Abstract

Indonesia, as the fourth most populous country in the world, faces complex challenges in managing population dynamics that directly impact national stability. This study analyzes the implementation of human security in Indonesia's population policy from a population management perspective on economic, social, and cultural resilience. Using a literature review method with a qualitative-descriptive approach, this study explores the integration of the people-centered security concept in the context of Indonesia's demographic transition, which is undergoing a second demographic transition. The findings show that although Indonesia has an adequate regulatory framework, there are still significant gaps in operationalizing the principles of human security, which include freedom from fear and freedom from want. Existing population policies have not fully accommodated the dimensions of economic security, community security, political security, and cultural security, as reflected in the fragmentation of policy approaches and weak cross-sectoral coordination. An integrative human security implementation model through adaptive population governance shows great potential in optimizing the demographic dividend and mitigating the risks of the demographic burden. The implementation of this model contributes significantly to strengthening economic resilience through sustainable economic growth, social resilience through community empowerment, and cultural resilience through the preservation of identity in the era of globalization. The interconnectedness between the three pillars of resilience creates a multiplier effect that strengthens Indonesia's national resilience system in facing future demographic challenges.

Abstract

Narcotics abuse in Indonesia is a serious crime that affects the nervous system and causes dependence. Legal subjects range from users to producers. This thesis examines the interpretation and reformulation of Article 112 and Article 127 Paragraph (1) of Law No. 35 of 2009 to provide clear criminal qualifications and legal certainty. Using a normative judicial method, the research highlights that a criminal act occurs when both objective and subjective elements are met. Precise legal formulation is crucial to distinguish the roles of perpetrators, as every prohibited act must carry firm criminal sanctions for offenders.

Abstract

Cyber espionage crime is a form of cybercrime that has a strategic impact on national security, the economy, and individual privacy. This article analyzes the phenomenon of cyber espionage through a routine activity theory approach, focusing on three main elements: motivated perpetrators, decent targets, and the absence of effective guards and efforts to counter cyber espionage crimes within the rule of law in Indonesia. This research is normative juridical, with a conceptual, legislative approach, and uses secondary data that includes primary legal materials. In this study, the perpetrators are generally state actors or state-sponsored groups with high technical capabilities, while the target is digitally vulnerable strategic data. Weak legal protection and inadequate cybersecurity infrastructure result in ineffective prevention mechanisms. The results of this study show that, first, Indonesia does not yet have criminal law norms that explicitly regulate the crime of cyber espionage, thereby creating a legal vacuum and uncertainty for law enforcement. Second, the routine activity theory approach is very relevant to understanding the dynamics of cyber espionage crimes and urges the need to reform national criminal laws, strengthen digital security systems, and improve cyber literacy to strengthen the "guardian" element in preventing this crime effectively

Abstract

Corruption is an extraordinary crime that damages the economic and social foundations of a nation. However, judicial practice often shows significant sentencing disparities in corruption cases with similar modus operandi and state losses. This study analyzes non-juridical factors causing judicial disparities in corruption cases in Indonesia using normative-juridical approach through court decision analysis and literature review. Results indicate that besides juridical factors, significant non-juridical factors include: judges' personal background and values, social and political pressure, public issues and media coverage, and organizational culture within judicial panels. Sentencing disparities reflect not only legal failures but also human factors and social contexts in decision-making processes. Systematic efforts are needed including continuous judicial training, integrity strengthening, better judicial transparency, and socialization of sentencing guidelines.

Abstract

Marriage dispensation is often granted on the grounds of pregnancy and socialinteraction factors, even though the individuals involved are not yetpsychologically ready. This study aims to analyze the psychologicalunpreparedness of couples who marry through dispensation as a contributingfactor to divorce, as well as to identify the forms of legal protection available tothem. The research employs a juridical-empirical method, utilizing primary dataobtained from interviews at the Suwawa Religious Court and secondary dataderived from legislation and relevant literature. The findings indicate thatdivorces among dispensation marriage couples are largely caused by emotional,cognitive, and economic immaturity. Forms of legal protection for childreninclude preventive protection through marriage age regulations, repressiveprotection through law enforcement mechanisms, and rehabilitative protectionthrough recovery efforts. In conclusion, marriage dispensation is closelycorrelated with divorce; therefore, strengthening regulations, conductingcomprehensive psychological assessments, enhancing inter-agency coordination,and fostering parental guidance and religious values are essential.

Abstract

This study examines the ineffectiveness of the Witness and Victim Protection Agency (LPSK) in providing legal protection for child victims of sexual violence in Gorontalo Province. Based on victimology theory, ideal protection should be proactive, comprehensive, and focused on victim recovery. However, findings in the field indicate a significant gap between theory and practice. The LPSK’s implementation of protection is reactive, partial, and delayed, driven by informal coordination with the Women’s Empowerment and Child Protection Agency (DP3A). The LPSK, headquartered in Jakarta, only gets involved after a case escalates, creating dangerous bureaucratic delays and leaving victims vulnerable. The root of the problem is the lack of LPSK representative offices in the regions, which is exacerbated by internal factors such as limited budgets, as well as external factors such as low socialization, weak inter-agency coordination, and social stigma. This study concludes that this ineffectiveness is a complex, systemic problem, necessitating strategic measures such as establishing a LPSK representative office in Gorontalo, strengthening the budget, intensive outreach, and formalizing inter-agency synergy through joint Standard Operating Procedures (SOPs) to achieve optimal protection in accordance with the principles of victimology.

