Abstract

Shiites tend to prioritize Ahl al-Bayt's position in transmitting Hadith. It affects the determination of Hadith as a primary source in Islamic Sharia. The Zaydi Maddhab, the Shi'a branch, is very dominant in Yemen. However, al-Shawkani, educated by his father and his Zaydist teachers, has a different view from Zaydism in positioning Ahl al-Bayt. Al-Shawkani saw that the uncertain political conditions in Yemen and the rise of blind taqlid directed Muslims to go astray and heresy at that time. This study examines al-Shawkani's stance on Ahl al-Bayt's position in determining the basis of Sharia law through his relevant works. Therefore, this socio-historical investigation also reveals the contribution of al-Shawkani thought in Islamic studies. This research shows that although al-Shawkani was influenced by Zaydism, objectively, he did not prioritize Ahl al-Bayt and was not passionate about one particular madhhab—a stance often opposed by Yemen's Zaydist scholars. In his works, al-Shawkani indirectly agrees with the opinion of Sunni scholars in determining the narrators of the Hadith as the primary source for deciding Islamic Sharia law. Thus, the contribution of al-Shawkani, who positions Hadith narrators objectively and scientifically, both Ahl al-Bayt and non-Ahl al-Bayt, is set the same as the criteria most scholars of Hadith experts determined.

Abstract

The Islamic State in Iraq and Syria (ISIS) spreads radical terror and invites people to commit violence to achieve their goals. ISIS also spreads hatred towards other groups contrary to their views based on their exclusive religious understanding. They consider their group to be the most righteous and others to be apostates or infidels, including the state or the government. Therefore, the Indonesian government must be wary of this group. Thus, the Indonesian government has banned ISIS radicalism in Indonesia because it is not by the values of Pancasila and the constitution. This research examines the imprisoning policy of the perpetrators of spreading ISIS radicalism and the form of policy formulation as a containment effort for terrorism crimes in the future. This normative juridical research method uses a statute approach and a conceptual approach. This research shows that the policy is that criminal responsibility for spreading radicalism can be imposed on individuals and groups, whether civilian, military, or police, who are responsible individually, or corporations. The corporation in question is an institution that is suspected and proven to have spread radicalism which leads to acts of terrorism. This crime originates from the regeneration of terrorist cells, which develop despite the different ways and modes of carrying out their actions. In addition, different perspectives on ideology also encourage the proliferation of terrorist cells that seek to incorporate Islamic law constitutionally and change Pancasila with an exclusive religious ideology.

Abstract

This study discusses the considerations of the judges of the Magelang Religious Court in granting permission for polygamy. In this case, the applicant applied for permission to practice polygamy because his first wife had a mental disorder. This study aims to determine judges' Islamic legal considerations in making decisions. This type of research is library research, using an analytical descriptive approach. The panel of judges, in their decision, apart from being based on the juridical aspect, also referred to the rule of fiqh: "If there are two evils threatening each other, then watch out for the one with the greater evil by carrying out the one with the least evil," then granted the petitioner's request because it was judged that the evil was much smaller than rejecting it. The petitioner's ability to act reasonably towards their wives and children is also considered to have met the requirements for polygamy as emphasized in the Qur’an (surah al-Nisa [4]: 3), so that the granting of permission for polygamy by the panel of judges is following Islamic Law and not against Indonesian Law.

Abstract

Wives are often the economic contributors of families, especially those with low income. They are additional income earners for the family. This phenomenon also occurs in Temanggung Regency. They work in various sectors, from the domestic to the public sector, because most men in Temanggung work as farmers and laborers, so their income does not fulfill the family's economic needs. This article examines the phenomenon of working wives in Temanggung Regency from the perspective of Islamic law and Talcott Parson's structural-functionalism theory. In the Qur'an, the husband's responsibility is to complete the family's needs according to his portion of the duties because men have physical advantages over women. Islamic law allows wives to work in Temanggung if they do not neglect their primary duties as homemakers. However, Islam is not permitted if it will cause disharmony in the family. From Parson's perspective, it has been classified that the wife's job is to work at home, and the husband's job is to work outside, so there is no competition in the household. Regardless, working wives in Temanggung help husbands fulfill family needs to overcome dysfunctional household harmony

Abstract

This research aims to examine Ali Zain al-Jufri's religious moderation. Through his work, al-Insaniyya qabla al-Tadayyun (Humanity before Religiosity), al-Jufri responds to the religious forms of Muslims in several parts of the world. By focusing on this work, the researchers thoroughly explore al-Jufri's thoughts regarding religious moderation. Why is this work relevant for study? Apart from the fact that no previous research has examined al-Jufri's work, this work is increasingly relevant to study if we reflect on current sociological facts. Much violence occurs in the name of religion. Those behaviors are nothing more than forms of interpretation, which are then considered the voice of God. At least, al-Jufri's work is one way out as an oasis to these problems. The method used in this research is a review-based qualitative method that focuses on examining al-Jufri's work. This research is classified as library research. In the end, this research concluded that there are three significant values of al-Jufri's religious moderation, including the command to speak good words (Surah al-Baqarah [2]: 83), the prohibition on killing fellow humans (Surah al-Ma'idah [3]: 32), and the order to uphold justice on earth (Surah al-Nisa [5]: 135). Therefore, al-Jufri distinguished religion and religiosity. Humanity, for him, is above religiosity, not religion.

