As-Sakinah : Jurnal Hukum Keluarga Islam fokus mengkaji penelitian di bidang pemikiran hukum Islam dan hukum keluarga Islam, baik penelitian literasi maupun penelitian lapangan. Ruang lingkup kajian jurnal ini adalah bidang pemikiran Islam dan pemikiran hukum Islam yang berkaitan dengan keluarga, hak asasi manusia, perkawinan, perceraian, warisan, wasiat, hibah, wakaf, zakat dan sedekah. Diterbitkan oleh STAI Pelabuhan Ratu, Sukabumi 2 (dua) kali dalam setahun yaitu Mei dan November. Kata sakinah berarti sebuah ketenangan atau ketentraman yang dirasakan oleh suami dan istri dalam rumah tangga. Filosofi Jurnal As-Sakinah dapat mencerminkan nilai-nilai dan prinsip-prinsip yang berhubungan dengan kedamaian, ketentraman, harmoni, dan keberkahan dalam konteks keilmuan, khususnya dalam kajian hukum keluarga Islam. Jurnal As-Sakinah bertujuan untuk menjadi wadah penelitian yang mendorong pemahaman Hukum keluarga Islam, menggali nilai-nilai kehidupan yang harmonis, dan memberikan kontribusi bagi masyarakat yang lebih baik secara spiritual dan sosial.

Abstract

In the linguistic hierarchy scheme, Haqiqah occupies a superior position compared to Majaz, because Haqiqah is the main core while Majaz is only a derivative. Consequently, Majaz should not be used as the foundation for establishing Islamic law unless Haqiqah is difficult to implement, and at that time a supporting indicator (qarinah) is needed to clearly guide it. In Arabic linguistics, the term "an-nikâh" encompasses both the essential and the figurative meanings. Imam Nawawi explained that linguistically, "nikâh" means union. Sometimes, this term refers to the "marriage contract," and other times to the "husband-wife relationship." This research is qualitative through a literature study approach, relying on secondary data from relevant OJS-based books and scientific journals. From an in-depth analysis, the author concludes that the understanding of the concept of marriage in Islam—specifically the term "nikah"—can be explained through the lens of Haqiqah and Majaz. Experts in ushul fiqh and Arabic linguists state that the essence of "nikah" is "watha" (intimate relations). However, the fuqaha from the four schools of thought agree that the true essence is "agreement", while the majaz refers to "watha".

Abstract

This research discusses the concept of zihar from the perspective of Ibn Hajar Al-Haitami, as explained in the fiqh book Tuhfatul Muhtaj. The aim of this research is to understand what is meant by zihar according to Ibnu Hajar Al-Haitami's view, how the law applies, and how this affects the relationship between husband and wife in Islamic family law. This research uses qualitative methods with a normative and doctrinal approach, through text analysis of primary sources and literature studies from various Shafi'i school of jurisprudence literature. Research shows that zihar is considered a statement that has serious legal consequences, even though it does not directly end a marriage. Ibnu Hajar Al-Haitami stated that kafarat is a necessity that must be carried out as a way to restore the relationship between husband and wife and as a means of protecting women's dignity. The results of this research show that the concept of zihar in the sense of Shafi'i jurisprudence is not only an established rule, but also reflects the principles of justice, politeness in speaking, and protection of family rights in the Islamic legal system.

Abstract

In Petarukan District, Pemalang Regency, divorce conflicts are not only caused by early marriage, but also by unequal education levels between spouses, economic reasons, lack of family support, and differences of opinion. In practice, couples who intend to divorce at the KUA of Petarukan District usually first come to AMK for consultation. Often, the issue is that they are not mentally prepared for marriage, especially among young couples who seek consultation at KUM. This study aims to understand the implementation of the marriage guidance program at the KUA of Petarukan District and to examine the outcomes of this program in helping prospective brides and grooms achieve a sakinah, mawaddah, and rahmah family. The research methodology used is descriptive qualitative, with data collection techniques including interviews, observations, and documentation. The results show that the implementation of marriage guidance at the KUA of Petarukan District runs well, starting from attendance, delivery of materials on family life, to the simulation of the marriage contract. The purpose is to equip prospective couples with the knowledge and readiness to build a harmonious family (sakinah, mawaddah, and rahmah), and it is expected to continue in order to reduce divorce rates. The findings also indicate that this guidance is beneficial for couples after marriage. The materials provided can be applied in daily life, such as earning a living, serving one’s partner, and maintaining communication. Good communication is the key to creating harmony in the household.

Abstract

This study aims to analyze gender relations in the rights and obligations of husband and wife from the perspective of contemporary Islamic law amid the dynamics of social change in modern society. The development of globalization, cultural transformation, the increasing participation of women in the public sphere, and advances in information technology have influenced relationship patterns within Muslim families, particularly regarding the division of domestic and public roles between husbands and wives. These conditions have given rise to various reinterpretations of the concepts of marital rights and obligations that have traditionally been understood normatively in Islamic law. This study employed a qualitative approach using a library research method. Data sources were obtained from the Qur’an, hadith, classical and contemporary fiqh literature, as well as scholarly works related to Islamic family law and gender studies. Data analysis was conducted descriptively and analytically through normative and socio-contextual approaches to examine the relevance of Islamic law to the realities of modern family life. The findings reveal that Islamic law fundamentally positions marital relations on the principles of justice, responsibility, deliberation, and mutual complementarity. However, contemporary social changes require a more contextual understanding of the distribution of rights and obligations in order to align with the needs of modern families without neglecting the fundamental values of Islamic teachings. This study emphasizes that gender relations based on partnership, proportional equality, and mutual respect can create harmonious families and contribute to the social welfare of contemporary Muslim society.

Abstract

The rapid advancement of modern biotechnology—such as genome editing (CRISPR-Cas9), stem cell research, and end-of-life decisions—has placed Islamic law in a dilemmatic position between accelerating medical benefits and maintaining ethical-moral boundaries. This study aims to analyze the methodological limitations of conventional istinbath al-ahkam in responding to modern bioethical dilemmas, while simultaneously offering a solid model for reconstructing legal reasoning. This study is a normative-philosophical legal research using conceptual and philosophical approaches. The findings reveal that the mainstream istinbath methods, which are heavily dominated by textual-linguistic approaches (bayani) and linear analogy (qiyas), tend to experience epistemological stagnation. They often produce reactive and restrictive fatwas because they isolate legal texts from the reality of science. To overcome this deadlock, this study formulates a reconstruction model called the Transdisciplinary Hybrid Scheme. This scheme integrates the five basic principles of contemporary Maqasid asy-Syari'ah with four international biomedical ethics principles (autonomy, beneficence, non-maleficence, and justice). Through this hybrid scheme, the process of legal discovery moves beyond the boundaries of jurists and scientists across three systematic stages: clinical verification (tahqiq al-manat), maqasidi-bioethics filtration test, and the formulation of inclusive conditional rulings. This reconstruction proves that Islamic law is capable of providing progressive moral-legal certainty for future scientific disruptions without losing the spiritual roots of Sharia.
