Abstract

The Ministry of Communication and Digital (Komdigi), as the manager of the country's personal data, is responsible for the security of digital infrastructure through the implementation of Law Number 27 of 2022 concerning Personal Data Protection (PDP Law). The purpose of this study is to identify data breaches within the Ministry. The purpose is to analyze the policies of government officials within the Ministry as a form of accountability for government agencies regarding data breaches under the PDP Law. This study uses a normative research method. The legal material collection procedure in this study is a literature review. The results indicate that factors causing data breaches include human error, IT system weaknesses, and a lack of cyber audits, such as the 2023 case that affected 1.3 million users. Officials' responsibilities are regulated in Article 55 of Law Number 27 of 2022 concerning Personal Data Protection (PDP Law), which concerns data security due diligence, with administrative sanctions ranging from fines to criminal penalties or dismissal. Implementation still faces challenges such as a lack of cyber human resource training and cross-agency coordination Abstrak Kementerian Komunikasi dan Digital (Komdigi) selaku pengelola data pribadi negara bertanggung jawab atas keamanan infrastruktur digital melalui penerapan Undang-Undang Nomor 27 Tahun 2022 tentang Perlindungan Data Pribadi (UU PDP). Tujuan penelitian ini adalah untuk mengidentifikasi celah kebocoran data di Kementerian Komdigi. Untuk menganalisis kebijakan pejabat pemerintahan di Kementerian Komdigi sebagai bentuk tanggung jawab lembaga pemerintahan terkait kebocoran data berdasarkan UU PDP. Penelitian ini menggunakan metode penelitian normatif. Prosedur pengumpulan bahan hukum dalam penelitian ini yaitu kajian literatur atau studi kepustakaan. Hasil penelitian menunjukkan bahwa faktor penyebab kebocoran data meliputi kelalaian manusia, kelemahan sistem TI, minimnya audit siber, seperti kasus 2023 yang menyasar 1,3 juta pengguna. Tanggung jawab pejabat diatur dalam Pasal 55 Undang-Undang Nomor 27 Tahun 2022 tentang Perlindungan Data Pribadi (UU PDP) tentang due diligence pengamanan data, dengan sanksi administratif hingga pidana berupa denda atau pemecatan. Implementasi masih menghadapi tantangan seperti kurangnya pelatihan SDM siber dan koordinasi lintas instansi.

Abstract

This study aims to analyze the antinomy of norms between the protection of Sustainable Food Agricultural Land (LP2B) and the expansion policy of energy plantations in Papua in the context of the national energy emergency. The normative legal method uses a statutory, conceptual, and case approach, through a study of regulations related to LP2B, agrarian, and energy, as well as relevant doctrines and court decisions. The results show that there is regulatory disharmony between LP2B protection norms and energy expansion plans, which causes legal uncertainty in land management. The application of principles for resolving norm conflicts such as lex superior, lex specialis, and lex posterior has not been able to resolve the conflict because it is formal in nature. More substantive and integrative legal harmonization is needed to balance the interests of food security and sustainable and equitable energy ABSTRAK Penelitian ini bertujuan untuk menganalisis antinomi norma antara perlindungan Lahan Pertanian Pangan Berkelanjutan (LP2B) dan kebijakan ekspansi perkebunan energi di Papua dalam konteks darurat energi nasional. Metode hukum normatif dengan pendekatan perundang-undangan, konseptual, dan kasus, melalui studi terhadap peraturan terkait LP2B, agraria, dan energi, serta doktrin dan putusan pengadilan yang relevan. Hasil penelitian menunjukkan bahwa terdapat disharmoni regulasi antara norma perlindungan LP2B dan rencana ekspansi energi yang menyebabkan ketidakpastian hukum dalam pengelolaan lahan. Penerapan asas penyelesaian konflik norma seperti lex superior, lex specialis, dan lex posterior belum mampu menyelesaikan konflik karena bersifat formal. Diperlukan harmonisasi hukum yang lebih substantif dan integratif untuk menyeimbangkan kepentingan ketahanan pangan dan energi berkelanjutan dan adil.

