Abstract

Abstract: This research aims to conduct a comparative analysis of drug addict rehabilitation policies in Indonesia and Thailand, with a focus on the effectiveness, strategies and approaches implemented. The problem of drug addiction is a serious challenge in both countries, requiring well-structured rehabilitation programs to address the physical, psychological and social aspects of addiction. In Indonesia, rehabilitation efforts have focused more on a combination of medical treatment and social reintegration, with an emphasis on community-based initiatives. In contrast, Thailand has developed a more comprehensive and integrated system, which includes government-regulated treatment, community programs, and alternative punishments for drug offenders. This study analyzes key differences and similarities in the two countries' policies, and evaluates their impact on recovering addicts and broader social outcomes. By comparing the experiences of the two countries, this study aims to provide insights into effective rehabilitation strategies and recommendations for improving drug addiction recovery systems in Southeast Asia. Keywords: Comparative study, drug addiction, rehabilitation, policy analysis Abstrak: Studi ini bertujuan untuk melakukan analisis komparatif terhadap kebijakan rehabilitasi pecandu narkoba di Indonesia dan Thailand, dengan fokus pada efektivitas, strategi, dan pendekatan yang diterapkan. Masalah kecanduan narkoba merupakan tantangan serius di kedua negara, yang memerlukan program rehabilitasi yang terstruktur dengan baik untuk menangani aspek fisik, psikologis, dan sosial dari kecanduan. Di Indonesia, upaya rehabilitasi lebih banyak berfokus pada kombinasi pengobatan medis dan reintegrasi sosial, dengan penekanan pada inisiatif berbasis komunitas. Sebaliknya, Thailand telah mengembangkan sistem yang lebih komprehensif dan terintegrasi, yang mencakup pengobatan yang diatur oleh pemerintah, program-program komunitas, serta alternatif hukuman bagi pelanggar narkoba. Studi ini menganalisis perbedaan dan persamaan kunci dalam kebijakan kedua negara, serta mengevaluasi dampaknya terhadap pemulihan pecandu dan hasil sosial yang lebih luas. Dengan membandingkan pengalaman kedua negara, studi ini bertujuan untuk memberikan wawasan tentang strategi rehabilitasi yang efektif dan rekomendasi untuk meningkatkan sistem pemulihan kecanduan narkoba di Asia Tenggara. Kata kunci: Studi komparatif, kecanduan narkoba, rehabilitasi, analisis kebijakan.

Abstract

This study aims to analyze the legal provisions related to the division of joint property in divorce. In addition, this study also evaluates the implementation of these rules in judicial practice and the obstacles faced in resolving joint property disputes. The research method used is normative juridical with a statutory approach and analysis of court decisions. Data were obtained through a literature study of relevant legal regulations, doctrines, and jurisprudence. The results of the study indicate that the Civil Code regulates the division of joint property equally between husband and wife, unless there are certain reasons that affect the division. Meanwhile, the Marriage Law refers to the laws that apply to each party, both customary law, religion, and other regulations. In practice, there are still inconsistencies in the application of these rules in court, especially related to differences in judges' interpretations and the influence of the legal system adopted by the parties. This study recommends harmonization of the provisions in the Civil Code and the Marriage Law in order to create legal certainty. In addition, it is important for couples to understand the benefits of a marriage agreement as an effort to prevent disputes in the division of joint property after divorce.

Abstract

In essence, children can obtain, seek and share information through any media to support their development process. Therefore, the Internet is a platform that children can choose to fulfill their needs. However, the large number of sexual predators roaming social media puts children in a dangerous situation of being exposed to cyber grooming crimes. The methodology chosen in preparing this article is a normative research method that carries out studies by using various related scientific literature. Through this discourse, the fact is obtained that advances in cyber technology have exceeded the regulatory framework in Indonesia, resulting in the slow handling of contemporary forms of crime such as cyber grooming. Therefore, legal policy reform is needed to provide legal certainty in following up on cyber grooming crimes.

Abstract

The Benefit Value Reduction Policy is a policy taken by AJB Bumiputera 1912 as a joint venture insurance. This policy was made with the aim of providing legal protection for the payment of policyholder claims and maintaining its form of business. This research discusses the legal protection of the implementation of AJB Bumiputera policyholder claims and the liability of AJB Bumiputera 1912 for its policies. Although there has been Law Number 4 of 2023 concerning Insurance Development and Strengthening of the Financial Sector, its application and enforcement still encounter various obstacles. Through the qualitative analysis method, this research reveals that legal protection to policyholders in the implementation of claims has not been fully achieved optimally. This is reflected in the fact that there are still complaints from policyholders regarding delays in claim disbursement, unclear information regarding benefit value deductions, and weak transparency in the PNM implementation process. and AJB Bumiputera has not fully carried out its obligations in the PNM policy implemented in relation to claim payments that were not made in a timely manner in 2023 and 2024.
