Abstract

Essence of Advocate Existence Based on Islamic Law. Advocate is a person who provides legal assistance, in the court as well as outside of the court based on the Law. The legal services given such as legal advice, legal aid, and any other acts, are aimed to represent client’s interest. Advocates have multi tasks to be accomplished, from simply giving people advice to struggling the rights of persons deprived of their rights. Abstract

This study reviews the dichotomous concept of secular and shari’a laws. Such concept has led to new discourses: first, shari’a can influence national (modern) law without mentioning the Islamic framework in the formulation process. Second, the shari’a can stand on its own for particular religious groups who believe in its truth and place it in a higher position than the secular law. Third, the substance of shari’a and modern laws is integrable. This study uses an anthropological-sociological approach with Maqāṣid al-Sharī‘at framework. As a result, the study shows both national and regional legal products, on the one hand, are considered as the shari’a law as long as they are beneficial to and protect all people. On the other hand, the shari’a, which substantially reflects equality and fairness, can be claimed as modern law.     AbstrakStudi ini mengkaji konsep dikotomis hukum sekuler dan shari’a. Konsep tersebut melahirkan wacana-wacana baru: pertama, shari’a dapat mempengaruhi hukum nasional (modern) tanpa menyebutkan kerangka Islam dalam proses perumusannya. Kedua, shari’a dapat berdiri sendiri bagi kelompok agama tertentu yang meyakini kebenarannya dan menempatkannya pada posisi yang lebih tinggi dari hukum sekuler. Ketiga, substansi shari’a dan hukum modern terintegrasi. Penelitian ini menggunakan pendekatan antropologis-sosiologis dengan kerangka Maqāṣid al-Sharī‘at. Studi ini menyimpulkan bahwa produk hukum nasional dan daerah di satu sisi dianggap sebagai hukum shari’a selama bermanfaat dan melindungi semua orang. Di sisi lain, shari’a yang secara substansial mencerminkan kesetaraan dan keadilan dapat diklaim sebagai hukum modern.

Abstract

Rhythmic movement of the tides follow the movement of the moon,as the dominant component of which has a rhythmic, should the movement of tidal inform month trip in the form of style variations of tide generating force (GPP) which indicates the time in the Hijra calendar. This article aims to determine the indicator of the tidal movement indicating the time of the Hijri calendar. The timing of slack water (t sw) the movement receded into pairs (tsw s) in peak II relatively consistent for the three months of data were analyzed tidal movement. Consistency is shown on the results of the statistical analysis by comparing the Probability (Pr) to the Wilks’ Lambda ( ) is very small(<0.0001) which means that the time of slack water (t sw) can be a primary identifier in determining the Hijra calendar. Further research is needed to determine the time point t SWS belt of a general nature in order to facilitate the determination of the Hijra calendar through the movement of the tides.DOI: 10.15408/ajis.v17i2.5686

Abstract

Abstract: The Implementation of al-Wa’d in Syariah Business. Scholars are in disagreement with one another when it comes to their views on what Islamic law says about the legal requirements of meeting one’s obligations and how or whether protracting that obligation should be punished. Hanan bint Muhammad Husen Jistaniyah, says that iltizâm is the term for obligations that are statements involving will; luzûm is the term for obligations that come from syariah ruling. Wa’d, which forms part of a combination of mu‘âwadhât (tijârî) contracts, can be mulzimised in two ways. First, sides agree that contractual document must express explicitly that wa’d is binding, insofar as that obligation (ittifâqiyya) is fulfilled by both sides when, or on the condition that, it is able to be fulfilled. Second, the regulatory side makes and activates legislature saying that wa’d, which can be found in the combination of mu‘âwadhât (tijârî) contracts, is binding, so both sides are obliged to fulfill qânûniyya, when, or on the condition that, it is able to be fulfilled.Keywords: Contract, Fatwa, Mulzim, Wa’dAbstrak: Implementasi al-Wa‘d dalam Bisnis Syariah. Ulama berbeda pendapat tentang hukum memenuhi janji: dianjurkan (sunah/wajib dîniyya) dan wajib secara hukum (qadhâ’iyya). Menurut Hanan binti Muhammad Husen Jistaniyah, iltizâm adalah term kewajiban yang lahir karena pernyataan kehendak yang bersangkutan, sedangkan luzûm adalah term kewajiban yang lahir karena ketetapan syariah. Wa‘d yang merupakan bagian dari rangkaian akad mu‘âwadhât (tijârî) dapat di-mulzim-kan dengan dua cara. Pertama, pihak-pihak sepakat dan dinyatakan secara eksplisit dalam dokumen kontrak (akta) bahwa wa‘d yang dilakukan bersifat mengikat sehingga wajib dipenuhi oleh pihak-pihak (wajib ittifâqiyya) apabila sebab atau syaratnya telah terpenuhi; atau kedua, pihak regulator membuat dan memberlakukan peraturan perundang-undangan menyatakan bahwa wa‘d yang terdapat dalam rangkaian akad mu‘âwadhât dinyatakan sebagai wa‘d yang bersifat mengikat sehingga para pihak diwajibkan untuk memenuhinya (wajib qânûniyya), apabila sebab atau syaratnya telah terpenuhi.Kata Kunci: Akad, Fatwa, Mulzim, Wa’d.DOI: 10.15408/ajis.v12i1.968

