Abstract

AbstractIn the digital economy era, personal data has evolved into a high-value commodity that is often treated as part of a company’s strategic business information. However, Indonesia’s legal system continues to treat trade secrets and personal data protection as separate legal domains, despite their frequent intersection in practice. This article aims to analyze the necessity of harmonizing trade secret law and personal data protection law, framing personal data as business information that deserves dual-layer legal protection. This study employs a normative legal approach with a comparative juridical analysis of existing regulations, including Law No. 5 of 1999 and the Personal Data Protection Law of 2022. The analysis reveals that there is currently no regulatory bridge that explicitly recognizes personal data as a trade secret, even though overlapping protections exist in business practice. Thus, there is an urgent need for a harmonized and integrative legal framework to ensure legal certainty, prevent information misuse, and enhance protection of both individual rights and corporate interests within a unified legal structure.AbstrakDalam era ekonomi digital, data pribadi telah berkembang menjadi komoditas bernilai ekonomi tinggi yang kerap diperlakukan sebagai bagian dari informasi bisnis strategis. Namun, rezim hukum di Indonesia masih memisahkan antara perlindungan rahasia dagang dan data pribadi sebagai dua domain yang berbeda, meskipun keduanya sering beririsan dalam praktik. Artikel ini bertujuan untuk menganalisis kebutuhan harmonisasi antara hukum rahasia dagang dan hukum perlindungan data pribadi, dengan menempatkan data pribadi sebagai bagian dari informasi bisnis yang layak mendapatkan perlindungan ganda. Penelitian ini menggunakan pendekatan normatif dengan analisis yuridis-komparatif terhadap peraturan perundang-undangan yang berlaku, termasuk Undang-Undang Nomor 5 Tahun 1999 dan Undang-Undang Perlindungan Data Pribadi Tahun 2022. Hasil analisis menunjukkan bahwa belum terdapat jembatan regulatif yang secara eksplisit mengakui status data pribadi sebagai rahasia dagang, meskipun dalam praktik bisnis terdapat tumpang tindih perlindungan. Oleh karena itu, diperlukan formulasi kebijakan hukum yang harmonis dan integratif, guna menjamin kepastian hukum, mencegah penyalahgunaan informasi, serta meningkatkan perlindungan terhadap hak individu dan kepentingan korporasi dalam satu kerangka hukum terpadu.

Abstract

AbstractThe advancement of digital technology has significantly transformed the nature and mechanisms of legal agreements, including the evidentiary function of electronic contracts. However, a regulatory discrepancy exists between the Indonesian Law on Notary Position (UUJN) and the Law on Electronic Information and Transactions (UU ITE), particularly concerning the legal status of notarial deeds in digital settings. The main issue lies in the absence of clear provisions that recognise and regulate the role of notaries in authenticating electronic agreements, thereby leading to legal uncertainty. This study aims to identify the juridical challenges and formulate an ideal model of regulatory harmonisation. A normative juridical method is employed, using statutory and comparative approaches. The findings indicate that the legal position of notarial deeds in electronic agreements remains unrecognised due to the lack of supporting norms for digitalised notarial practice. It is concluded that regulatory harmonisation is urgently required through the revision of UUJN, the strengthening of notarial roles under UU ITE, and the establishment of a national digital notarial system to ensure legal certainty in the era of digital transformation.AbstrakPerkembangan teknologi digital telah mengubah bentuk dan mekanisme perjanjian hukum, termasuk dalam pembuktian perjanjian elektronik. Namun, terdapat ketidakharmonisan antara Undang-Undang Jabatan Notaris (UUJN) dan Undang-Undang Informasi dan Transaksi Elektronik (UU ITE) terkait kedudukan akta notaris dalam konteks digital. Permasalahan utama terletak pada absennya pengaturan yang mengakomodasi peran notaris dalam otentikasi perjanjian elektronik, sehingga menimbulkan ketidakpastian hukum. Penelitian ini bertujuan untuk mengidentifikasi tantangan yuridis yang dihadapi serta merumuskan model harmonisasi regulasi yang ideal. Metode yang digunakan adalah yuridis normatif dengan pendekatan peraturan perundang-undangan dan studi komparatif. Hasil pembahasan menunjukkan bahwa kedudukan akta notaris dalam perjanjian elektronik belum terlindungi secara hukum akibat belum adanya norma yang mendukung digitalisasi kenotariatan. Kesimpulannya, diperlukan harmonisasi regulasi melalui revisi UUJN dan penguatan peran notaris dalam UU ITE, serta pembentukan sistem kenotariatan digital nasional untuk menjamin kepastian hukum di era transformasi digital.