Abstract

Akuisisi Gojek oleh Grab mencerminkan dinamika globalisasi ekonomi digital yang mengancam kedaulatan ekonomi nasional, khususnya dalam konteks penguasaan aset strategis oleh entitas asing. Penelitian ini menganalisis kelemahan struktural dalam kerangka hukum Indonesia dalam menghadapi akuisisi lintas batas di sektor teknologi, dengan menyoroti keterbatasan Undang-Undang Larangan Monopoli, Undang-Undang Penanaman Modal, dan regulasi sektoral lainnya. Kajian ini juga mengevaluasi efektivitas peran Komisi Pengawas Persaingan Usaha (KPPU) dalam pengawasan transaksi digital yang kompleks, serta mengkaji kemungkinan adopsi praktik internasional seperti mekanisme foreign investment screening dan perlindungan data strategis. Dengan pendekatan yuridis normatif dan analisis kualitatif deskriptif, penelitian ini menyimpulkan bahwa belum terdapat sistem hukum yang memadai untuk menjaga kontrol atas pengambilan keputusan strategis dan distribusi nilai tambah dalam ekonomi digital Indonesia. Diperlukan reformasi regulasi yang menyeluruh, termasuk pembentukan omnibus law kedaulatan ekonomi digital, peningkatan kapasitas kelembagaan, dan integrasi prinsip kedaulatan digital dalam kerangka konstitusional Indonesia. Penelitian ini berkontribusi terhadap pemahaman hukum ekonomi digital, serta menawarkan solusi kebijakan yang realistis untuk menjaga keberlanjutan dan kemandirian ekonomi digital Indonesia di tengah tekanan globalisasi. Melalui kerangka hukum yang kuat dan responsif, Indonesia diharapkan mampu menyeimbangkan antara keterbukaan investasi dan perlindungan terhadap kepentingan nasional strategis.

Abstract

This study aimed to analyze the practice of kawin turun in Olibu Village, Paguyaman Pantai District, Boalemo Regency, and to examine its legal implications under the Compilation of Islamic Law (KHI). Kawin turun referred to a customary form of marriage conducted without official registration at the Office of Religious Affairs (KUA) and was not followed by a complete, enduring household life. The practice emerged as a response to out-of-wedlock pregnancy to preserve family honor and satisfy social expectations. The study employed a qualitative approach with a descriptive-analytical method. The findings indicated that kawin turun did not fully satisfy the pillars and conditions for a valid marriage under Islamic law or the state’s positive law. Consequently, the marriage was not legally recognized, legal protection for women and children was weakened, and civil rights—such as maintenance (nafkah), inheritance, and the child’s legal status—became vulnerable. Therefore, more intensive legal education and religious guidance consistent with sharia principles were needed so that the community understood the importance of marriage registration and the cultivation of marriages characterized by sakinah, mawaddah, and rahmah.Keywords: kawin turun; Compilation of Islamic Law; customary law; marriage; Gorontalo.

Abstract

This study aims to analyze Pancasila ideology as the foundation for establishing the concept of a state based on law in Indonesia and its implementation in the reform era. Indonesia, as a constitutional state as stipulated in Article 1 paragraph (3) of the 1945 Constitution, possesses characteristics that differ from the concepts of rechtsstaat and rule of law in Western countries. These differences are influenced by Indonesia’s historical, ideological, social, and cultural background. The Indonesian rule of law did not emerge from resistance against absolutism, but rather from the spirit of independence and the noble values embodied in Pancasila. This research employs a doctrinal legal research method with a statute approach, using primary legal materials such as Pancasila and the 1945 Constitution, as well as relevant secondary literature. The findings indicate that the Indonesian legal state is fundamentally a Pancasila-based rule of law, integrating the principles of supremacy of law, equality before the law, and protection of human rights with the values of divinity, humanity, unity, democracy, and social justice. The implementation of Pancasila in the reform era must be reflected in development paradigms in the fields of law, politics, education, ideology, and national resilience to achieve justice and public welfare.

Abstract

Presidential Regulation Number 20 of 2018 on the Employment of Foreign Workers was enacted to promote investment and national economic growth. However, its implementation has raised various legal issues, particularly concerning the protection of local workers. This study aims to analyze the conformity of Presidential Regulation Number 20 of 2018 with Law Number 13 of 2003 on Manpower and to examine its impact on employment opportunities and career development of local workers in Indonesia. This research employs normative legal research using statutory and conceptual approaches. The findings indicate that several provisions of Presidential Regulation Number 20 of 2018 potentially conflict with the Manpower Law and the principle of the hierarchy of laws and regulations, thereby creating unequal competition between foreign workers and local workers. Furthermore, the implementation of technology and skill transfer has not been carried out optimally. This study concludes that strengthening supervision and policies for the protection of local workers is necessary to ensure justice and legal certainty within the national manpower system.
