Abstract

Suku Anak Dalam is known as an isolated community in Jambi adhering to animism and dynamism. However, in the last few decades, some of Suku Anak Dalam people have converted to Islam. This article examines the changes in the inheritance system, and factors influencing them. This study uses qualitative analysis with a socio-legal perspective. Data was collected through interviews, observation, and documentation. The result reveals that, in practice, the use of customary inheritance law seems to be more dominant than Islamic inheritance law. Furthermore, the shifting in the inheritance system could be seen in the inheritance distribution methods and inheritance classification. These changes are influenced by the religious conversion, social interaction with incomers and their migrations to other regions. AbstrakSuku Anak Dalam dikenal sebagai kelompok masyarakat terasing di Jambi. Mereka  menganut kepercayaan animisme dan dinamisme. Namun, dalam beberapa dekade terakhir, Suku Anak Dalam telah melakukan konversi agama menjadi Islam. Artikel ini mengkaji tentang bentuk pergeseran sistem kewarisan ini serta faktor-faktor yang mempengaruhinya. Penelitian ini menggunakan analisis kualitatif dalam perspektif normatif-sosiologis. Sementara itu, pengumpulan data dilakukan melalui wawancara, observasi, dan dokumentasi. Hasil penelitian ini menunjukkan bahwa dalam praktiknya, berlaku dualisme hukum, yaitu hukum waris Islam dan hukum waris adat. Namun, penggunaan hukum waris adat terlihat lebih dominan dibandingkan hukum waris Islam. Selanjutnya, pergeseran sistem kewarisan, di antaranya terlihat pada proses pewarisan hingga perubahan bentuk dan penggolongan harta waris. Terjadinya pergeseran nilai ini dipengaruhi oleh beberapa faktor, di antaranya: konversi agama, interaksi sosial dengan pendatang, dan migrasi ke wilayah lain.

Abstract

Corporate Social Responsibility and Zakat of Company in the Perspective of Islamic Economic Law. Awareness of social responsibility by companies (corporate social responsibility) is increasing today. Almost every company has a board focusing on social services. In the Islamic banking industry, this social responsibility gets serious attention. Abstract

Abstrak: Hukum Dapat Berubah dengan Berubahnya Suatu Keadaan. Hukum adalah suatu aturan, baik itu yang bersumber dari Ilahî disebut dengan hukum taklîfî, maupun yang bersumber dari Insânî disebut dengan hukum wadh’i.  Namun dikarnakan keadaan tertentu, hukum terkadang dapat berubah dari yang semula, bisa dikarnakan situasi, tempat, iklim, teknologi, dan lain-lain. Tetapi, hukum yang dapat berubah adalah suatu hukum yang bersifat ijtihādī, dan juga suatu hukum dapat berupa harus memiliki ketentuan-ketentuan yang bersifat akurat, tidak semua keadaan bisa mengubah suatu hukum.Kata Kunci: ḍawābiṭ, al-ẓurūf, al-aḥkām, taghayyurAbstract: Law May Be Changed According to the Circumstances. Law is a rule, whether it is derived from the divine law called taklīfī, as well as those that derived from human, called as waḍ‘ī. However, law can sometimes be transformed from the original, regarding the situation, place, climate, technology, etc. Moreover, law can be changed is qualified as ijtihādī, and must obviously be based on the accurate reasons. Abstract

Indonesia is a country built on the pillars of diversity, in terms of ethnicity, culture, custom, and religion. Indonesian society is also known as a religious society, with religious values in various aspects of life. However, Indonesia is not a religious country, nor a secular country. If for Indonesians, religion is not their main purpose, then, it is a part of their life.There has been a smooth cohesion between religion and tradition in Indonesia. One of the examples is the tradition of Nyabek Toloh in Madura, which is a marriage proposal tradition. This paper examines the practice of nyabek toloh in Romben Guna village, Dungkek Region, Sumenep-Madura. The purposes of nyabek toloh are to symbolize the establishment of a relationship between the family of a male and female fiancé; to show the responsibility of a man to a woman by giving toloh; to maintain man’s dignity, and to maintain the tradition of sangkolan (elders). Conducting nyabek toloh is a must in abhakalan (marriage proposal); the absence of nyabek toloh will lead to the cancellation of abhakalan.

This study shows that jinayah Islamic jurisprudence and criminal law determine how to overcome rechterlijk dwaling by conducting a review of the decision. There are same principals why both rechterlijk dwaling and jinayah Islamic jurisprudence exist. This comes weather from internal and external of the judge. Abstract

This article specifically discusses the important issues on physical health requirements for presidential candidates in Islamic and Indonesian perspectives. This article presents two important conclusions as follows: first, in the Islamic perspective, the majority of scholars argue that a person whoi s physically less or unhealthy cannot be elected as president. The result of comparison analysis of Islamic perspective and Indonesian perspective shows some similarities. First, the importance of a presidential candidate meets the criteria of physical health. Abstract

