Abstract

Advances in information and communication technology (ICT) have brought about signicant changes in the conduct of electoral campaigns. The campaign has incorporated online elements with the potential to reach a wider range of constituents and in a very fast time. However, at the same time, the use of digital campaigns also brings with it negative practices which ultimately threaten the integrity of the campaigns. This paper discusses a number of factors that underlie the importance of monitoring digital campaign activities which have now become a strategic alternative for election contestants in order to gain votes. This paper also discusses how digital campaign oversight can be carried out effectively. This study uses qualitative research method with literature studies to discuss in depth various rationales regarding the importance of digital campaigns to be monitored and effective forms of oversight to be able to realize fair and equal campaigns as an important basis for democratic elections. The study of literature is used as the data collection technique. Oversight of digital campaigns is very strategic because of a number of potential negative effects of manipulative practices that threaten the fundamental aspects of democratic campaigns, namely the right of voters to obtain valid and reliable information, as well as an equal level of playing eld for all election contestants. To realize these fundamental aspects, oversight of digital campaigns requires a conducive legal framework, supportive legislative institutions, capable monitoring and supervisory bodies, political parties that adhere to campaign norms and ethics, and constructive cooperation with social media platform owners. Abstract

The complexities of election and simultaneous election in 2024 have brought difcult challenge. This research aims at revealing strategic communication of Election Monitoring Institute (Bawaslu) in disseminating legal information and legal products through JDIH to general public. This research employs qualitative method with case study approach. This study proves that JDIH of West Java Election Monitoring Institute (Bawaslu) has actively socialized and educated public with various programs to inform legal product it issued. However, the medium used is very limited as the disseminations were conned to conventional media such as internet. This method is insufcient, as in the context of West Java, internet has been massively used and public has been fed with overwhelming information. In addition, in the post truth era, democracy can potentially turn into threat, as the combination of wide use of internet and open and unrestricted public sphere could potentially lead to the massive circulation of hoax, misinformation and disinformation. Based on this reality, considering use of social media platform as means of dissemination is inevitable. Moreover, strategic communication can be taken by dening goals and objects, determining social media platform and evaluating existing strategy, media monitoring and observation.

Abstract

The regulation of election crimes in the Pilkada Law and the Election Law, especially in terms of the definition and mechanism for handling election crimes, has juridical implications, both formal and material. In terms of the definition of election crime, the emergence of the classification of election crimes and violations, does not necessarily emphasize the difference between the regulation of offenses and sanctions between crimes and violations, so that there tends to be over-criminalization in terms of criminal law enforcement. On the other hand, the mechanism for handling election crimes is limited by the time of handling, making many cases of alleged election crimes unfinished. In this context, the urgency of classifying election crimes into crimes and violations as well as establishing a mechanism for handling election crimes must be seen and measured from the perspective of criminal law policies. This study uses a normative law research approach, namely normative case studies in the form of products of legal behavior, in this case the legal products studied are the Pilkada Law and the Election Law. The research specification in this article is descriptive analytical research, which describes the applicable laws and regulations associated with legal theories and practices of implementing positive law concerning the enforcement of criminal law for election crimes in the perspective of criminal law policies. Based on the results of the study, the classification of election crimes into violations and crimes at the formulation level does not have clear boundaries and standards both qualitatively and quantitatively. This causes at the level of implementation and execution, the distinction between violations and crimes is no longer important. Thus, the classification of election crimes into violations and crimes does not have significant implications for law enforcement efforts for election crimes. In addition, the mechanism for handling election crimes regulated in the Pilkada Law and the Election Law is not able to maximally encourage the fulfillment of the legal objectives of law enforcement regulations in the Pilkada Law and the Election Law.

Abstract

Election law enforcement is one of the important principles for fair elections. In its form, election law enforcement includes election criminal law enforcement. Regulations regarding election criminal law based on Law Number 7 of 2017 are based on retributive justice. In its development, the basis of criminal justice has now begun to change towards restorative justice. This restorative justice aims to provide a form of justice and restoration to victims, by placing perpetrators and victims on an equal footing in the case settlement process. This study uses a juridical method, namely research on positive legal principles and legal principles. In addition, legal interpretation and legal philosophy are also used. The results of the study show that the use of restorative justice for the enforcement of election criminal law in the 2024 election is still not possible, due to the unavailability of an adequate legal basis. Amendments to Law 7 of 2017 must be made to the form of justice that is to be realized. Apart from that, it is necessary to regulate a case settlement mechanism that is capable of realizing restorative justice. However, prevention efforts can be carried out by election supervisors, to minimize the number of cases that must be resolved.

Abstract

Election dispute resolution rules that apply to the execution of elections do not suddenly appear. It is the outcome of a protracted search for a democratic electoral system. As a result, it is essential to investigate the history and development of Indonesia's election dispute settlement mechanisms as well as the legal standards that have been established in the past. This is the normative study and has a historical legal perspective. According to the study's findings, Bawaslu is the sole authority responsible for resolving election-related disputes, and his rulings are final and binding. It is possible to implement Bawaslu's decision without relying on the judgment of other organizations. It is fair to assume that Bawaslu's authority in settling issues about the electoral process has changed from what was once known as "residual authority" to being "royal authority."

