Abstract

The rapid development of financial technology (fintech) has given rise to new business models, one of which is the aggregator, which functions as an intermediary for financial product information. The presence of aggregators facilitates consumers in comparing various financial products; however, it also poses new challenges related to information transparency, consumer protection, and compliance with Sharia principles, particularly in Islamic financial products. This study aims to analyze the legal position of aggregators, examine regulatory obligations concerning transparency and consumer protection, and compare governance practices in the marketing of Islamic financial products involving aggregators. The research employs a literature review and policy analysis of relevant laws, regulations, and related documents. The findings indicate that Financial Services Authority Regulation (POJK) Number 4 of 2025 has provided a normative foundation for the regulation of aggregators; nevertheless, its implementation still leaves gaps, especially in the standardization of Sharia compliance information disclosure. The comparative analysis also reveals differences in orientation between conventional aggregators and Sharia-specific aggregators. This study recommends strengthening standard clauses on aggregator platforms, including clarity of contracts, fee transparency, and structured complaint-handling mechanisms, in order to enhance consumer protection and ensure Sharia compliance. Abstract

The development of the digital economy has brought significant changes to the halal industry through digitalization and technological transformation. The use of digital technology affects not only production and distribution processes but also halal certification systems, supply chain transparency, and marketing strategies for halal products. On the one hand, this transformation creates opportunities to improve business efficiency and expand market access, particularly for halal industry players. On the other hand, it presents challenges related to human resource readiness, digital literacy, and the consistent application of ethical values and sharia compliance. This study aims to examine the role of digitalization and technological transformation in the development of the halal industry in the digital economy era. The research adopts a qualitative approach using a literature review method by analyzing academic publications, policy documents, and digital-based halal industry practices. The findings indicate that digitalization contributes positively to accelerating halal certification processes, enhancing product traceability, and expanding marketing reach through digital platforms. Technological transformation also encourages the emergence of innovative halal business models that are more adaptive to market dynamics. Nevertheless, the development of a digital-based halal industry requires responsive regulatory support, strengthened digital literacy among business actors, and the integration of sharia values to ensure that technological utilization remains sustainable and responsible. Abstract

Productive waqf is one of the instruments of Islamic economics that has great potential in improving the welfare of the ummah. Darussalam Kersamanah Islamic Boarding School, Garut, has developed productive waqf as part of its efforts towards economic independence and empowerment of the surrounding community. The problem is how the mechanism of productive waqf economy of the Islamic Boarding School at Pondok Pesantren Darussalam Kersamanah Garut and how the Analysis of Maqasid Syariah about Productive Waqf in Pondok Pesantren Darussalam Kersamanah Garut. The research method used is a qualitative approach with a case study at Darussalam Kersamanah Islamic Boarding School. Data were collected through observation, in-depth interviews, and document study. The results showed that the management of productive waqf in this pesantren has fulfilled the principles of Maqasid Syariah, namely maintaining religion (hifz ad-din) by strengthening Islamic education, maintaining life (hifz an-nafs) through providing economic needs for students and the community, maintaining reason (hifz al-aql) by increasing access to education, maintaining lineage (hifz an-nasl) by supporting family welfare, and maintaining wealth (hifz al-mal) through optimizing waqf assets for economic sustainability. Productive waqf at Darussalam Kersamanah Islamic Boarding School, Garut, has become a model that can be replicated in the management of pesantren economy based on Maqasid Syariah. Abstract

Differences of opinion regarding the legality of bank interest in Islam have become a significant issue in the modern economic system, particularly in conventional banking practices. From the Islamic perspective, bank interest is often associated with riba, which is explicitly prohibited in the Qur’an. However, amid differing interpretations, various justifications have emerged among scholars. This study aims to examine the views of Muhammadiyah and Nahdlatul Ulama (NU) scholars in Garut Regency concerning the justification of riba in conventional banking transactions. This research employs a qualitative method with a literature study approach and in-depth interviews with scholars from both organizations. Data were obtained through documentation and direct interviews with Muhammadiyah and NU figures in Garut. The findings reveal both similarities and differences in the perspectives of the two groups of scholars. Both agree that bank interest in private banking is categorized as riba and thus prohibited (haram). However, regarding state-owned banks, Muhammadiyah scholars tend to classify it as syubhat (doubtful), while NU scholars consider it permissible (halal) since the profits are redirected for the benefit of the community. This study highlights the importance of understanding scholarly differences in examining Islamic economic law and underscores the urgency of dialogue between scholars and banking practitioners in formulating solutions that align with Sharia principles. Abstract

Unemployment is one of the most pressing issues in the Indonesian economy, especially in rural areas such as Mekarsari Village, Cilawu District, Garut. Unemployment is a significant challenge that hinders economic growth and community welfare in the Mekarsari Village area. So that the formulation of the problem arises: What are the factors causing the high unemployment rate in Mekarsari Village, Cilawu District, Garut, How can the application of Sharia Economic Law help reduce unemployment in Mekarsari Village, and What are the programs or initiatives that have been implemented in Mekarsari Village to overcome unemployment through a sharia approach. The objectives to be achieved from this study are to determine the factors causing the high unemployment rate in Mekarsari Village, Cilawu District, Garut, To determine the application of Sharia Economic Law can help reduce unemployment in Mekarsari Village and To determine the programs or initiatives that have been implemented in Mekarsari Village to overcome unemployment through a sharia approach. The research method used by the researcher is qualitative with data collection through in-depth interviews, observation, and document analysis. The results of the study indicate that the implementation of Sharia Economic Law, through community empowerment programs and sharia-based business development, significantly reduces the unemployment rate, strengthens MSMEs, and improves the welfare of the Mekarsari Village community. This study is expected to contribute to the development of more effective sharia economic policies at the local level. the Mekarsari Village community. Abstract

