Abstract

Negligence of promoters in organizing music concerts can cause losses to consumers as occurred in the exchange of e-tickets for the SEVENTEEN "Right Here" World Tour in Jakarta concert by PT Melania Citra Permata (Mecimapro) on February 4, 2025 at Lotte Mall Jakarta, which resulted in queues, inconvenience, and physical injury to consumers. This study aims to analyze the form of legal protection for consumers based on Law Number 8 of 1999 concerning Consumer Protection and the promoter's legal responsibility for the losses incurred. This study uses a normative legal research method with a statutory approach and a conceptual approach, which is analyzed descriptively qualitatively through literature studies. The results of the study indicate that Mecimapro has violated its preventive protection obligations because it failed to provide an orderly and safe ticket exchange system, while repressive efforts in the form of an apology and amicable settlement have not fulfilled the provisions for compensation as stipulated in Article 19 of the Consumer Protection Law. Legally, Mecimapro's actions can be classified as a breach of contract under Article 1239 of the Civil Code and an unlawful act under Article 1365 of the Civil Code. Therefore, the promoter, as a business actor, is obligated to provide legal protection and compensation to consumers for any losses they experience.

Abstract

The crime of human trafficking (TPPO) is a serious that fundamentally violates human rights (HAM). The TPPO cases occurring in Maumere, Sikka Regency, East Nusa Tenggara, face unique challenges due to geographic, social, and economic factors. This article aims to analyze the TPPO handling process in Maumere in depth, evaluate its compliance with human rights principles, and identify obstacles and existing solutions. In writing this article, the author used qualitative methods with literature review techniques. The results indicate that the handling of TPPO cases in Maumere has been carried out in accordance with legal provisions, but in several aspects, it still does not fully comply with human rights principles, particularly regarding victim protection, fulfillment of the right to justice, and rehabilitation of victims. Frequently encountered obstacles include limited law enforcement resources, weak coordination between agencies, and a lack of public understanding. In this article, the author recommends the need to increase the capacity of law enforcement, collaborate among stakeholders to ensure just and human rights-based TPPO handling, and provide adequate facilities.

Abstract

This study analyzes the legal validity of the Power of Attorney to impose Mortgage Rights executed after a bankruptcy decision.The research is based on a case study of the Commercial Court Decision of Semarang Number 11/Pdt.Sus-GLL/2023 in conjuction with previous related rulings. The background of this particularly when creditors attempt to secure their interest through unilateral legal actions after a bankriptcy declaration. This study aims to examine the legal consequences of post-bankruptcy Power of Attorney to impose Mortgage Rights execution and evaluate its compliance with Indonesian bankruptcy law and civil law priciples. The research employs a normative juridical method using statutory and case aaproaches. The findings indicate that the execution of Power of Attorney to impose Mortgage Rights and the subsequent establishment of mortgage rights after a bankruptcy decision are legally invalid. This is due to the debtor losing authority over their assets upon the declaration of bankruptcy, as regulated under Law Number 37 of 2004 on Bankruptcy and Suspension of Debt Payment Obligations. Besides that the action also  violates the subjective  conditions of the agreement in Article 1320 of the Civil Code and is an act against the law. The implication of this research emphasizes the importance of  protecting the pari passu  pro rata parte principle to ensure  fairnessfor all creditos in the bankruptcy process.

Abstract

This study aims to analyze juridically the unilateral termination of regional contract employees by the Regent of West Manggarai through Notification Letter Number BKPPD.870/536/XII/2021, as well as to examine the termination process and the fulfillment of the affected employees’ rights. The research problems focus on how the termination process was carried out and how the rights of the contract employees were fulfilled following the unilateral termination. The research employs an empirical legal method with a descriptive qualitative approach. Data were obtained through interviews with dismissed contract employees and local government officials, and were supported by secondary data derived from legislation and legal literature. The results show that the termination process of regional contract employees in West Manggarai Regency did not comply with applicable legal procedures, particularly the provisions of Law Number 13 of 2003 on Manpower. The termination was conducted without bipartite negotiations or the mechanism for industrial relations dispute settlement, thereby constituting a procedural defect. Furthermore, the fulfillment of employees’ rights was not carried out optimally, as most contract employees did not receive compensation despite the remaining period of their employment contracts. Accordingly, improvements are required in local government policy mechanisms regarding the management of contract employees to ensure alignment with the principles of justice, legal certainty, and the protection of workers’ rights.

Abstract

The strengthening alliance between religious and state authorities in post-Reform Indonesia reveals a paradox within democratic development: while political liberalization has expanded, the moralization of public policy through religious influence has intensified. This study aims to examine the relevance of Mikhail Bakunin’s critique in God and the State to the dual authority configuration—spiritual and temporal—within modern Indonesian society. Employing a qualitative approach through literature review and philosophical-critical analysis, Bakunin’s thought is interpreted as a lens to assess how religion-state relations suppress individual freedom, rational autonomy, and pluralism. The research draws on primary sources from Bakunin’s writings and secondary data including journal articles, policy documents, and sociopolitical reports. The findings demonstrate that Bakunin’s triple critique—against theology, statism, and their alliance—offers a sharp analytical framework to understand the mechanisms of domination embedded in Indonesia’s religio-political landscape. His rejection of both divine and bureaucratic legitimacy exposes how moral authority can be transformed into political power that marginalizes dissent and diversity. The study concludes that Bakunin’s perspective is not merely historical but provides a critical tool to evaluate substantive democracy and civil liberties in Indonesia. It challenges the assumption that religious morality and state authority are inherently benevolent, and instead reveals their potential to form structural oppression disguised as rational governance and ethical order.