Abstract

AbstractCustomary law exists in the form of traditions and societal habits, even though it is unwritten. Therefore, although customary law is not formally sanctioned by the state (not positivized), it is still implemented in the lives of the people. The validity of customary law is not always marked by the presence of sanctions but can be observed through expressions that reflect the community’s sense of justice in relation to customary law, particularly in the face of globalization, with a focus on efforts to preserve local cultural heritage. Globalization has a significant impact on traditional communities that continue to uphold their customary legal systems. This method emphasizes the normative aspect of law, namely the regulations issued by the government or legal bodies to govern public behavior. Collaborative efforts between indigenous communities, the government, and international institutions are necessary to formulate a legal framework that respects and supports indigenous rights while promoting sustainable development. Thus, the preservation of local culture can be maintained by integrating traditional values with global dynamics, enabling customary law to better reflect and accommodate the public’s need for justice, as a law that evolves in real practice within Indonesia’s positive legal system.AbtsrakHukum adat sebagai living law merupakan bagian integral dari sistem sosial masyarakat Indonesia yang pluralistik. Meskipun tidak dikodifikasi secara formal, hukum adat tetap hidup dalam praktik keseharian dan mencerminkan nilai-nilai keadilan lokal. Globalisasi dan modernisasi telah menimbulkan tantangan terhadap eksistensinya, terutama ketika sistem hukum nasional lebih mengutamakan pendekatan legalistik dan kodifikasi. Artikel ini menganalisis urgensi integrasi nilai-nilai kearifan lokal ke dalam hukum nasional secara konstruktif dan kontekstual. Dengan menggunakan pendekatan normatif dan konseptual, penelitian ini menegaskan pentingnya pengakuan formal terhadap hukum adat serta pembentukan mekanisme kelembagaan seperti pengadilan adat yang mendapat legitimasi negara. Integrasi hukum adat bukan hanya memperkuat identitas hukum nasional, tetapi juga memperluas cakupan keadilan substantif serta memberikan solusi alternatif dalam penyelesaian konflik, perlindungan hak asasi manusia, dan pembangunan hukum yang berkelanjutan.

Abstract

AbstractThe valuation of copyright as a fiduciary collateral asset is a critical component in the development of intellectual property-based financing schemes. As an intangible asset, copyright possesses unique characteristics that differentiate it from conventional forms of collateral, requiring structured, measurable, and accountable valuation approaches. This article explores the valuation mechanisms of copyright by examining internationally recognized methods such as the cost approach, market approach, and income approach. Using a normative legal method, this study analyzes the relevant Indonesian legal framework, including the Copyright Law, the Fiduciary Security Law, and Government Regulation No. 24 of 2022 on the Creative Economy. The findings indicate that, although there is a legal foundation for using copyright as collateral, the absence of national valuation standards and specialized appraisal institutions remains a major obstacle. Therefore, regulatory reform and the establishment of accredited intellectual property appraisers are essential to ensure the legality, objectivity, and financial viability of copyright-based fiduciary guarantees.AbstrakValuasi hak cipta sebagai objek jaminan fidusia merupakan elemen fundamental dalam menjamin keberlangsungan transaksi pembiayaan berbasis kekayaan intelektual. Hak cipta yang bersifat tidak berwujud memerlukan metode penilaian yang berbeda dari aset konvensional, dan pendekatan yang lazim digunakan adalah pendekatan biaya, pasar, dan pendapatan. Penilaian ini menjadi dasar bagi lembaga keuangan dalam menentukan besaran kredit yang layak diberikan dan memitigasi risiko gagal bayar. Meskipun kerangka hukum di Indonesia telah membuka ruang hukum bagi pemanfaatan hak cipta sebagai jaminan fidusia, hambatan utama masih terletak pada belum tersedianya standar valuasi nasional dan lembaga penilai khusus yang kompeten di bidang kekayaan intelektual. Untuk itu, dibutuhkan sinkronisasi regulasi, peningkatan kapasitas institusi appraisal, serta penyusunan pedoman teknis valuasi yang dapat diadopsi oleh sektor keuangan, guna menjadikan hak cipta sebagai agunan yang kredibel dan berdaya guna dalam sistem pembiayaan nasional.

