Kanun: Jurnal Ilmu Hukum
anun: Jurnal Ilmu Hukum (KJIH), the Indonesian Journal of Autonomy Law, is an international journal dedicated to the study of autonomy law within the framework of national and international legal systems. Published thrice annually (April, August, December), KJIH provides valuable insights for scholars, policy analysts, policymakers, and practitioners. Managed by the Faculty of Law at Syiah Kuala University in Banda Aceh, Indonesia, KJIH has been fostering legal scholarship since its establishment in June 1991, with the ISSN: 0854 – 5499 and e-ISSN (Online): 2527 – 8428. In 2020, it received national accreditation (SINTA 2) from the Ministry of Research and Technology of the Republic of Indonesia and the National Research and Innovation Agency. KJIH is actively pursuing indexing in prestigious databases like Scopus, Web of Science and other global indexes. We publish in English for accessibility, not as a political statement. The Editorial Board shall not be responsible for views expressed in every article.

The usage and management of the sea resources are still having classic obstacles either technical or structural. Aceh’s sovereign on the sea should be realized by the optimizing its resources wisely. For that reasons, the comprehensive understanding in terms of fulfilling Human Rights is relevant enough to be an indicator and it is part of state responsibility. This article aims to explain the reality of the sovereignty based on human right principle. Regarding to the management of the resources, the Aceh Government is taking part to manage and use it. Article 162 (1) of Aceh Governance Act states the Government and regional governments are entitled to manage the resources living in the territory. The development refers that, Aceh has great opportunity to develop its sovereignty. Thus, the state responsibility in fulfilling economic rights, social, and culture as demanded can be realized. ABSTRAK: Provinsi Papua memiliki begitu banyak sumber daya alam, tetapi masyarakatnya masih hidup dalam keterbelakangan dan serba kekurangan. Kondisi ini menjadi pemicu timbulnya konflik di Papua. Untuk mengatasi persoalan dimaksud melalui Undang-Undang No. 21 Tahun 2001 sebagaimana telah diubah dengan Undang-Undang No. 35 Tahun 2008, Provinsi Papua diberikan status sebagai daerah otonomi khusus dengan berbagai kewenangan, salah satu kewenangan dimaksud adalah dalam bidang pengelolaan sumber daya alam. Pemberian kewenangan dalam pengelolaan sumber daya alam ini dimaksudkan sebagai upaya untuk meningkatkan pendapatan masyarakat, sehingga masyarakat Papua dapat hidup lebih makmur dan sejahtera. The Authority of Natural Resources Management in the Scope of Special Autonomy in Papua ABSTRACT: Papua Province has a lot of natural resources, but the people still live poverty. The condition has caused a conflict in Papua. In order to handle the problems, the Act Number 21, 2001 has awarded the province as special autonomy with several authorities; one of these is in the field of managing natural resources. The provision in the field of managing natural resources is aiming at increasing the income of people of Papua Province hence they will be living in wealth and prosperity.

ABSTRACT: A public notary has an authority as a notary as an officer as mentioned in the Act of Public Notary in Article 1 Number 3 that is a public officer pointed for a temporary time and has the power as notary. A replacement notary is appointed by compentent officer based on the act not by the notary who refers him. The rule on the legal status of the replacement notary is needed not only for the interest of the notary, but also for public who needs the notary. Land tenure conflict arising from unauthorized land use crimes is a significant aspect of Indonesia's agricultural reform era. Such conflicts have been observed in various regions of the country, indicating a pattern of managing property without the consent of the rightful owner or their representative. However, there is a lack of public understanding regarding the specific elements of criminal activity that fall under the broad term "grabber," which encompasses property-related crimes. This article used a normative approach to look at the issue of the law on unauthorized land use crime in community. This issue becomes particularly contentious in cases involving Plantation Use Right (HGU) land, where individuals without proper rights attempt to assert control. When the HGU expires, it often reveals that the state is the rightful owner, leading to the criminal classification of "acquiring land without a legal permit or representative" and qualifying as a "misappropriation of land rights" under criminal law. To prevent such crimes in the future, it is crucial for the government to demonstrate a strong commitment to law enforcement and educate the community on this matter.

The enactment of electronic signatures, especially at the General Meeting of Share-holders (GMS) and responses to legal actions from electronic signatures in the deed of Decision of the General Meeting of Shareholders in a Limited Liability Company, will be confronted by the progress of the era and the legality of the deed. This research method is classified as normative research, the approach method is descriptive analytical. This study shows that the regulation of electronic signatures on the deed of the Statement of Shareholders' Meeting Resolutions is the development of the form of legal evidence. For this reason, the form of evidence is made in the form of electronic information or electronic documents. The effect of the signing if it is done through electronic media, namely the result of the GMS decision has a legal impact on the status of ratification in the law. If the GMS has an electronic signature so that the legality of the legal action is recognized, the government and especially the legislators make legal rules to regulate with certainty the validity of the results of the GMS electronically, so that legal certainty is formed.

Penelitian ini ingin menjawab keberadaan hukum pertanahan setelah otonomi daerah. Pemberian otonomi pada pemerintah daerah dan pemerintahan kabupaten/kota setelah reformasi merupakan upaya untuk memberi pelayanan secara cepat dan tepat pada masyarakat bidang pertanahan. Dengan melakukan studi dokumen, ditemukan bahwa otonomi dibidang pertanahan justru berdampak pada hukum agraria. Undang-Undang Peraturan Dasar Pokok-Pokok Agraria yang mengandung prinsip kewenangan dibidang pertanahan bersifat sentralistik, dengan sendirinya harus berubah. Pemerintah di daerah harus memberikan pelayanan dibidang pertanahan pada era otonomi daerah ini. Agrarian Law of Land After Regional Autonomy This study aims to answer the existence of land law after regional autonomy. Giving autonomy to the regional government and district/city government after reform is an effort to provide quick and precise services to the land sector community. By conducting document studies, it was found that autonomy in the land sector had an impact on Agrarian Law. The Basic Law of Agrarian Principles which contains the principle of authority in the land sector is centralized, and must naturally change. Governments in the regions must provide services in the land sector in this regional autonomy era.

