Abstract

Konsep hukum Islam mengenai pernikahan siri berakar pada nash-nash al-Quran dan hadis yang memberikan landasan bagi praktik ini. Dalam pandangan Islam, perkawinan siri dapat sah jika memenuhi syarat-syarat tertentu, meskipun hal ini seringkali bertentangan dengan hukum positif di Indonesia yang mengatur perkawinan secara resmi. Di Indonesia, perkawinan siri seringkali terjadi di luar kontrol hukum negara dan tidak diakui secara resmi. Implikasi hukum dari praktik ini mencakup status hukum anak, hak-hak waris, dan kewajiban-kewajiban finansial antara pasangan. Sementara itu, secara sosial, perkawinan siri dapat menimbulkan stigmatisasi terhadap perempuan yang terlibat serta menimbulkan ketidakstabilan dalam struktur keluarga. Dalam menangani perkawinan siri, diperlukan pendekatan yang holistik yang melibatkan kerjasama antara institusi agama, lembaga hukum, dan masyarakat sipil. Pendidikan dan peningkatan kesadaran masyarakat tentang konsekuensi hukum dan sosial dari perkawinan siri menjadi kunci untuk mengurangi praktik ini. Penelitian ini menggunakan metode analisis literatur tentang konsep hukum Islam mengenai perkawinan siri di Indonesia dan implikasinya. Diharapkan artikel ini dapat menjadi kontribusi dalam pemahaman lebih lanjut tentang masalah yang kompleks ini serta mendorong diskusi dan tindakan yang lebih luas untuk menangani perkawinan siri dengan bijaksanaan dan adil.

Abstract

This study aims to examine the role of the ulama in modern politics in Indonesia, focusing on the dynamics from rebellion to diplomacy. The research also analyzes the role of ulama using the political elite theories of Vilfredo Pareto and Gaetano Mosca to provide a new perspective on the power and influence of ulama in Indonesian politics. The methodology used is a literature review with a qualitative research approach, utilizing primary data from authoritative books, journals, and online sources. The results show that the ulama has a significant role in various aspects of Indonesian politics. In the early post-independence period, ulama such as Kyai Haji Hasyim Asy'ari played a role in mass mobilization against colonialists, while ulama like Abdurrahman Wahid (Gus Dur) used diplomatic strategies to maintain their influence despite efforts by the government to depoliticize religion. After the reform era, ulama gained a more significant space in politics, both through Islamic-based political parties and in their roles as advisors and mediators. The study also reveals that the ulama plays a crucial role in shaping public policies that reflect Islamic values. Fatwas issued by the Indonesian Ulama Council (MUI) often influence government policies in various fields, such as Sharia economics. Furthermore, ulama is involved in political education for the public, advocacy for marginalized groups, and participation in interfaith dialogue at international forums. Analysis based on Pareto and Mosca's political elite theories indicates that ulama is part of the elite holding moral and spiritual power and functions as advisors and mediators in practical politics. The process of elite circulation and the importance of religious organizations in maintaining their power highlight how the ulama continuously adapts and functions within the dynamic political power structure in Indonesia. With their long history of contribution and adaptation, ulama in Indonesia is poised to continue being a significant pillar in shaping the nation's political and social future.

Abstract

The aim of this research is to find out in detail the legal basis for religious blasphemy in Indonesian legislation in general and the Criminal Code in particular and to provide an overview of the relationship between religious blasphemy and human freedom from a human rights perspective. This type of research is normative legal research, namely examining rules or concepts related to the title of the research. The results of this research are that religion is a guide to life that comes from Almighty God to regulate human life so that human life becomes safe, peaceful and orderly. The position of religion is very sacred in society so that it cannot be disturbed or damaged by any individual or group, otherwise there will be horizontal conflict in society which can affect the unity and unity of a nation. One of the disturbances that often befalls a religion is religious desecration. This desecration can take the form of insulting religious symbols such as divinity, prophets, holy books, buildings of worship and so on. The government as the front guard in realizing security and public order regulates this in a legal regulation called the Criminal Code, in the Criminal Code there are several articles that regulate provisions related to religious blasphemy, this is very important to provide threats and deterrent effects to the public so that they do not commit crimes. actions that lead to pollution or blasphemy of religion in Indonesia.

Abstract

Sexual violence against children is an act of sexual harassment or coercion carried out against minors. These actions can include various forms, ranging from unwanted touching, sexual exploitation, to rape. This research aims to examine and analyze how the law is applied and the effectiveness of punishment in the decision of the Sukabumi City District Court Number 3/Pid.Sus-Anak/2023/PN.Skb. The type of research used is normative law with data sources in the form of interviews and observations, supported by literature study. The method used to process and analyze the data obtained was qualitative analysis with the research location being at the Sukabumi City District Attorney's Office and the Sukabumi City District Court. The research uses the theory of Child Legal Protection and the theory of the Juvenile Criminal Justice System. The results of the research explain that Children in Conflict with the Law were proven guilty of committing violence by forcing children to have sexual intercourse repeatedly, violating Article 81 paragraph (1) Jo. Article 76D of the Child Protection Law. Children in conflict with the law are sentenced to imprisonment at the Special Child Development Institute (LPKA) and job training. Overall, although this punishment has good intentions, its effectiveness has not been fully achieved because several aspects of implementation still need to be improved.

