Abstract

This research discusses the tradition of the Hajj pilgrimage, where people come to visit people who have just returned from the Hajj, not someone visiting the holy land of Mecca, and also discusses community solidarity when the Hajj pilgrimage tradition takes place. The method used in this research is a qualitative research method with a phenomenological approach. With two research results, namely: (1) Knowing the meaning of the Hajj pilgrimage tradition, where in this tradition it is not people who visit the holy land but visits of people who have just returned from the Hajj with a specific purpose; (2) Know the forms of solidarity in the form of mutual cooperation and mutual assistance activities during the traditional Hajj pilgrimage activities

Abstract

This research aims to analyze, explain and determine the act of robbery and the criminal responsibility imposed on the perpetrator. The type of research used is normative juridical which examines sources of primary legal materials consisting of statutory regulations, then secondary legal materials consisting of literature related to research, in the form of legal journals, written works, scholarly doctrines and various references. can be linked to research, then supported by tertiary legal material sources related to the issues raised in this research. The results of this research reveal that the act of robbery meets the requirements as a criminal act which is categorized as an act of robbery with violence as regulated in Article 365 of the Criminal Code and the criminal liability imposed on the perpetrator will be studied based on the elements of the article in Article 365 of the Criminal Code by looking at the form of the act and the consequences it causes.

Abstract

Continuing public services using applications and information technology is the bandung regency regional government's effort to implement E-government to increase the smoothness of providing services to the community by using the sakedap application (integrated population service system) in making KTPs which influences the effectiveness of the bureaucracy and to maximize services public and bureaucracy by implementing E-Government with adequate facilities and infrastructure. This aims to increase community participation, information transparency (Open Government), and decision making. The purpose of this article is to find out the influence of using this application for public services on the effectiveness of service implementation in Cileunyi District and the factors that influence public services. The method used is a qualitative method by collecting observational data, statistical data and literary data explored in printed and electronic media, then the data goes through a process of analysis, triangulation, presentation and data verification. The data analysis stages consist of data exploration and classifying data, interpreting and describing data, developing data and presenting data in the form of text and images about the subject matter. The theory used is based on the Stages of E-Government (Hiller Bélanger, 2001), namely Information, Two-Way Communication, Transaction, Integration, and Participation. The research results show that the use of the "Sakedap" application has an influence on the effectiveness and efficiency of public services in Cileunyi District with several driving efforts, namely socialization, bureaucratic organizational management, provision of facilities, infrastructure and human power, especially in providing technological facilities for safe data storage and Hassle-free administration and transactions.

Abstract

Shopee is one of the companies that is changing its business processes through e-commerce, which focuses on online buying and selling. Legal protection for consumers in online buying and selling transactions requires confirmation of responsibility related to online buying and selling practices and problems of default caused by business actors. To what extent is the role of the marketplace and business actors responsible for the default losses experienced by consumers. The type of legal research used is empirical juridical legal research. The data sources used are primary data and secondary data. Data collection techniques include interviews, documentation, observation. The data analysis used is qualitative data analysis. The research results obtained by the author are that (1) The buying and selling practices used in the Shopee marketplace use the Business to Consumer and consumer to consumer transaction systems. (2) The responsibility for legal protection for consumers provided by Shopee as a marketplace is related to defaults or unlawful acts caused by business actors, so the burden of responsibility is borne by the business actor by referring to the contract that the parties agreed to. The protection provided by Shopee is limited to supervision, regulator, facilitator, finding solutions, and making decisions regarding defaults or unlawful acts that occur.

Abstract

Praktik peradilan menunjukkan bahwa terdapat kecenderungan penggugat juga menarik DJKI sebagai pihak berperkara dalam gugatan pembatalan merek terdaftar. Berkenaan dengan hal tersebut, terdapat pertimbangan Hakim dalam Putusan Mahkamah Agung No. 457 K/Pdt.Sus-HKI/2022 yang menyatakan bahwa DJKI wajib ditarik sebagai Turut Tergugat. Tujuan penelitian ini adalah untuk menentukan apakah pertimbangan Hakim dalam putusan tersebut telah sesuai dengan Undang-Undang Nomor 20 Tahun 2016 tentang Merek dan Indikasi Geografis, serta mengkaji bagaimana kedudukan DJKI pasca putusan tersebut. Metode penelitian dalam penelitian hukum ini didasarkan pada pendekatan yuridis-normatif. Hasil penelitian menunjukkan 3 kesimpulan yang dapat ditarik. Pertama, Putusan Mahkamah Agung No. 457 K/Pdt.Sus-HKI/2022 tidak sejalan dengan Undang-Undang Nomor 20 Tahun 2016 tentang Merek dan Indikasi Geografis, pendapat ahli hukum kekayaan intelektual, teori kepatuhan pejabat pemerintahan terhadap putusan pengadilan, dan pendapat Hakim dalam 11 (sebelas) putusan pengadilan berkekuatan hukum tetap yang serupa. Kedua, merek “Yunteng” milik penggugat terkualifikasi sebagai merek terkenal, serta terdapat persamaan pada keseluruhannya antara merek Penggugat dan Tergugat. Ketiga, meskipun putusan tersebut tidak sesuai dengan apa yang seharusnya, putusan tersebut adalah putusan Mahkamah Agung yang berpotensi untuk dijadikan referensi bagi hakim berikutnya dalam perkara serupa.