Abstract

This research is motivated by the problem of disorganized overhead cables in Bandung City, which disrupts urban aesthetics and public safety. The government responded through the Passive Telecommunications Infrastructure (IPT) Program using an underground ducting system. The study aims to analyze the level of public knowledge and perception regarding the objectives and benefits of cable management on the strategic Diponegoro Street. A quantitative descriptive-analytical approach was utilized, with data collected through questionnaires from 55 road users. The 15-item research instrument was proven valid and reliable, with a Cronbach's Alpha of 0.941. Findings reveal that public perception is categorized as very positive and high overall. The "Right Target" and "Right Policy" dimensions received the highest appreciation, as respondents recognized the program's urgency for Smart City acceleration and the reliability of the Electronic-Based Government System (SPBE). Despite short-term environmental stress during construction, the benefits of visual aesthetics and psychological safety dominate public perception. The implications of this study provide a scientific basis for the government to continue and expand cable management policies to other vital corridors to create modern, safe, and sustainable urban spaces.

Abstract

Meneguhkan Martabat Manusia: Telaah Filosofis tentang Hak Asasi Manusia di Indonesia examines the position of human rights within the framework of democracy and the rule of law in Indonesia. This study is motivated by the continuing occurrence of human rights violations, both by individuals and state authorities, despite the existence of constitutional guarantees and legal protections. The objective of this research is to analyze the forms of human rights, the role of the state in protecting those rights, the realities of human rights violations, and the social, economic, and political factors that influence them. The research employs a normative juridical approach through literature study by examining laws, official documents, books, and relevant academic journals related to human rights and democracy. The findings show that fundamental human rights in Indonesia include the right to life and security, freedom of opinion and religion, and the rights to education, health, and social welfare. However, the implementation of these rights is often hindered by weak law enforcement, abuse of power, social inequality, poverty, intolerance, and limited public awareness regarding human dignity. This study implies that the protection of human rights requires stronger legal enforcement, human rights education, and active participation from both the government and society in building a democratic and humane nation.

Abstract

Corruption is an extraordinary crime that has significant impacts on economic conditions, social life, and public trust in the legal system. One of the efforts to combat corruption in Indonesia is the regulation of the death penalty under the Corruption Eradication Law, particularly Article 2 paragraph (2), which allows its application under “certain circumstances.” This study aims to examine the concept of corruption, the development of its legal regulation in Indonesia, and the implementation of the death penalty from juridical, sociological, and practical perspectives. The research employs a normative juridical method with a descriptive-analytical approach supported by literature studies of legislation, books, and scientific journals. Data were analyzed qualitatively to obtain a comprehensive understanding of the issue. The findings indicate that the death penalty has been legally regulated as the most severe sanction for corruption offenders. However, despite its legal basis, the sanction has never been applied in practice. This situation is influenced by the ambiguity of the term “certain circumstances,” human rights considerations, and institutional challenges in law enforcement, including the dynamics of the role of the Corruption Eradication Commission (KPK). In addition, law enforcement authorities tend to exercise caution and often prefer alternative charges to avoid legal and social controversy. Therefore, clearer legal norms, consistent law enforcement, and stronger institutional commitment are necessary to ensure the effectiveness of corruption eradication policies.

Abstract

This study aims to identify the reasons why the Lamaholot indigenous community in Adonara Island, East Flores Regency, prefers to resolve assault crimes through customary law and to understand the settlement mechanism applied in the community. This research employed an empirical juridical method with a case approach. Data were collected through interviews, observations, and documentation, then analyzed descriptively using a qualitative approach. The results indicate that the Lamaholot community prefers customary law settlement due to the high level of trust in customary leaders, the fast, simple, and low-cost settlement process, as well as the strong values of kinship and social harmony within the community. In addition, the community’s belief in the moral and spiritual power of customary sanctions strengthens compliance with customary decisions. The settlement mechanism consists of several stages, namely reporting the case to customary leaders, summoning the disputing parties, conducting customary deliberations, reaching a peace agreement, and implementing customary sanctions such as customary fines, sacrificial animals, and the traditional oath known as tuak lolon goka. This settlement pattern reflects a restorative approach because it emphasizes the restoration of social relations and reconciliation between the offender and the victim. The study also shows that Lamaholot customary law is relevant to the concept of restorative justice within the national legal system, although challenges remain regarding the harmonization between customary law and positive law in Indonesia.

Abstract

Reconciliation is viewed as an effective method for managing conflicts since it focuses on dialogue, mediation, and resolving disputes through peaceful means. This study aims to examine the role of reconciliation in addressing family conflicts from the perspective of conflict management. The research employs a literature review approach by analyzing journal articles, books, news reports, and other relevant sources related to reconciliation, mediation, conflict resolution, and peace education. The findings reveal that reconciliation contributes significantly to reducing prolonged conflicts, improving communication, rebuilding trust, and strengthening positive relationships among family members. Mediation and family-centered approaches play an essential role in facilitating the reconciliation process by encouraging dialogue, mutual respect, and shared understanding between conflicting parties. Furthermore, peace education supports the reconciliation process by helping individuals overcome emotional trauma, develop empathy, and increase awareness of the importance of maintaining harmonious and non-violent relationships within the family. The study also highlights that sustainable reconciliation requires active participation and commitment from all family members. Therefore, reconciliation can be regarded as an important strategy for managing family conflicts because it emphasizes communication, compassion, cooperation, and peaceful problem-solving to achieve long-term family harmony and social well-being.