Abstract

This research aims to analyze the weak public criticism of the practice of nepotism in Indonesia through the Elite Theory perspective developed by Vilfredo Pareto and Gaetano Mosca. Nepotism, which is defined as giving important posts or positions to relatives or close friends without considering competence, has become an integral part of the Indonesian political system. This study uses descriptive qualitative research to explore the factors that influence people's attitudes towards nepotism and the interactions between these factors. Data sources were obtained through library research which included literature, articles and previous research. The research results show that the normalization of nepotism in Indonesia is strengthened by a paternalistic political culture, low community political participation, and economic dependence on political elites. The dominance of organized elites, as explained by Pareto and Mosca, plays a central role in weakening society's critical voice. Pareto emphasized that elites use nepotism to maintain power and hinder the circulation of new, more competent elites, while Mosca pointed out that elites manipulate public opinion and maintain the status quo through control over important resources and institutions. This condition results in apathy and the inability of society to form an effective opposition to the ruling elite. This research concludes that the weak public criticism of nepotism is a consequence of the dominance of elites who use their power to maintain control and avoid criticism. To overcome this problem, reforms are needed in the political and cultural system in Indonesia, including increasing transparency, strengthening anti-corruption institutions, as well as more inclusive and participatory political education. These findings provide a significant contribution to understanding the dynamics of power and social behavior in Indonesia and offer practical recommendations for strengthening the critical role of society in dealing with nepotism practices.

Abstract

This research aims to analyze human trafficking, which is a form of transnational crime that continues to increase in Indonesia, even though various legal and policy efforts have been taken to tackle it. This study aims to analyze the driving factors behind the crime of human trafficking and identify the challenges facing the implementation of countermeasures policies in Indonesia. The two problem formulations that are the focus of this research are: first, what are the factors that encourage the crime of human trafficking in Indonesia? Second, what challenges are faced in implementing policies to combat human trafficking in Indonesia? The results of this research show that the main driving factors include poverty, low levels of education, gender inequality, and weak law enforcement. In addition, the main challenges in implementing policies include less than optimal coordination between institutions, limited resources, and cultural and social barriers. Based on these findings, a holistic and synergistic approach is needed between the government, society and international institutions to increase the effectiveness of combating human trafficking in Indonesia.

Abstract

The aim of this research is to explain the political and legal aspects of changes in the terms of office of village heads in Indonesia and to analyze the maslahah perspective. This research is a descriptive-analytic literature study using a normative approach. The results of this research are that the current term of office and period of the village head is considered insufficient to develop the village due to the tension and polarization of society after the Village Head Election, the village head's term of office being too short will result in failure to achieve the vision and mission. However, this cannot be used as an absolute reason for extending the term of office of the village head, considering that it will be the entry point for changes to be made in aspects of the terms of the executive institutions of the president, governor, regent, mayor and legislative institutions, both the DPR and DPD at the center and also in the area. The extension of the term of office at the village government level has the potential to make the democratic climate of village government unhealthy and can even foster oligarchy in the village. Giving a village head a long term of office is not a guarantee that a development climate will be developed, the village head is actually required or given a challenge to work effectively and efficiently within the specified period in developing the design of his village. In the perspective of maslahah murlah, namely establishing laws in matters that are not mentioned at all in the Qur'an or al-Sunnah, with consideration for the benefit or interests of human life which is based on the principle of attracting benefits and avoiding damage. The extension of the village head's term of office is actually contrary to the concept of maslahah murlah.

Abstract

This study aims to critically assess government policies in implementing village authority in governance based on Law No. 6 of 2014 concerning Villages. This law grants greater authority to villages to manage and regulate the interests of local communities based on initiatives, original rights, and/or traditional rights that are recognized and respected within the governance system of the Unitary State of the Republic of Indonesia. This research conducts a literature review of various relevant sources to analyze how government policies have been implemented at the village level and the challenges faced in their implementation. The study also explores the role of village governments in governance and the obstacles that arise due to limited resources, capacity, and support from both central and regional governments. The findings indicate that although Law No. 6 of 2014 provides a clear legal framework for villages to manage their own affairs, the implementation of these policies still faces numerous challenges. These include the lack of understanding and capacity of village officials, as well as suboptimal support from regional and central governments. Abstract

Penelitian ini bertujuan untuk menganalisis peran negara dalam menghadapi gerakan separatisme Organisasi Papua Merdeka (OPM), khususnya dalam konteks pelanggaran HAM, faktor-faktor pemicu separatisme, dan upaya penyelesaian konflik. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan sejarah, konseptual, dan perundang-undangan, dengan data sekunder berupa buku, jurnal, dan artikel terkait. Hasil penelitian menunjukkan bahwa negara memiliki peran penting dalam menjaga keamanan, keadilan, kesejahteraan, dan kebebasan di Papua. Pelanggaran HAM yang terjadi di Papua, seperti penyiksaan, diskriminasi, dan perampasan hak, merupakan faktor utama yang mendorong gerakan separatisme. Faktor-faktor lainnya meliputi kesenjangan ekonomi, konflik identitas, dan propaganda separatis. Penelitian ini menyimpulkan bahwa penyelesaian konflik yang efektif melibatkan dialog, mediasi, perlindungan hak asasi manusia, dan upaya pemerataan pembangunan. Penelitian ini diharapkan dapat memberikan kontribusi ilmiah dalam memahami kompleksitas konflik di Papua dan mendorong upaya penyelesaian konflik yang berkelanjutan.

Abstract

In the increasingly developing digital era, social media has become the main platform for communication and interaction between citizens. The presence of social media, which includes various platforms such as Facebook, Twitter, Instagram, and TikTok, not only facilitates information sharing, but also creates a space for individuals to express opinions and participate in public discussions. However, this phenomenon brings significant challenges to constitutional law, especially in the context of freedom of expression. This journal examines the implications of constitutional law for the regulation of social media, highlighting how the regulations implemented can affect individuals' rights to express opinions. This research uses a qualitative approach with analysis of relevant regulations as well as case studies from various countries facing similar situations. The research results show that although the state has the right to regulate social media in the public interest, these regulations must be balanced and not curb freedom of expression.
