Abstract

Regional House of Representative is the state institution existing after the fourth amendment of the Constitution 1945. Its functions have been worded in Article 22 of the Constitution. The element of the institution is people representatives from region is working for their regions.before the Court decision, it is deemed as a body has no significant rules as a legislation body.  The members are chosen by voters directly making it should have more power. It  is relevant due to the fact that the problems are bigger. If it is deemed that the members are directly elected, the consideration is too weak as it is rule by the   election in 2004 has ruled this. The court decision on 27 March 2013 making the power has been in accordance with the constitution. Given to this, the body can have more roles in handling the interests of the people. Abstract

ABSTRACT: Dengan diberlakukannya UU No.32/2009 maka ketentuan UU No. 23/1997 menjadi tidak berlaku lagi. UU No. 32/2009 ini diberi nama UU tentang Perlindungan dan Pengelolaan Lingkungan Hidup yang isinya ternyata lebih luas pengaturannya dibandingkan dengan UU sebelumnya, yang diberi judul UU tentang Pengelolaan lingkungan Hidup, termasuk masalah pengaturan ketentuan pidananya baik dilihat dari sudut hukum pidana materilnya maupun formilnya. Ada beberapa persoalan berkaitan dengan hukum pidana materil yang berbeda ketentuannya dibandingkan dengan UU No. 23/1997. Diantaranya lebih diperbanyak perbuatan yang dapat diberi sanksi Pidana (perbuatan pidana), kemudian sistem penjatuhan hukumannya yang mengenal hukuman minimum baik untuk pidana penjara atau pidana denda, kemudian berkaitan dengan pertannggungjawaban, semakin dipertegas korporasi sebagai subyek hukum pidana. Sedangkan yang berhubungan dengan hukum pidana formilnya adalah soal pembuktian, dimana dalam UU No.32/2009 ini macam-macam alat bukti yang dapat digunakan untuk tindak pidana ini ditambah lagi selain dari yang ditentukan dalam pasal 184 ayat (1) KUHAP. Selain itu juga telah dimasukkan tentang perlunya sistem peradilan pidana terpadu guna penanganan yang lebih efektif. Abstract

ABSTRACT: In order to achieve welfare, everyone has a right to have and own land individually including the right n it. However, the reality of Indonesian shows that the gap of ability to have land causing the low income is not able to compete the have. In terms of protecting the have not, the state has a power to interfere as stated in the Land Act as to be a legal basis for it. There is an explicit rule regulating the protection towards the low-income people as mentioned in Article 11 of the Act and there are also regulations substantially in Articles 7, 9, 17 of the Act. In addition, there is a rule for implementation of the Act but Is only limited to the protection of the have not in owning he land for farming and there is no regulation on the ownersip for the land in city and non-farming land. The availability such rules in not balanced with the implementation; hence there are many people that are low-income category have not had the land yet. Land for Low Income People

Abstract

This article examines the legal protection model due to the corona virus disease (Covid-19) in Indonesia. With the global impact of the Covid19 virus pandemic, the country's activities and survival have come to a halt. This article determines the form of Reconstruction of the Legal Protection Model for the Impact of the Global Corona Virus Disease 19 Pandemic in Indonesia. This study uses normative methods that are doctrinal, analytical, exploratory and explanatory with qualitative analysis. The results shows that the Indonesian state relies on largescale social funding policies (PSBB) with a disaster scheme that is recommended as a health emergency. It is an ideal model of legal protection against the impact of COVID-19 based on human rights (HAM) and the supremacy of law which are integrated and connected to resolve multisectoral impact problems. Abstract

The aims of this study is to analyze the implementation of empowerment by the Aceh Social Department for people with disabilities and the obstacles in its implementation, in accordance with government regulation No. 52 year 2019 about the welfare accomplishment for people with disabilities.This legal study employs the juridical-empirical method using primary data gathered from interviews and secondary data from literature review as supporting material. Afterward, the data is analyzed using a qualitative approach.The findings showed that the Aceh Social Service based on the Minister of Social Affairs Regulation No. 9 year 2018 concerning Basic Service Technical Standards on a Minimum Service Standardsin the Social Sector in Province and Regency/City only authorized to implement the empowerment for the disabled who were in the orphanage, where, Aceh currently has only one orphanage under Aceh Social Service which available special for the disabled-blind. The obstacles in its implementation are inaccurate data available, limited budget and limited human resources, resulted the empowerment has not implement optimally. A systematic planning and mapping should be done by related party, with the aim, every type of disability can be reached and the efforts can be performed properly, until the independent and the inclusive people with disabilities/disabled groups can be achieved.

