Abstract

This study discusses the regulation of the position of insurance agents as business partners in cooperation agreements with life insurance companies, especially regarding the aspect of legal protection in the event of unilateral termination of the relationship. Although agents are often referred to as "business partners", legally they have the status of representatives of insurance companies based on Law Number 40 of 2014 concerning Insurance and POJK Number 69/POJK.05/2016. This legal relationship is regulated in an agency agreement that contains the rights, obligations, and limits of the agent's authority in marketing insurance products. In practice, unilateral termination of the relationship that is not based on legitimate reasons or does not comply with the agreement has the potential to cause disputes. Agents or business partners who are harmed can claim compensation based on breach of contract (Article 1243 of the Civil Code) or unlawful acts (Article 1365 of the Civil Code). In addition, violations of the principle of fair competition can be reported to the KPPU. Therefore, the cooperation agreement must be drafted clearly and fairly, regulating the time period, termination mechanism, and legal protection. The ultimate goal of this regulation is to create legal certainty, balance of rights and obligations, and protection for all parties involved in life insurance agency relationships.

Abstract

discipline have a positive and significant effect on employee performance at the Binjai City Transportation Agency. The research method is causal associative research with the help of the SPSS Version 26 program. This study uses multiple linear regression. The population in this study was 62 respondents. The sample in this study was 62 respondents. Primary data collection used a questionnaire. The results of the study indicate that leadership style partially has a positive and significant effect on employee performance at the Binjai City Transportation Agency. Organizational communication partially has a positive and significant effect on employee performance at the Binjai City Transportation Agency. Work discipline partially has a positive and significant effect on employee performance at the Binjai City Transportation Agency. Leadership style, organizational communication and work discipline simultaneously have a positive and significant effect on employee performance at the Binjai City Transportation Agency.

Abstract

The objective of this study is to analyze how the local government, particularly the administration of Kembang Village, manages village funds and financial assets. This study employs a qualitative research approach. The research subjects include ten individuals: the Village Head, Village Secretary, Village Treasurer, Hamlet Head, Neighborhood/Community Unit Leaders (RT/RW), Community Leaders, and local community members. Data collection methods in this study consist of observations, interviews, and document analysis. The findings indicate that the Kembang Village government manages finances effectively, adhering to the principles of transparency and high community participation. Additionally, several factors hinder the management of village assets.

Abstract

This article examines the criminalization of traditional fishermen who are defending mangrove forests from conversion to palm oil plantations in Kuala Langkat Village, Tanjung Pura District, Langkat Regency. This conflict reflects the disparity in power relations between coastal communities and corporations supported by some state apparatus. The research uses a descriptive qualitative approach by gathering information from news articles and analyzing legal documents as well as environmental policies. The findings indicate that fishermen who maintain their fishing grounds are accused of damaging plantation facilities and illegally occupying land. This criminalization overlooks the fact that mangrove forests are a primary source of livelihood and ecological protection for the community. The article recommends an ecological justice approach and legal protection for traditional fishermen in coastal agrarian conflicts.

Abstract

Trademark counterfeiting is a form of crime that has serious impacts on the business world and consumers. In the era of global and digital trade, the existence of brands is very vital. Therefore, brand protection through a criminal law approach is absolutely necessary. Effective and responsive law enforcement in Medan City is an important representation in providing legal certainty and protection of intellectual property rights in Indonesia's regions. The crime of trademark counterfeiting is a form of violation of Intellectual Property Rights (IPR), especially trademark rights. This counterfeiting occurs when someone uses the same or similar brand to a registered brand owned by another party without permission, thereby harming the rightful owner and misleading consumers. In Indonesian positive law, this act is regulated in Law Number 20 of 2016 concerning Trademarks and Geographical Indications, specifically Article 100 paragraphs (1) and (2), and can be expanded by the application of Article 263 of the Criminal Code if accompanied by the use of false documents. Based on the objective and subjective elements in criminal law and Moeljatno's opinion, trademark counterfeiting meets the qualifications as a criminal act. In the Medan District Court Decision No. In case No. 2152/Pid.Sus/2024/PN Mdn, the panel of judges found the defendant guilty of using the “Yamalube” brand without permission from PT Yamaha Indonesia Motor Manufacturing, with visual evidence resembling the original product. The judge sentenced him to prison, a fine, and ordered the destruction of evidence. However, law enforcement in Medan City faces obstacles, such as the nature of the complaint offense, differing legal interpretations, weak coordination among law enforcement officials, the prevalence of counterfeit products in the market, and low legal awareness among business actors and consumers. This demonstrates the need for preventive and coordinated efforts to optimize brand protection.