This research is motivated by the practice of the joint liability system in group financing, which is commonly used by cooperatives but has raised practical issues in the field. The main problem lies in the implementation mechanism of this system and its relevance to the principles of Islamic commercial jurisprudence (Fiqh Muamalah). The purpose of this study is to examine how the joint liability system operates, provide recommendations to improve its effectiveness, and analyze it from a Fiqh Muamalah perspective. This study employs a qualitative method through a field research approach, using data collection techniques such as observation and interviews. The results show that the implemented joint liability system does not fully align with the principles of mutual assistance (ta’āwun) and mutual consent (antarāḍin) in Fiqh Muamalah. In practice, members who initially agreed to share liability often feel disadvantaged because they must cover the arrears of others, leading to potential conflicts. This system creates a social burden for punctual members and may increase delinquencies due to a lack of individual responsibility. Keywords: Muamalah; Guarantee; Joint Liability; Financing; Group

Abstract

This research aims to explain the financing system in Islamic banking and the mechanism for designing financing contracts that comply with the principles of Islamic law. The study emphasizes the importance of accuracy in determining the type of financing contract so that banking institutions can provide professional services while maintaining customer trust through the implementation of transactions that adhere to sharia provisions. The research employs a qualitative approach using a library research method, conducted through the review of various literatures related to financing systems and contracts in Islamic banking. The results of the study indicate that the Islamic financing system generally consists of three main forms: profit-sharing financing, sale-based financing, and lease-based financing. Furthermore, the design of financing contracts in Islamic banking can be carried out through several important stages, including understanding the characteristics of customer needs, assessing the customer’s financial capacity, considering the bank’s sources of third-party funds, and ensuring that the contract complies with the principles of fiqh muamalah (Islamic commercial jurisprudence).Keywords: system, design, sharia financing

Abstract

Pawn transactions are a form of contract in muamalah intended to provide debt security. However, in practice, deviations often occur, one of which is the transfer of pawned goods without the owner’s consent. This phenomenon is quite common in Karangtengah Village, Kadungora Sub-district, Garut Regency, where pawned goods such as motorcycles are transferred by the pawnee (murtahin) to third parties without the approval of the pledger (rahin). The main research problems are how Islamic law regulates pawn rights and the protection of the owner, how the transfer is practiced in the local community, and how Islamic law views such practices. The purpose of this study is to provide a comprehensive understanding of the legal status of pawn transfers according to sharia, while assessing their implications for justice and trust in transactions. This research employs a qualitative descriptive method, using interviews with local residents and related documentation. The findings reveal that unauthorized transfers violate sharia principles, including the rule of ghasab (unlawful appropriation), and reflect the community’s weak legal awareness. In conclusion, this practice is invalid under Islamic law. Therefore, legal education, greater community awareness, and the implementation of written contracts are needed to uphold justice and trust in pawn transactions. Abstract

Perkembangan media sosial mendorong munculnya praktik jasa titip pembelian barang dari luar negeri, salah satunya melalui platform Instagram. Praktik ini diminati karena memudahkan konsumen mendapatkan produk luar negeri dengan cepat dan praktis. Namun, hal ini juga menimbulkan persoalan dalam Hukum Ekonomi Syariah terkait kejelasan akad, transparansi biaya atau fee, kehalalan produk, serta potensi gharar dan penipuan. Rumusan masalah dalam penelitian ini meliputi mekanisme transaksi jasa titip di Instagram, akad-akad yang digunakan, serta tinjauan Hukum Ekonomi Syariah terhadap praktik jasa titip tersebut. Penelitian ini bertujuan untuk menganalisis mekanisme jasa titip melalui Instagram, menganalisis akad-akad yang digunakan, serta meninjau kesesuaiannya dengan prinsip Hukum Ekonomi Syariah. Metode penelitian yang digunakan adalah kualitatif dengan pendekatan deskriptif. Data diperoleh melalui observasi, wawancara dengan pelaku dan konsumen jasa titip, serta studi pustaka terkait akad dan prinsip muamalah. Hasil penelitian menunjukkan bahwa mekanisme jasa titip melalui Instagram dilakukan secara online mulai dari pemesanan hingga pengiriman barang, dengan menggunakan beberapa akad seperti wakalah bil ujrah, salam, murabahah, ju‘alah, ijarah, dan samsarah. Secara prinsip praktik ini diperbolehkan, tetapi dalam pelaksanaannya masih ditemukan unsur ketidakjelasan biaya, kehalalan produk yang belum terjamin, serta potensi penipuan, sehingga belum sepenuhnya sesuai dengan Hukum Ekonomi Syariah.

Abstract

This study aims to analyze the implications of cyber law on online Islamic economic transactions and its contribution to the development of legal and Sharia economic studies in the digital era. Using a qualitative approach with a library research method, this study examines books, journal articles, regulations, fatwas, and other relevant academic publications concerning cyber law and Islamic commercial jurisprudence. The data were analyzed using content analysis techniques, including the identification of core concepts, categorization of legal issues, and synthesis of literature. The results indicate that the implementation of cyber law plays a significant role in securing Sharia-compliant digital transactions by strengthening authentication mechanisms, data protection, contract transparency, and the prevention of cybercrime. These findings generate an integrative conceptual framework that connects national cyber regulations with Sharia principles, forming a theoretical basis for understanding digital muamalah practices. The study concludes that harmonizing cyber law with Islamic legal values is essential to ensuring legal certainty, ethical conduct, and fairness in online Sharia transactions. Further research is recommended, particularly empirical studies, to evaluate platform compliance with Sharia requirements and assess the effectiveness of regulatory supervision in practical settings.