Abstract

Artikel ini ingin menjawab pentingnya penetapan aturan hukum yang tegas dan kompre-hensif yang dapat memberikan perlindungan terhadap data pribadi yang berlangsung melalui media elektronik di Indonesia. Permasalahan ini muncul dengan perkembangan teknologi informasi saat ini telah menimbulkan persoalan hukum baru, yaitu mengenai perlindungan keamanan atas data pribadi yang berlangsung melalui media elektronik. Banyaknya pihak yang menggunakan media elektronik tersebut sebagai alat komunikasi dan transaksi mengakibatkan terjadinya penyalahgunaan data pribadi. Sejumlah negara seperti Uni Eropa, Amerika, Inggris, Hongkong, Singapura, dan Malaysia, telah memi-liki aturan yang tegas dan komprehensif berkenaan dengan data pribadi. Akan tetapi sampai sejauh ini Indonesia belum punya undang-undang khusus yang mengatur perlin-dungan data pribadi. Di Indonesia aturan mengenai hal tersebut terdapat dalam Pasal 26 UU No. 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik dan juga tercantum dalam beberapa aturan hukum lainnya yang terpisah. Meskipun demikian, Pasal tersebut dianggap umum. hal ini dipandang perlu segera disahkan dalam bentuk undang-undang tersendiri untuk memberikan jaminan keamanan dan perlindungan data pribadi serta dapat memberikan sanksi baik dalam bentuk pidana ataupun perdata bagi yang menyalahgunakan data pribadi tersebut.  Urgency of Personal Data Protection Law in Indonesia: Comparative Study of English and Malaysia Law  This article aims to answer the importance of enactments assertive and comprehensive legal rules in Indonesia that can provide personal data protection on electronic media. This problem emerges with the recent development of information technology which has led to new legal issues. The issues are about security and protection towards personal data that occured through electronic media. There are people who use electronic media as a tool of communication and transaction which may lead to the abuse of personal data. Some countries such as the European Union, the United States, the United Kingdom, Hongkong, Singapore and Malaysia already have assertive and comprehensive law regarding the protection of personal data; however, so far there is no specific law in Indonesia that regulates personal data protection. In Indonesia, the regulation about personal data protection is stated in Article 26 of Law Number 11 Year 2008 on Information and Electronic Transactions and also this personal data protection regulation listed in several separate legal rules. Nevertheless, it’s Article is considered general. Therefore, it is deemed necessary to be immediately ratified in the form of law to provide security and protection and may impose sanctions in both criminal and civil forms for those who misuse the personal data.

Abstract

ABSTRAK. Di Provinsi Aceh pertambangan minyak menjadi salah satu kegiatan pertambangan terbesar dan menjadi sumber daya alam unggulan bagi pendapatan daerah. Permasalahan muncul setelah pertambangan tersebut berhenti beroperasi, banyak lahan-lahan bekas pertambangan yang ditelantarkan oleh perusahaan sehingga memunculkan potensi tumpang tindih hak atas tanah di kemudian hari. Penelitian ini menggunakan socio-legal research. Melalui pendekatan ini, objek hukum akan dimaknai sebagai bagian dari subsistem sosial di antara subsistem-subsistem sosial lainnya. Hasil penelitian ini memberikan gambaran bahwa kegiatan pertambangan di Provinsi Aceh memiliki dampak negatif terhadap ekosistem hutan yang ada di Aceh. Akibatnya, Aceh mengalami kekeringan ketika musim kemarau, hasil pertanian mereka pun menurun. Selain itu eksploitasi yang dilakukan perusahaan tambang mengakibatkan banyaknya lahan pertambangan yang ditelantarkan. Upaya pemerintah dalam pengaturan pemanfaatan, penggunaan serta peruntukannya dapat menjadi kewenangan pemerintah daerah. Pengawasan harus dilakukan dengan adanya kerjasama antara Badan Pertanahan Nasional dan pemerintah daerah dalam memproteksi permohonan sertifikasi tanah di atas lahan bekas tambang. Policy of the National Land Authority on Ex Mining Land in Aceh Province  ABSTRACT. Oil exploration is one of the largest mining and natural resources for local revenue. A problem arises when the mine quits its operations, it then abandoned by the company causes the potential overlap of land rights in the future. This is socio-legal research. By it, the legal objecs are interpreted as part of the social subsystem among the others. The research shows that mining activity has a negative impact on the forest ecosystem. Thus, Aceh suffers from droughts during dry season, their agricultural products decrease. In addition, the company abondons mining lands. Efforts done by the government in regulating the usage, and painning is a local government authority. It should be done by the cooperation between the National Land Agency and local gevernments in protecting the certification application on the former mining lands.