Abstract

Personal Data Protection is normatively regulated in the provisions of Law Number 27 of 2022, with the enactment of these provisions it should be a solution to problems that arise in the election oversight process, especially the election law enforcement process. The concept of personal data protection is important, especially with regard to Supervision of the Registration and Verification Stages of Election Contestants, Compilation of Voter Lists and Voting. In this stage it is closely related to the privacy of personal data and the personal dignity of a person to hold information and how this information is used. With the enactment of the concept of personal data protection in election supervision, it should be able to strengthen the position of election supervisors in preparing more technical legal instruments to prevent and deal with alleged election violations.

Abstract

This paper will look at the recruitment process for the Election Supervisory Committee at the sub district level in the 2024 election as a form of implementation of the Election Supervisory Body Regulation Number 4 of 2022 concerning the third amendment to the Election Supervisory Board Regulation Number 19 of 2017 concerning the formation, dismissal and interim replacement of the Election Supervisory Board. Provincial Election Supervisors, Regency/City Election Supervisory Board, District Election Supervisory Committee, Kelurahan/Village General Election Supervisory Committee, Overseas General Election Supervisory Committee, and Polling Place Supervisors, the role of Adhoc Supervisors as the front guard when conducting general elections simultaneously in 2024, in updating the data it was found that the activities carried out by the Election Supervisory Committee at the sub-district level in West Java Province were optimally pursued starting from the beginning of the election until the election ended.

Abstract

Women's political participation is an embodiment of the fulfillment of their citizenship rights. . Women as citizens and political entities have the right to improve their lives in the political sphere, so that women and other minority groups are not discriminated against. The tendency to give more space in the public sphere to men causes women not to have sufficient space in the ideas of statehood, including concerning the level of political participation. The research method carried out is descriptive research with data collection techniques with documentation studies. This paper aims to further analyze that the real issue of women and politics is not just the fulfillment of the 30% quota in parliament but how women can be involved in decision and policy making through various public spaces that open the widest possible access for women.In a such way, women can fully contribute to practical politics, especially with the holding of elections.

Abstract

Netralitas Aparatur Sipil Negara (ASN) menjadi salah satu persoalan yang selalu muncul pada penyelenggaraan Pemilu dan Pemilihan. Meskipun, Pemerintah telah membuat ragam regulasi untuk membatasi keterlibatan ASN dalam segala bentuk kegiatan politik, perilaku tidak netral masih saja terjadi. Hasil pengawasan pada Pemilu 2019 lalu, di provinsi Jawa Barat terdapat 20 (dua puluh) perkara pelanggaran Netralitas ASN terjadi di 12 (dua belas) Kabupaten/Kota. Seluruh perkara pelanggaran Netralitas ASN telah ditangani oleh Bawaslu Kabupaten/Kota dan ditindaklanjuti dengan penerusan rekomendasi ke Komisi Aparatur Sipil Negara (KASN) oleh Bawaslu Provinsi. Pengawas Pemilu seluruh tingkatan melakukan upaya pengawasan Netralitas ASN sesuai mandat yang telah diatur dalam Undang-Undang Pemilu dengan menerapkan konsep “Cegah, Awasi, Tindak” untuk mengatasi masalah pelanggaran netralitas ASN. Tupoksinya mengawasi keterlibatan ASN dalam segala bentuk kegiatan Kampanye, Mencegah terjadinya pelanggaran Netralitas ASN, dan menindak ASN yang menguntungkan/merugikan Peserta Pemilu. Penelitian ini mendasarkan kepada landasan pemikiran bahwa ASN wajib menjaga netralitasnya dalam kegiatan politik.

Abstract

Penelitian ini berkenaan dengan strategi komunikasi dalam menjaga sikap dan/atau perilaku netral aparatur sipil Negara dalam pemilihan kepala daerah, dalam konteks teori tindakan sosial.Berdasarkan kepada model P-Process, strategi komunikasi terdiri dari lima tataran, yaitu tataran analisis, rancangan strategik, pengembangan dan pengujian, implementasi, dan evaluasi. Selanjutnya, melalui metode kualitatif, kajian dalam penelitian ini akan dilakukan dengan menggunakan teknik analisis deskriptif. Berdasarkan hasil penelitian diketahui, Badan Pengawasan Pemilihan Umum (Bawaslu) Jawa Barat dalam upaya menjaga netralitas aparatur sipil negara(ASN) melakukan perubahan sikap dan/atau perilaku para aparatur sipil negara di daerah Jawa Barat, melalui penyebaran informasi atau pesan. Proses penyebaran pesan ini dilakukan melalui tahapan analisis, rancangan strategik, pengembangan dan pengujian, implementasi, dan evaluasi.Dengan demikian strategi komunikasi yang dilakukan oleh Bawaslu jabar selain sebagai sebuah aktivitas politik, juga merupakan sebuah arena dari berbagai ide dan keyakinan yang secara sistematis berkaitan dengan kondisi aktual, spiritual dan material di dalam masyarakat.Berdasarkan hasil penelitian diketahui pula,implementasi dari strategi komunikasi yang dilakukan oleh Bawaslu Jabar lebih menekankan kepada komunikasi kelompok daripada kepada komunikasi massa atau antarpribadi.
