Abstract

The standard of environmental quality is one of the instruments in preventing environmental pollution beside KLHS, special plan, environemtal analysis, UKL-UPL, permission, etc. the standard comprises of the standards of water, water waste, sea water, air ambien, emission, and nuisance. Politics of law in determination of the standards as a preventive  instrument of the pollution is based on Article 28H verse (1) of the Indonesian Constitution 1945 states that healthy and good environment is a human rights that should be guaranteed, Article 33 of the Act also provides that national economy must be based on economic democracy by environmentally principle. The determination is one of the legal responsive forms raised from democracy politics configuration to answer the need of people for the healthy and good environment. Abstract

ABSTRACT: This research aims to explore how the protection on fishery in the Indonesian territorial and Economy Exclusive Zone in Aceh and obstacles faced by the government in providing the protection on fishery resources in Aceh. Descriptive analytical method is applied to describe and find the legal facts wholly relating to the protection. The research shows that the implementation of monitoring in terms of conducting the laws has obstacles especially regarding the staffs monitoring it, patrol vessels and budget in monitoring the protection. Abstract

The initiative to include 'uqubat ta'zir whips as a punishment for those who commit animal killing, as stated in Qanun Aceh Number 11 of 2019 concerning Wildlife Management, has been rejected due to its reference to Law Number 5 of 1990 concerning Natural Resources Conservation. This initiative holds significance in terms of the conceptual understanding and application of caning as a criminal sanction in Indonesia. Through doctrinal methods, this study has determined that caning for perpetrators of animal killing falls under 'uqubat ta'zir, where the form, type, and severity of punishment are determined by the ruler based on philosophical, juridical, and sociological considerations. The implementation of caning for those who commit animal killing is deemed appropriate, as the regulations in Indonesia are founded upon values deeply rooted in the community. Therefore, it is fitting to carry out this punishment, similar to other offenses regulated in the Aceh Qanun Jinayat.

Abstract

Tujuan penelitian ini untuk menganalisis bagaimana koordinasi struktur dalam penegakan hukum terhadap penangkapan ikan ilegal di perairan Aceh. Analisis ini berdasarkan pemahaman bahwa pemanfaatan sumber perikanan yang dilakukan oleh kapal perikanan harus selalu berdasarkan izin. Khusus bagi nelayan kecil dikecualikan. Realitasnya penangkapan ikan banyak terjadi secara ilegal, sehingga perlu dilakukan penegakan hukum terhadap pelaku pelanggaran. Penelitian ini menggunakan metode sosio-legal, dengan melihat hukum yang tidak terpisahkan dari berbagai faktor lain. Temuan penelitian menunjukkan bahwa penegakan hukum belum terlaksana secara efektif. Struktur yang terlibat dalam penegakan hukum di laut adalah Penyidik Pegawai Negeri Sipil, Tentara Nasional Indonesia Angkatan Laut, dan Kepolisian Air dan Udara. Penegakan hukum dilakukan melalui pengawasan dan penangkapan terhadap kapal-kapal yang melakukan penangkapan ikan secara ilegal. Sebanyak 36 kapal ditangkap dan dikenakan sanksi hukumnya. Koordinasi struktur dalam penegakan hukum masih kurang. Disarankan supaya dilakukan penegakan hukum secara terus-menerus yang efektif dan dilakukan koordinasi secara intensif antara para penegak hukum dengan memperkuat personil dan peralatan dalam penegakan hukum di laut. Improvement of Structural Coordination in Illegal Fishing Law Enforcement in Aceh This study aims to analyze the structural coordination in law enforcement against illegal fishing on the Aceh coast. This analysis is based on the understanding that the use of fisheries by fishing vessels must always be based on a permit. Especially for small fishermen it is excluded. In fact, many fishing occurs illegally, so it is necessary to enforce the law against the perpetrators. This research uses the socio-legal method, by looking at the law that is inseparable from various other factors. Research findings indicate that law enforcement has not been implemented effectively. The structures involved in the law enforcement are Civil Servant Investigators, the Indonesian National Army, the Navy, and the Air and Water Police. Law enforcement is carried out through the supervision and arrest of vessels fishing illegally. A total of 36 ships were arrested and subject to sanctions. Structural coordination in law enforcement is lacking. It is recommended that effective continuous law enforcement and intensive coordination between law enforcement agencies be carried out by strengthening personnel and equipment in law enforcement at sea.

