Jurnal Keamanan Nasional is a scientific and open-access journal managed and published by Puskamnas, Universitas Bhayangkara Jakarta Raya. This journal is a peer-reviewed journal that aims and focuses to publish new work of the highest caliber across the full range of legal scholars, which includes but is not limited to works in security studies, terrorism, political killings, riots, mass riots, rebellions, security disturbances, maritime security, food security, economic security, and others. However, articles are not included in the area of security studies, national security, human security, or any dimension as long as it is in a security perspective, both traditional and non-traditional security.

Abstract

Food security is a very important thing in people’s lives. Good food security will lead to a good social order as well. During the COVID-19 pandemic, the Indonesian state experienced a slump in various fields, which resulted in Indonesia’s economic growth experiencing a significant decline. The stability of food security with the transmission of the COVID-19 virus outbreak experienced obstacles and disruptions, starting from the inhibition of food production, distribution, and production transportation, including production support equipment which resulted in serious food availability problems. The Indonesian government in dealing with this pandemic outbreak has issued regulations or policies to suppress the spread of the COVID-19 virus by issuing Large-Scale Social Restrictions, but the impact or effect it causes is that many industrial sectors have finally closed their businesses, be it from the hotel, restaurant sector. or tourism, as well as malls or retail which in turn has an impact on the reduction of labor and the departure of industrial players. The benchmark for food security is highly dependent on the surrounding environment, both national and international domestic factors. If the two environments give a good effect, of course, food security will be achieved well. And vice versa if the environment is not good, then what will arise is food and other problems that surround it, including food sufficiency. Poor food security, especially for poor families ‘ food security is the emergence of negative actions such as crime and the like. The government in dealing with this problem has issued a quick policy by carrying out a program of economic recovery and transformation with the issuance of Presidential Regulation Number 82 of 2020 concerning the Corona Virus (COVID-19) Management Committee and National Economic Recovery whose aim is expected to restore existing economic conditions in order to achieve growth. stable and equitable economy in all lines of people’s lives.

Abstract

This research investigates the appointment of acting regional heads in preparation for the 2024 simultaneous regional head elections from a constitutional law perspective. Given the urgency of the matter, the study delves into various crucial aspects, including the ramifications of the absence of Government Regulations, transparency issues, and the appointment of active TNI and POLRI members as acting regional heads. Key research questions include analyzing the appointment process vis-à-vis constitutional law and assessing the legality of appointing military and police personnel as acting regional heads according to statutory regulations. Conducted as a normative juridical inquiry, the research utilizes primary, secondary, and tertiary legal resources. Methodologically, legal materials are gathered through literature review and processed via inventory, identification, categorization, and systematization, employing a qualitative juridical approach for analysis. The study concludes that while the formal or textual process of appointing acting regional heads aligns with specific legal provisions, it falls short in adhering to fundamental constitutional principles such as the rule of law, democracy, legality, and regional autonomy. Moreover, it highlights deficiencies in transparency, openness, and accountability, essential elements of good governance and state administration. Additionally, the appointment of military and police personnel as acting regional heads is deemed unlawful, violating pertinent laws and a Constitutional Court decision.

Abstract

A bank credit agreement is a standard agreement whose contents are determined unilaterally by the bank, with the aim of efficiency. Micro, small, and medium enterprises have an important role in economic development and growth. Small and medium enterprises often enter into banking credit agreements for business development. Due to the COVID-19 pandemic, the Indonesian government issued Presidential Decree No. 12 of 2020 stipulating the Determination of Non-Natural Disasters for the Spread of Corona Virus Disease 2019 (COVID-19) as a National Disaster. COVID-19 has had an impact on aspects of people’s lives. One of them has an impact on the decline in the economic capacity of the community which in turn can result in the debtor not fulfilling the achievements in the banking credit agreement. This study uses a normative juridical research method. The data collection method that the author uses is a literature study/documentation, namely data collection in a literature/document study is an activity of tracing, checking, and reviewing secondary data. The results of the research on the implementation of banking credit agreements are the fulfillment of the contents of the agreement in the form of implementation and obligations that have been agreed upon in the banking credit agreement. The COVID-19 pandemic has affected the implementation of banking credit agreements. The COVID-19 pandemic affects the ability of debtors to carry out their achievements. The government through the OJK issued POJK Number 48/POJK.03/2020, which is a regulation to provide restructuring to debtors. The COVID-19 pandemic can also be used as an excuse for debtors to experience force majeure. However, not all debtors are categorized as experiencing force majeure.