This article aims to critically study the shift of Donggo Customs and traditions due to its dialectics with Islamic law. The Donggo customary law is based on the traditional practices and local wisdom of their ancestors that are believed to have noble values and truth. Since the 17th Century, the dialectics signified by the Bima kingdom’s political system changes from the old customs into Islamic law. This has influenced all aspects of the Bima  people’s live, including the Donggo community. This is qualitative research, with data from interviews and document studies. This study reveals that the Donggo Community’s customary law, preserved and practiced today, comes from the dialectics between customary law and Islamic law. The practiced traditions include baja sentence, the flogging law, the mbolo weki culture, maja labo dahu and raju ritual. In Islamic law, such traditions are called ‘urf or al-‘ādah, which are living traditions in a society used as legal sources and recognized by Islamic legal scholars. Customary law implemented by the Donggo indigenous people is considered substantially similar to Islamic teachings. So, Donggo customs, corresponding with the Islamic law (‘urf ṣaḥīh), are maintained, while the contradicting ones (‘urf fāsid) are abandoned.Abstrak:Artikel ini bertujuan untuk mengkaji secara kritis pergeseran adat dan tradisi Donggo sebagai proses dialektika dengan hukum Islam. Hukum adat Donggo didasarkan pada praktik tradisional dan kearifan lokal nenek moyang mereka, yang diyakini memiliki nilai-nilai luhur dan kebenaran. Sejak abad ke-17, dialektika yang ditandai dengan sistem politik kerajaan Bima berubah dari adat lama menjadi hukum Islam. Hal ini telah mempengaruhi seluruh aspek kehidupan masyarakat Bima, termasuk masyarakat Donggo. Jenis penelitian ini adalah kualitatif, dengan data dari wawancara dan studi dokumen. Kajian ini mengungkapkan bahwa hukum adat Masyarakat Donggo yang dilestarikan dan dipraktikkan hingga saat ini, merupakan hasil dari dialektika antara hukum adat dan hukum Islam. Tradisi yang dipraktikkan antara lain hukuman baja, hukum cambuk, budaya weki Mbolo, ritual Maja Labo dahu dan Raju. Dalam hukum Islam, tradisi semacam itu disebut `urf atau al-`adah, yaitu tradisi yang hidup dalam masyarakat yang dijadikan sumber hukum dan diakui oleh para sarjana hukum Islam. Adat atau hukum adat yang dilaksanakan oleh masyarakat adat Donggo secara substansi dianggap mirip dengan ajaran Islam. Jadi, adat Donggo yang sesuai dengan syariat Islam (`urf shahih) tetap dipertahankan, sedangkan yang bertentangan (`urf fasid) ditinggalkan.

Abstract

This paper deals with the review of the equipment used by security officers during demonstrations by explaining their concept and the two types of equipment namely lethal and non-lethal, and detailing their types which have been used currently. This paper also evaluates the legitimacy of their usages in accordance with the provisions of Islamic law and related Islamic Law views. This study has concluded that it is illegal to use these type of equipment except in specific cases and under certain conditions to avoid certain imminent danger.DOI: 10.15408/ajis.v16i1.2904

Abstract

Abstrak: Pluralisme Hukum dalam Penyelesaian Sengketa Waris di Besemah, Sumatera Selatan. Persoalan warisan hadir dalam setiap tradisi, mulai dari tradisi-tradisi besar hingga tradisi-tradisi kecil karena sebagaimana pendapat Vinogradoff bahwa warisan diberikan setelah kematian orang tua agar anak-anaknya mampu menjalani hidupnya setelah orang tua mereka meninggal. Karena itu, hukum Islam sebagai tradisi besar dan hukum adat Besemah sebagai tradisi kecil menetapkan aturan tentang warisan. Kedua sistem hukum ini dipraktikkan di Sumatera Selatan, khususnya di kelompok etnik Besemah. Tradisi warisan Besemah dipraktikkan secara luas di masyarakat Besemah. Namun, ketika ada perselisihan tentang warisan yang diajukan ke pengadilan, terdapat dua pengadilan yang berwenang untuk menyelesaikan perselisihan tersebut. Pengadilan Negeri mengadili unsur adat dari warisan (budel) dan kemungkinan unsur pidana dalam perselisihan waris tersebut. Namun ketika perselisihan diajukan ke Pengadilan Agama, hakim akan mengacu pada hukum Islam. Dengan begitu, negara mengakui pluralisme hukum waris.Kata Kunci: budel, jurai, warisan, Pengadilan Agama, Pengadilan NegeriAbstract: Legal Pluralism in Settling Inheritance Disputes in Besemah, South Sumatera. Inheritance issue is present in almost every tradition, ranging from great traditions to little ones because as Vinogradoff view that inheritance is given after the death of parent(s) in order that his/her children are able to lead his/her life after the his/her parents passed away. Therefore, Islamic law as great tradition, and Besemah’s customary law as little tradition lay rules on inheritance. The two legal systems are practiced in South Sumatera, especially in Besemah ethnic group. Besemah’s inheritance tradition is practiced widely in the society of Besemah, but when there is a dispute on inheritance adjudicated to court, there are two courts authorized to settle the dispute. State court tries the traditional element of inheritance (budel) and the assumed criminal element in the dispute. But when the dispute is booked to religious court, judges would refer to Islamic law. Here the state acknowledges pluralism of law of inheritance.Keywords: budel, jurai, inheritance, religious court, state court

Abstract

This research is based on the linguistic design of religious texts with diplomatic solutions to the Israeli-Palestinian conflict based on the perspective of Fiqh Siyasah .. Since the conflict of these two nations in 1947 to the present day, in the geopolitical context that the solution of the presence of peace in these two regions is to equate the international perception to this conflict as a mediator. The reason is that there is an alignment with linguistic design on the text of the Qur'anic verse which always' uses a plural form . Interestingly, the number of Jews in the world is 15 million, compared with Indonesia 250 million people, but the Qur'an never uses pronouns for Jews as a minority group or even always mentioned the majority. In the Siyasah fiqh , if this happens may take several alternatives; priority and Sad Dzari'ah benefit . . Sources of data used are the Qur'an and the hadith of the prophet. The method used in this research is to analyze bibliography data with content analysis approach . The study concludes that there are differences in text and context in the efforts to resolve the Israeli-Palestinian conflict and the two-state peace solution.
