal representation by advocates was extremely expensive, making it accessible only to individuals of high social status. At that time, indigenous people, who were generally impoverished, could not afford legal representation. However, this situation has changed with the enactment of Law No. 16 of 2011 on Legal Aid. This law guarantees the constitutional right of every individual to receive free and quality legal assistance, especially for underprivileged communities, through Legal Aid Posts (Posbakum). Advocates working at Posbakum help marginalized individuals understand their rights, provide legal consultations, and prepare essential legal documents.

Abstract

Sex reassignment of transsexual individuals is something that is quite viewed by many people, regarding the legal status of a person who undergoes sex reassignment surgery, especially with marriage in Indonesia, and the District Court Decree (PN) provides guidance and explanation regarding this matter. The nature of God Almighty creates two sexes between male and female, along with the development of science and technology, especially in the field of medicine for those who experience conditions can also be called Sex Reassignment Surgey as a form of treatment in order to match their soul. Therefore, the researcher analyzes how Islamic law and national law regulate the legal status of transsexuals after sex reassignment and its implications for their rights and analyzes the procedure for sex reassignment and its impact. The stages of analysis use the descriptive method and deductive mindset. The results of this study conclude about the replacement of transsexual genitals in the consideration of the judge and granting the application in accordance with Islamic law and national law based on Law number 4 of 2004 written in article 28 paragraph 1.

Abstract

This study aims to analyze the level of Quality of Work Life (QWL) among operational employees at PT. Perkebunan Nusantara IV Regional III, Kebun Sei Garo. The research sample consists of 90 operational employees from PT. Perkebunan Nusantara IV Regional III, Kebun Sei Giro, using a total sampling technique. The data collection method employed is a descriptive quantitative approach utilizing a QWL scale based on a four-point Likert scale. The research instrument comprises 84 items. The findings show that the average QWL score is 268.95 with a standard deviation of 41.85, and the data are normally distributed (Kolmogorov-Smirnov sig = 0.090). Generally, Afdeling II and IV exhibit the highest levels of QWL, particularly in aspects of compensation, working conditions, and job opportunities. In contrast, Afdeling III demonstrates a lower level of QWL, especially concerning social relevance and job opportunities. In conclusion, the QWL of operational employees at PT. Perkebunan Nusantara IV Regional III, Kebun Sei Garo is at a high level; however, special attention and targeted interventions are needed for Afdeling III to enhance work quality and employee motivation.