Abstract

Abstract- This article aims to examine the role of society in improving the effectiveness of law enforcers in Indonesia. This research uses qualitative analysis methods from various sources such as papers, academics, journals and online media. It can be concluded from the discussion that public awareness of the law is still lacking, but the role of the community is also very influential in optimizing the work of law enforcers.  Community participation is not only understanding the law, but also obeying, implementing and enforcing existing laws in Indonesia. Public legal awareness greatly influences the success in implementing existing laws. Effective law enforcement has integrity, justice, honesty, commitment, and is guided by applicable laws and regulations..

Abstract

Kasus kepailitan yang diputus oleh pengadilan Niaga menyatakan perusahaan pengembangan properti pailit karena tidak mampu melunasi hutangnya hal tersebut berpotensi merugikan konsumen yang tengah terlibat dalam transaksi jual beli maka dari itu Perlindungan Konsumen sangatlah penting salah satunya upaya menjamin kepastian hukum untuk memberi perlindungan bagi konsumen. Bertujuan untuk memperingatkan konsumen agar lebih berhati-hati dalam memutuskan untuk membeli properti. Metode yang digunakan dalam penulisan ini yaitu yuridis normatif yang memfokuskan pada penerapan kaidah-kaidah atau norma dalam hukum positif. Kepailitan dijelaskan dalam undang-undang Nomor 37 tahun 2004 tentang kepailitan dan penundaan kewajiban Pembayaran utang. Dalam melindungi konsumen sesuai pasal 19 ayat 1 undang-undang Perlindungan Konsumen pelaku usaha bertanggung jawab memberikan ganti rugi atas kerusakan pencemaran atau kerugian konsumen yang terjadi pada konsumen. Dalam kasus ini perlu pembaharuan undang-undang tentang perlindungan konsumen serta konsumen yang ingin melakukan perjanjian agar lebih teliti.

Abstract

Ketertarikan dalam penelitian ini dapat bertujuan untuk mendapatkan informasi, mengidentifikasi dan menganalisis kebijakan   kuota   produksi dan transportasi batu bara  apakah sudah dilakukan sesuai prosedur tetap yang berlaku di Provinsi Jambi dan menganalisis bagaimana penerapan pengendalian ideal terhadap kebijakan kuota produksi dan transportasi batu bara ditinjau dari aspek pelayanan kepada masyarakat. Pengumpulan data diperoleh melalui wawancara dimana para informan ditentukan secara purposive sampling,   observasi dan studi dokumentasi dengan instansi dan pihak terkait, dan studi literasi, buku, jurnal. Jenis penelitian ini mengunakan analisis deskriptif kualitatif.  Hasil yang didapatkan dari penelitian ini adalah belum terlaksananya dengan baik penerapan prosedur tetap angkutan batubara di Provinsi Jambi pada saat ini dan di sanagat di butuhkan percepatan pembuatan/pembangunan jalan khusus batubara di Provinsi Jambi dengan beberapa pilihan pendekatan Kementerian Pekerjaan Umum dan Perumahan Rakyat (PUPR) dan atau colborative  governance pemerintah dan swasta dengan dana pancingan dari pemerintah (RAPBD) dan sumber-sumber pendapatan lainnya), serta pemenuhan terhadap hak-hak perlindungan dan pelayanan kepada masyarakat belum optimal di lakukan di lingkungan masyarakat. Solusi yang bisa di tawarkan adalah percepatan pembangunan jalan khusus angkutan batubara di Provinsi Jambi.

Abstract

The closure of the TikTok Shop has had a significant impact on the digital economy in Indonesia. This abstract highlights the background to the closure policy, the objectives of the policy, and its impact on the online business ecosystem in Indonesia. This research uses public policy analysis methods and digital economic impact surveys. The results show that the closure of the TikTok Shop creates new challenges for online businesses, especially sellers who rely on the platform. Economic challenges involve declining revenues, loss of customers, and uncertainty in the e-commerce market. While these policies may have specific objectives, their overall impact on the digital economy needs to be considered. The conclusions of this research underscore the need for adaptation strategies for online business actors to overcome changes in governance in the digital ecosystem.

Abstract

This research was conducted using interview data regarding changes in a person's attitude or behavior when they fall in love which have an impact on the surrounding environment. This research was created in order to understand the impact of changes in a person's behavior. This research aims to explore and understand the role of communication in stimulating social change in the behavior of individuals who are experiencing a phase of falling in love with the surrounding environment. This research uses a qualitative approach, case study method, and descriptive research type. The results of the research show that this change in behavior tends to provide positive changes, affecting their awareness and the intensity of feelings is the main factor in this change in behavior.