Abstract

This paper examines the implementation of the Agreement on Trade-Related Investment Measures (TRIMS) within the legal framework of the Republic of Indonesia, particularly through Law Number 25 of 2007 concerning Investment. As a member of the World Trade Organization (WTO) since 1995, Indonesia is required to harmonize its investment policies with international trade principles, especially the National Treatment and the Prohibition of Quantitative Restrictions as reflected in GATT 1994. Although Indonesia received special and differential treatment that allowed a longer transition period, the alignment of domestic investment laws with TRIMS obligations remains essential to ensure fair competition and prevent trade-distorting investment measures. This paper analyzes how Indonesia incorporates TRIMS principles into its national investment regulations, with particular attention to Article 18 of the Investment Law, which provides various investment facilities but potentially raises issues related to performance requirements. The study concludes that while Indonesia has made significant progress in integrating TRIMS-compatible rules, several provisions—especially those linking incentives to the use of domestic goods—may still pose risks of inconsistency with WTO commitments.

Abstract

AbstractThe development of digital criminal law in Indonesia has entered a new phase with the enactment of Law Number 1 of 2024 concerning the Second Amendment to the Electronic Information and Transactions Law (ITE Law). This amendment reconstructs the defamation offense previously governed by Article 27 paragraph (3) into Article 27A, shifting the paradigm from insult to attack on honor. This study aims to analyze the shift in the legal construction of defamation offenses following the second revision of the ITE Law and to evaluate its implications for criminal liability and the protection of freedom of expression. The research method employed is normative juridical with a statute approach and a conceptual approach. The results indicate that Article 27A clarifies the objective element of accusing a specific act and alters the status of the offense to an absolute complaint offense (absolute klachtdelicten), which theoretically limits victim subjectivity and prevents the criminalization of criticism not based on facts. Furthermore, the reduction of criminal sanctions to a maximum of two years implies that detention cannot be imposed during the investigation process. However, this study finds that the protection of freedom of expression still faces challenges at the implementation level, particularly regarding the burden of proof in the public interest exception clause, which potentially triggers a chilling effect in the digital sphere. AbstrakPerkembangan hukum pidana digital di Indonesia memasuki babak baru dengan disahkannya Undang-Undang Nomor 1 Tahun 2024 tentang Perubahan Kedua atas Undang-Undang Informasi dan Transaksi Elektronik (UU ITE). Perubahan ini merekonstruksi delik pencemaran nama baik yang sebelumnya diatur dalam Pasal 27 ayat (3) menjadi Pasal 27A, yang mengubah paradigma dari delik penghinaan menjadi penyerangan kehormatan. Penelitian ini bertujuan untuk menganalisis pergeseran konstruksi hukum delik pencemaran nama baik pasca revisi kedua UU ITE serta mengevaluasi implikasinya terhadap pertanggungjawaban pidana dan perlindungan kebebasan berekspresi. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan (statute approach) dan pendekatan konseptual (conceptual approach). Hasil penelitian menunjukkan bahwa Pasal 27A mempertegas unsur objektif menuduhkan suatu hal dan mengubah status delik menjadi aduan mutlak (absolute klachtdelicten), yang secara teoretis membatasi subjektivitas korban dan mencegah kriminalisasi atas kritik yang tidak berdasar fakta. Selain itu, penurunan sanksi pidana menjadi maksimal dua tahun berimplikasi pada tidak dapat dilakukannya penahanan selama proses penyidikan. Namun, penelitian ini menemukan bahwa perlindungan kebebasan berekspresi masih menghadapi tantangan pada tataran implementasi, khususnya terkait beban pembuktian pada klausul pengecualian kepentingan umum yang berpotensi memicu chilling effect di ruang digital.

Abstract

The increasing number of criminal acts in the land sector, such as land grabbing, falsification of land documents, and abuse of authority by land officials, demonstrates systemic weaknesses in Indonesia’s land law and its enforcement, resulting in legal uncertainty and a sense of injustice for lawful land right holders. This study aims to analyze: first, the regulation and implementation of criminal liability for land-related offences in Indonesian positive law and their relevance to legal certainty; second, the factors that hinder the optimal enforcement of criminal liability in handling land crimes; and third, the ideal reconstruction of criminal liability that can more effectively ensure equitable legal certainty. The research employs a normative legal method with a descriptive-analytical character, using statute and case approaches to examine the Basic Agrarian Law, the Criminal Code/Law No. 1 of 2023, sectoral land regulations, and court decisions on land-related criminal cases. The findings reveal that although the normative basis for criminal liability and the instrument of legal certainty through land registration are formally available, their implementation is constrained by fragmented and insufficiently specific offence formulations, limited capacity and weak coordination between law enforcement agencies and land administration bodies, as well as a strong culture of informal dispute settlement that neglects effective restoration of victims’ rights. This article proposes a reconstruction of criminal liability that emphasizes the establishment of a specific category of land-related offences, strengthening the capacity and guidelines for law enforcement, and integrating criminal judgments with administrative measures and a digital land information system as prerequisites for realizing equitable legal certainty for land right holders in Indonesia.
