Abstract

Agrarian disputes require resolution. For years, acquiring people’s land for constructing toll infrastructure project still use compensation as the popular term. Philosophically, the term means a reward in the form of money or non-money (in kind) which creates agrarian disputes. The partnership-profit sharing or syirkah offers a win-win solution to solve agrarian disputes. This article used systematic literature review (SLR) approach, which is similar with helicopter view model in looking at the topic of a particular study as a whole by using machine engine system. The aim of using this approach is obtaining complete and comprehensive information that have not been conducted by the previous researches.

Abstract

The present study aims to explore the depth of conflict of legal norms between the Sharia Economic Law Compilation (KHES), Financial Authority Services (OJK) regulations, and the National Sharia Board of the Indonesian Ulema Council (DSN-MUI) fatwas, investigate the causes of this normative divergence, and explore harmonization strategies to create legal certainty for Sharia financial institutions in Indonesia. Designed with normative legal research methodology, this study garnered data through literature review and analyzes it using interpretation method. Study findings demonstrate that there are eighteen different norms in the three regulations, with some differences resulting in conflict. The causes of these conflicts vary, including the use of ambiguous terms, adoption of conventional definitions, errors in translation of terms, and inconsistencies in concept development. In addition, the concurrent application of rules, differences in terminology, time gaps in issuance, and overlapping authorities also contribute to disharmony. This research contributes by offering a comprehensive solution, which includes identifying the sources of disharmony, harmonizing concepts and definitions, and applying legal interpretation and construction methods. This approach addresses the discrepancies and create a harmonious normative balance in policy and regulation. The implications of this research are very significant for Sharia financial institutions in Indonesia, as it identifies conflicts of legal norms between KHES, OJK regulations, and DSN-MUI fatwas and explores harmonization strategies

Abstract

This research aims to analyze the importance of local wisdom in mitigating domestic conflicts, emphasizing its relevance in contemporary society. The study was motivated by the observation of high rates of post-marital conflicts, including divorce, domestic violence, and infidelity, which pose significant social challenges. Employing a qualitative methodology, the research gathered data through interviews with four categories of informants: The Head of Office, the Head of Islamic Community Guidance and KUA, Traditional Leaders, Husbands and Wives, and Islamic Religious Counselors. Secondary data were sourced from relevant documents to complement the primary data. The findings reveal that marriage guidance rooted in local wisdom significantly enhances the confidence of brides and grooms in their marital life by imparting essential knowledge and skills. Couples who participate in such pre-marital guidance report feeling better prepared to navigate domestic life, thus reducing the likelihood of conflicts. This preparation is crucial in fostering a harmonious (Sakīnah) family environment. The study underscores the efficacy of local wisdom values from Lontarak, which align with societal norms and etiquette, such as Abbulo Sibatang and Ati Maccinong. These values play a pivotal role in the guidance process, promoting understanding and respect within the marital relationship. Consequently, the incorporation of local wisdom into marriage guidance programs emerges as a vital strategy for addressing and preventing domestic conflicts, thereby contributing to the overall stability and well-being of families.

Abstract

The aim of this study was to find a visionary learning model for subject Islamic Education and Character (IE-C) to shape character. The application of visionary learning in IE-C based on idealism makes it possible to achieve learning objectives by achieving spiritual aspects with noble character, especially for Z generation. Hence, the educators are encouraged to integrate future competencies (4K) in all IE-C materials, so that they can optimize the potential of students' visionary intelligence that consists of SQ, EQ, IQ, and PQ. The research method used in this study is a descriptive analysis with qualitative approach The results of this study indicate that in visionary learning an educator tries to integrate faith and practice into all IE-C learning. This learning focuses on the habituation program and future motivation, thus encouraging the creativity of Z generation students to be critical, communicative and able to collaborate with their friends. So that, the growth of noble character in the students of Z generation, can be implemented and the results can be expected to be achieved.

Abstract

In response to the need for enacting Islamic education to tackle radicalism and violent extremism (RVE), the present study aims to explore the models of moderate Islam-based education in Indonesia and Australia and to explain the challenges in promoting moderate Islam in both countries. Grounded in an exploratory case study, data were garnered through in-depth interviews and observation. Findings of this study expose that firstly, the Nahdlatul Ulama (NU) chairmen in both Central Java, Indonesia and Melbourne, Australia portrayed the same views on moderate Islam; it was religiously and ideologically situated between two radical and extremist groups, i.e., the fundamentalist group and the liberal one. Secondly, the model of moderate Islam-based education depicted by the NU chairpersons in Central Java, Indonesia employed two approaches, namely: formal madrasas/schools and non-formal education, and the strategies performed in the formal education proposed a design of moderate Islam value-based learning. Meanwhile, the model of moderate Islam-based education in Melbourne, Australia applied non-formal education. Lastly, this study also reveals several challenges encountered in fostering moderate Islam to confront the problem of RVE emerged in the sector of Islamic education in Indonesia and Australia.

