Abstract

ABSTRACT: Dynamic of commitment of International Community in the issue of control upon global warming has been developed since 1919 up to present. Abstract

The objective of this study was to offer policy concept ideas in fulfilling restitution for the victims in accordance with the required attainment of justice. Restitution related to the payment of costs charged to the person based on a court decision that has permanent legally enforceable for the costs suffered by the victim or heir. This study used a normative method using a statutory approach and a case approach. From the three court decisions and one trafficking case in the constabulary, the victim's comprehension of the legal handling experienced is sufficient to accommodate the victim's wishes in obtaining victim's rights. Conclusions are drawn through an inductive to deductive thought process. Of the three decisions reviewed, it proved that the application of restitution payments was not able to fulfill a sense of justice for the victim. In fact, in practice, the fulfillment of compensation payments is in the non-penal space, from the perspective of victim recognition, it is sufficient to accommodate their wishes and hopes for the fulfillment of the expected restitution rights. In order to provide legal certainty for victims of the fulfillment of restitution rights, a legal breakthrough is required. The diversion method as a confirmation of ensuring the payment of the victim's restitution right is an offer. The concept of diversion can be carried out with the limitation of the criteria for the impact experienced by the victim, and the legality of legality is determined through a court decision or decision, as legal achievement through restorative justice is able to restore conflicts from perpetrators and victims.

Abstract

Penelitian ini ingin menguraikan penggunaan paradigma dalam penelitian hukum. Konteks penelitian hukum yang dimaksudkan di sini adalah dengan menggunakan pendekatan ilmu lain. Penelitian ini berangkat dari pemahaman bahwa basis penelitian hukum itu selalu berkembang. Atas dasar itulah, orientasi pada diskursus teori dan konsep sangat penting dilakukan. Dalam hal ini, hukum berada dalam konsep sebagaimana pemaknaan oleh para subjek dalam interaksi mereka. Ada debat mengenai apakah penggunaan ilmu lain dalam penelitian hukum dibenarkan atau tidak. Sebagian sarjana beranggapan penggunaan pendekatan ilmu lain dalam menyelesaikan masalah hukum, tidak masalah, dengan catatan digunakan sebagai ilmu bantu. Sebagian sarjana menganggap berbagai ilmu bantu dalam penelitian tidak bisa digunakan dalam penelitian ilmu hukum. Legal Research Paradigm This study wants to elaborate the used of paradigm in legal reseach. The context of legal reseach intended in this study means using another science approachs. The reseach argue that the legal research still developing itself. So, the orientation of theory discourse and concept is very important. Law is a concept that interpreted  by persons during their interaction. There is a debate whether the use of other knowledge in legal research is justified or not. Some scholars assume that the use of other science approaches in solving legal problems is not a problem, with note that it is used as auxilliary science. However, other scholars assume that various auxilliary science in research can not be used in legal research.

Abstract

ABSTRAK. BPHTB merupakan jenis pajak properti dikenakan atas perolehan hak atas tanah dan/atau bangunan. Penelitian menggunakan metode yuridis normatif dan yuridis empiris. Hasil penelitian menunjukkan Peranan BPHTB terhadap Pendapatan dari sektor Pajak Daerah tahun 2011-2015 rata-rata sebesar 6,08%, terhadap APBK tahun 2011-2015 rata- rata sebesar 0,06%, terhadap APBG tahun 2015-2016 rata-rata sebesar 6,39%. Upaya untuk mengoptimalkan pendapatan BPHTB yaitu Pemeriksaaan objek BPHTB, meningkatkan kerjasama dan pemberian sanksi, kendala-kendalanya yaitu belum ada SOP BPHTB dan UPTD BPHTB, Kurangnya Pengawasan dan banyaknya jual beli di bawah tangan. BPHTB tetap dipertahankan sebagai pajak daerah dikarenakan memenuhi kriteria Pajak Daerah, meningkatkan PAD, meningkatkan akuntabilitas daerah. Role of Tax Bea Acquisition of Land and Building to Increase Local Revenue District Pidie ABSTRACT. The process fee of Owning Land’s and Building’s Right (BPHTB) is a kind of property tax which is charged due to owning land’s and building’s right process. This is juridical normative and empirical research. The research shows that the role of BPHTB on the income from Regional Tax sector from 2011-2015 is average 6,08%, average the Local Budget of Income and Spending of Pidie District (APBK) between 2011-2015 is 0,06%, average APBG from 2015-2016 is 6,39%. The efforts done to optimize the BPHTB’s income are by checking towards the object of tax of BPHTB, increasing cooperation and providing sanctions, the obstacles faced are lacking of Standard Operating Procedure (SOP) of BPHTB, the Implementing Technical Unit Department (UPTD) of BPHTB, monitoring and there are many unrecorded transactions. BPHTB is kept as a local tax as it fulfills the Regional Tax criteria, increases Local Revenue and district accountability