Abstract

ABSTRACT: An adopted child is the child which his rights has been changed from his parents, guardian that is valid or other people that are responsible for taking care, education and to grow the child by in the family of adopted parents based on the decision of the court. The parents are responsible for daily life and education of the child. In Islamic law the adopted parents are still having relationship with his biological parents; hence the child is not going to be one of the parties receiving the legacy from the adopted parents. Abstract

ABSTRACT: The conflict of trawl has been occurring for long time in Aceh.  Using trawl is not only illegal but also resulted in a decrease of catcher number got by fishermen in the place. This article aims to explain the conflict in Lhok Meureubo in relation to the legal ban of the usage of trawl, the conflict settlement process, as well as the steps taken by the Government of West Aceh district in anticipating its usage in the future. The methods applied include normative and empirical research. The normative research is done through legal materials. While the empirical one is conducted by interviewing a sample of purposively selected sample. The conflict in Lhok Meureubo is due to the use of trawling gear, it has been happening since 2003. The conflicts come up by the use of trawl types that are not environmentally friendly. The use of such fishery catcher has been taking time for a long time, but after the tsunami, the use of mini-trawling increasingly from a variety of aid for tsunami victims. The steps taken by the Government of West Aceh district to overcome the problem in the future, is especially by replacing the trawl gear with the one that is more environmentally friendly. The fishermen who use the trawl which the boat already registered is then reported to the Department of Marine and Fisheries of West Aceh district to get the trawl replaced by environmentally friendly trawl. A Settlement Model of Trawl Conflict in West Aceh

Abstract

ABSTRAK: Pembatalan Undang-Undang No. 7 Tahun 2004 tentang Sumber Daya Air (UUSDA) secara keseluruhan, berdampak kekosongan aturan pelaksanaan tanggung jawab pelestarian sumber air. Hal itu disebabkan UUP sebagai pengganti UUSDA tidak memiliki PP terkait dengan tanggung jawab pelestarian sumber daya air. Sebaiknya UUSDA tidak dibatalkan secara keseluruhan, tetapi hanya dihapuskan pasal yang dipandang bermasalah saja seperti pasal 3, 4, 5, dan 6. Sedangkan pasal-pasal yang lain perlu dipertahankan seperti pasal 21 UUSDA beserta peraturan pelaksanaannya karena masih relevan untuk dipertahankan. Agar wujudnya aturan hukum yang responsif yang dapat menjawab permasalahan hukum dalam masyarakat, khususnya kerusakan pada sumber air yang diakibatkan oleh aktivitas pembangunan.  Water Resource Protection Responsibility Isue after the Nullification of the Art Number 7, 2004 ABSTRACT: The abolition of the Act Number 7, 2004 regarding Water Resource has impact on the empty rule of implementation. It result from the Act as the replacement of the Water Resource has had the Government Regulation relating the responsibility of the resource. It would be better if the Act is not changed totally however it deletes Articles having problems namely Articles 3, 4, 5 and 6. While other articles should be defended namely Article 21 of the Act and its implementing rules. In terms the realization of laws to be responsive would answer  problem in society especially the destruction of the resouscer due to the development acitivities.