Abstract

This study aims to examine and analyze the application of criminal sanctions against corruption based on progressive law. This study uses a normative juridical approach with descriptive analysis. The data used was secondary data obtained through a literature study, which was then analyzed qualitatively. Based on the research, Progressive law requires the state to embrace a boundless function and use its power to tell people what they must and must not do so as to allow them to get hold of their desired affluence. Progressivism in law is a legal philosophical overview that may have the potential to realize the ideas of justice and legal certainty. This paper emphasized that progressive law basically can be used as an alternative in law enforcement, and the establishment of law should in line with this thinking.

Abstract

This article argues for the importance of building an intervention-based policing model in an emergency situation. Through a case study of the Bogor Police’s strategy in dealing with the COVID-19 pandemic, this article finds gaps in empirical and theoretical developments regarding the effectiveness of modern democracy-based and community-based policing models in the midst of the Covid-19 pandemic. This article looks at the importance of the intervention policing paradigm, which is a combination of values-based regulation in the community and the legitimacy-based regulation of the police authority. The intervention policing model emphasizes the importance of three police intervention approaches; participatory intervention, institutional intervention, and regulatory intervention as a policing model in emergency situations such as the COVID-19 pandemic.

Abstract

This article aims to analyze several factors that caused the government to reject the return of ex-ISIS Indonesian citizens to Indonesia. This research was explanatory research using a qualitative approach. Meanwhile, the data collection technique was a literature study using the Google Scholar search engine and Harzing Publish or Perish. The authors used Miles and Huberman’s data analysis technique using the interactive model qualitative data analysis technique. The authors found that two factors influenced the rejection of the return of ex-ISIS Indonesian citizens: internal and external factors. Internal factors consist of political factors, security factors, and cultural factors. Meanwhile, the external factors related to the Global War on Terrorism (GWOT). As for the political factor, the ex-ISIS members have a radical ideology for gaining their political interests. Then from the security factor, it was found that the ex-ISIS members had combat skills and knowledge, which would significantly affect the security and living conditions of the community. Finally, from cultural factors, ex-ISIS members tend to have an intolerant nature resulting from their ideology. The existence of this intolerant nature will undoubtedly clash with the diverse cultural conditions of the Indonesian people. The external factor is Indonesia’s participation in the effort to fight global terrorism together with other countries.

Abstract

The end of the Cold War marked the shift of world threats from traditional military threats to asymmetric non-traditional threats of terrorism. Terrorist groups emerge with various backgrounds. Domestic political instability in the form of conflict and separatism to revenge motivation or being affected by the threat of terrorism in other countries. The purpose of this research is to analyze the strategy and approach of peace to resolve the terrorism conflict. The method used in this research is the literature review. The data sources in this study were taken from the Scopus database and several other databases such as Connected Papers, Open knowledge maps, and Google Scholar to support this research, then some data were taken from the news. The findings in this study emphasize that apart from the hard approach and also the soft approach as an approach to resolving the conflict of terrorism, there are other approaches that can be used as an alternative approach, namely the conflict triangle where this approach has not been widely adopted in Indonesia.

Abstract

The recent escalation of tensions between Russia and Ukraine has caught the world’s attention. Tensions are characterized by the leadership of hundreds of thousands of Russian troops on Ukraine’s borders and the response of many NATO members, including the United States, to Russian pressure. NATO threats against Russia have played a role in increasing tensions on the Russia-Ukraine border. This article analyzes the nature of Russian-Ukrainian relations, the background to rising tensions between the two countries, and the international reaction to the situation. The international community must continue to seek peaceful solutions to avoid the threat of another world war. The ongoing conflict will ultimately harm many parties not only in European countries but also in other regions.

Abstract

Research on conflict resolution has mainly focused on conflict resolution between nations, ethnicities, races, and regions. The study aims to explain the dynamics of conflict resolution between villages that often occur in Kerinci Regency. This study focuses on conflict resolution between villages of Pendung Talang Genting and Sleman. The study used a qualitative method with a phenomenological approach. The participants involved in the study were residents, village officials, and respected village elders. The results of the study revealed that conflict resolution was carried out through mediation, if a conflict cannot be resolved through mediation, legal action is then taken. Conflict resolution is also conducted using compensation and taking a softer line. Yet there are focus on the termination of conflict.

Abstract

Theorists have argued many perspectives and multidimensionality of national security, therefore identifying essential factors of them becomes an important issue in the measurement model. Based on Stephan’s theories on intergroup threats theory and Jacob’s about the top of five models of national security,it was constructed a questionnaire to measure the perceived national security of the younger generation (APKN). This research aims to measure the level of reliability, and validity and identify the main factors of APKN. The sample was 333 out of 373 students and employees, characterized by age 16-30 years old selected randomly The result showed APKN questionnaire which consists of 35 items had a level of Cronbach Alpha reliability of 0.703, 21 items were valid and there were three main factors found: security dimension, social-economic dimension, and barrier dimension.