Abstract

ABSTRAK: Korupsi merupakan suatu bentuk perbuatan yang dikategorikan berupa penyuapan, manipulasi dan lainnya. Dalam kajian hukum di Indonesia, korupsi tergolong dalam perbuatan tindak pidana seperti tertuang dalam UU No. 31 Tahun 1999 jo UU No. 20 Tahun 2001. Dilihat dari dampaknya, perbuatan ini tidak hanya mempengaruhi moralitas manusia secara personal, tetapi juga menyangkut kepentingan umum. Dimana rusaknya sendi-sendi kehidupan dalam segala aspek mampu menciptakan kemerosotan nilai-nilai moralitas dan kesenjangan sosial yang paling parah, seperti kemiskinan, tidak kejahatan yang parah dan lainnya. Hal ini menyebabkan pengrusakan terhadap kemaslahatan umum dan bertentangan dengan tujuan pensyari’atan. Akibat dari dampak tersebut, Islam melarang dan mengharamkan perbuatan tersebut dan dapat diganjar dengan sanksi yang berat. Metode yang digunakan yaitu penelitian hukum normatif, yang mencari dan menemukan sumber hukum dari literatur-literatur kepustakaan yang berkaitan dengan topik bahasan yang dikaji. Corruption in Islamic Law ABSTRACT: Corruption is an action that is categorized in the form of bribery, manipulation etc. Indonesia’s legal study, corruption belongs to the deeds of the offenses set forth in the Act Number 31, 1999 in relation to the Act Number 20, 2001. Form the impact, this action not only affects human morality personality, but also public interest. The damages to all aspects of life are able to create slump values of morality and the most severe social inequality, such as poverty, crime is not severe and more. This causes destruction of the public good and contrary to the purpose Islamic law obedience. As a result, Islam forbids and prohibits such action, and can be rewarded with severe sanctions. This is normative legal research, seeking and finding the source of the laws of literature related to the topic being studied.

Abstract

This article examines the persistent non-compliance of producers with halal product regulations in Indonesia and its implications for safeguarding the rights of Muslim consumers. Despite the enactment of the Halal Product Assurance Law in 2014, a significant discrepancy exists between regulatory mandates and actual adherence. Through a normative-juridical approach involving legal interpretation and analysis of government reports and academic literature, this study delves into the various factors contributing to this issue. The research findings indicate that non-compliance arises from a combination of regulatory uncertainties, institutional inefficiencies, and socio-economic challenges. Notably, inadequate enforcement mechanisms, overlapping institutional jurisdictions, and the financial burden of certification processes are identified as key factors. This non-compliance undermines the halal integrity of products, thereby violating the rights of Muslim consumers as stipulated by Islamic law. Resolving this issue necessitates a comprehensive overhaul of the halal certification system, encompassing streamlined procedures, improved inter-agency collaboration, and strengthened enforcement measures. These efforts contribute to the broader dialogue on religious consumer rights and regulatory adherence in diverse societies, offering valuable insights for policymakers and stakeholders in the halal sector.

Abstract

The enactment of national Law No. 25 of 2007 on Investment is carried out in the framework of uplift the initiation of a favorable domestic business condition for investment to reinforce the competitiveness of the domestic economy and advance investment; while the right of indigenous has been marginalized. The recent case of conflict between the government investment policy and the Indeginous people under the Rempang Eco City project in Batam is remain contentious. This article utilized the normative approaches to investigate this issue, and Rempang case become a context to investigate. Resolving land tenure conflicts between the local community and BP Batam must begin with tracing the history of the land through history, cultural heritage, natural physical signs, recognition and testimony from residents and traditional institutions. Protecting foreign investors must also take care of indeginous people rights surrounding it.

Abstract

The Uganda government has taken legal and institutional measures (such as the Uganda constitution, National Environmental Act and the Climate Change Act) to ensure clean and healthy environment and resolving major environmental issues. However, the rate of street trading within the terrain of Uganda, has resulted in the illegal dumping of refuse. It suffices to state that illegal dumping of refuse could generate major environmental issues such as flood, soil pollution, water pollution, air pollution, and destruction of habitat. This study embarks on a hybrid method of study in examining the need to combat the threat of street trading associated with the illegal dumping of waste. 290 questionnaires were sent to respondents residing in the various regions of Uganda. The data obtained through the questionnaire was analyzed using a descriptive and analytical method of research. The study therefore found that, there are unchecked incidents of street trading which often result in illegal dumping of refuse. Furthermore, the continuous dumping of refuse as a result of street trading could result in severe environmental pollution. The study therefore concludes and recommends that for a sustainable environment free from any form of pollution, there is a need for the Uganda government to through institutional measures reinforce the laws against illegal dumping of refuse resulting from street trading.

Abstract

The role of the legal system, particularly through the Anti-Corruption Commission (KPK) and other law enforcement agencies in Indonesia, is pivotal in addressing high-profile corruption cases. However, these efforts have been impeded by factors such as political interference, resource limitations, and a lack of anti-corruption culture, posing challenges for the future. This article employs a normative legal research methodology, utilizing statutory and conceptual frameworks. Data collection involved a thorough literature review of relevant laws and regulations related to anti-corruption issues. In this context, the collaboration between the legal system and civil society emerges as a synergistic force in establishing a robust anti-corruption ecosystem. Emphasizing preventive measures like asset declarations and conflict-of-interest regulations offers valuable insights into the proactive role the legal system can assume in averting corruption before it spreads.