Abstract

Today, humanity is facing the challenge of the authenticity of knowledge. Various efforts have been made to reach the point of truth. However, these efforts have yet to yield optimal results. Therefore, this study aims to address the problem of the search for truth. This study employs descriptive analysis to analyze the attaining of truth that humanity has conducted thus far from al-Zamakhshari's perspective. From this, it is found that modern humans excessively rely on human reason, which is purely empirical; moreover, reason ('aql) plays a role in critical thinking in revealing various phenomena. He also states that reason holds a significant function and role in the Islamic philosophical approach. He asserts that reason is an essential tool for comprehending Revelation and attaining truth: to comprehend the literal and deeper esoteric meaning of the Qur'anic verses and to employ it in interpreting the Qur'an. Al-Zamakhshari also believes that reason plays a crucial role in moral and spiritual life: to enable the differentiation between good and evil and guide individuals towards the right path. Thus, reason becomes a tool to attain the value of truth. Through reason, humans can comprehend the meaning of Revelation, both outwardly and inwardly. It is because truth is not merely physical but also metaphysical; thus, reason must be accompanied by Revelation to attain the meaning of truth. Consequently, reason is the instrument in moral and spiritual life.

Abstract

Islamization in Indonesia has been through a different process in each region. The spread of Islam in Indonesia has occurred in several ways, including preaching (da'wah). Walisongo is an Islamic figure who plays a significant role in the spread of Islam, especially in Java. Besides Walisongo, other Islamic figures also preached to disseminate Islam in Indonesia. This research emphasizes the biography of Sheikh Hisammuddin and his contribution to Islamization, especially in Lamongan. The method used in the research is the historical method, which consists of five stages of research: topic selection, heuristic, source criticism, interpretation, and finally, the historiography stage. This research aims to comprehend the biography of Sheikh Hisamuddin, the model of the spread of Islam by Sheikh Hisamuddin in Lamongan, and the exemplary example of Sheikh Hisamuddin as a preacher of Islam. As a direct descendant of Sunan Ampel, he has his method of spreading Islam, such as a cultural approach, social approach, elements of tawhid, political methods, and Pondok Lelono. In addition to contributing to the development of Islam in Lamongan, Sheikh Hisamuddin has an exemplary attitude; he is a person who is diligent and pious, hardworking, wise, devout in worship, and firm.

Abstract

Environmental problems become humanitarian problems, such as damaged area layers, erosion, and disease outbreaks that make the ecosystem unbalanced, which will endanger humans. Meanwhile, the discussion of Islamic relations and environmental ethics has always continued to be debated, ranging from handling and solving to sustainable businesses. This paper aims to elucidate the eco-religious paradigm and implications of ecological ethics in Islamic studies, including environmental movements. The study employs the analytical descriptive literature research issue. Islamic study and environmental ethics functionally serve as a tool or media that provides insight into various approaches to comprehending the relationship between Islam and environmental ethics so as not to be trapped in the fanaticism of secularism and human arrogance in dealing with nature. This study contributes theoretically through relationship theory, inter-relationship to interaction in terms of religious and environmental ethics points of view. Also, it seeks to make practical contributions in the form of human spiritual awareness to preserve the environment as a form of constructing natural values (hablu min al-‘alam). Furthermore, environmental ethics continues to evolve, adjusting to the need to assemble harmony in the future.

Abstract

Nurcholish Madjid and Abdurrahman Wahid are regarded as two of Indonesia's most influential Muslim intellectuals at the turn of the twentieth century. Adapting the concept of Barton (1997), both Madjid and Wahid are not only prominent public intellectuals but also can be considered intellectual ulama, scholars who combine the best of classical scholarship and intellectual leadership with modern secular and Islamic learning and participated alongside other public intellectuals in Indonesia's civil society forums. In addition, Greg Barton labels these personalities and characteristics of thought as Neo-Modernists or Neo-Modernist thinkers. This paper examines the interpretation of Madjid, who studied in a more Western academic culture, and Wahid, who studied in a Middle-Eastern country, on civil society as the manifestation of both Neo-Modernism's thought, followed by a discussion on the similarities and differences between the two ideas. Through an exploratory and comparative analysis, this study reveals that the Neo-Modernism interpretation of civil society articulated by both can be seen in their progressive thought towards Islam and society, Madjid with his idea of 'secularization' and further changed into 'de-sacralization'; while Wahid with his thinking on the indigenization of Islam (pribumisasi Islam). Their thoughts introduce an open, inclusive, progressive understanding of the relationship between Islam and civil society, asserting social pluralism and modernity and stressing the need for tolerance and understanding. Moreover, this paper also argues that both interpretations of Islam and civil society have been constructive for Indonesia in promoting democratic reforms, strengthening the importance of the Pancasila (the five pillars) foundation and state constitution, not religious sectarianism (theocracy), thus refuting the notion that Islam is incompatible with democracy and pluralism and assisting Indonesian society in the productive synthesis of Islamic ideas and modern concepts such as democracy, liberalism, and secularism.

Abstract

Muslims recognize the significance of mosques as sites of worship and as centers for their religious and other activities. Various efforts are organized and designed to make mosques relevant to cultural changes and the needs of Muslims. Mosque buildings are often not identical in each region and nation, with different customs and cultures, and are sometimes even similar to other religions. In addition, the temptation of capitalism also raises questions about mosque designs that are overly grand and problematic for the socio-economic life of the community. This article aims to interrogate whether such a well-built mosque is permissible from the perspective of scholars of the four madhhabs of fiqh and the aesthetics of Muhammad Iqbal. Thus, this research uses descriptive-interpretive and textual methods to scrutinize fiqh views and analyze Iqbal's aesthetic perspective on the mosque building. The study revealed that the four madhhabs allow decorations on mosque buildings so that the mosque remains the principal place of worship and does not inconvenience the solemnity of the congregation's prayers. Furthermore, the mosque's decoration, ornamentation, design, and construction must provide meaningful objectives with practical usefulness and philosophical value; otherwise, for Iqbal, decorating a mosque in excess is wasteful and unavailing, and embellishing a mosque means squandering time and money.