ABSTRAK. Salah satu organ penting dari sebuah perusahaan adalah rapat umum pemegang saham. Rapat umum pemegang saham adalah forum tertinggi untuk pengambilan keputusan perusahaan. Keputusan rapat umum pemegang saham akan menjadi dokumen hukum baik bagi pemegang saham dan bagi perusahaan itu sendiri. Keputusan akan memiliki kekuatan bukti jika telah dicatat dalam rapat umum pemegang saham yang kemudian dituangkan ke dalam akta notaris yang bernama Rapat Umum Pemegang Saham. Notaris sebagai pejabat publik dalam akta Rapat Umum Pemegang Saham hanya bertanggung jawab atas kebenaran akta formal minuta dari pertemuan. General Meeting of Shareholders Dosier as Authentic Deed in Relation to Responsibility of Public Notary as Public Officials ABSTRACT. One of the important organ of a company is the general meeting of shareholders. The general meeting of shareholders is a top forum for decision-making of a company. Decision of general meeting of shareholders will be a legal document both for shareholders and for the company itself. The decision will have the strength of evidence if it has been recorded in the minutes general meeting of shareholders which is then poured into a notarial deed which is named General Meeting of Shareholders. Public Notary as a public official in the deed General Meeting of Shareholders is only responsible for the correctness of the formal deed the minutes of the meeting.

ABSTRACT: This article aim is to describe regarding customary law in the Indonesia legal system inconnection with Indonesia cionstitusian and other national law level and its impact toward the customary law application in the field.Based on this analytical study can be summerised that: 1). the structure of customary law in Indonesia national law system is the similar position with any other national law. The diffrerence among of them is customary law unrecorded writtenly such as national law; 2). UUD 1945 as Indonesia’s constitusion recognises beside written law also available unwritten law as known with named customary law (hukum adat); 3). UUD 1945 more prioritise written law in form of undang-undang level and other Indonesia’s national law level in creating and managing social live; 4). This reality must be responsed by parliament in craeting Qanun (regional law) in Aceh through accomodating customary law that grow, live and rise in the community, it is caused customary law is an awaranes of law rising in community as populer named living law; and 5). The judicial roles and the finder of law is very strategic in overseeing the legal awaranes occur in the community that must be used as the main consideration in handling particular legal case, therefore judicialprudence is one of legal indentity source whic lives in community. ABSTRACT: Basically, a crime is a conduct that is seen as a deviant act. A criminal case settlement, besides solving it before the court, in Aceh society, there are many cases of crime solved through customary law way. This research purposes at knowing the existence of customary law and sanction towards the violator of criminal law and whether this kind of sanction is effective as a legal basis in settling the case. This research applies both normative and empirical methods. The data then analyzed qualitatively based on juridical, logical, systematic interpretation by inductively and deductively. The research shows that the settlement patterns of customary law judicial system still exists as it prioritizes the settlement based on democratic way and always include family, peace, humbleness principles that may relate back the relationship broken between the perpetrator and victim and keep balance in the society comprehensively. ABSTRAK: Berlakunya Undang-Undang Nomor 23 Tahun 2014 tentang Pemerintahan Daerah membawa konsekuensi baru terkait pelaksanaan urusan pemerintahan konkuren antar tingkat pemerintahan di daerah. Kajian ini bertujuan untuk mendekonstruksi urusan pemerintahan konkuren pemerintah daerah sehingga akan terlihat titik berat otonominya. Penelitian yang dilakukan dengan koridor doctrinal research dan menggunakan statute dan conceptual approach ini menghasilkan temuan sebagai berikut: Perubahan kewenangan konkuren pemerintah daerah yang diatur dalam UU No. 23 Tahun 2014 membawa konsekuensi terjadinya polemik antar pemerintah provinsi dan pemerintah kabupaten/kota serta infleksibilitas, inefektifitas dan inefisiensi dalam pelaksanaan urusan pemerintahan tertentu, seperti pelaksanaan kewenangan di bidang perizinan pertambangan yang akan lebih baik jika dilaksanakan oleh pemerintah kabupaten/kota karena sesuai dengan aspek perpajakan daerahnya. Hal ini menjadikan pembagian urusan pemerintahan konkuren daerah dalam UU No. 23 Tahun 2014 bernuansa the thinnest version rule of law. Deconstruction of Concurrent Government Affairs Based on Law Number 23 of 2014 on Local Governance ABSTRACT: The enactment of Law No. 23 of 2014 on Local Governance brings new consequences related to the implementation of concurrent government affairs between levels of local government. This study aims to deconstructing the administration of local government concurrent affairs so that it looks the emphasis autonomy. Research conducted by doctrinal research corridors and using the statute and conceptual approach, resulted in the following findings: The changes of local government concurrent authority as stipulated in Law No. 23 of 2014 brought consequences of a polemic between the provincial government and district/city governments as well as inflexibility, ineffectiveness and inefficiency in the implementation of government affairs, such as the exercise of authority in the field of licensing mining would be better if implemented by the district/city governments because in accordance with aspects of taxation area. This makes the distribution of concurrent local government affairs in Law No. 23 of 2014 shades of the thinnest version rule of law.