Abstract

Pengetahuan tradisional merupakan hasil inovasi maupun kreasi dari manusia baik dari segi pengetahuan, seni, dan sastra. Pengetahuan tradisional dapat dimanfaatkan secara ekonomi demi kemajuan dan kesejahteraan masyarakat. Metode penelitian yang digunakan yaitu yuridis normatif dengan spesifikasi deskriptif analitis. Upaya Indonesia dalam melindungi kekayaan intelektual atas pengetahuan tradisional di Indonesia yaitu pemerintah Indonesia sedang menyiapkan Rancangan Undang-Undang tentang Pengetahuan Tradisional dan Ekspresi Budaya Tradisional. Upaya lain yang dapat dilakukan yaitu melalui cara inventarisasi atau dokumentasi atas pengetahuan tradisional disuatu wilayah dan dapat dilakukan dengan cara mempublikasikan pengetahuan tradisional tersebut seluas-luasnya. Faktor yang melatarbelakangi pengetahuan tradisional belum dimanfaatkan secara optimal sebagai sumberdaya ekonomi yaitu kurangnya pengetahuan masyarakat tentang perlindungan atas pengetahuan tradisional dan biaya untuk memproduksi kekayaan intelektual cukup tinggi. Legal Protection of Intelectual Property Rights to Economic Benefits of Traditional Knowledge Traditional knowledge is the result of innovation and creation of human beings both in terms of knowledge, art, and literature. Traditional knowledge can be utilized economically for the betterment and prosperity of society. The research method used is normative juridical with analytical descriptive specification. Indonesia's efforts in protecting intellectual property on traditional knowledge in Indonesia is the Indonesian government is preparing draft of the law on Traditional Knowledge and Traditional Cultural Expression. Other efforts that can be done is through the inventory or documentation of traditional knowledge in a region that can be done by publishing the traditional knowledge as widely as possible. The underlying factors of traditional knowledge have not been optimally utilized as economic resources namely the lack of public knowledge about the protection of traditional knowledge and the cost of producing intellectual property is high enough.

Abstract

ABSTRACT: Regardless of difference meaning and perception on justice, access to justice has been universally recognized in international system of human rights. Access to justice by the children in over the world is not an exemption part of the system. This essay aiming at discussing the availability of access to justice and offering effort to optimilize the access. The study reveals that, according to normative approach, the guarantee of access of the children to justice has been comprehensively administered on the convention of the rights of the child, national laws, and local laws in Aceh. At practical level, however, much should be done by both national and local government. It covers a rank of action from making a new law that support the best interest of the child to improve knowledge of the child on their own rights, as guaranted by the international, national, and local law. Access to Justice for Children

Abstract

ABSTRAK: Hasil kajian ilmuan ditemukan bahwa perubahan iklim memberi dampak negatif pada berbagai sektor, salah satunya kelautan dan perikanan. Dampak negatif pada bidang kelautan adalah terjadinya kenaikan permukaan air laut yang diakibatkan oleh pemanasan global yang menyebabkan mencairnya es di kutub utara dan selatan. Selain itu cuaca ekstrem juga merupakan dampak dari pemanasan global yang langsung dirasakan oleh hampir seluruh masyarakat dunia, terutama nelayan. Nelayan sangat bergantug kelangsunga hidupnya pada iklim. Aceh sebagai provinsi yang berbatasan langsung dengan laut, sebagian masyarakat Aceh berprofesi sebagai nelayan, sektor perikanan merupakan salah satu pilar ekonomi masyarakat yang terkena dampaknya. Hasil Penelitian mendapati bahwa dampak perubahan iklim terhadap sektor perikanan di Aceh telah sampai pada tahap yang mengkhawatirkan, terutama pada masyarakat nelayan tradisional dan kapal boat penangkap ikan kecil. Lebih lanjut pengaturan dan keterlibatan pemerintah daerah Aceh dalam membantu masyarakat dalam menghadapi dampak perubahan iklim sampai saat ini masih sangat minim. Hal ini dapat dilihat di beberapa kawasan yang mayoritas masyarakatnya nelayan, sangat minim sarana dan prasarana, serta informasi terkait dampak perubahan iklim. Saat ini Qanun No.7 Tahun 2010 tentang Perikanan, belum mampu memberikan dampak yang signifikan terhadap sector perikanan di Aceh Besar pada umumnya, hal ini dikarenakan sampai dengan saat ini belum adanya Pergub terkait qanun tersebut. Oleh sebab itu diperlukan penanganan segera untuk dapat mengatasi hal ini, sehingga dapat melahirkan program-program dari turunan qanun tersebut untuk dapat meningkatkan kesejahteraan masyarakat nelayan.  Local Government Policy on Facing the Impact of Climate Change on Fishery Sector ABSTRACT: Fishermen depends on the weather, and Aceh as a province that faces the sea directly, the fisherman in Aceh feel difficult life than before. Almost all the fisherman have no other source for their income, they only depend on fisheries as their livehood. Research finds that effect on climate change to the fisheries sector in Aceh has  been in critical level, especially for fisherman that uses traditional method and using small boat. Furthermore, regulation and the involvement of Aceh Government is lack in handling the problems. This situation can be seen in majority of fisherman, lacks of facility and information related to the impacts of climate change. Now, generally, Qanun (Local Regulation) No. 7/2010 on Fisheries is still unable to give significant impacts for fisheries sector in Aceh Besar. It is because until now there is Governor Regulation related to those Qanun. Therefore, it needs to handle and overcome the problems. Thereby, the programs that related to Qanun can be implemented and can increase the fisherman welfare.