Abstract

This study aims to determine the effect of Customer Relationship Management (CRM) on customer loyalty at PT Bank Mandiri (Persero) Tbk Padangsidimpuan Branch. The research method used is quantitative, with a data collection approach through observation, questionnaires, interviews, and documentation studies. Data analysis was carried out using simple linear regression techniques, hypothesis testing (t test), and the coefficient of determination (R²) test. The results showed that the regression coefficient value was +0.509, which indicated a positive relationship between CRM and customer loyalty. Hypothesis test analysis produces at value of +6.364 with a significance level of 0.000, which is smaller than 0.05. This shows that CRM has a positive and significant effect on customer loyalty partially. Based on the coefficient of determination analysis, the R² value of 43.9% indicates that CRM is able to explain 43.9% of customer loyalty variability, while the remaining 56.1% is influenced by other factors not discussed in this study. Thus, this study concludes that Customer Relationship Management has a significant influence on customer loyalty at PT Bank Mandiri (Persero) Tbk Padangsidimpuan Branch. These results strengthen the hypothesis that CRM is an important factor in building and increasing customer loyalty.

Abstract

In this approach, the author uses a quantitative associative approach that aims to determine the causal influence of the variables studied. The data presented are numbers and analyzed using statistics. The population used in this study is the entire population of LQ-45 companies from 2017-2021, totaling 45 companies. The sample was determined based on a purposive sampling method, namely by taking a sample of companies during the research period based on certain criteria. Based on the criteria, the sample in this study was 21 LQ-45 companies. The data analysis technique used in this study is data that is sought simultaneously by obtaining it outside the company. In this study, data collection was carried out using a documentation study technique. Meanwhile, the data analysis techniques used are multiple linear regression, classical assumption tests, t-tests, f-tests, and coefficients of determination. Partially, Profitability has a significant effect on Earnings Management. Partially, Leverage has a negative and insignificant effect on Earnings Management. Simultaneously, the results obtained in this study are that the variables of Profitability and Leverage do not affect Earnings Management in LQ-45 Companies Listed on the Indonesia Stock Exchange for the 2017-2021 period.

Abstract

Work productivity is a comparison between the results achieved and employee participation per unit of time. Age has an influence on labor productivity. A person's length of service has an influence on their work. The study was conducted in Afdeling 2, Afdeling 4 and Afdeling 5 during the period March - May 2024. The purpose of this study was to identify factors that influence the work productivity of harvest employees in oil palm plantations using quantitative descriptive research methods. The results of the study indicate a positive and significant influence of age and work experience on the Work Productivity of harvest employees in PT.X plantations Based on Multiple Linear Regression Analysis Y = 24.034 + 0.228X1 + 0.231X2. Based on the results of the hypothesis test, the results are the calculated t value of the Age variable (X1) 4.132 > 1.987 t table value and significant value 0.000 < 0.05 meaning that the Age variable (X1) has an effect on the variable Work productivity of harvest employees (Y), the calculated t value of the Work Experience variable (X2) 3.815 > 1.987 t table value and significant value 0.000 < 0.05 meaning that the Work Experience variable (X2) has an effect on the variable Work productivity of harvest employees (Y). The results of the determination test are 36.5%.

Abstract

The highest cost proportion in the maintenance costs of oil palm plantations is the cost of fertilization. One of the mechanical fertilization methods uses a Fertilizer Spreader. The purpose of this study was to examine the cost of fertilization using a Fertilizer Spreader on Mature Plants (TM) of oil palm in Afdelling II and III of Pulau Tiga Plantation of PT. Perkebunan Nusantara IV Regional VI KSO in 2024. The research method used a quantitative descriptive method. The research data were analyzed using Parametric Test Analysis, namely the Independent Sample T-Test with a level of ? = 5%. The parameters observed were the components of the fertilization costs of oil palm Mature Plants (TM) at PT. Perkebunan Nusantara IV Regional VI KSO, as well as the differences in the costs of fertilizing oil palm mature plants in Afdelling II and Afdelling III at PT. Perkebunan Nusantara IV Regional VI KSO. The results of the study showed that the composition of the costs of mechanical fertilization using a Fertilizer Spreader on oil palm plantations consisted of fertilizer purchase costs, transportation costs, loading costs to trucks, loading and unloading costs to the Spreader, fuel costs and operator costs. The largest composition of mechanical fertilization costs in the last 3 years in oil palm Producing Plants (TM) in Afdelling II is in the purchase of fertilizer with a percentage of 96.68%, or Rp. 4,623,833,780 while in Afdelling II the largest composition is the cost of purchasing fertilizer with a percentage of 96.93% or Rp. 3,401,494,919. The results of the independent sample T-test analysis test show a P-Value or Sig. (2-tailed) of 0.255> 0.05, so based on the basis of decision making that, there is no significant (real) difference between the fertilization costs of Afdelling II and Afdelling III in the Pulau Tiga Plantation of PT.