Abstract

The present study to analyze the social activities of the fundamentalist movements in contrast to those of the moderate Islamic movement in Indonesia. It focusses on two groups in Salatiga Central Java: the Hati Beriman Foundation and the Khadijah Volunteer representing the fundamentalist groups, which they call themselves as the Back-to-Islam movement, and the Muhammadiyah and Nahdlatul Ulama (NU) representing the moderate groups. By observing the activities of those groups and interviewing their key activists, the study investigates their contstations and why the Back-to-Islam group has gained more popularity to te public rather than those of the moderate groups. The results show that that the emergence of Back-to-Islam movements marks a new contestation between Muslim fundamentalism and moderate Muslims in Indonesia. Previously, the contestation focused on debates around the meaning of Islamic texts or teachings, but now it moves forward to get more Muslim sympathy in general. Moreover, that transition arises because of the political defeat of Muslim fundamentalist groups in upholding Islamic law (sharia). Besides, the transition occurred because fundamentalist Muslim groups considered that Muslims in Indonesia were experiencing pressure through radical stigma and terrorism.

Abstract

This article was written with the aim of knowing a comprehensive description of the thematic interpretations of the Ministry of Religion of the Republic of Indonesia concerning law, justice and human rights from the perspective of maqasid al-shari'ah and ad dakhil wal ashil analysis which has not been done much. Even though in the midst of the reality of a pluralistic life such as Indonesia, this is urgent to do. This is proven by the unpopular use of law, justice and human rights from a thematic interpretation perspective by considering maqasid al-shari'ah and ad-dakhil wal-ashil. This study uses a library research model with a qualitative-verification approach. The data collection method uses the documentation method. The analysis results show that thematic interpretation of law and justice at Thematic Tafsir of Ministry of Religion of the Republic Indonesia has taken into account the source of authentic interpretation (al-ashil), comprehensive knowledge related to the principles of the science of interpretation and the conditions that must be met by the team of interpreters, and there is no distorted interpretation because all the interpreters have the mastery.

Abstract

This article is intended to find out:1) how the interpretation of Sayyid Qutb regarding dhikr contained in Tafseer Fi Zilal al-Quran is, 2) how dhikr as an anxiety therapy for modern society problems in viewpoint of Sayyid Qutb in the context of current social life is. This study used a library research using descriptive qualitative approach. The study results showed: 1) The interpretation of Sayyid Qutb regarding dhikr as stated in the Tafseer Fi zilal al-Qur'an has various meanings. Among the meanings are a) remembering, b) prayer, c) calling the name of Allah, d) lessons/wisdom, e) thinking of natural phenomena, f) knowledge, g) warnings, h) the books of Allah. 2) dhikr as an anxiety therapy for the modern society problems in viewpoint of Sayyid Qutb in the current context of social life is dhikr has several functions in the context of anxiety therapy for the Islamic individuals, including: the function of a) prevention, b) guidance, and c) treatment.

Abstract

This research will trace the process of transmission of falak science in Java from its inception to its current development: the geneology and the process of transmitting astronomy and developed pattern in Java. This research is a qualitative descriptive study with a historical approach. The steps taken are collecting data from the object under study (heuristic), verifying or criticizing the source, and making conclusions and interpreting existing authentic data. The analytical method used is descriptive analysis. The results showed that at the beginning of its development, the science of astronomy was studied and developed by Syekh Abdurrahman bin Ahmad al-Mishri al-Batawi who was then taught to Habib Usman al-Batawi, Sheikh Abdul Hamid al-Dumairi al-Batawi, and KH. Ahmad Dahlan as-Samarani. From here the science of astronomy developed and gave birth to a number of works including Tadzkirah al-Ikhwan, and Bulugh al-Wathar. The development of astronomy is then carried out through educational institutions both formal and informal. For formal education through tertiary institutions and informal through Islamic boarding schools.

Abstract

The model of science integration is conducted with different approaches. One model of integration in Islamic economics is the Islamization approach. This study aims to describe Islamization as an integrated approach in the field of Islamic economics. This study is a literature review supported by data and analysis with main sources from books, articles and websites. The research findings show that the Islamization has an impact on the development of scientific disciplines. In the midst of the strong offer of various integration paradigms, the Islamization as the mainstream approach is relevant to development of Islamic scientific integration, including Islamic economics. To realize the integration of Islamic economics, activists of Islamization must continue formulating theories and develop methodologies of Islamic economics with an integrative paradigm. The implication of this study is that the efforts are still needed so that Islam is not only a tool of justification for economic theory in the process of the movement of science Islamization.