Abstract

Muḍārabat agreement in financing system by shariāh banks supposedly refers to the freedom of contract (al-hurriyāt). However, Bank Sumut Shariāh as one of the shariāh banks in Indonesia apparently does not apply this principle in the financing schemes. This study presents an analysis of the use of muḍārabat agreement in the financing system, according to its justice and beneficial principles. The study was carried out through exploratory and descriptive observations, while the obtained data was analyzed using an in-depth descriptive content method. The results revealed that the bank intends to implement a non-shariāh agreement instead of muḍārabat agreement in the financing system. The agreement is supposedly constructed according to al-hurriyāt where both parties have fair and proportional obligations and rights. Expectedly, it will imply to the raise of other benefits and equities in the economic growth and financing system, especially to those of the small and medium scale enterprises.

Abstract

Penelitian ini bertujuan untuk menganalisis dan memetakan produk hukum daerah apa saja yang dapat mendorong upaya perwujudan kabupaten/kota layak anak. Tingginya kasus dan kekerasan terhadap anak merupakan fakta bahwa hak-hak anak belum terpenuhi oleh pemerintah, termasuk pemerintah daerah. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan peraturan perundang-undangan, analitis, dan konseptual. Hasil penelitian ini menunjukkan bahwa: roadmapping kebutuhan hukum daerah agar terciptanya kabupaten/kota ramah anak bersumber dari kewenangan daerah rezim hukum pemerintahan daerah yang diatur dalam UU No. 23 Tahun 2014 tentang Pemerintahan Daerah dan rezim hukum sektoral perlindungan anak yang diatur dalam UU No. 23 Tahun 2003 tentang Perlindungan Anak. Produk hukum daerah yang dibutuhkan antara lain peraturan daerah dan peraturan bupati/walikota. Setidaknya terdapat lima Perda yang dibutuhkan dalam rangka mewujudkan kabupaten/kota layak anak yaitu Perda tentang Perlindungan Anak, Perda tentang Pengembangan Partisipasi Anak dalam Pembangunan, Perda tentang Pemberian ASI Esklusif, Perda tentang Ketahanan Keluarga, dan Perda tentang Kawasan Tanpa Rokok. Pemetaan kebutuhan produk hukum daerah ini nantinya akan menjadi arah kebijakan hukum untuk mewujudkan kabupaten/kota layak anak. Mapping the Needs of Local Law In Order to Create the Friendly District and City Area For Kids This study aims to analyze and to map local regulations that can encourage efforts to form districts/cities that are child-friendly. The high cases of violence against children is a fact that children's rights have not been protected by the government, including local governments. This study uses a normative legal research method with a statutory, analytical and conceptual approach. The results showed that the authority to form regional regulations to create child-friendly districts/cities originated from the authority regulated in the Law No. 23 of 2014 concerning Regional Government and the sectoral legal regime for child protection as stipulated in the Law No. 23 of 2003 concerning Child Protection. Regional legal products needed include regional regulations and regent/mayor regulations. At least there are five Regional Regulations needed in order to realize child-friendly districts/cities, namely Regional Regulations on Child Protection, Regional Regulations on the Development of Child Participation in Development, Regional Regulations on Providing Exclusive ASI, Regional Regulations on Family Resilience, and Regional Regulations on Non-Smoking Areas. Mapping the need for regional legal products will later become the direction of legal policy to realize districts/cities that are child-friendly.