Abstract

The implementation of regional autonomy in Indonesia since the Reform Era, particularly through Law Number 23 of 2014 on Regional Government, has been expected to enhance public welfare through the decentralization of authority and the strengthening of regional capacity. However, in practice, several challenges persist, including regional development disparities, the low quality of public services, and the suboptimal management of local resources. Data from the Central Bureau of Statistics indicate that poverty rates in several underdeveloped regions remain above the national average, while the Human Development Index (HDI) in certain areas is still categorized as moderate to low. This study aims to analyse the implications of the implementation of regional autonomy on improving community welfare. This normative research employs a descriptive-analytical method and a statutory approach, drawing on literature studies and secondary data analysis from government reports and international journals. The findings reveal that regional autonomy has positive implications in improving access to public services, accelerating infrastructure development, and encouraging community participation in local development. Nevertheless, its effectiveness is still influenced by the institutional capacity of local governments, the quality of human resources, as well as the level of transparency and accountability in governance. Therefore, strengthening good governance practices and enhancing the capacity of the regional apparatus are essential to ensure that the primary objective of regional autonomy in improving public welfare can be achieved optimally.

Abstract

This study aims to analyze the constitutional position of Village Community Institutions (LKD) in the Indonesian state system based on the 1945 Constitution of the Republic of Indonesia, examine the legal construction of LKD in the hierarchy of laws and regulations, and analyze the implications of LKD's constitutional legitimacy on the implementation of village governance. This study uses a normative legal research method with a statutory, conceptual, and historical approach, as well as legal material collection techniques through library studies. The results of the study indicate that the constitutional position of LKD is implicit-derivative, sourced from Article 1 paragraph (2), Article 18B paragraph (2), and Article 28C paragraph (2) of the 1945 Constitution of the Republic of Indonesia. The normative construction of LKD is pyramidal-incomplete: solid at the level of laws to ministerial regulations, but weak at the constitutional and village regulation levels. Strengthening the constitutional position of the Village Fund Management (LKD) is an urgent need considering that Indonesia has more than 75,000 villages that require effective participatory institutions. Meanwhile, various empirical studies show that the authority of the LKD remains unclear, there is a lack of synchronization between Home Affairs Ministerial Regulation Number 18 of 2018 and regional regulations, and the suboptimal implementation of the empowerment function and channeling of village aspirations. These conditions indicate a gap between normative regulations and institutional implementation in the field, so that legislative reform and vertical harmonization of regulations are needed to strengthen legal certainty and the effectiveness of village governance. ABSTRAK Penelitian ini bertujuan untuk menganalisis kedudukan konstitusional Lembaga Kemasyarakatan Desa (LKD) dalam sistem ketatanegaraan Indonesia berdasarkan UUD NRI Tahun 1945, mengkaji konstruksi hukum LKD dalam hierarki peraturan perundang-undangan, serta menganalisis implikasi legitimasi konstitusional LKD terhadap penyelenggaraan pemerintahan desa. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan, konseptual, dan historis, serta teknik pengumpulan bahan hukum melalui studi kepustakaan. Hasil penelitian menunjukkan bahwa kedudukan konstitusional LKD bersifat implisit-derivatif, bersumber dari Pasal 1 ayat (2), Pasal 18B ayat (2), dan Pasal 28C ayat (2) UUD NRI Tahun 1945. Konstruksi normatif LKD bersifat piramidal-tidak lengkap: solid pada tingkat undang-undang hingga peraturan menteri, namun lemah pada tataran konstitusional dan peraturan desa. Penguatan kedudukan konstitusional LKD menjadi kebutuhan yang mendesak mengingat Indonesia memiliki lebih dari 75.000 desa yang memerlukan kelembagaan partisipatif yang efektif, sementara berbagai penelitian empiris menunjukkan masih adanya ketidakjelasan kewenangan LKD, ketidaksinkronan antara Permendagri Nomor 18 Tahun 2018 dengan regulasi daerah, serta belum optimalnya pelaksanaan fungsi pemberdayaan dan penyaluran aspirasi masyarakat desa. Kondisi tersebut menunjukkan adanya kesenjangan antara pengaturan normatif dan implementasi kelembagaan di lapangan, sehingga diperlukan reformasi legislasi dan harmonisasi regulasi secara vertikal guna memperkuat kepastian hukum dan efektivitas penyelenggaraan pemerintahan desa.