Abstract

Leaving terrorism is a real thing that happened among Indonesian terrorists. Nevertheless, some experts and laypersons often do not believe that terrorists will leave their groups and their ideology. This study scrutinized leaving terrorism among Indonesia terrorists and push factors that lead to their transformation to be moderate and refuse violence in the pursuit of their goals. This study is based on interviews with five members Jamaah Islamiyah and twenty-five people that are related to them from friends and families. This study confirms that out-groups contact, including the targeted out-groups contact, becomes an important push factor for the subject to leave terrorism. Banyak ahli dan masyarakat umumnya tidak percaya bahwa teroris dapat  meninggalkan ideologi dan kelompoknya. Penelitian  ini mengkaji tentang beberapa mantan teroris Jamaah Islamiah yang meningalkan kegiatan teror serta kelompoknya. Selain itu, penelitian ini  menjelaskan faktor yang mendorong perubahan mereka menjadi kaum moderat dan bahkan menolak kekerasan sebagai cara meraih tujuan politik dan keagamaan. Penelitian ini menggunakan metode kualitatif dengan wawancara mendalam dan telaah literatur sebagai instrumen utama pengumpul data dan informasi. Narasumber penelitian ini adalah lima mantan anggota Jamaah Islamiyah dan dua puluh lima orang yang dianggap memiliki kaitan yang relevan dengan kelima orang tersebut. Temuan penelitian  menjelaskan bahwa kontak dengan individu di luar jaringan merupakan faktor pendorong krusial yang mendorong individu keluar dari jaringan dan ideologi teror

Abstract

This study aims to examine how the concept of jihad and Tha’ifah manshurah psychologically and sociologically shape the strong basis of ideology and collective identities in jihadist community in Indonesia. Three former alumni of Afghanistan serve as key informants and three others play as secondary informants who provide the context of strengthening the jihad ideology and the formation of collective identities on the jihadists in Indonesia. In-depth interviews and review of documents, especially literature written directly by key informants, are used as data collection instruments. All the data that have been collected through interviews and review of documents are then analyzed by using the content analysis technique and thematic analysis. The study concludes that the jihad in the sense of fighting is considered as the only tool to fight the jihadist ideology that tends to perceive themselves as the chosen people of God to fight all the life.DOI: 10.15408/ajis.v16i1.2890

Abstract

Abstract: The Jarîmah Qadhaf in Determining the Legal Status of Illegitimate Children. The decision of South Jakarta Religious Court which compared a child born within an unregistered marriage with a child born outside marriage are equal is a real form of rejection of the plaintiff’s claim in a lawsuit of the legal status of illegitimate children. From an Islamic criminal law perspective, determining the legal status of illegitimate children contains an element of jarîmah qadhaf or the criminal act of adultery which is prohibited in Q.s. al-Nûr [24]: 4. The legal process in this case still proceeding after the plaintiff expressed an intention to continue to the appeals process at the Jakarta PTA level and if necessary up to the level of the Supreme Court of Cassation. In the process of seeking justice, this will certainly bring benefits to the discourse and dynamics of Islamic family law in the future.Keywords: jarîmah, qadhaf, claim, illegitimate children, children of adulteryAbstrak: Unsur Jarîmah Qadhaf dalam Penetapan Status Hukum Anak Luar Kawin. Putusan Pengadilan Agama Jakarta Selatan yang menganggap sama antara anak yang lahir akibat perkawinan tidak tercatat dengan anak lahir di luar perkawinan merupakan sebuah bentuk nyata penolakan gugatan pihak penggugat dalam perkara gugatan status hukum anak luar kawin. Dalam perspektif hukum Pidana Islam, penetapan status hukum anak luar kawin ini mengandung unsur jarîmah qadhaf atau tindak pidana menuduh zina yang dilarang dalam Q.s. al-Nûr [24] ayat 4. Proses hukum dalam perkara ini masih terus bergulir setelah pihak penggugat menyatakan pikir-pikir untuk kemudian diteruskan pada proses banding ke tingkat PTA DKI Jakarta dan jika perlu hingga pada tingkat Kasasi Mahkamah Agung RI. Abstract

The essence of learning is to improve the quality of learners and to complete the national education goals that have been established, inaccordance with the mandate of the constitution. The effort to improve the quality of education through curriculum has been responded by the Ministry of Religious Affairs in 2013 on the subject of Islamic Education and Arabic Language. The implementation of the 2013 curriculum at public ElementarySchool, in this case is the subjects of Fiqh, become a break through to conductthe learning process to be more dynamic and innovative. Abstract

Learning Ushûl al-Fiqh Based on Problems. The goal of learning ushûl al-fiqhin order to apply the rules concerning useful arguments to obtain laws will appear successful if the model that is used triggers the student to think constructively and contextually by using participative learning principles in analyizing ushûl al-fiqhrules. The focus of problem that needs to be answered in this research is to see conceptually the effectiveness of learning ushûl al-fiqhbased on problems in reaching the applicable ushûl al-fiqhlearning goals. Based on conceptual-qualitative analysis results, I argue that model of problem-based learning with its various limitations can be used as an innovative model in learning ushûl al-fiqh.DOI: 10.15408/ajis.v14i2.1288

Abstract

Mahar Tradition in Muslim Locality: Mahar and Social Structure in Indonesian Muslim Society. Law consists of two fundamentals: moral and formal dimensions. Muslim legal scholars greatly appreciate the interplay of both aspects. Legal positivism separates them and law is ultimately framed in a formal-standard logical construct. Legal moral values are universal. It is flexible, universal and can be easily adapted into local contexts. Sociologically, social and cultural structure has proven to play an important role in the structuring of legal format. This paper proves that the practice of dower in a number of Muslim societies changes and varies crossing local boundaries. The dower tradition has been changed from money and other practical objects, into more symbolic materials, namely accessories and religious symbols.DOI: 10.15408/ajis.v14i1.1239
